AN ORDINANCE APPROVING ZONING APPLICATION NUMNER OZ 03-05
CHANGING THE ZONING OF PROPERTY LOCATED IN THE NORTHWEST
QUARTER OF SECTION 28, TOWNSHIP 21 NORTH, RANGE 14 EAST, TULSA
COUNTY, OKLAHOMA, FROM AG AGRICULTURAL DISTRICT TO CS
COMMERCIAL SHOPPING CENTER DISTRICT, AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, public hearings have been held regarding the request for rezoning of
the property herein described, and
WHEREAS, the Owasso City Council has considered the recommendation of the
Owasso Planning Commission and all statements for or against the requested rezoning of
application OZ- 03 -05,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITE' OF
OWASSO, OKLAHOMA:
Section 1. The zoning classification of the following described property, to wit:
A TRACT OF LAND THAT IS PART OF THE NE/4 FO THE NW/4 OF SECTION
28, TOWNSHIP 21 NORTH, RANGE 14 EAST, OF THE INDIAN MERIDIAN,
TULSA COUNTY, STATE OF OKLAHOMA, SAID TRACT BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF SAID NE/4 NW/4, THENCE
S00°07'18"W ALONG THE EASTERLY LINE OF THE NE/4 NW/4, FOR A
DISTANCE OF 550.00 FEET TO A POINT, SAID POINT BEGINNING A NORTHEAST

BACKGROUND:
The City Council approved the rezoning of a tract of land from AG (Agriculture) to CS
(Commercial Shopping Center) on May 20, 2003. The property is located on the south side of East
86" Street North, %: mile cast ofNorth 129`h East Avenue.
Attached is a copy of Ordinance No. 756, formally adopting the City Council's action of May 20,
2003.
RECOMMENDATION:
The staff recommends Council approval of ordinance 756.

Mr. M11ce Myers has submitted an application to the Planning Commission for a rezoning of property
located on the south side of 8e Street North about %: mile east of 129` East Avenue. The property is
proposed for CS (Commercial Shopping Center District) zoning classification. A general area map is
attached for review.

The tract is approximately 5.25 acres in size. The existing land use is vacant for the subject property,
as is the land use for properties to the north and to the east. Land south of the site is occupied by
apartments and land to the west holds a medical clinic. The subject tract is currently zoned AG
Agricultural.
The subject property is located on a primary arterial road (8e Street North) and is served by municipal
wastewater lines.
ANALYSIS:
If the application is approved, the subject property would be zoned CS (Commercial Shopping
Center District). Then, the property would be available for commercial development.
The Owasso 2010 Master Plan identifies the subject property as having a future land use of
commercial. Accordingly, the staff finds the proposal to be consistent with the Owasso 2010
Master Plan.
Staff has received no phone calls or correspondence in opposition of the request. Letters were
mailed to surrounding property owners on April 10, 2003 and the legal advertisement was
published in the Owasso Reporter on April 17, 2003.
RECOMMENDATION:
The staff recommends approval of OZ- 03 -05.

All persons interested in this matter may be present at the hearing
and present their objections to or arguments for any or all of the
above matters.
In the event that such proposed rezoning is approved, in whole or
in part, by the Owasso Planning Commission, said Planning
Commission shall submit its recommendation to the City Council of
the City of Owasso for its consideration and action, as provided by
law.
The City Council's review of the recommendation of the Planning
Commission on the proposed rezoning shall be at a meeting time
and place to be determined by the Council, said information to be
available from the Owasso City Planner.
