THAT ALL PERSONS RESIDING THEREIN SHALL BE SUBJECT TO THE
JURISDICTION, CONTROL, LAWS, AND ORDINANCES OF THE CITY OF
OWASSO, OKLAHOMA, ESTABLISHING THE SAME AS PART OF WARD ONE
OF SAID CITY, DIRECTING THE FILING OF THIS ORDINANCE,
WHEREAS, pursuant to the provisions of Title 11, Section 21 -103, et seq., of the
Oklahoma Statutes, the City of Owasso is permitted to annex additional territory providing a
petition in writing, signed by not less than three - fourths of the legal voters and owners of not less
than three- fourths (in value) of the property hereinafter described, the same being contiguous to
the corporate limits of the City of Owasso, requesting that said property be annexed and added to
the City of Owasso is submitted; and
WHEREAS, the City of Owasso received a petition to annex additional territory, signed
by not less than three - fourths of the legal voters and owners of not less thk tbree- fourths (in
value) of the property hereinafter described, the same being contiguous to the corporate limits of
the City of Owasso, requesting that said property be annexed and added to the City of Owasso;
and
WHEREAS, on October 11, 2001, and October 18, 2001, notice of the presentation of
said Petition was given by the Petitioner by publication in the Owasso Reporter, a newspaper of
general circulation published in the City of Owasso, Oklahoma, and notice was given that said
Petition would be considered by the City Council of the City of Owasso, at a meeting to be held
on November 6, 2001 at 6:30 PM at the Community Center, Owasso, Oklahoma; and
WHEREAS, on the 6th day of November, 2001, said Petition was duly considered by the
City Council and was determined to have complied with the provisions of Title 11, Section 21-
103, et seq., of the Oklahoma Statutes, and further, that proper legal notice of presentation of
said petition had been given; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT, TO-WIT:
Section 1. the following described territory lying in Tulsa County, Oklahoma which is
contiguous to the present corporate limits of the City of Owasso and described in the petition for
annexation presented to the City Council in accordance with the provisions of Title 11, Section

Section 2. That from and after the effective date of this Ordinance, the real estate and territory
described in Section 1 hereof shall be a part of the City of Owasso, Oklahoma, and in Ward One
thereof, and all persons residing therein, and all property situated thereon, shall be and are hereby
declared to be subject to the jurisdiction, control, laws, and ordinances of the City of Owasso,
Oklahoma, in all respects and particulars.
Section 3. That from and after the effective date of this Ordinance, the real estate and territory
described in Section 1 hereof, shall be deemed to be in a CG, Commercial General, zoning
district of the City of Owasso in accordance with the provisions of Section 110.3 of the Owasso
Zoning Ordinance.
Section 4. That there be filed in the office of the County Clerk of Tulsa County, Oklahoma, a
true and correct copy of this Ordinance, together with an accurate map of the territory hereby
annexed.
Section 5. That by the reason of time, an emergency is declared to exist whereby this ordinance
shall become effective immediately upon passage and the first publication thereof provided by
state law.

CORRECTING ZONING CLASSIFICATION
DATE: January 31, 2002
BACKGROUND:
In November of 2001, the City Council approved the annexation of a triangular tract of land containing
3.94 acres, more or less, located adjacent to the east service road of the Owasso Expressway, between E.
96th Street North and N. 106th Street North. A location map is attached for your information and review.
Originally, the property was annexed zoned AG (Agriculture), which is often the case when the City
annexes undeveloped property. However, the Owasso Zoning Code provides the provision for property
being annexed to maintain its Tulsa County zoning classification if so desired by the applicant and if there
is a similar zoning classification already existing in the city limits. Unfortunately, due to staff error, the
annexation was processed without the understanding that the applicant wanted to maintain the Tulsa
County zoning of CG (Commercial General).
At the time negotiations were occurring with land owners along the Owasso Expressway for the donation
of property for the new Tulsa Technology Center site, the owner of the subject property was willing to
donate land between E. 106th Street North and E. 116th Street North (now identified as the future site of the
TTC) providing the City of Owasso did not oppose his efforts to obtain off -site advertising signs at three
locations along the service road. The City's position on this issue was that providing the applications for
the off -site advertising were already in the process prior to annexation, the city would not oppose. The
owner of the property, Mr. Robinson, has applied for the off -site advertising and the CG zoning is
necessary in order to obtain approval from the Department of Transportation.
While it continues to be staff's position that off -site advertising is not a desirable amenity in a growing
community and that signs should be used for identification purposes, not advertising, it is sometimes more
important to offer other amenities in exchange. The ability for the City of Owasso to obtain the future site
of a Tulsa Technology Center campus in our community, thus offering an additional educational choice in
Owasso that had not previously existed for residents and employers, was the goal.
Ordinance No. 693, Amended, would correct the zoning of the subject property from AG (Agriculture) to
CG (Commercial General) which was the previous classification in Tulsa County. Commercial zoning
along a highway service road is not inappropriate, as a significant portion of property located along the
existing service roads is already zoned commercially, in large part due to good vehicular access and
merchant visibility. Recent zoning efforts along the Owasso Expressway support this development trend.
The owner of the subject property, Mr. Ken Robinson, or his representative Mr. David Charney, will be in
attendance Tuesday evening should you have any questions.
RECOMMENDATION:
Staff recommends City Council approval of Ordinance No. 693, Amended, correcting the zoning
classification on the subject property from AG (Agriculture) to CG (Commercial General).

BACKGROUND
Charney & Charney, agent for the owner, has submitted to the City of Owasso a petition for
annexation of their property totaling 3.94 acres, more or less. The subject property is located north
of E. 98th Street N. and east of U.S. Highway 169. A location map attached for your information
and review.
The subject property is currently zoned AG (Agriculture) and would remain so upon annexation,
as required under Owasso's Annexation Policy. If annexation is approved, the subject property
will require rezoning and platting prior to development.
The Owasso Planning Commission reviewed the request at the October 9, 2001 regular meeting
and unanimously recommended approval.
Legal notification was published in the October 11th & 18th editions of the Owasso Reporter. A
copy of the notification is attached for your review.
RECOMMENDATIONS
Staff recommends approval of this annexation.
