ORDINANCE NO. 633
AN ORDINANCE ACCEPTING, ADDING, AND ANNEXING TO THE CITY OF
OWASSO, OKLAHOMA, ADDITIONAL LANDS AND TERRITORY IN TULSA
COUNTY, PROVIDING THAT FROM AND AFTER THE PASSAGE AND
PUBLICATION OF THIS ORDINANCE THAT ALL OF THE REAL PROPERTY
WITHIN SAID TERRITORY HEREIN DESCRIBED SHALL BE A PART OF THE
CITY OF OWASSO, OKLAHOMA, AND FURTHER DECLARING THAT ALL
PERSONS RESIDING THEREIN SHALL BE SUBJECT TO THE JURISDICTION,
CONTROL, LAWS, AND ORDINANCES OF THE CITY OF OWASSO, OKLAHOMA,
AND DIRECTING THE FILING OF THIS ORDINANCE;
WHEREAS, pursuant to the provisions of Title 11, Section 21-103, et seq., of the
Oklahoma Statutes, the City of Owasso is permitted to annex additional territory providing that the
governing body receives written consent from the owners of at least a majority of the acres to be
annexed;and
WHEREAS, the Owasso Land Trust, L.L.C. has requested the annexation of additional
territory, and the City of Owasso has received said written consent to annex additional territory, the
same being contiguous to the corporate limits of the City of Owasso; and
WHEREAS, notice of the presentation of said annexation request was given by publication
in the Owasso Reporter, a newspaper of general circulation published in the City of Owasso,
Oklahoma, and notice was given that said annexation request would be considered by the City
Council of the City of Owasso, at a meeting to be held on February 15, 2000 at 6 :30 PM at the
Community Center, Owasso, Oklahoma; and
WHEREAS, on the 15'" day of February, 2000, said consent was duly considered by the
City Council and was determined to have complied with the provisions of Title 11, Section 21 -103,
et seq., of the Oklahoma Municipal Code, and further, that proper legal notice of presentation of
said petition had been given; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA.
Section 1. That the following described territory lying in Tulsa County, Oklahoma which is
contiguous to the present corporate limits of the City of Owasso and described in the annexation
request presented to the City Council in accordance with the provisions of Title 11, Section 21 -103,
et seq., of the Oklahoma Statutes, and more particularly described as follows, to -wit:

Section 2. That from and after the passage and publication of this Ordinance, the real estate
and territory described in Section 1 hereof shall be a part of the City of Owasso, Oklahoma, and all
persons residing therein, and all property situated thereon, shall be and are hereby declared to be
subject to the jurisdiction, control, laws, and ordinances of the City of Owasso, Oklahoma, in all
respects and particulars.
Section 3. That from and after the passage and publication of this Ordinance, the real estate
and territory described in Section 1 hereof, shall be deemed to be in the AG (Agriculture) zoning
district of the City of Owasso in accordance with the provisions of Section 110.3 of the Owasso
Zoning Ordinance.
Section 4. That there be filed in the office of the County Clerk of Tulsa County, Oklahoma,
a true and correct copy of this Ordinance, together with an accurate map of the territory hereby
annexed.

BACKGROUND
At the February 15, 2000 meeting, the Owasso City Council unanimously approved a request for
annexation of two tracts and a portion of right -of -way located in Sections 9, 16, and 21, all in T-
21-N, R -14 -E. The subject properties are in two locations on the west side of N 1450'E Avenue.
A case map is attached for your information and review.
As reported to you previously, the subject property's zoning will become AG (Agriculture) upon
annexation. Attached is a copy of Ordinance No. 633 which formally adopts the City Council's
actions on February 15, 2000.
RECOMMENDATION:
Staff recommends approval of Ordinance No. 633.

BACKGROUND
David Chamey has requested the annexation of two tracts and a portion of right -of -way located
in Sections 9, 16, and 21, all in T -21 -N, R -14 -E. The subject properties are in two locations on
the west side of N 145th E Avenue.
Tracts A is five foot wide strip of land located in the public right -of -way on N 145th E Avenue.
This strip does not include the roadway itself. Tracts B through F consist of a contiguous 160 acre,
more or less, tract that is located on the southwest corner of E 106" Street N and N 145" E Avenue.
This Owasso Comprehensive Plan calls for a combination of commercial and single- family uses
however, the zoning designation upon annexation will be AG (Agriculture). Rezoning on the
subject property will need to be submitted separately and can only be adopted by Council after the
subject property is officially annexed.
Tracts G through I are related to the proposed site for the Tulsa Technology Center. This property
consists of approximately 40 acres and is located approximately 1/4 mile north of E 106th Street N on
the west side of N 145th E Avenue.
These properties are located in the water service area of Rural Washington Water District #3. The
developer is proposing to extend the Elm Creek Sewer Interceptor to the north along N 145th E
Avenue. The extension of this sewer will be critical for the future development of this site.
Preliminary discussion of the sewer situation indicates that the developer is moving forward with a
plan to extend sewers to this area, which should eliminate this barrier to development.
The proposed annexation conforms to the City of Owasso Annexation Policy and was processed
according to our procedures involving a citizen sponsored annexation.
Notification of the annexation request was published in the Owasso Reporter on January 20, 2000
to notify the public of the annexation request before the Planning Commission meeting on February
8, 2000. This will be followed by notification published two consecutive weeks in the Owasso
Reporter on January 27, 2000 and February 3, 2000 to notify the public of possible City Council
action regarding the request on February 15, 2000. The annexation policy and procedures are
attached for your information and review.

The Owasso Annexation Committee reviewed the proposed annexation request at their February 7,
2000 special meeting. They recommended approval of the annexation. They noted that the
annexation request may be inconsistent with typical annexation policy and procedures because of
the annexation of a narrow strip to provide contiguous property for these otherwise noncontiguous
tracts. In their motion however, it was noted that the economic development potential of this site
provided good reason for a deviation from the standard policy. The Annexation Committee also
recommended that the current annexation policy be reviewed to ensure it meets our anticipated
annexation needs. The Owasso Planning Commission offered the same recommendations in their
February 8, 2000 endorsement of the annexation request.
RECOMMENDATION
Staff recommends approval of the proposed annexation request.

ANNEXATION POLICY
While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing city limits.
All properties should be annexed into the city limits as the lowest zoning classification,
that is, AG, agricultural. Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the city will be legal,
but non - conforming, which means that they may continue but cannot be expanded without
proper zoning.
4. All public infrastructures that do not met city standards will not be improved by the city
until brought to the city standard and accepted by the City Council. Such public facilities
must be improved at owners expense by the establishment of a special assessment district
or some other financing method.
5. Where a city limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistence and allow city employees and
citizens to know where the city boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for
a six month period after rejection by the City Council.
