ORDINANCE CLOSING TO THE PUBLIC USE OF TWO UTILITY
EASEMENTS LOCATED IN SECTION 19, TOWNSHIP 21 NORTH, RANGE
14 EAST, TULSA COUNTY, OKLAHOMA, AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, the City of Owasso, Oklahoma, has deemed it necessary and expedient to close and
partially close to the public use a portion of two utility easements;
WHEREAS, said utility easements are described as follows:
An easement closure within a tract of land in the Northwest Quarter (NW /4) of
Section 19, Township 21 North, Range 14 East of the Indian Base and Meridian,
City of Owasso, County of Tulsa, State of Oklahoma more particularly
described as follows:
Beginning at the northeast corner of Lot 14, Block 3, Fairways IV subdivision,
thence S 14 °31'13" E a distance of 115.82 feet, thence S 63 °49'33" W a distance
0 0 of 5.11 feet, thence N 14'31'13" W a distance of 116.85 feet, thence N 75 °28'47"
U) E a distance of 5.00 feet to the point of beginning. Containing 581.69 sq feet or
0.013 acres.
And
Commencing from the southwest corner of Lot 14, Block 3, Fairways IV
subdivision, thence N 43 °35'08" W a distance of 11.51 feet to the point of
beginning, thence N 43 °35'08 "W a distance 6.80 feet, thence N 63 034'35" E a
distance of 59.28 feet, thence S 14'31'13" E a distance of 6.64 feet, Thence S
63 °34'35" W a distance of 55.90 feet to the point of beginning. Containing 374.34
sq feet or 0.008 acres.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA, THAT,
Section 1. The following described utility easements, be, and the same is hereby closed
and partially closed to the public use, to -wit:

hereby repealed to the extent of the conflict only.
Section 4. If any part or parts of this ordinance are deemed unconstitutional, invalid
or ineffective, the remaining portion shall not be affected but shall remain in full force and effect.
Section 5. The provisions of this ordinance shall become effective thirty (30) days
from the date of final passage as provided by state law.
Section 6. That there be filed in the office of the County Clerk of Tulsa County,
Oklahoma, a true and correct copy of this Ordinance.

BACKGROUND:
At the April 21, 2009 meeting, the Owasso City Council approved a request to close a portion of a
utility easement and a utility easement on property located at 9902 East 93'd Court North. Attached
is a copy of Ordinance No. 940 that formally adopts the City Council's action of April 21, 2009.
The Council took the action on these utility easement closures following the Planning
Commission's approval on April 13, 2009.
RECOMMENDATION:
The staff recommends Council approval of Ordinance No. 940.
