WHEREAS, the City of Owasso, Oklahoma, has deemed it necessary and expedient to close to public use a portion of a certain utility easement; WHEREAS, said utility easement is described as follows: The southern most 3' of the northern 11' utility easement of Lot 6, Block 2, Fairways 11 Addition to the City of Owasso. WHEREAS, pursuant to Title 11, Oklahoma Statutes, Section 42-110, the only holde'l of a franchise or purported holders of a franchise that may purport to have a special right or privilege to use said utility easement are Public Service Company of Oklahoma, and/or Oklahoma Natural Gas Company, and/or Southwestern Bell Telephone Company, and/or TC1 Cable Television Company; and, WHEREAS, the above holders of franchise or purported holders of a franchise that may purport to have a special right or privilege to use said utility easement have waived their objections to the closure of said easement, if any. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OP OWASSO, OKLAHOMA, THAT, Section 1. The following described utility easement, be, and the same is hereby closed to the public use, to -wit: The southern most 3' of the northern I V utility easement of Lot 6, Block 2, Fair -ways 11 Addition to the City of Owasso. Section 2. The municipality shall retain the absolute right to reopen the public way or easement without expense to the municipality. Closing of the public way or easement shall not affect the right to maintain, repair, reconstruct, operate or remove utility, public service corporation, or transmission company facilities of service therein, nor shall a closing affect private ways existing by operation of law unless released in writing by the owners thereof. Attached is a copy of Ordinance No. 580 which formally adopts the City Council's action of June 16, 1998. RECOMMENDATION: Staff recommends Council approval of Ordinance No. 580. ATTACHMENTS: 1. Subject Map TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: EASEMENT CLOSING REQUEST ACE CUSTOM HOMES DATE: June 10, 1998 BACKGROUND: The City of Owasso has received a request for the closing of a portion of a utility easement located within Lot 6, Block 2, Fairways II Addition. The portion of the easement to be closed is described as the southern 3 feet of the northern 11 foot utility easement. A case map is enclosed for your information and review. The subject property is currently in the process of being developed with a single-family residence. The residence, as it is proposed, would encroach 2.5 feet into the northern 11 foot utility easement. Area utility companies have reviewed the request and have no objections to the closing request. The Planning Commission unanimously approved the closing request at their June 9, 1998 regular meeting. Staff also has no objections to the request. If approved by the City Council, an Ordinance will be presented at the July 7, 1998 meeting to formally adopt the actions of the Council. RECOMMENDATION: Staff recommends Council approval of the easement closing request, closing the southern 3 feet of the northern 11 foot utility easement on Lot 6, Block 2, Fairways II. ATTACHMENTS: 1.
