AN ORDINANCE APPROVING ZONING APPLICATION NUMBER
OZ-00-12 CHANGING THE ZONING OF PROPERTY LOCATED WITHIN
SECTION 6, TOWNSHIP 21 NORTH, RANGE 14 EAST, TULSA COUNTY,
OKLAHOMA, FROM AG (AGRICULTURE) TO RS-3 (RESIDENTIAL SINGLE -
FAMILY, HIGH DENSITY), REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, public hearings have been held regarding the request for rezoning of the
property herein described, and,
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso
Planning Commission and all statements for and against the requested rezoning of application
OZ-00-12.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT, TO -WIT:
Section 1. The zoning classification of the following described property, to -wit:
THE NORTH HALF (N/2) OF THE SOUTHEAST QUARTER (SE/4) OF THE
NORTHEAST QUARTER (NE/4) OF SECTION 6, TOWNSHIP 21 NORTH,
RANGE 14 EAST OF THE INDIAN BASE AND MERIDIAN, LESS AND EXCEPT,
THE SOUTH 332 FEET OF THE EAST 325 FEET THEREOF. CONTAINING 17.65
ACRES, MORE OR LESS, ACCORDING TO THE U.S. SURVEY THEREOF,
be, and the same is hereby rezoned from AG (Agriculture) to RS-3 (Residential Single -
Family, High Density).
Section 2. That all ordinances or parts of ordinances in conflict herewith be, and the same, are
hereby expressly repealed.
Section 3. That this Ordinance shall become effective thirty (30) days from the date of first
publication as provided by state law.

BACKGROUND
At the October 17, 2000 regular meeting the City Council unanimously approved a rezoning
request for a 17.65 acre, more or less, parcel of land located north of E. 116th Street N. and west of
N. Garnett Road.
Ordinance No. 662 would formally adopt the action taken by the City Council at the October 17,
2000 meeting.
RECOMMENDATIONS
Staff recommends approval of Ordinance No. 662.

BACKGROUND
A &W Land Development ahs requested approval of a rezoning application. The subject property is
17.65 acres, more or less, and is located north of E. 116th Street N. and west of N. Garnett Road.
The applicant is requesting rezoning on the subject property from AG (Agriculture) to RS -3
(Residential Single - Family, High Density).
If approved, the rezoning would allow for the development of the subject property as a portion of
the future Phase V of Country Estates.
The Owasso Planning Commission reviewed the request at the October 10, 2000 regular meeting
and unanimously recommended approval of OZ- 00 -12. At that meeting, there was no citizen
comment regarding this application.
RECOMMENDATIONS
Staff recommends approval of OZ- 00 -12, rezoning the subject property from AG (Agriculture) to
RS -3 (Residential Single - Family, High Density).

BACKGROUND
A & W Land Development, owner, has submitted a request for rezoning of a 17.65 acre
parcel of land from AG (Agriculture) to RS -3 (Residential Single - Family, High Density).
The subject property is generally described as a portion of the north half (N /2) of the
southeast quarter (SE/4) of the northeast quarter (NE/4) of Section 6, Township 21 North;
Range 14 East and is located north of E. 116th Street N. and N. Garnett Road.
ANALYSIS
The subject property is undeveloped and vacant. The property will be a portion of a
future phase of Country Estates. The property is bound on the west and south by existing
Country Estates subdivision and on the north and east by Tulsa County rural residential.
The Comprehensive Plan shows this area as low- intensity residential. It is staff s opinion
that rezoning the subject property to RS -3 is consistent with the Comprehensive Plan.
The potential use of this property, if zoned RS -3, would be strictly limited to the BULK
AND AREA REQUIREMENTS IN RESIDENTIAL DISTRICTS as set forth in Chapter
4, Section 430 of the Owasso Zoning Code.
The addition of this parcel to the property currently planned as Country Estates V, would
allow for a northern access point onto N. Garnett Road.
Notices of this rezoning were mailed to surrounding property owners on September 19,
2000, and the legal advertisement was published in the September 21, 2000 edition of the
Owasso Reporter. Calls were received from a couple of the property owners notified.
Generally, the callers were confirming this would be an extension of the existing
development. One caller expressed concern over the possible exacerbation of drainage
problems.
RECOMMENDATION
Staff recommends approval of OZ -00 -12 subject to the following conditions:
1. Development impact issues related to all areas of Country Estates be
addressed at the time of platting of Phase V.
