AN ORDINANCE AMENDING ORDINANCE NO. 704 AND CLOSING
TO THE PUBLIC USE A PORTION OF A MUTUAL ACCESS

MUNICIPALITY, AND REPEALING ALL ORDINANCES OR PARTS OF

WHEREAS, the City of Owasso, Oklahoma, has deemed it necessary and
expedient to close to public use a portion of a certain access easement;
WHEREAS, the legal description of the access easement contained a
scrivener's error as published in Ordinance No. 704;

WHEREAS, said access easement is correctly described as follows:

Section 2 The municipality shall retain the absolute right to reopen the public
way or easement without expense to the municipality. Closing of the public
way or easement shall not affect the right to maintain, repair, reconstruct,
operate or remove drainage facilities of service therein, nor shall a closing
affect private ways existing by operation of law unless released in writing
owners thereof.
Section 3 That all ordinances or parts of ordinances in conflict
and the same. are hereby expressly repealed.

BACKGROUND:
At the March 19, 2002 meeting, the Owasso City Council approved Ordinance No. 704, closing
to the public a mutual access easement. A copy of a map that reflects the access easement that
was closed is attached for your information and review.
Ordinance No. 704 contained a scrivener's error within the legal description of the mutual access
easement. Ordinance No. 704 -A corrects that legal description. The original memo submitted
by Mr. Ewing is also attached for your information and review.
RECOMMENDATION:
Staff recommends Council approval of Ordinance No. 704 -A.

BACKGROUND
Pittman Poe & Associates is requesting review of a closing of a mutual access easement as
recorded in the office of the Tulsa County Clerk in Book 5709, Page 611 -614 and generally
described as a portion of the East Half of the Southwest Quarter (E /2 SW /4) of Section 18,
Township 21N, Range 14E, Tulsa County, State of Oklahoma. The subject property is located
north of E. 96`h Street N. and west of N. Garnett Road.
The subject existing mutual access easement, recorded April 27, 1995, was established to ensure
future access through Coventry Gardens along N. 102nd E. Avenue to a 15 acre tract reserved for
a future school site. The school site has now been relocated westward to front along N. Mingo
Road and the subsequent platting of the first phase of Honey Creek at Bailey Ranch has rendered
the easement obsolete.
The Owasso Technical Advisory Committee reviewed the closing request at the February 27,
2002 regular meeting. No comments regarding the easement closing were recorded. Each public
utility provider has provided signed certificates stating they have no objection to the closing.
Copies of the certificates of approval are attached for your information and review.
The Owasso Planning Commission reviewed the requested partial easement closure at the March
12, 2002 regular meeting and unanimously recommended approval.
If the requested closing is approved by Council, Ordinance No. 704 will formally adopt that
action.
RECOMMENDATIONS
Staff recommends approval of the closing of the recorded mutual access easement (Book 5709,
Page 611 -614).
