AN ORDINANCE APPROVING ZONING APPLICATION NUMBER
OZ -01 -03 CHANGING THE ZONING OF PROPERTY LOCATED WITHIN
O SECTION 5, TOWNSHIP 21 NORTH, RANGE 14 EAST, TULSA COUNTY,
OKLAHOMA, FROM AG (AGRICULTURE) TO RS-3 RESIDENTIAL SINGLE-
FAMILY, HIGH DENSITY), REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, public hearings have been held regarding the request for rezoning of the
property herein described, and,
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso
Planning Commission and all statements for and against the requested rezoning of application
OZ-01-03.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT, TO -WIT:
Section 1. The zoning classification of the following described property, to -wit:
A TRACT OF LAND IN THE SOUTH HALF (S/2) OF THE SOUTHWEST QUARTER (SW/4)
OF SECTION 5, TOWNSHIP 21 NORTH, RANGE 14 EAST OF THE INDIAN BASE AND
MERIDIAN, TULSA COUNTY, STATE OF OKLAHOMA, ACCORDING TO THE U.S.
GOVERNMENT SURVEY THEREOF. SAID TRACT MORE PARTICULARLY DESCRIBED
AS FOLLOWS, TO -WIT.
COMMENCING AT THE SOUTHWEST CORNER OF SECTION 5, T21N, R14E;
THENCE N89°56' 08 "E ALONG THE SOUTH LINE OF SAID SECTION 5 A

BACKGROUND
Stan Sallee, owner, has requested approval of a rezoning application. The subject property is 37.42
acres, more or less, and is located north of E. 116th Street N. and east of N. Garnett Road. The
applicant is requesting rezoning on the subject property from AG (Agriculture) to RS -3 (Residential
Single - Family, High Density).
The Owasso Planning Commission reviewed the request at the May 8, 2001 regular meeting and
unanimously recommended approval of OZ-01-03. At that meeting, there was no citizen objection
regarding this application.
RECOMMENDATIONS
Staff recommends approval of OZ-01-03, rezoning the subject property from AG (Agriculture) to
RS-3 (Residential Single - Family, High Density).

DLH Engineers, agent for the owner, has submitted a request for rezoning from AG
(Agriculture) to RS -3 (Residential Single - Family, High Density) on property located north of E.
116th Street N. and east of N. Garnett Road. The subject property is approximately 37.42 acres in
size.
The subject property is currently vacant and undeveloped. The property is bound on the west by
N. Garnett Road and, further, by Country Estates, also zoned RS-3; on the north and east by
undeveloped farmland and large -lot county subdivisions; and on the south by commercial and
county residential.
ANALYSIS
The applicant is requesting rezoning on a parcel of land, approximately 37.42 acres in area, from
AG (Agriculture) to RS-3 (Residential Single - Family, High Density).
The Owasso 2010 Land Use Master Plan designates this land as low- intensity residential.
Therefore, the proposed use of single - family detached residential is appropriate for the property.
During the discussion prior to annexation approval for the subject property, Mr. Lawrence
Poyner stated that through an historical agreement with previous landowners, a portion of his
septic field lies within the subject property. The applicant and the applicant's agent have been
made aware of Mr. Poyner's claim, and have agreed to look into the matter. This issue should be
resolved by the time of final platting of the property.
Letters were mailed to surrounding property owners on April 17, 200 land legal notification of
the proposed rezoning was published in the April 19, 2001 edition of the Owasso Reporter. Staff
received no calls from citizens regarding this application.
Staff recommends approval of OZ-01-03.

BACKGROUND
At the June 5, 2001 regular meeting, the City Council unanimously approved a rezoning request for
a 37.42 acre, more or less, parcel of land located within the Southwest Quarter (SW/4) of Section 5,
Township 21N, Range 14E.
Ordinance No. 678 would formally adopt the action taken by the City Council at the June 5, 2001
meeting.
RECOMMENDATIONS
Staff recommends approval of Ordinance No. 678
