HomeMy WebLinkAbout316_Amend Section 12_ Artilce 3_Municipal Court Witness Fees & Bailiff Compensation44535 BOOK 4607 PAGE 2107 CITY OF OWASSO, OKLAHOMA ORDINANCE NO. 316 STATE OF OKLAHOMA TULSA COUNTY FILED OR RECORDED 1982 APR 20 PM 12:54 ANITA NESBITT COUNTY CLERK AN ORDINANCE AMENDING SECTION 12 -22, CHAPTER 12, ARTICLE 3 OF THE CODE OF THE CITY OF OWASSO, OKLA- HOMA, ESTABLISHING PROCEDURES FOR MUNICIPAL COURT WHEREAS, Ordinance No. 187 was passed by the City Council of the City of Owasso, State of Oklahoma, on the 2nd day of September, 1975, and WHEREAS, the aforesaid ordinance was codified in Section 12 -22, Chapter 12, Article 3 of the Code of the City of Owasso, Oklahoma; and WHEREAS, public hearing, after proper notice thereof, has been held regarding amendment of the procedure for municipal court administration, and WHEREAS, the Owasso City Council has considered the rec- ommendations made during such hearing above referred to, and further, has duly deliberated same. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA. I. That Section 12 -22, Chapter 12, Article 3 of the Code of the City of Owasso, Oklahoma, providing in part, as follows, Witness in any proceeding in the court, other than police officers or peace officers, shall be entitled to two dollars ($2.00) per each day of attendance, plus five cents ($.05) per each mile actually and necessarily traveled in going to and returning from the place of attendance, if their residence is outside the limits of the municipality........, be, and same hereby is amended to provide, as follows, Witness in any proceeding in the court, including police officers or peace officers, shall be entitled to five dollars ($5.00) per each day of attendance, plus five cents ($.05) for each mile actually and necessarily traveled in going to and returning from the place of attendance, if their residence is outside the limits of the municipality. II. That the Municipal Judge shall select a qualified person to serve as part-time Bailiff of the Municipal Court, such person BOOK 4607 PAGE 2108 to serve only during times in which Municipal Court is in session and to perform all duties necessary and proper to the conduct of the Municipal Court, unless such duties are otherwise designated to another officer or the municipality. Compensation for the part -time Baliff shall be set at the rate of $6.50 per hour said sum to be paid from the Municipal Court on contract labor basis. III. That all ordinances or parts of ordinances in conflict herewith be, and the same hereby are, expressly repealed, all ordinances, or parts of ordinances, not in conflict herewith remain unaffected hereby.
