AN ORDINANCE APPROVING ZONING APPLICATION NUMBER OZ 99-06
CHANGING THE ZONING OF PROPERTY LOCATED IN SECTION 22, TOWNSHIP 21
NORTH, RANGE 14 EAST, OF THE INDIAN BASE AND MERIDIAN, ROGERS
COUNTY, OKLAHOMA, FROM AG (AGRICULTURE DISTRICT) TO RS-2
(RESIDENTIAL SINGLE FAMILY MEDIUM DENSITY DISTRICT), RM-2
(RESIDENTIAL MULTI - FAMILY DISTRICT), CS (SHOPPING CENTER DISTRICT), OM
(OFFICE MEDIUM INTENSITY DISTRICT), AND CG (GENERAL COMMERCIAL
DISTRICT), AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH.
WHEREAS, public hearings have been held regarding the request for rezoning of the
property herein described, and,
WHEREAS, the Owasso City Council has considered the recommendation of the
Owasso Planning Commission and all statements for and against the requested rezoning of
application OZ-99-06.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT
Section 1. The zoning classification of the following described property, to wit:

At the April 20, 1999 meeting, the Owasso City Council approved a request to rezone property
located in Section 22, Township 21 North, Range 14 East, City of Owasso, Rogers County,
Oklahoma. The 314 acre subject property is located north of E 86th Street N, between N 145th E
Avenue and N 161th E Avenue. The rezoning request changes the zoning on the subject property
from AG (Agriculture) District to RS -2 (Residential Single Family Medium Density) District,
RM -2 (Residential Multi- Family) District, CS (Shopping Center) District, OM (Office Medium
Intensity) District, and CG (General Commercial) District.
Attached is a copy of Ordinance No. 613 which formally adopts the City Council's action of
April 20, 1999, thus establishing the change in zoning designation from AG to OM.
RECOMMENDATION:
Staff recommends Council approval of Ordinance No. 613.

SUBJECT: REZONING — 0Z-99 -06, PRESTON LAKES
DATE: April 14, 1999
Please note that this zoning change is substantially identical to a previous case (OZ- 98 -11), which
was approved by the Planning Commission and City Council in July and August of 1998, although
the revised plan includes an additional 60 acres to the original 254 acres. Last year the applicant
submitted a certified list of residents living within 300 feet of the subject property. Unfortunately,
an omission of several houses was later discovered. Ae failure to notify all residents within 300
feet of the proposed zoning change resulted in an invalidation of the previous action.
The applicant, Preston Lakes LLC, proposes a rezoning of 314 acres of land, more or less, currently
zoned AG (Agriculture). The applicant is also requesting a PUD supplemental zoning district
described in the Preston Lakes PUD application elsewhere in this agenda. The proposed zoning
change and PUD will serve as a large, mixed -use development, including commercial, multi- family
apartments, and single - family housing.
The subject property is generally located north of E 86Th St. N between N 145Th E Ave. and N 161st E
Ave. The proposed zoning is from AG to RS -2 (Residential Single - Family Medium Density
District), RM -2 (Residential Multi- Family District), CS (Shopping Center District), OM (Office
Medium Intensity), and CG (General Commercial District).
The subject property is currently undeveloped and is abutted by large lot single - family residences
zoned RS -40 and RS -25, located in unincorporated Rogers County to the north of the subject
property. To the west of the property across N 145x' E Avenue is Silver Greek Addition. To the
south lies additional undeveloped land as well as Cambridge Park, a large -lot addition located in
Rogers County.
The subject property was annexed in June 1998 and is the first parcel of land in Rogers County to
become part of the City of Owasso. The planned Elm Creek Sewer Interceptor will, for the first
time, make development to City of Owasso standards in Rogers County feasible. The interceptor
will have the capacity to serve this area as well as other tracts of undeveloped land nearby.
The 1985 Owasso Comprehensive Plan recommends smaller commercial and multi- family areas,
however, the introduction of the sewer interceptor significantly changes the outlook for
development in the area and the comprehensive plan should be updated to reflect these new

conditions. Staff finds the proposed zoning to be appropriate and compatible with the community
Notice of this zoning change was published in the Owasso Reporter and letters were sent to
property owners within 300 feet of the proposed zone change. A sign with information relevant
to the proposed zoning change was also posted on the subject property.
At the April 13, 1999 Planning Commission meeting, several citizens appeared to ask questions
and express concerns about existing and proposed development. In the course of the discussion,
many questions appeared to be satisfactorily addressed. There was one citizen from Paradise
Valley who remained opposed to the rezoning. He stated that he did not want any development
in the area. He also stated that he would not give up his horses, and he was informed that, since
he still lived in unincorporated Rogers County, he would not have to.
The Owasso Planning Commission recommended approval of the proposed rezoning at the April
13, 1999 regular meeting by a vote of 4 -0, with one member asking to recuse himself from the
vote. The complete staff report is enclosed for your information and review.
RECOMMENDATION
Staff recommends approval of the zoning proposal as submitted.

BACKGROUND
Please note that this zoning change is substantially identical to a previous case (OZ- 98 -11),
which was approved by the Planning Commission and City Council in July and August of 1998.
The plan is virtually the same as the original submission, but includes an additional 60 acres to
the original 254 acres. The applicant submitted a certified list of residents living within 300 feet
of the subject property. Unfortunately, an omission of several houses was later discovered. The
failure to notify all residents within 300 feet of the proposed zoning change resulted in an
invalidation of the previous action.
APPLICANT AND STATUS OF APPLICANT: The applicant is Preston Lakes LLC.
REQUESTED ACTION AND PURPOSE: The applicant proposes a rezoning of 314 acres of
land, more or less, currently zoned AG (Agriculture). The applicant is also requesting a PUD
supplemental zoning district described in the Preston Lakes PUD application elsewhere in this
agenda. The proposed zoning change and PUD will serve as a large, mixed -use development,
including commercial, multi - family apartments, and single - family housing.
LOCATION AND SIZE: The subject property is located in the south half of Section 22, T -21-
N, R -14 -E, City of Owasso, Rogers County, Oklahoma, generally located north of E 86ih St. N
between N 145" E Ave. and N 16151E Ave. The proposed zoning is as follows: from AG to RS-
2 (Residential Single- Family Medium Density District) ± 260.03 acres, RM -2 (Residential Multi -
Family District) ± 12.6 acres, CS (Shopping Center District) ± 21.67 acres, OM (Office Medium
Intensity) ± 15 acres, and CG (General Commercial District) ± 5.0 acres.

Although the proposed CS (Shopping Center Commercial), CG (General Commercial), and RM-
2 (Residential Multi - Family) Districts are slightly larger than the 1985 plan suggests, the
importance of this node has also increased. When the comprehensive plan was drafted 12 years
ago, few predicted that this area would have so much potential for development. Unforeseen
conditions such as the growth of the 86' St. corridor and construction of the sewer interceptor
have changed the outlook for this area. These changing conditions should be accounted for in the
Comprehensive Plan update currently being developed.
The Comprehensive Plan also calls for low- density residential development on the remainder of
the tract. The developer proposes an appropriate RS -2 (Residential Single - Family Medium
Density) District for the same area. Large floodplain areas near Elk Creek would make a full
build out of this site very costly and difficult. In the accompanying PUD plan, the developer
shows large tracts of open space conserved in these floodplain areas.
Notice of this zoning change was published in the Owasso Reporter and letters were sent to
property owners within 300 feet of the proposed zone change. A sign with information relevant
to the proposed zoning change was also posted on the subject property.
The zoning proposal for this tract appears to generally conform with the existing Comprehensive
Plan, and to the Owasso Zoning Code. Staff recommends approval of the zoning proposal as
submitted.

To be considered is a zoning change of 16.67 acres, more or less, from AG (Agriculture) District to CS
(Commercial Shopping Center) District.
The above described tracts are located on the north side of E 86th Street N, east of N 145th E Avenue and
contain 314 acres, more or less. Also proposed for the above described properties is a Planned Unit
Development, proposing development to include commercial, single- family housing, multi - family
housing, and a large park
