BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWAS-
SO, OKLAHOMA, THAT, TO-WIT:
Section One: Part 10, Offenses and Crimes, Chapter 3, Offenses
Against the Public, Section 10-309, Discharging Weapons, Throwing Mis-
siles, is amended to provided as follows, to-wil:

civilian in the presence and under the direction of duly commissioned police
officers of the City of Owasso. Oklahoma. while participating In training or
tournament aclivijies on the Owasso Police Department Firing Range, to
discharge or fire any species of firearms, air pistol, air gun, slingshot or dis-
charge a grenade, bomb or similar device, or other weapon, or throw any
missile within the city, except when necessary for the protection of me or
property in acoordance with law.
Section 'l\vo: This ordinance shall become effective thirty (30) days from
the date of first publication as provided by state law.

BACKGROUND:
Current city ordinances (Part 10, Chapter 3

Construction of a police department operated firearms range is anticipated in the near future at
a site located directly south of the city's wastewater treatment plant. That site is located within
the corporate limits of the City of Owasso and is, therefore, subject to Section 10-309 of the
Code of Ordinances as cited above. Therefore, use of the facility by both police officers and
civilians for training would be prohibited absent changes in the current law
Since its inception, the potential uses of the police firearms range has included the concept of
conducting civilian training classes and target shooting for a fee. That concept was developed
an effort to partially recover some of the capital and maintenance costs of the facility.

The department's staff reviewed the existing ordinance and conferred with the City Attorney to
determine options available to allow use of the range for both purposes. The result of that
discussion was the development of an amendment to the existing Code of Ordinances. That
amendment, if adopted, will allow for the discharge of weapons by police officers and by
civilians "under the direction of a duly commissioned police officer of the City of Owasso,
Oklahoma participating in training or tournament activities on the Owasso Police
Department firing range..." Thus, the effect of the amendment would be to allow the
department's personnel to train at the facility and allow the department to participate in an
entrepreneurial endeavor if a positive financial result was anticipated
