AN ORDINANCE ACCEPTING ADDING AND ANNEXING TO CIT)C10F,. jS
OWASSO, OKLAHOMA, ADDITIONAL LANDS AND TERRITORY IN SECTIOK
27, TOWNSHIP 21 NORTH, RANGE 14 EAST, ROGERS COUNTY, KLAHOVIA,
PROVIDING THAT FROM AND AFTER THE PASSAGE AND PUBLICATION OF
THIS ORDINANCE THAT ALL OF THE REAL PROPERTY WITHIN SAID
TERRITORY HEREIN DESCRIBED SHALL BE A PART OF THE CITY OF
OWASSO, OKLAHOMA, AND FURTHER DECLARING THAT ALL PERSONS
RESIDING THEREIN SHALL BE SUBJECT TO THE JURISDICTION, CONTROL,
LAWS, AND ORDINANCES OF THE CITY OF OWASSO, OKLAHOMA,
ESTABLISHING THE SAME AS PART OF WARD THREE OF SAID CITY,
DIRECTING THE FILING OF THIS ORDINANCE, AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, pursuant to the provisions of Title 11, Section 21 -103, et seq., of the
Oklahoma Statutes, the City of Owasso is permitted to annex additional territory providing a
petition in writing, signed by not less than three - fourths of the legal voters and owners of not less
than three - fourths (in value) of the property hereinafter described, the same being contiguous to
the corporate limits of the City of Owasso, requesting that said property be annexed and added to
the City of Owasso is submitted; and
WHEREAS, the City of Owasso received a petition to annex additional territory, signed
by not less than three- fourths of the legal voters and owners of not less than three- fourths (in
0 value) of the property hereinafter described, the same being contiguous to the corporate limits of
the City of Owasso, requesting that said property be annexed and added to the City of Owasso;
and
WHEREAS, on October 11, 2001, and October 18, 2001, notice of the presentation of
said Petition was given by the Petitioner by publication in the Owasso Reporter, a newspaper of
general circulation published in the City of Owasso, Oklahoma, and notice was given that said
Petition would be considered by the City Council of the City of Owasso, at a meeting to be held
on November 6, 2001 at 6:30 PM at the Community Center, Owasso, Oklahoma; and
WHEREAS, on the 6d' day of November, 2001, said Petition was duly considered by the
City Council and was determined to have complied with the provisions of Title 11, Section 21-
103, et seq., of the Oklahoma Statutes, and further, that proper legal notice of presentation of
said petition had been given; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT, TO -WIT:
Section 1. the following described territory lying in Rogers County, Oklahoma which is
contiguous to the present corporate limits of the City of Owasso and described in the petition for
annexation presented to the City Council in accordance with the provisions of Title 11, Section
21 -103, et seq., of the Oklahoma Statutes, and more particularly described as follows, to -wit:

Section 2. That from and after the effective date of this Ordinance, the real estate and territory
described in Section 1 hereof shall be a part of the City of Owasso, Oklahoma, and in Ward
Three thereof, and all persons residing therein, and all property situated thereon, shall be and are
hereby declared to be subject to the jurisdiction, control, laws, and ordinances of the City of
Owasso, Oklahoma, in all respects and particulars.
Section 3. That from and after the effective date of this Ordinance, the real estate and territory
described in Section 1 hereof, shall be deemed to be in the AG (Agriculture) zoning district of
the City of Owasso in accordance with the provisions of Section 110.3 of the Owasso Zoning
Ordinance.
Section 4. That there be filed in the office of the County Clerk of Rogers County, Oklahoma, a
true and correct copy of this Ordinance, together with an accurate map of the territory hereby
annexed.
Section 5. That this Ordinance shall become effective thirty (30) days from the date of first
publication as provided by state law.

The Owasso Public Works Department is requesting approval of the annexation of a portion of
right -of -way located at the southeast comer of the intersection of E. 86th Street N. and N. 145th E.
Avenue. A location map and boundary map are attached for your information and review.
The annexation of this remaining portion of the right -of -way is required prior to planned
improvements of the intersection.
A letter from Rogers County consenting to the annexation is included for your review. Also
attached is the staff report submitted to the Council for acceptance of the donation of the right -of-
way.
The Owasso Planning Commission reviewed the request at the October 9, 2001 regular meeting
and unanimously recommended approval.
Legal notification was published in the October 11th & 18th editions of the Owasso Reporter. A
copy of the notification is attached for your review.
RECOMMENDATIONS
Staff recommends approval of the annexation of the right -of -way located at the southeast corner of
the intersection of E. 860' Street N. and N. 145th E. Avenue.

SUBJECT: ANNEXATION OF SOUTHEAST CORNER OF 86TH STREET N. AND 145TH
E. AVE INTERSECTION
DATE: October 2, 2001
The 1998 Bond Issue includes funds for widening and signalization of the intersection at East 86th
Street North and North 145th East Avenue. Before the project is started, all Right -of -Way should be
within City Limits so that the value of all improvements made by the City will be retained by the City.
The portions of the intersection in Sections 21 (northwest comer), 22 (northeast comer), and 28
(southwest comer) have all been annexed in previous annexations for Silver Creek, Preston Lakes, and
the Green's Apartments, respectively.
On September 4, 2001, the City Council accepted ROW donation from the Owasso Public School
System (see attachment 1). Prior to that date, 16.5 feet of ROW existed on the Pamela Hodson
Elementary School site. The donation gave an extra 43.5 feet of ROW, bringing the ROW on the
southeast corner of 145 E. Avenue up to 60 feet from centerline. The ROW on the school's property
has never been within City Limits.
On August 16, 2001, City staff sent Rogers County a letter requesting comments regarding possible
annexation of the said ROW. A letter of response was received September 11, 2001, from the Rogers
County Assistant District Attorney, stating that Rogers County had no objections to the proposed
annexation (see attachment 2). It is understood that all ROW annexed will be maintained by the City.
REQUEST:
The City of Owasso Public Works Department requests presentation of this proposal to the Planning
Commission, involving annexation of ROW on the southeast comer of 86th Street N. and 145`' E. Ave
intersection.

BACKGROUND:
One of the projects included in the October 1997 bond issue was the widening of the intersection
at 86" St N and N 145"East Ave. Final engineering is complete on the intersection, indicating
additional rights -of -way needed. Owasso Public Schools, the property owner on the southeast
comer of the intersection, is required by State law to donate necessary right -of -way for public
projects. Attached is a Deed of Dedication signed by Ms. Marilyn Hinkle, president of the Board
of Education of Owasso for the school's portion of the right -of -way necessary for the intersection
project.
RECOMMENDATION:
Staff recommends acceptance of the donation of right -of -way from Independent School District
No. 11 (Owasso Public Schools), and authorization for the City Clerk and Mayor to execute said
acceptance.

Commissioner Graves has forwarded your letter of August 16, 2001 requesting
comments on the above referenced project to the Office of the District Attorney, Rogers
County, Oklahoma. Commissioner Graves has authorized this office to state that Rogers
County would have no objection to the annexation of the intersection of 86th Street North
and 145th East Avenue and attendant roadways as proposed by the City of Owasso.
Rogers County understands that upon annexation by the City of Owasso, Rogers County

The undersigned, constituting not less than three - fourths of the
registered voters and being owners of not less than three- fourths (in
value) of the hereinafter described real estate situated in Tulsa
County, Oklahoma, to -wit:
LEGAL DESCRIPTION
Southeast Corner of E. 86th Street N. and N. 145th E. Avenue
The tract of land containing a part of the NW / 4 of the
NW / 4 of Section 27 Township 21 North, Range 14 East
of the I.B. &M., being more particularly described as
follows: Beginning at the Northwest corner of Section 27,
Township 21 North, Range 14 East, thence easterly along
the North Line of said Section 27 a distance of 530.0 feet,
thence southerly along a line parallel to the West line of
said Section 27 a distance of 16.5 feet to a point on the
existing public Right of Way, thence westerly along a line
parallel to the North line of said Section 27 a distance of
55 feet, thence southerly along a line parallel to the West
line of said Section 27 a distance of 43.5 feet, thence
westerly along a line parallel to the North line of said
Section 27 a distance of 415.0 feet to a point 60.0 feet
East of the West line of said Section 27 and 60.0 feet
south of the North line of said Section 27, thence
southerly to a point 93.5 feet South of the North line of
said Section 27 and 60.0 feet East of to West line of said
Section 27, thence westerly along a line parallel to the
North line of said Section 27 a distance of 60 feet to a
point on the West Line of said Section 27, thence

NOTICE TO THE PUBLIC
You are hereby advised that the above request for annexation was
filed with the City Planner of the City of Owasso on the 2" day of
October 2001, and that said request will be presented to the
Owasso City Council, at the Owasso Community Center, 301
South Cedar, Owasso, Oklahoma at 6:30 PM on the 6b day of
November 2001.
All persons interested in this matter may be present at the hearing
and give their objections to or arguments for the proposal. The
Planning Commission will submit its recommendation to the City
Council of the City of Owasso for its consideration and action, as
provided by law.
A map showing the proposed annexation area accompanies this

At the November 6, 2001 regular meeting, the City Council unanimously approved an annexation
petition for a 0.72 acre, more or less, parcel of land located at the southeast comer of E. 86" Street
N. and N. 145'h E. Avenue.
Ordinance No. 694 would formally adopt the action taken by the City Council at the November 6,
2001 meeting.
Staff recommends approval of Ordinance No. 694.
