That Part 15 - Traffic and Vehicles, Chapter 3, Section 15, Vehicle Equipment, of the Code of Ordinances of the City of Owasso, Oklahoma, be and the same is hereby amended by there being provided as Section 15-309 the following, to -wit: Z:� Section 15-309: Loud Sound Amplification Systems Prohibited. a. No person operating or occupying a motor vehicle on a street, highway, alley, parking lot, or driveway shall operate or permit the operation of any sound amplification system from the vehicle so that the sound is plainly audible at a distance of fifty (50) or more feet from the vehicle- b- "Sound amplification system" is defined as any radio, tape player, -compact disc player, loud speaker, or other electronic device used for the amplification of the human voice, music, and/or musical, instruments. C_ "Plainly audible" is defined as any sound produced by a sound amplification system from the vehicle which clearly can be heard at a distance of fifty (50) feet or more. Measurement standards shall be by the auditory senses, based upon direct line of sight. Words or phrases need not be discernible and base reverberations are included. T he motor vehicle may be stopped, standing, parked or moving on a street, highway, alley, parking lot, or driveway. d- It is an affirmative defense to a charge under this section that the operator is authorized by law to operate the sound amplification system, for any of the following Z circumstances: (1) The system was being operated to request medical or vehicular assistance or to warn of a hazardous road condition, (2) The vehicle was an emergency or public safety vehicle-, (3) The vehicle was owned and operated by the City of Owasso, or public or private utility company", (4) The vehicle was used in authorized public activities, such as parades, fire-works, sports events, or other activities which have been approved by the appropriate City official or body. e. Any person who violates any provision of this section, upon conviction, shall be subject to a fine in the amount of Fifty Dollars ($50.00), exclusive of cost. 2780-288.owa/or5 I I Section I REPEALER- Any ordinance or parts of ordinances inconsistent with the terms and provisions of this Ordinance is hereby repealed- provided, however, that such repeal shall be only to the extent of such -inconsistency and. in all other respects this Ordinance shall be cumulative of other ordinances Zn regulating and governing the subject matter covered by the Ordinance. regulating Section SEVERABILITY. regardless of cause, any section, subsection, paragraph, sentence, or clause of this ordinance or the application of said ordinance is rendered or declared invalid or unconstitutional by any court action., or by reason of any existing or subsequently enacted legislation, the remaining sections, subsections, paragraphs, sentences, or clauses shall continue in full Force and effect and shall be construed thereafter as being the entire provisions of this Ordinance.
