WHEREAS, public hearings have been held regarding the request for rezoning of the property herein described, and, WHEREAS, the Owasso City Council has considered the recommendation of the Owasso Planning Commission and all statements for and against the requested rezoning of application OPUD-15A. Cates, City Attorney MEMORANDUM TO: HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: DONNA SORRELLS CITY PLANNER SUBJECT: ORDINANCE NO. 691 PUD AMENDMENT OPUD-15A DATE: October 31, 2001 BACKGROUND At the October 16, 2001 regular meeting, the City Council unanimously approved Planned Unit Development OPUD-15A an amendment to the Preston Lakes Planned Unit Development. The subject property contains 254 acres, more or less. Ordinance No. 691 would formally adopt the action taken by the Council at the October 16, 2001 meeting. Ordinance No. 691 MEMORANDUM TO: HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: DONNA SORRELLS CITY PLANNER SUBJECT: PUD AMENDMENT OPUD -15A (WARD THREE) DATE: October 10, 2001 BACKGROUND Preston Lakes, L.L.C. has requested approval of a minor amendment to the Preston Lakes Planned Unit Development (OPUD-15). This amendment affects only Lots 3, 8, 13 and 18, Block 1, Preston Lakes Amended. The subject property is located at the northeast corner of E. 86th Street N. and N. 145th E. Avenue. A location Map is attached for your information and review. The applicant recently requested an amendment to the Preston Lakes plat that modified an area of 18 previously platted duplex lots to 30 single - family lots. The duplex lots were organized around cul -de -sacs that have been constructed. The cul-de-sacs' existence has limited the redesign of the area and caused the four subject lots to be slightly less than the minimum 65 foot width established by the PUD Outline Development Plan. As this is a minor amendment, no legal notification was required prior to the Planning Commission or Council hearing the request. The Owasso Planning Commission reviewed the request at the October 9, 2001 regular meeting and unanimously recommended approval subject to the condition that no future variances shall be granted by the Owasso Board of Adjustment on the affected lots. Staff concurs with this recommendation. RECOMMENDATIONS Staff recommends approval of OPUD -15A subject to the condition of approval imposed by the Owasso Planning Commission. 1. Location Map 2. TEXT Pursuant to Section 880.9 of the City of Owasso, Oklahoma, Zoning Code, the Planned Unit Development for Preston Lakes is hereby amended to permit a Minimum Lot Frontage on certain single- family detached residential lots to be less than 65 feet in width. Specifically, 18 residential lots that were previously platted for duplex construction (36 dwelling units) are being re- platted to accommodate 30 single- family structures. Such re -plat, although resulting in a less dense land use, will result in four certain residential lots having less frontage than permitted in the original text of said Planned Unit Development. The four affected lots, as identified on the proposed Amended Plat, are as follows: Lots 3, 8, 13 and 18, Block 1, Preston Lakes Amended; It is acknowledged that such changes are minor in nature and the proposed Amended Plat maintains substantial compliance with the outline development plan of the subject P.U.D. and the purposes and standards of the P.U.D. provisions thereof. It is hereby acknowledged that the Preston Lakes P.U.D. is hereby amended to permit said four lots to have less frontage than permitted in the original text of said Planned Unit Development, specifically the dimensions of said lots shalt conform to the dimensions set forth on the Preston Lakes Amended Plat submitted simultaneously herewith.
