AN ORDINANCE RELATING TO PART FIVE - BULIDING
REGULATIONS AND CODES, CHAPTER ONE - BUILDING
CODE AND PERMITS, SECTION5-101 - BUILDING
CODE ADOPTED AND SECTION 5-102 - ADDITIONS AND
CHANGES TO BUILDING CODE, AMENDING SECTIONS
5-101 AND 5-102 TO PROVIDE FOR ADOPTION OF
BOCA BASIC BUILIDING CODE 1987 ADDITION, AS
WELL AS SUBSEQUENT ADDITIONS THERETO,
PROVIDING SAVINS CLAUSE, DECLARING AN
EMERGENCT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA, THAT:
Section One. Part Five - Building regulations and
Codes, Chapter One - Building Code and Permits, Section
5-101 - Building Code Adopted, of the Code of Ordinances of
the City of Owasso, Oklahoma, be amended to privide as
folows, to-wit:
The BOCA Basic Building code, 1987 Addition
thereof, as well as the most current addition of
the BOCA Basic Building Code thereafter, as
published by the Builiding Officials and Code
Administrations International, Inc., is hereby
adopted as the Building Code of the City for the
control of buildings and structures as therein
provided. Each and all of the regulations,
provisions, penalties, conditions and terms of
the BOCA Basic Building Code are hereby referred
to, adopted, incorporated, and madea part
hereof as if fully set forther hereafter in tis
Code with the additions, insertions, deletions,
and changes, if any, proscibed in this Chapter.
Section Two. Part Five - Building Regulations and
Codes, Chapter One - Buliding Code and Permits, Section
5-102 - Additions and changes to Buliding Code of the Code
of Ordinances of the City of Owasso, Oklahoma, be amended to
provide as follows, to-wit:
A. The following sections of the BOCA Basic Building
code are hereby revised:
1) Section 100.1 (Page one, second line), insert:
City of Owasso, Oklahoma;
2) Section 103.4 (page three, first line), insert:
June 5, 1979;
3) Section 114.3 (page eleven, third line), insert:
Resolution of the City of Owasso, Oklahoma 87-13 and 86-16;
4) Section 117.4 (page thirteen fifth, sixth,
seventh lines), Insert: "An offense", "$200.00", "Thirty
days";
5) Section 118.2 (page thirteen, fourth and fifth
lines), insert: Not greater than the penalty as provided
under section 1108 of the Code of Ordinances of the City of
Owasso, Oklahoma;

6) Section 2906.1, (page four thirty- eight, first,
second, and third lines), insert: as provided pursuant to
Ordinance of the City of Owasso, Oklahoma, number 309.
Section Three. All Ordinances or parts of
Ordinances in conflict herewith are hereby expressly
repealed.
Section Four. Nothing in this Ordinance or in the
Building Code hereby adopted shall be construed to effect
any suit or proceeding pending in any Court, or any rights
acquired, or any liability incurred, or any cause(s) of
action(s) acquired or existing, under any Act or Ordinance
hereby repealed as cited in Section Three (3) of this
Ordinance; nor shall any just or legal right or remedy of
any character be lost, impaired or affected by this
Ordinance.
Section Five. That by reason of the absence of
any Code provision authorizing utilization of the BOCA Basic
Code, 1987, or the most current addition thereof, and as a
consequence thereof the application of outdated regulations,
such affecting the health, safety and welfare of the
community, an emergency is hereby declared to exist whereby
the provisions of this Ordinance shall, upon approval and
publication, become effective immediately.
APPROVED THIS 17th day of May, 1988, with the
Emergency Clause voted upon and approved separately.
