The property is located on the north side of East 96"' Street North, %a mile east of North Mingo Road. Attached is a copy of Ordinance No. 757, formally adopting the City Council's action of May 20, 2003. RECOMMENDATION: The stall' recommends Council approval of ordinance 757. ATTACHMENT: Ordinance No. 757 CITY OF OWASSO, OKLAHOMA ORDINANCE NO. 757 AN ORDINANCE APPROVING ZONING APPLICATION NUMBER OZ -03 -06 CHANGING THE ZONING OF PROPERTY LOCATED IN THE SOUTHWEST QUARTER OF SECTION 18, TOWNSHIP 21 NORTH, RANGE 14 EAST, TULSA COUNTY, OKLAHOMA, FROM AG AGRICULTURAL DISTRICT TO OL LIGHT INTENSITY OFFICE DISTRICT, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. WHEREAS, public hearings have been held regarding the request for rezoning of the property herein described, and WHEREAS, the Owasso City Council has considered the recommendation of the Owasso Planning Commission and all statements for or against the requested rezoning of application OZ- 03-06, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA. Section 1. The zoning classification of the following described property, to wit: A STRIP, PIECE OR PARCEL OF LAND BEGINNING SE CORNER OF THE SOUTHWEST QUARTER, THENCE W 400', N 320', E 399.11', S 320' TO POINT OF BEGINNING, LESS THE S 30', THEREOF SECTION 18, TOWNSHIP 21 NORTH, RANGE 14 EAST, TULSA COUNTY, OKLAHOMA; CONTAINING 2.660 ACRES, MORE OR LESS; be, and the same hereby is, zoned from AG Agricultural District to OL Light Intensity Office District. Gray, City Attorney APPROVED AS TO CONTENT: Eric Wiles, Community Development Director 751 MEMORANDUM TO: THE HONORABLE MAYOR AND COUNCIL CITY OF OWASSO FROM: ERIC WILES COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: OZ- 03 -06, A REQUEST FOR REZONING OF 2.66 ACRES DATE: May 14, 2003 BACKGROUND: Mr. Tim Siegfried has submitted an application to the Planning Commission for a rezoning of property located on the north side of 96s` Street North about '/2 mile east of Mingo Road. The property is proposed for OL (Office Low Intensity District) zoning classification. A general area map is attached for review. PROPERTY CHARACTERISTICS: The legal description of the property is as follows: A STRIP, PIECE OR PARCEL OF LAND BEGINNING SE CORNER OF THE SOUTHWEST QUARTER, THENCE W 400', N 320', E 399.11', S 320' TO POINT OF BEGINNING, LESS THE S 30', THEREOF SECTION 18, TOWNSHIP 21 NORTH, RANGE I4 EAST, TULSA COUNTY, OKLAHOMA, CONTAINING 2.660 ACRES, MORE OR LESS; The tract is approximately 2.66 acres in size. The existing land use is vacant for the subject property. Land north, south, and east of the site is occupied by single - family houses and the property to the west holds Bailey Elementary School. The subject tract is currently zoned AG Agricultural- The subject property is located on a primary arterial road (9e Street North) and is served by municipal wastewater lines. ANALYSIS: If the application is approved, the subject property would be zoned OL (Low Intensity Office District). Then, the property would be available for office development. The Owasso 2010 Master Plan identifies the subject property as having a future land use of residential. However, the plan also identifies the community's lack of medical facilities as a major issue to be addressed by the Planning Commission. Excerpt from Owasso 2010 Master Plan: Issue #9 Lack of medical facilities in the community. Action Statement: Support local clinics and encourage the development of advanced medical care in the area to help improve quality of life. Action Plan: - Establish the need for medical facilities and determine deficiencies in community and region. - Ensure adequate land area is available for developing medical facilities; identify key corridors. - Consider collaborations to stimulate medical research. - Support Chamber of Commerce initiatives in actively courting medical facilities to the area. The staff finds that this application directly meets the issue put forth by the plan. Accordingly, the staff finds the proposal to be consistent with the Owasso 2010 Master Plan. Staff has received no phone calls or correspondence in opposition of the request. Letters were mailed to surrounding property owners on April 10, 2003 and the legal advertisement was published in the Owasso Reporter on April 17, 2003.
