ORDINANCE NO. 766
AN ORDINANCE OF THE CITY OF OWASSO, OKLAHOMA RESERVING
RIGHT OF CITY COUNCIL TO REPEAL ORDINANCE NO. 763 OF THE
CITY; PROVIDING FOR SEVERABILITY OF PROVISIONS; AND
CONTAINING OTHER PROVISIONS RELATED THERETO.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OW ASSO, OKLAHOMA AS
FOLLOWS:
Section 1. In the event Ordinance No. 763 of the City of Ow as so, Oklahoma (the "City") is
approved by the registered, qualified voters of the City on October 14, 2003, the City Council
reserves the right to repeal said Ordinance No. 763 by vote of the City Council; provided however
said Ordinance No. 763 shall not be repealed by vote of the City Council of the City in the event
proceeds of the excise tax levied pursuant to said Ordinance No. 763 are being used or have been
pledged by the City or any public trust having the City as beneficiary for the purpose of paying debt
service on obligations issued by the City or any public trust having the City as beneficiary.
Section 2. Severability. The provisions of this Ordinance are severable, and if any part or
provision hereof shall be adjudged invalid by any court of competent jurisdiction, such adjudication
shall not affect or impair any of the remaining parts or provisions hereof.

Staff will recommend that City Council approve Ordinance Number 766
RECOMMENDATION:
On the 5th day of August, 2003, the City Council approved Ordinance Number 763, the
"City of Owasso Sales Tax Ordinance of 2003". Such ordinance is scheduled for
submission to the registered, qualified electors of the City of Owasso, Oklahoma, on the
14th day of October, 2003. Ordinance Number 766 is being presented for consideration
in an effort to more clearly express the intent of the City Council that Ordinance Number
763 may by action of the City Council be repealed at anytime that the City Council
deems it in the best interests of the citizens provided; however, such sales tax is no longer
necessary for any bonded indebtedness of the City or any of the public tmsts of which the
City is beneficiary and the sales tax is pledged.
BACKGROUND:
Presented for consideration by the City Council is Ordinance Number 766, an Ordinance
of the City of Ow as so, Oklahoma, Reserving the Right of the City Council to Repeal
Ordinance Number 763 ofthe City; Providing for Severability of Provisions; and
Containing other Provisions related thereto.
