ORDINANCE NO. 349
AN ORDINANCE CLOSING TO THE PUBLIC USE THE
EASTERN FIVE FEET (51) OF UTILITY EASEMENT
LOCATED ON WESTERN SIDE OF LOT 20, BLOCK 5, EL
RIO VISTA II, AN ADDITION TO THE CITY OF OWASSO,
COUNTY OF TULSA, STATE OF OKLAHOMA, ACCORDING TO
THE RECORDED PLAT THEREOF, AND RETAINING UNTO
SAID CITY OF OWASSO, OKLAHOMA, THE ABSOLUTE RIGHT
TO REOPEN SAME WITHOUT EXPENSE TO THE
MUNICIPALITY.
WHEREAS, there does presently exist an easement fifteen
feet (151) in width on the western side of Lot 20, Block 5,
of E1 Rio Vista II, an addition to the City of Owasso,
Oklahoma, according to the recorded plat thereof;
WHEREAS, the one and one -half (1 1/2) story frame
dwelling structure located on the aforementioned lot
encroaches on the eastern five feet (51) of the utility
easement above referenced; and,
WHEREAS, there have been encountered structural
difficulties with said one and one -half (1 1/2) story frame
dwelling which the Council has been advised have been
corrected; and,
WHEREAS, all the utility lines located in the eastern
five feet (51) of the fifteen foot (151) utility easement
have been relocated at the expense of the owner of the
aforementioned lot, and that the eastern five feet (5') of
the fifteen foot (151) utility easement is no longer
necessary for public purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF OWASSO, OKLAHOMA:
Section 1: That the eastern five (5) feet of the utility
easement located on west side of Lot 20, Block 5, E1 Rio
Vista II, an addition to the City of Owasso, County of Tulsa,
State of Oklahoma, be and same hereby is closed.

BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY Of'
OWASSO, OKLAHOMA:
Section 2: That the municipality shall retain the absolute
right to reopen said easement without expense to the
municipality.
