HomeMy WebLinkAbout921_Adopting the International Building CodeAN ORDINANCE RELATING TO PART 5, BUILDING REGULATIONS AND CODES, CHAPTER 1, BUILDING CODE AND PERMITS GENERALLY, OF THE CODE OF ORDINANCES OF THE CITY OF OWASSO, OKLAHOMA, AMENDING SAME BY ADOPTING THE INTERNATIONAL BUILDING CODE. THIS ORDINANCE AMENDS PART 5, CHAPTER 1, OF THE CITY OF OWASSO CODE OF ORDINANCES BY AMENDING SECTION 5 -101. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, C, THAT, TO -WIT: SECTION ONE (1): Part Five, Building Regulations and Permits, Chapter 1, Building Code Adopted, of the Code of Ordinances of the City of Owasso, Oklahoma, shall be amended as follows: SECTION 5 -101 BUILDING CODE ADOPTED There is hereby adopted by the City Council for the purposes of prescribing regulations governing the conditions and maintenance of all property, buildings, and structures that certain code known as International Building Code, latest edition, excluding all Appendix Chapters, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Owasso, in the State of Oklahoma for regulating and governing the conditions and maintenance of all property, buildings, and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary, and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the City Clerk's office of the City of Owasso are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in this ordinance. SECTION TWO (2): REPEALER All ordinances, or parts of ordinances, in conflict herewith are hereby repealed to the extent of the conflict only. SECTION THREE (3): SEVERABILITY If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the remaining portion shall not be affected but shall remain in full force and effect. SECTION FOUR (4): DECLARING AN EFFECTIVE DATE The provisions of this ordinance shall become effective thirty (30) days from the date of final passage as provided by state law. SECTION FIVE (5): CODIFICATION The City of Owasso Code of Ordinances is hereby amended by amending the ordinance to be codified in Part 5, Chapter 1, as section 5 -101. The proposed ordinance more appropriately adopts the International Code Council (ICC) International Building Code. The International Building Code is the code referenced and utilized by the Community Development Department as well as the State Fire Marshal for existing and new construction issues. The ordinance, if approved, provides for the adoption of the entire International Building Code, as if the entire code were set out at length within the ordinance. Adoption of this ordinance would provide for regulating and governing the conditions and maintenance of all property, buildings, and structures; by providing the standard for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary, and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures. RECOMMENDATION: Staff recommends Council approval of Ordinance No. 921, formally adopting the ICC International Building Code. ATTACHMENTS: 1. Ordinance No. 921
