ORDINANCE NO 277
AN ORDINANCE LEVYING AND ASSESSING AN ANNUAL
TAX UPON THE GROSS RECEIPTS FROM RESIDENTIAL
AND COMMERCIAL SALES OF GAS IN THE CITY OF
OWASSO, OKLAHOMA, AND PROVIDING FOR A LEVY OF
2% ON THE GROSS RECEIPTS FROM SUCH SALES AND
PROVIDING THAT SUCH TAX SHALL BE IN LIEU OF
ANY OTHER FRANCHISE, LICENSE, OCCUPATION OR
EXCISE TAX LEVIED BY THE CITY OF OWASSO,
OKLAHOMA, PROVIDING FOR PAYMENT, DISPOSITION,
PENALTIES FOR REFUSAL TO PAY; PROVIDING FOR
LEINS FOR NON-PAYMENT AND TERM FOR WHICH LEVY
IS MADE; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA:
Section 1. There is hereby levied and assessed an
annual tax of 2% upon the gross receipts from residential
and commercial sales of gas sold by any person, firm, or
corporation within the City of Owasso.
Section 2. The tax herein levied shall be in lieu of
any other franchises, license, occupation or excise tax
levied by the City of Owasso.
Section 3. The tax of 2% levied by ths Ordinance
shall be for an initial term of One (1) Year and shall
remain the same for subsequent yerars u ntil amended or
repealed.
Section 4. The tax money shall be payable quarterly
and placed in the general revenue fund of the City of
Owasso.
Section 5. The provisions of Ordinance No. 276
providing for failure or refusal to pay tax, penalties and
providing for liens for non-payment of tax shall apply
hereto and persons, firms, associations or corporations
engaged in the business of furnishing gas within the City of
Owasso shall be bound thereny.
Section 6. Emergency Clause.
An emergency is hereby declared to exist for the
preservation of the public peace, health and safety, by reason
whereof, the Ordinance shall take effect immediately from
and after its passage, approval and publication.
PASSED AND APPROVED and the emergency clause ruled
upon separately this 4th day of december, 1979.
