That from and after the passage and publication of this Ordinance, the real estate and territory described in Section 1 hereof, shall be deemed to be in the AG (Agriculture) zoning district of the City of Owasso in accordance with the provisions of Section 110.3 of the Owasso Zoning Ordinance. Section 4. That there be filed in the office of the County Clerk of Tulsa County, Oklahoma, and correct copy of this Ordinance, together with an accurate map of the territory hereby annexed. DEEN ORDINANCE NO. 634 DATE: February 29, 2000 At the February 15, 2000 meeting, the Owasso City Council unanimously approved a request for the annexation of an 10 acre tract located on the northwest corner of E 96TH Street N and Mingo Road (N 97TH E Avenue). The subject property is described as the S/2 E/2 SE /4 SEA of Section 13, T -21 -N, R -13 -E. A case map is attached for your information and review. As reported to you previously, the subject property's zoning will become AG (Agriculture) upon annexation. Attached is a copy of Ordinance No. 634 which formally adopts the City Council's actions on February 15, 2000. RECOMMENDATION: Staff recommends approval of Ordinance No. 634. ATTACHMENTS: 1. MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: THERON WARLICK CITY PLANNER SUBJECT: ANNEXATION REQUEST DAVID CHARNEY — DEEN DATE: February 9, 2000 BACKGROUND David Charney, on behalf of Owasso Land Trust, LLC, has requested the annexation of an 10 acre tract located on the northwest corner of E 96th Street N and Mingo Road (N 97th E Avenue). The subject property is described as the S/2 E/2 SE /4 SE /4 of Section 13, T -21 -N, R -13 -E. E 96th Street N terminates just to the west of Mingo Road. To the east of the subject property is an undeveloped portion of the Lakes PUD that is proposed to contain commercial development. To the south is additional undeveloped land located in Tulsa County. The area to the south is a portion of the original Bailey Ranch PUD and is proposed to contain light industrial uses. To the southeast of the subject property is a large detention pond that is a portion of the Fairways golf course development. Water and sewer is reasonably close to the subject property site. Existing portions of the Fairways addition are located approximately 1/4 mile to the east of the subject property. This property lies within the 1981 court settlement boundary and, although it is a portion of the Rural Washington Water District #3, it can also be served by OPWA. So long as the developer pays $50 per tap to the Rural Water District, provision of water by the City of Owasso is possible. As noted in previous annexation cases, it is prudent to discuss the feasibility of providing water and sewer to the subject property. At this time, it appears that water and sewer will be available to the site and there are no barriers to development noted. Notification of the annexation request was published in the Owasso Reporter on January 20, 2000 to notify the public of the annexation request before the Planning Commission meeting on February 8, 2000. This will be followed by notification published two consecutive weeks in the Owasso Reporter on January 27, 2000 and February 3, 2000 to notify the public of possible City Council action regarding the request on February 15, 2000. In addition to the annexation policy and procedures, a copy of the rural water district court settlement are attached for your information and review. All properties should be contiguous to existing city limits. 3. All properties should be annexed into the city limits as the lowest zoning classification, that is, AG, agricultural. Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the city will be legal, but non - conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not met city standards will not be improved by the city until brought to the city standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. Where a city limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow city employees and citizens to know where the city boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Adopted by Council on March 1, 1988. The parties have agreed that the shaded area in Exhibit "A" which is attached hereto and made a part hereof ldefInes the area within Rural Water District No. 3 that can be served by OPWA. In addition, it is agreed that OPWA can serve the subdivisions and additions to the town of Owasso, Oklahoma known as Meadowcrest, Hillside, Northdale, Steeq, Westport I and and II and Hale Acres I and I1 subdivisions without further authority from RWD 13. RWD t3 has agreed that no charges will 1. be made to any persons for permission to hook onto OPVA water system in the above enumerated subdivisions. 3. The parties being advised by the Court, it was the opinion of the Court that charges Ear water taps payable to (RWD #3 should be collected by RWD A3 and upon presentment of the receipt for payment thereof, OPWA would then have the authority to sell its own water tap and install a water tap within the shaded area at the location described on the tap receipt obtained fibm RWD f3. 4. The parties have further agreed that in the event there are any water lines or improvements within the area (herein granted OPWA, that OPWA will negotiate with RWD f3 for the purchase of said lines or improvements taking into consid- eration only the cost thereof less depreciation. The parties have further agreed that any persons now served by RWD f3 may continue to purchase water from RWD 43 until such time as OPWA takes title to said lines by paying RWD 13 therefor. 5. The parties have further agreed that RWD 13 would charge persons desirous of purchasing a water tap from OpwA the sum of $50.00 for each tap requested not to exceed 5200.00 per acre In consideration of payment thereof, opwA would have the right to sell water to said persons with no further liability on behalf of said persons; firms or cor- porations or OPWA. 6.
