HomeMy WebLinkAbout432_Amend Part 5 Ch 2_Building Codes_Repealing Plumbing & Mechanical Contractors Bonds5354 0429 91 033642 ORDINANCE NUMBER 432 CITY OF OWASSO, OKLAHOMA TULsA CouNfy+ CLeRw AN ORDINANCE RELATING TO PART 5 -- BUILDING REGULATIONS AND CODES, CHAPTER 2-- PLUMBING REGULATIONS, SECTION 5- 205 -- PLUMBING CONTRACTOR'S BOND, REPEALING SECTION 5 -205, RENUMBERING THE REMAINING SECTIONS, AND CHAPTER 8-- MECHANICAL CODE, SECTION 5 -804 -- BOND REQUIRED, REPEALING SECTION 5 -804 AND RENUMBERING REMAINING SECTIONS, DECLARING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT: Section One: Part 5-- Building Regulations and Codes, Chapter 2-- Plumbing Regulations, Section 5- 205 -- Plumbing Contractor's Bond be and same hereby is repealed. Section Two: That the remaining Sections of Chapter 2 -- Plumbing Regulations, following Section 5- 205 -- Plumbing Contractor's Bond shall be renumbered in the following manner, to- wit: Section 5 -205 Plumbing inspector, office created, duties. Section 5 -206 Revocation of plumbing license or permit. Section 5 -207 Fines, violations. Section Three: That Part 5 -- Building Regulations and Codes, Chapter 8-- Mechanical Code, Section 5- 804 - -Bond Required, is hereby repealed. Section Four: That Section 5 -805 of Chapter 8 should be and same hereby is renumbered as 5-804. Section Five: This ordinance shall, upon passage, take effect thirty (30) days from the date of first publication as provided by state law. Dated this 16th day of July, 1991. Cates, City Attorney MEMORANDUM TO: HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: RODNEY J. RAY, CITY MANAGER SUBJECT: REQUEST FOR AMENDMENT OF THE OWASSO BUILDING CODE REFLECTING THE CHANGE IN STATE LAW WHICH NOW ALLOWS PLUMBING CONTRACTORS AND MECHANICAL CONTRACTORS TO BE BONDED "STATEWIDE ". DATE: JULY 12, 1991 BACKGROUND During 1989, the State of Oklahoma passed legislation allowing electrical contractors to present a forfeit bond once which is valid statewide. This eliminates the previous requirement to supply separate proof of bonding to each community in which a contractor worked. Following this State action, the City of Owasso repealed its previous requirement for a local electrical contractor's license with the knowledge that cities are allowed to draw on the state bond if a contractor fails to pay fees under the new law. In 1990, similar legislation was passed releasing both plumbing and mechanical contractors from the one bond /per city restriction. With this new "statewide" bonding for plumbing and mechanical contractors the repeal of our Iocal bonding regulations is herein requested. RECOMMENDATION I recommend Council adoption of Ordinance 11432 relating the Owasso Building Codes. jk/council /codes
