AN ORDINANCE APPROVING ZONING APPLICATION NUMBER
OZ -01 -06 CHANGING THE ZONING OF PROPERTY LOCATED WITHIN
SECTION 7, TOWNSHIP 21 NORTH, RANGE 14 EAST, TULSA COUNTY,
OKLAHOMA, FROM CG (COMMERCIAL GENERAL) TO RS-3 (RESIDENTIAL
SINGLE- FAMILY, HIGH DENSITY) REPEALING ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, public hearings have been held regarding the request for rezoning of the
property herein described, and,
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso
Planning Commission and all statements for and against the requested rezoning of application
OZ- 01 -06.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT, TO -WIT:
Section 1. The zoning classification of the following described property, to -wit:
THE NORTH 1236.24 FEET OF THE SOUTH 1766.24 FEET, LYING WEST OF THE
ATCHISON, TOPEKA, AND SANTA FE RAILROAD TRACTS, OF GOVERNMENT
LOTS 3 & 4, SECTION 7, TOWNSHIP 21 NORTH, RANGE 14 EAST OF THE INDIAN
BASE & MERIDIAN, TULSA COUNTY, STATE OF OKLAHOMA
be, and the same is hereby rezoned from CG (Commercial General) to RS -3 (Residential
Single - Family, High Density).
Section 2. That all ordinances or parts of ordinances in conflict herewith be, and the same, are
hereby expressly repealed.
Section 3. That this Ordinance shall become effective thirty (30) days from the date of first
provided by state law.

BACKGROUND
At the October 2, 2001 regular meeting, the City Council unanimously approved a rezoning request
for a 12.95 acre, more or less, parcel of land located north of E. 106th Street N. and east of N. Mingo
Road.
Ordinance No. 688 would formally adopt the action taken by the City Council at the October 2,
2001 meeting.
RECOMMENDATIONS
Staff recommends approval of Ordinance No. 688.

BACKGROUND
D. M. Sokolosky, applicant, has requested approval of a rezoning application. The subject property
is 12.95 acres, more or less, and is located east of N. Mingo Road and 530 feet north of E. 106th
Street N. The applicant is requesting rezoning on the subject property from CG (Commercial
General) to RS -3 (Residential Single - Family, High Density).
The Owasso Planning Commission reviewed the request at the September 17, 2001 special meeting
and unanimously recommended approval of OZ-01-06. At that meeting, several citizens voiced
concerns over potential drainage issues arising from development.
RECOMMENDATIONS
Staff recommends approval of OZ- 01 -06, rezoning the subject property from CG (Commercial
General) to RS -3 (Residential Single - Family, High Density).

BACKGROUND
D. M. Sokolosky, applicant, has submitted a request for rezoning from CG (Commercial
General) to RS -3 (Residential Single - Family, High Density) on property located east of N.
Mingo Road and 530 feet north of E. 106`h Street N. The subject property is approximately
12.95 acres in size.
The subject property is bound on the west by rural residential, zoned AG (Agriculture); on the
north by Metro Heights subdivision, zoned RS -3 (Residential Single - Family, High Density); and
on the east by railroad right -of -way and further east and on the south by vacant, undeveloped
land zoned AG (Agriculture).
ANALYSIS
The Owasso 2010 Land Use Master Plan designates the subject property as commercial/office.
The Owasso Planning Commission and City Council approved rezoning of the subject property
to CG (Commercial General) in December 1999.
As the request currently before the Planning Commission represents a use less intense than that
reflected on the comprehensive plan, staff is supportive.
Letters were mailed to surrounding property owners on August 21, 2001 and legal notification of
the proposed rezoning was published in the August 23, 2001 edition of the Owasso Reporter.
Staff received one e-mail message from a citizen regarding this application. A copy of the e-
mail is attached for you information and review.
RECOMMENDATION
Staff recommends approval of OZ- 01 -06.
