Cates, City Attorney Mark Wilken, Mayor MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: THERON WARLICK CITY PLANNER SUBJECT: ANNEXATION REQUEST BY SOKOLOSKY AND VINES ORDINANCE NO. 618 DATE: September 30, 1999 BACKGROUND At the September 21, 1999 meeting, the Owasso City Council unanimously approved a request for annexation of property within Section 7, Township 21 North, Range 14 East. The subject property consists of two tracts of land located on east side of Mingo Road, north of N 106' E Avenue. Each tract is 15 acre in size, with a total annexation request of 30 acres, more or less. A case map is attached for your information and review. As reported to you previously, the subject property's zoning will become AG (Agriculture) upon annexation. Attached is a copy of Ordinance No. 618 which formally adopts the City Council's actions on September 21, 1998. RECOMMENDATION: Staff recommends approval of Ordinance No. 618. ATTACHMENTS: 1. MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: THERON WARLICK CITY PLANNER SUBJECT: ANNEXATION REQUEST SOKOLOSKY & VINES DATE: September 15, 1999 BACKGROUND D.M. Sokolosky and David Vines have requested the annexation of two individually owned 15.4 acre tracts totaling approximately 30.8 acres. The subject properties are described as tracts of land that are part of Government Lots Three (3) and Four (4) in Section Seven (7), Township Twenty- one (21) North, Range (14) East of the Indian Base and Meridian, Tulsa County, State of Oklahoma. The properties are generally located on the northeast comer of Mingo Road (N 97th E Ave.) and E 106th Street N, between Mingo Road and the SKO Railroad Right -of -way. The subject property abuts the existing City Limits on the E 106th Street N (south) side. The land is undeveloped and presently zoned AG (Agriculture) in Tulsa County. Upon annexation, the subject property will be given the City of Owasso AG designation. Preliminary discussions with the owners indicate that they may seek residential zoning, and possibly commercial zoning near the intersection of E 106th Street N. To the west of the subject property, across Mingo Road, there are a few single - family homes and mobile homes fronting Mingo and developed to large -tract, Tulsa County standards. To the east of the subject property is the SKO Railroad line, which currently runs approximately two trains a day. To the north of the subject property is an abandoned strip mine. To the south of the subject property, across N 106th St., is very small triangular tract zoned CS. Sewer will be available to site approximately 500 feet to the west via the North Owasso Sewer Interceptor, now under construction. This property lies within the 1981 court settlement boundary and, although it is a portion of the Rural Water District, it can also be served by OPWA. At this time however, OPWA lines are located approximately %2 mile to the north or south of the site and water is already on site from Rural Washington Water District #3 (RWWD #3). For obvious reasons, the developer is considering using RW WD #3, and according to the settlement, that may be an option. Provision of water does not need to be resolved prior to annexation and can be addressed prior to platting of any subsequent development. This was followed by notification published two consecutive weeks in the Owasso Reporter on August 26 and September 2, 1999 to notify the public of possible City Council action regarding the request on September 21, 1999. In addition to the annexation policy and procedures, copies of the sewer inceptor map, and court settlement are attached for your information and review. The Owasso Annexation Committee recommended approval of the annexation request at their September 13, 1999 special meeting and the Owasso Planning Commission also recommended approval at their September 14, 1999 regular meeting. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2. All propetties should be cont-iguotis to existing city limits, 3. All properties should be.annexed: into the city limits as the lowest zoning classification, that is AG, agricultural. Landowners may then petition for rezoning if -they desire further development of their.property. All legal uses annexed into the city will be legal, but non - conforming, which means that they may continue but cannot. be expanded without proper zoning. 4. All public infrastructures that do not met city standards will not be improved by the city until brought to the city standard and accepted by, the City Council. Such public facilities must be improved at owners expense by the establishaent of a special assessment district or some other financing method. 5. The parties have further agreed that any persons now served by RWD E3 may continue to purchase water from RWD t3 until such time as OPWA takes title to said lines by paying RWD #3 therefor. The parties have further agreed that RWD would charge persons desirous of purchasing a water tap from the sum of ;50-00.for each tap requested not to exceed OPWA 6200.00 per acre. In consideration of payment thereof, opwA 'would have the right to sell water to said persons with no further liability on behalf of said persons; firms or cor- porations or OPWA. 6. IT 1S FURTHER AGREED that within the territory granted in Paragraph 2, supra, that there is no objection on the part of OPWA to the RWD 03 serving a territory with one tap for 23h acres or more if a developer o P K owner, reauerFew service from RWD /3 rather OPWA. It is understood however that OPWA is not obligated to furnish any city services or sewer service to Property connected to RWD #3 water system rather than the OPWA eater system. 7 RWD 03 is to be paid $50.00 for each tap already in Place in E1 Rio Vista subdivision but OPWA shall not be reaponsible for the collection thereof. 8. It is further agreed that the parties will at Ilto negotiate and interchange for purpose of supplying water to each other on an emergency basis. 9. It is further agreed that an original of the settlement agreement shall be filed in the above captioned case. 10.
