HomeMy WebLinkAbout339_Closing Easement in Owasso Business ParkBOOK 4874 PAGE 1750 387819 ORDINANCE NO. 339 AN ORDINANCE CLOSING TO THE PUBLIC USE ANY PUBLIC WAY OR EASEMENT LOCATED ON THE NORTH 40 FEET OF LOT 1, BLOCK 1, OWASSO BUSINESS PARK, AN ADDITION TO THE CITY OF OWASSO, TULSA COUNTY, STATE OF OKLAHOMA, ACCORDING TO THE RECORDED PLAT THEREOF, AND RETAINING UNTO SAID CITY OF OWASSO, OKLAHOMA, THE ABSOLUTE RIGHT TO REOPEN SAME WITHOUT EXPENSE TO THE MUNICIPALITY. WHEREAS, heretofore by virtue of Plat No. 4204, platting as an addition to the City of Owasso, Tulsa County, State of Oklahoma, Owasso Business Park, same having theretofore been approved by the City Council of the City of Owasso, Oklahoma, after due and proper proceedings thereon, on the 15th day of December, 1981, and same being filed of record on the 12th day of April, 1982, there was imposed upon the North 40 feet of Lot One (1), Block One (1), Owasso Business Park, an Addition to the City of Owasso, Tulsa County, State of Oklahoma, certain utility easement; WHEREAS, by virtue of platting of Dogwood Center, an addition to the City of Owasso, Oklahoma, being a subdivision of a part of the Northwest Quarter of the Northeast Quarter of the Northeast Quarter (NW /4 NE /4 NE /4) of Section 31, Township 21 North, Range 14 East, and a resubdivision of Lot One (1), Block One (1), Owasso Business Park, Tulsa County, Oklahoma, containing 0.53 acres more or less, same being approved by the City Council on the 21st day of June, 1983, and being Plat No. 4434, same being filed on the 5th day of January, 1984, the easements above referred to in the North 40 feet of Lot One (1), Block One (1), Owasso Business Park, an Addition to the City of Owasso, Tulsa County, State of Oklahoma, are no longer necessary for the public use, and WHEREAS, after due and proper notice hereof, the City Council of the City of Owasso, Oklahoma, deems it necessary and expedient that said City close to the public use any easements located on the North 40 feet of Lot One (1), Block BOOK 4874 PAGE 1751 One (1), Owasso Business Park, and further, that same be accomplished by ordinance without requiring such to go before the Owasso Planning Commission, by virtue of their having heretofore considered same and passing upon the consideration of the Plat No. 4434, Dogwood Center, more particularly described as Lot One (1), Block One (1), Dogwood Center to the City of Owasso, Tulsa County, State'of Oklahoma, according to the recorded plat thereof, and, WHEREAS, by virtue of the provisions of 11 O.S. §42- 110(C), the City of Owasso, Oklahoma, shall retain the absolute right to reopen the easement without expense to the municipality. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA: Section 1: That the easements located on the North 40 feet of Lot One (1), Block One (1), Owasso Business Park, be and same hereby are closed to the public use.
