HomeMy WebLinkAbout285_Providing Penalties & Fines for Municipal OffensesORDINANCE NO. 285 CITY OF OWASSO, OKLAHOMA AN ORDINANCE AMENDING CHAPTER 14, ARTICLE 1 SECTION 3 PROVIDING PENALTIES AND FINES FOR , CONVICTION OF ANY OFFENSE AGAINST THE ORDINANCES OF THE CITY OF OWASSO; REPEALING PENALTIES IN ALL ORDINANCES IN CONFLICT HEREWITH AND SUBSTITUTING PENALTIES THEREFOR AS HEREIN SET OUT; PROVIDING FOR A FINE OF UP TO $100 AND/OR IMPRISONMENT UP TO THIRTY (30) DAYS, PROVIDING FURTHER FOR COMPELLING ANY PERSON FINED FOR VIOLATION OF A MUNICIPAL ORDINANCE WHO IS FINANCIALLY ABLE BUT REFUSES OR NEGLECTS TO PAY THE FINE OR COSTS TO SATISFY THE AMOUNT OWED BY WORKING ON THE STREETS, ALLEYS, AVENUES, AREAS AND PUBLIC GROUNDS OF THE MUNICIPALITY AT A RATE NOT LESS THAN $5.00 PER DAY FOR USEFUL LABOR, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, that Chapter 14, Article 1, Section 3 thereof be amended to read as follows. "Offense; Penalty. In all cases where, by any provision of this Code or any title or chapter hereof or by other ordinances of the City of Owasso, a person commits an offense, he shall upon conviction be fined any sum not exceeding $100 or by imprisonment up to thirty (30) days or by both fine and imps isonment including the costs. PROVIDED, that the penalty herein prescribed shall prevail over any other penalties prescribed in ordinances in conflict herewith and any ordinances in conflict herewith are hereby specifically repealed and the penalties herein prescribed are hereby substituted therefor. Any person, firm or corporation cited or complained of as violating any provisions of the Code or Ordinances shall be entitled to a trial by jury That an emergency is hereby declared to exist for the preservation of the public peace, health and safety, by reason whereof this Ordinance shall take effect immediately from and after its passage, approval and publication.
