HomeMy WebLinkAbout338_Amend Section 5_Building Code335051 BOOK 4836 PAGE 1611 STATE OF OKLAHOMA TULSA COUNTY FILED OR RECORDED 1984 DEC 28 PM 12:39 JOAN HASTINGS TULSA COUNTY CLERK ORDINANCE NO. 338 AN ORDINANCE AMENDING THE PROVISIONS OF SECTION 5 -101, BUILDING CODE OF THE CITY OF OWASSO, OKLAHOMA, ON AN INTERIM BASIS, REPEALING PROVISIONS INCONSISTENT OR IN CONFLICT THEREWITH AND DECLARING AN EMERGENCY. WHEREAS, by virtue of prior Code of the City of Owasso, Oklahoma, in particular Section 4 -1, the latest addition of the BOCA Basic Building Code, as published by the Building Officials and Code Administrators International, Inc., constituted the Building Code of the City of Owasso, Oklahoma, for the control of building and structures therein; and, WHEREAS, by virtue of adopting Ordinance No. 332 of the City of Owasso, Oklahoma, adopted by the City Council of the City of Owasso, Oklahoma, on the 1st day of April, 1984, said provision was continued in full force and effect as codified in Section 5 -101 of the Code of Ordinances for the City of Owasso, Oklahoma; and, WHEREAS, on January 1, 1984, the 1984 addition of the BOCA Basic Building Code, as published by the Building Officials and Code Adminis- trators International, Inc., same being the latest addition, became the applicable Building Code of the City for the control of building and structures therein by virtue of the provisions above referred to; and, WHEREAS, the 1984 addition of the BOCA Basic Building Code, as published by the Building Officials and Code Administrators International, Inc., is extremely cumbersome in terms of administration as well as cost prohibitive by virtue of inclusion therein by reference of a multiplicity of resource material not contained in such BOCA Basic Building Code, 1984 Addition; and, WHEREAS, it is the desire of the City Council of the City of Owasso, Oklahoma, that there be designed, adopted, and implemented a building code more suitable to the needs of the City of Owasso, M Oklahoma. NOW, THEREFORE, BE IT ORDAINED BY TBE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA: Section 1. That the provisions of Section 5-101 of the Ordinances of the City of Owasso, Oklahoma, providing as follows: The BOCA Basic Building code, the latest addition thereof, as published by the Building Offiials and code Administrators International, Inc., is hereby adopted as the Building Code of the city for the control of buildings and structures as therein provided. Each and all of the regulations, provisions, BOOK 4836 PAGE 1612 penalties, conditions and terms of the BOCA Basic Building Code are hereby referred to, adopted, incorporated, and made a part hereof as if fully set out in this Code with the additions, insertions, deletions, and changes, if any, prescribed in this chapter, be and same hereby is amended to provide as follows: The BOCA Basic Building Code, 1981 Addition thereof, as published by the Building Officials and Code Administrators International, Inc., is hereby adopted as the Building Code of the City for the control of buildings and structures as therein provided. Each and all of the regulations, provisions, penalties, conditions, and terms of the BOCA Basic Building Code are hereby referred to, adopted, incorporated, and made a part hereof as if fully set out in this Code with the additions, insertions, deletions, and changes, if any, prescribed in this chapter. Section 2. That this Ordinance remain effective, governing the control of buildings and structures within the City of Owasso, Oklahoma, until a permanent ordinance dealing herewith is adopted. Section 3. That all ordinances of a general and permanent nature of the City in effect on or before the effective date hereof, and which are in conflict herewith, are hereby repealed from and after the effective date of this Ordinance. Section 4. That the Council of the City of Owasso, Oklahoma, recognizing the inability and cost prohibitiveness of implementation of the 1984 Addition of the BOCA Basic Building Code, as published by the Building Officials and Code Administrators International, Inc., and further recognizing the immediate need for implementation of a building code capable of administration and enforcement without the incurrence of great expense, finds that it is immediately necessary for the preserva- tion of the peace, health, and safety of the City and the inhabitants thereof, that the provisions of this Ordinance be put into full force and effect upon passage and publication hereof, and that by reason thereof, an emergency is hereby declared to exist, by reason whereof this Ordinance shall take effect and be in full force from and after its passage and publication, as provided by law.
