WHEREAS, public hearings have been held regarding the request for approval of a Planned Unit Development concerning the property herein described, and, WHEREAS, the Owasso City Council has considered the recommendation of the Owasso Planning Commission and all statements for and against the requested approval of OPUD-14, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA; Section 1. That the zoning map of the City of Owasso, Oklahoma be amended to reflect the supplemental designation of PUD (Planned Unit Development) on the following described property, to wit: A PART OF THE E/2 OF SECTION 21, T-21-N, R-14-E MORE PARTICULARLY DESCRIBED AS FOLLOWS: Section 2. The City Council hereby authorizes development upon such tract in accordance with the provisions of the Outline Development Plan of October 9, 1996 submitted with the application, as well as all amendments or modifications thereto, as required by the City Council, same being hereby made a part of such Outline Development Plan and included therewith. i Section 3. Cates Ronald D Cates, City Attorney MEMORANDUM TO: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OWASSO FROM: TIMOTHY ROONEY COMMUNITY DEVELOPMENT DIRECTOR DATE: November 22, 1996 At the November 19, 1996 meeting, the Owasso City Council recommended approval of a rezoning request for a Planned Unit Development on an approximate 141.30 acre parcel of land located within the East Half of Section 21, Township 21 North, Range 14 East; further described as being located north and west of the northwest corner of E. 86th Street North and N. 145th E. Avenue. OPUD-14 was approved with 17 conditions of approval which are attached, along with a subject map, for your information and review. Ordinance No. 534 would formally adopt the City Council's action of November 19, 1996, as well as requiring all of the 17 conditions of approval to become part of the Outline Development Plan of the Planned Unit Development. Ordinance No. 534 11" Given the above analysis, it is the staff's opinion that OPUD-14 is consistent with the Comprehensive Plan and the PUD Chapter of the Zoning Code and, therefore, staff recommends Council approval subject to the following conditions: I That the applicant's Development Text and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code. 2. That unless specifically set out in the standards and conditions of this PUD, single-family lots shall meet the requirements of a typical RS-2 district. 3. That unless specifically set out in the standards and conditions of this PUD, all commercial development shall meet the requirements of a typical CS district. 4. That within the PUD, the maximum number of dwellings shall not exceed 467 (Underlying RS-2 zoning would permit up to 525 dwelling units). Z" 5. That the reference on page 16 of the PUD text pertaining to a lien being placed on a Homeowner's Association member's "personal property" be changed to "real property. " 6. That minor transfers (15 % increase in a development area's density) of dwellinc, units from one residential development area to another can occur if a ZD significant change in the character of either development area is not created. 7. That all conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD. S. That no building permits be issued within any portion of the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. 9. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. 10. That a detailed drainage report be submitted at the time of platting, and certification of such document by an engineer. Staff Report OPUD-14 Page 9 of 9 tn 11. That if the eventual street layout is similar to that which is proposed, a stop sign shall be required at the third 4-way intersection from E. 86th Street North. 12. That the northernmost access point to N. 145th E. Avenue from the PUD property shall tine up with the southernmost access point of the Whispering Pines Addition (Rogers County). 13. Acceleration/Deceleration lanes will be required on E. 86th Street North and N. 145th E. Avenue. 14. Sidewalks will be required along E. 86th Street North and N. 145th E. Avenue. 15, No flag lots are permitted within any portion of the PUD. 16. If needed, commercial area may be required to provide on-site detention. This to be determined at site plan review for commercial property. 17. Detailed landscaping plans (type, species, size, location, irrigation) shall be required to be submitted with site plans of any commercial development. Said plans will be reviewed by staff and must be approved by the Planning Commission. 4
