That from and after the effective date of this Ordinance, the real estate and territory described in Section 1 hereof, shall be deemed to be in the AG (Agriculture) zoning district of the City of Owasso in accordance with the provisions of Section 110.3 of the Owasso Zoning Ordinance. Section 4. That there be filed in the office of the County Clerk of Rogers County, Oklahoma, a true and correct copy of this Ordinance, together with an accurate map of the territory hereby annexed. Cates, City Attorney TO: HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: DONNA SORRELLS SUBJECT: ANNEXATION RIGHT -OF -WAY DATE: October 31, 2001 The Owasso Public Works Department is requesting approval of the annexation of a portion of right -of -way located at the southeast comer of the intersection of E. 86th Street N. and N. 145th E. Avenue. A location map and boundary map are attached for your information and review. The annexation of this remaining portion of the right -of -way is required prior to planned improvements of the intersection. A letter from Rogers County consenting to the annexation is included for your review. Also attached is the staff report submitted to the Council for acceptance of the donation of the right -of- way. The Owasso Planning Commission reviewed the request at the October 9, 2001 regular meeting and unanimously recommended approval. Legal notification was published in the October 11th & 18th editions of the Owasso Reporter. A copy of the notification is attached for your review. Legal Notification MEMORANDUM TO: DONNA SORRELLS CITY PLANNER FROM: JARED T. BATES CAPITAL PROJECTS ENGINEER SUBJECT: ANNEXATION OF SOUTHEAST CORNER OF 86TH STREET N. AND 145TH E. AVE INTERSECTION DATE: October 2, 2001 The 1998 Bond Issue includes funds for widening and signalization of the intersection at East 86th Street North and North 145th East Avenue. Before the project is started, all Right -of -Way should be within City Limits so that the value of all improvements made by the City will be retained by the City. The portions of the intersection in Sections 21 (northwest comer), 22 (northeast comer), and 28 (southwest comer) have all been annexed in previous annexations for Silver Creek, Preston Lakes, and the Green's Apartments, respectively. On September 4, 2001, the City Council accepted ROW donation from the Owasso Public School System (see attachment 1). Prior to that date, 16.5 feet of ROW existed on the Pamela Hodson Elementary School site. The donation gave an extra 43.5 feet of ROW, bringing the ROW on the southeast corner of 145 E. Avenue up to 60 feet from centerline. The ROW on the school's property has never been within City Limits. On August 16, 2001, City staff sent Rogers County a letter requesting comments regarding possible annexation of the said ROW. A letter of response was received September 11, 2001, from the Rogers County Assistant District Attorney, stating that Rogers County had no objections to the proposed annexation (see attachment 2). It is understood that all ROW annexed will be maintained by the City. REQUEST: The City of Owasso Public Works Department requests presentation of this proposal to the Planning Commission, involving annexation of ROW on the southeast comer of 86th Street N. and 145`' E.
