WHEREAS, public hearings have been held regarding the request for rezoning of the property herein described, and, WHEREAS, the Owasso City Council has considered the recommendation of the Owasso Planning Commission and all statements for and against the requested rezoning of application OZ- 01 -02. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT, TO -WIT: Section 1. The zoning classification of the following described property, to -wit: LOT 1, BLOCK 2 ORIGINAL TOWN OF OWASSO be, and the same is hereby rezoned from RS -3 (Residential Single- Family, High Density) to OL (Office Light). Section 2. That all ordinances or parts of ordinances in conflict herewith be, and the same, are hereby expressly repealed. Section 3. Birch. Ordinance No. 677 would formally adopt the action taken by the City Council at the May 15, 2001 meeting. RECOMMENDATIONS Staff recommends approval of Ordinance No. 677. ATTACHMENTS 1. Ordinance No. 677 v /11_� MEMORANDUM TO: H'ONOARBLE MAYOR AND COUNCIL CITY OF OWASSO FROM: DONNA SORRELLS CITY PLANNER SUBJECT: REZONING OZ -01 -02 DATE: May 9, 2001 BACKGROUND David Charney, attorney for the owner, has submitted a request for rezoning from RS -3 (Residential Single - Family, High Density) to OL (Office Light) on property located at 302 N. Birch. The subject property is approximately 9,600 square feet in size. The subject property currently contains a vacant, dilapidated residential structure. To meet the structure setback requirements of the Office zoning district, the existing structure would be removed and a compliant structure would be erected. The property is bound on the north by RS- 3 (Residential Single- Family, High Density), on the west by CS (Commercial Shopping) including Dale & Lee's, on the south by RS -3 and the First United Methodist Church, and on the east by RS -3 zoning and use. There remains few residential structures within the blocks between N. Birch and N. Main Streets and between E. 3`d and E. 5s' Streets. Past rezoning of the portion of this area south of E. 2 "d Street established CH (Commercial, High Intensity) zoning. The CH district extends west to W. Atlanta Street. While the request is not in line with the Comprehensive Plan, staff feels this particular property is oriented to the surrounding residential in such a way as to not encourage future redevelopment or reuse of the property as residential. It is staff's opinion, also, that office uses, including the existing churches, is an appropriate buffer between the stable residential neighborhoods to the north. Letters were mailed to surrounding property owners on March 19, 2001 and legal notification of the proposed rezoning was published in the March 22, 2001 edition of the Owasso Reporter. The Owasso Planning Commission heard the rezoning request at the April 10, 2001 regular meeting. At that time, the Commission tabled the item until the next regular meeting to allow for a full Commission vote. The application was heard again at the May 8, 2001 regular meeting where the Commssion voted 4 -1 to recommend approval of the rezoning request. Several protestors attended the first hearing of the rezoning request by the Planning Commission. Concerns, primarily, were regarding traffic and potential use of the property. Mr. Chamey directly addressed some of the concerns of the attendees. No objectors were present at the second hearing of the request by the Commission. RECOMMENDATIONS Staff recommends approval of OZ- 01 -02, rezoning the subject property from RS -3 (Residential Single - Family, High Intensity) to OL (Office Light). ATTACHMENTS 1. Location Map
