ORDINANCE NO. 398
AN ORDINANCE CLOSING TO THE PUBLIC USE UTILITY EASEMENTS
IN THE LAKERIDGE FIRST ADDITION TO THE CITY OF OWASSO,
LOCATED
TULSA
COUNTY, OKLAHOMA, ACCORDING THE THE RECORDED PLAT THEREOF, AND
RETAINING UNTO SAID CITY OF OWASSO, OKLAHOMA, THE ABSOLUTE RIGHT
TO REOPEN SAME WITHOUT EXPENSE TO THE MUNICIPALITY.
WHEREAS, the City of Owasso, Oklahoma, has deemed it
necessary and expedient to close to public use certain utility
easements, and
WHEREAS, said utility easements are described as follows:
The north five (5) feet of Lot Twenty -three (23) of Block
Three (3) of the Lakeridge First Addition to Owasso,
Oklahoma, AND
The south ten (10) feet of Lot Twenty -two (22) of Block
Three (3) further described as follows to -wit: Beginning at
the Southwest corner of Lot Twenty -two, thence easterly
along the common lot line between Lot Twenty -three (23) and
Lot Twenty -two (22) for a distance of 100.04 feet, thence
north ten (10) feet, thence westerly and parallel to the
south lot line of Lot Twenty -two (22) to a point on the
westerly line of Lot Twenty -two (22), thence southerly on a
curve to the left having a radius of 50.0 feet to the point
of beginning, all in Block Three (3) of the Lakeridge First
Addition to Owasso, Oklahoma, and
WHEREAS, pursuant to Title 11, Oklahoma Statutes, Section
42 -110, the only holders of a franchise or purported holders of a
franchise that may purport to have a special right or privilege
to use said utility easements are Public Service Company of
Oklahoma and /or Oklahoma Natural Gas Company, and /or Southwestern
Bell Telephone Company and /or Tulsa Cable Television Company, and
WHEREAS, the above holders of franchise or purported holders
of a franchise that may purport to have a special right or

privilege to use said utility easements have waived their
objections to the closure of said easements, if any.
NOW THEREFORE, BE IT ORDAINED BY COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA:
Section 1. That the above described utility easements, be,
and the same are hereby closed to the public use.
Section 2. That the municipality shall retain the absolute
right to reopen the public ways or easements without expense to
the municipality. Closing of the public ways or easements shall
not affect the right to maintain, repair, reconstruct, operate or
remove utility, public service corporation, or transmission
company facilities of service therein, nor shall a closing affect
private ways existing by operation of law unless released in
writing executed by the owners thereof.
PASSED, APPROVED AND ADOPTED this 6th day of
September, 1988.
