BACKGROUND
Pursuant to discussions conducted with the City Council at work sessions, the attached memorandum
from Ms. Stagg references the intent to apply for an ODOT beautification grant to be utilized at the
interchange of the Owasso Expressway and E. 76th Street North. This item has been listed on the
Council work session in order to permit the Council an opportunity to ask any questions you may
have regarding the grant application and its funding source.
RECOMMENDATION:
Staff has reviewed the draft grant application and is prepared to direct Ms. Stagg to proceed
providing there are no concerns expressed.

BACKGROUND
Since 1996 as part of the Federal Enhancement Program, the Oklahoma Department of
Transportation's (ODOT) highway Tree Grant Prograin has provided financial incentives to
local government for the planting of greenery along Oklahoma highways. Each successful
applicant may receive up to $25,000 for the purchase and/or planting of trees and shrubbery to be
located in designated highway right-of-way. Successful applicants are required to contribute no
less than 25% of the total project cost (or up to $8,334). Examples of acceptable matching funds
other than cash include donated or in -kind labor and materials, care and maintenance of trees or
installation of an irrigation system.
Grant funding may be used for the purchase and installation of trees and bushes — complete with
an irrigation system — but may not be spent for signs, fencing, retaining walls, flowers or any
other decorative items. Additionally, the trees must be planted within one year from the award
of the grant and maintained for no less than five years. The work must be competitively bid.
Approximately $250,000 in federal funding is available in this year's grant program. The grant
application is due to ODOT's Beautification Office by July 14, 2005, and successful applicants
will be notified in October 2005.
GRANT APPLICATI®N� (YEAR 2005):
Impact on highway beautification is of utmost importance to the program, thus it is weighed
heavily during the application review. Following an evaluation of US Highway 169 right-of-way
for "impact on highway beautification", it is recommended that beatification to the interchange at
ODOT's Tree Grant Program

US Highway 169 and East 76"' Street North be proposed. Existing landscaping is scarce and in
poor condition (Attachment A). Efforts to beautify the interchange, following the completion of
construction improvements in 2003, have been stalled due to competing priorities.
Recommended enhancements include the planting of over 170 trees and bushes on all four
corners of the interchange (Attachments B). A portion of the planting will be located
strategically to greet travelers along US HWY 169 as they approach the interchange. A
rendering of what a driver may see as he/she approach the interchange is shown in Attachment
C.
Cost estimates for the construction of recommended improvements, complete with the required
3-year maintenance program, are presented below:

9. A PRE -EMERGENT HERBICIDE, TREFLAN, EPTAN OR EQUAL SHALL BE APPLIED TO ALL SHRUB BEDS
PRIOR TO THE INSTALLATION OF PLANT MATERIAL. THE HERBICIDE TO BE APPLIED PER
MANUFACTURER'S SPECIFICATIONS AND ALL STATE AND LOCAL CODES. ADVISE THE OWNER OF

10. PRIOR OF INSTALLATION OF SOD, ALL PROPOSED LAWN AREAS SHALL BE DISKED AND RAKED

The City of Owasso has received a request from Mr. and Mrs. Davidson for the annexation of
approximately 6.64 acres. At this time it is the staffs understanding the applicant is requesting
this annexation petition in order to begin a process that will result in the development of
transitional property.

PEVELOPMENT LROCESS:
The first step in the development of a piece of property in Owasso is annexation. Annexation is
the method whereby land located outside the City limits is made a part of the City. Property
owners and land developers sometimes choose to have their property annexed into Owasso in
*rder to receive Owasso municipal services, such as police and fire protection, refuse collection,
and sanitary sewer,
Once the property development proposal shows a division of lots that is acceptable to both the
developer and the City of Owasso, afinal plat application is submitted. A final plat illustrates
the layout and dimension of lots included on the final plat, right-of-way widths, casements, and
other physical characteristics that must be provided for review by the City. After obtaining
approval from the TAC and Planning Commission, the final plat is considered by the City
Council. If approved, the final plat is filed with the office of the County Clerk and governs all
L'uture development on that property.
The fourth step in the development of a piece of property in Owasso is the site plan. Site plans
are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking,
access, landscaping, and building footprint are presented in the site plan. Once a site plan is
approved, the development is clear to apply for a building permit and to submit construction
1,,,,)Ians for the building's foundation, plumbing, electrical system, and HVAC.
ANNEXATION REVIEW PROCESS
The annexation process is initiated when a property owner submits a petition to the City of
Owasso requesting that the City bring the property into the City limits.
The applicant must submit as part of the request a signed petition requesting the annexation, an
accurate legal description and map of the property being requested for annexation and a certified
300' radius report so that staff may send legal notices to surrounding property owners.
Upon receipt of all appropriate materials the staff initiates the review process which begins with
a thorough analysis of the request. The primary consideration is the property's compliance with
the Owasso Annexation Policy. The policy establishes a set of guidelines that define which
properties are considered for annexation,
The annexation request is then presented to the Owasso Annexation Committee for review and
recommendation. The Annexation Committee is made up of staff, elected officials and citizens.
The Committee reviews the joetition or compliance with the Annexation Poliev and establig'kq

The Owasso Planning Commission holds a public hearing to determine if the property is
co
City Council.
The Owasso City Council will make the final determination to annex the property or refuse
annexation. If the property is annexed into the City limits an ordinance officially declaring the
annexation is written and adopted by the City Council. Once adopted the ordinance is circulated
to appropriate regional and national agencies for recording and altering maps.
CONS11DERATIONS OF ANNEXATION
The following annexation policy for the City of Owasso is provided as a guideline and should
not be constructed as inflexible requirements for annexation.
I . While there is no minimum tract size, propei ties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing City Limits.
3. All properties should be annexed into the City limits as the lowest zoning classification,
that is, Agricultural (AG). Landowners may then petition for rezoning if they desir*
further development of their property. All legal uses annexed into the City will be legal,
but non -conforming, which means that they may continue but cannot be expanded
without proper zoning,
4. All public infrastructures that do not meet City standards will not be improved by the
City until brought to the City standard and accepted by the City Council. Such public
facilities must be improved at owner's expense by the establishment of a special
assessment district or some other financing method.
5. Where a City limit boundary ends at a dedicated street, the boundary will not include the
street right-of-way. This policy will establish consistency and allow City employees and
citizens to know where the City boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for a
six month period after rejection by the City Council.
Staff received a petition from Mr. and Mrs. Davidson for the annexation of approximately 6.64
acres located south of E. 96h St. N., between 1/4 and 1/2 mile west of N. 145" E. Ave.,
immediately east of Nottingham Estates. At this time it is our understanding the applicant is
requesting this annexation petition in order to begin a process that will result in the development
of property for transitional use .
The Owasso 2015 ,and Use Master Plan calls for residential development for the 6.64 acre tract
Staff published legal notice of the annexation petition in the Owasso Reporter and letters of
notification were mailed to property owners within a 300' radius.
At their June 8, 2005 meeting the Owasso Annexation Committee unanimously recommended
approval of OA 05-01

bordered on the north and on the east by Tulsa county, large lot residential, and on the south and
to the west by Nottingham estates.
The property and surrounding areas have developed for single-family purposes. The property is
not adjacent to any site identified as transitional use by the 2015 Land Use Master Plan. The
property is also'/4 mile away from the nearest site planned for transitional use..
Staff published legal notice of the, annexation petition in the Owasso Reporter and letters of
notification were mailed to property owners witWn a 300' radius.
The staff has received correspondence from the developer of Nottingham Estates opposing the
proposed amendment to the land use plan. Also, the staff recently attended a meeting of the
Nottingham Estates homeowners association, and the association voiced its opposition to the
proposed amendment.
RECOMMENDATION
to recommends that the designated land use for the subject property remain residential and not
be changed to transitional.

Dear Mr. McCulley:
I am a resident of the Nottingham Estates addition. I enjoy the relaxed lifestyle my
family and neighbors have been afforded by living in this quiet, residential neighborhood and
the security and peace of mind that conic from knowing that the City of Owasso had the
foresight to develop a "Master Plan" for the growth of its residential and commercial
developments.
I was recently made aware of an attempt by a small group trying to amend the
"Master Plan" by having a 6.6 acre tract adjacent to Nottingham Estates which is currently
zoned as residential changed to transitional. I don't believe that making this zoning change is
in the best interest of our neighborhood as it would completely undermine the general
purpose of what Residential Districts were designed to accomplish.. That purpose primarily
being to "Protect the character of residential areas by excluding inharmonious
commercial and industrial activities".
If you allow this tract to be rezoned, it will start a chain reaction of rezoning requests
along 96th street between 129th E. Ave. and 145 E. Ave. This will increase traffic
congestion and detrimentally effect property values by all those living in the vicinity.
I don't want to claim to understand all of Owasso's Master Plan but when the city
manager, Rodney Ray states to the honorable mayor and city council "the staff will
recommend denial of this request" that is good enough for me. I have enclosed a copy of
that memo for your review.

It has come to our attention that there is a proposal before the Planning
Commission to annex a piece of property located on 96 th street near the entrance
of Nottingham Estates into the Owasso city limits and an application to change
the master plan regarding the zoning of this particular piece of property. As
property owners in Nottingham Estates we are strongly opposed to any change
in the master plan. We purchased our home based on the assumption that all
properties surrounding, Nottingham were to be used as r6sidential development.
Allowing this property to be zoned as commercial would do nothing but deter
future residential development and bring down property values in our area.
There are plenty of areas in Owasso booming with commercial growth, The city
needs to stay true to its master plan and allow the residential areas to thrive as
well.

I are writing this letter to protest the notification we received of the rezoning of the
above subject property.
I have lived in Owasso for more than 30 years, raised my children here, and
have watched the city grow and prosper .... I am proud of Owasso and all it has
accomplished.
After looking at many homes, we decided to move to Nottingham Estates last
summer as it is an upscale neighborhood, has a great "neighborhood
association", and we felt this area would insure the value of our home for years to
come. However, I feel the "office" zoning of the above referenced property would
be a detriment to our neighborhood. It is not in compliance with the "2015 Land
Use Master Plan" of Owasso and would be out of place in this residential area.
If rezoned, the property should be "residential" in keeping with the master plan.
Listed below are additional reasons for my protest of this zoning:

As property owners in Nottingham Estates it has come to our attention that there is
a proposal to come before the Planning Commission to annex and rezone
approximately 6 acres of property located on 96t" Street East. We are opposed to
the rezoning of this property for commercial use for several reasons.
First and foremost, we understand that rezoning this property for commercial use
would go against the Land Use Master Plan. If this land is annexed by the City of
Owasso,, it should be designated for residential use. To rezone this for commercial
use would be the equivalent of spot zoning. We are certainly -concerned that
rezonin•g this property for commercial use would change the aesthetics of this area.
When we relocated to Owasso from Louisiana in August of 2004, one of our
primary considerations in selecting a home was that we would be surrounded by
other residential areas. Rezoning this property would have the potential to change
that completely.
We are pleased that Owasso is growing but support the growth to be planned
according to the Land Use Master Plan.

trip in the Tulsa area we quickly fell in love with Owasso, our neighbors, and this

the years to become one of the most desirable urban cities in Oklahoma. Prior to moving

strongly opposed to the modification of the Owasso Master Plan to classify this property
as Commercial/Office. My opposition consists of several concerns:
® The areas surrounding the Nottingham sub -division have naturally developed as
single-family residential areas. Zoning the subject property for commercial use
would be considered spot -zoning and reduce the property value in the surrounding
residential areas;
® As a mother of young children, I am concerned about the increased traffic in the
form of automobiles, as well as, additional people, noise, and pollution and the
danger those items pose for my children, family and neighborhood;
® Commercial zoning creates a lower tax base for our Owasso schools in the form
of decreased property values;
® Commercial growth does not blend well in a residential setting.

St. to be zoned as commercial. When we purchased our home, we understood the
surrounding area to be zoned residential. While we are not opposed to annexation, our

We made our purchasing decision based on that plan. Our concerns are that this will
disrupt our quiet neighborhood in terms, of light, noise, and traffic. There are enough
areas that are currently commercial and areas where that type of zoning makes sense,

Dear Sir or Madam:
first, thank You for giving of your time to help plan the future of our community. Without
your service, and the service of others like you, our community would not become as
prosperous as what we see in 2005. Second, we are writing in response to the petition before
the Owasso Planning commission — the 6-acre tract of land directly cast of Nottingham
Estates. We live directly behind the property and would welcome annexation by the City.
However, we strongly oppose the modification of the Owasso Master Plan to classify this
property as Commercial/Office. We oppose this zoning for several reasons.
We believe that the areas around our sub -divisions have naturally developed as single -
.family residential areas. To zone the property under consideration commercial would
be considered spot -zoning and reduce the property value in the surrounding residential
areas.
Being in such close Proximity to the subject property, we are 'also concerned about car
noise, light noise caused by parking lot lights, and the mismatched office space in
comparison to the surrounding residential houses.
Lower tax base for our Owasso Schools. The amount of . office space that could
successful be accommodated on this tract of land would generate less revenue for our

schools. Creating an area for an additional 20-30 homes would increase the value of
our community and insure our schools continue to be the best in Oklahoma.
Finally, zoning this property as commercial would create a precedence for other areas
on east 9e street. We strongly feel that commercial growth belongs where it is
occurring (Smith Market, Home Depot area, etc.) Commercial growth does not belong
mixed in with residential communities.
We appreciate you considering the points we have made above in your decision on the I 3'1 of
June. We trust that you will make the best decision for the citizens in Owasso.

To Whom It May Concern:
First, we would like to say that we love living here in Owasso. We moved here in
January 2003 and have fallen in love with this community. Our neighborhood is
absolutely vibrant with activity and fun. Your planning and vision are responsible for
this and are now required to protect it.
We are opposed to changing the existing plan to allow the Commercial Zoning the 6-
acre tract east of Nottingham Estates, for the following reasons.
1) Traffic- We feel this would increase the traffic count in a community that is full
of small children. Our association is already exploring additional stop signs
and speed bumps. This would only make traffic worse in our area.
2) Aesthetics- From an aesthetics standpoint we purchased here for the beauty
of the surrounding homes and common areas. Commercial businesses would
damage those aesthetics that we cherish.
3) Light/noise pollution- In addition, we are concerned about light and noise.
4) Property values- Some of our opposition is more personal. We are concerned
also that property values will degrade. in addition to personal losses though,
this, could impact the tax base, which could in turn affect our great school
system (another reason we chose Owasso to reside in, we have a four year
old boy and a six year old girl,
5) Not in current plan- This not in keeping with the existing plan, which is an
excellent one. Mixing commercial with residential causes difficulties in the
best of circumstances. It simply is not in the plan. The precedents this would
set would be alarming to us.
Our objective is not to stand in the way of progress. We just don't see any long term
benefit to the community in changing the plan. We thank you for you tireless
dedication to the city, and applaud your efforts. Please take our recommendation
into consideration when you make your decision -

Section One: That Part 12 — Planning, Zoning and Development, Section 12-405, of the
Code of Ordinances of the City of Owasso, Oklahoma, is hereby amended to read as follows, and
the same being codified as set forth below, to -wit:
SECTION 12-405. LANDS TO WHICH SPECIAL FLOOD HAZARD APPLIES
The provisions of this chapter shall apply to and govern the placement of structures and
improvements and man-made changes of land, and the issuance of building permits or occupancy
permits for property within the areas of special flood hazard in the city.
Section Two: That Part 12 — Planning, Zoning and Development, Section 12-406, of the
Code of Ordinances of the City of Owasso, Oklahoma, is hereby amended to read as follows, and
the same being codified as set forth below, to -wit:
SECTION 12-406. BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD
HAZARD
The areas of special flood hazard identified by the Federal Emergency Management Agency in a
scientific and engineering report entitled, "The Flood Insurance Study for Tulsa County,
Oklahoma and Incorporated Areas," dated April 16, 2003 with accompanying Flood Insurance
Rate Map (FIRM) are hereby adopted by reference and declared to be a part of this chapter.
Copies for public review shall be available in the Community Development Department of the
City.
Section Three: The provisions of this ordinance shall become effective thirty (30) days
from the date of first publication as provided by law.

A. The flood hazard areas of the city are subject to periodic inundation which
results in loss of life and property, health and safety hazards, disruption of
commerce and governmental services, and extraordinary public expenditures
for flood protection and relief, all of which adversely affect the public health,
safety and general welfare.
These flood losses are created by the cumulative effect of obstructions in —
floodplains which case an increase in flood heights and velocities, and by the]
occupancy of flood hazard areas by uses vulnerable to floods and hazardous
other lands because they are inadequately elevated, flood proofed or otherwi
protected from flood damage. (Ord. No. 367,3/17/87)
2. Require that uses vulnerable to floods, including facilities which serve such
uses, be protected against flood damage at the time of initial construction;
3. Control the alteration of natural floodplains, stream channels, and natural
protective barriers, which are involved in the accommodation of flood waters;
4. Control filling, grading, dredging and other development which may increase
flood damage; or
5. Prevent or regulate the construction of flood barriers which will unnaturally
divert flood waters or which may increase flood hazards to other lands.

4. "Base flood" means the flood having a one percent (1%) chance of being
equaled or exceeded in any given year:
"Critical feature" means an integral and readily identifiable part of a flood
protection system, without which the flood protection provided by the entire
system would be compromised;
6. "Developmenf' means any man-made change in improved and unimproved
real estate, including but not limited to buildings or other structures, mining,
dredging, filing, grading, paving, excavation or drilling operations;
a. Built, in the case of a building in zones AI-30, AE, A, A99, AO, AH,
B, C, X and D, to have the top of the elevated floor, or in the case of a
building in zones VI-30, VE, or V, to have the bottom of the lowest
horizontal structure member of the elevated floor elevated above the
ground level by means of pilings, columns (posts and pliers), or shear
walls parallel to the floor of the water; and
b. Adequately anchored so as not to impair the structural integrity of the
building during a flood of up to the magnitude of the base flood;
In the case of zones, Al-30, Al, A, A99, AO, AH, B, C, X, D, "elevated building" also
includes a building elevated by means of fill or solid foundation perimeter walls with
openings sufficient to facilitate the unimpeded movement of flood waters. In the case of
zones VI-30, VE, or V, "elevated building" also includes a building otherwise meeting
the definition of "elevated building", even though the lower area is enclosed by means of
breakaway walls if the breakaway walls meet the standards of Section 60.3(e)(5) of the
Nation Flood Insurance Program regulations;
8. "Existing construction" means for the purpose of determining rates, structures
for which the "start of construction" commenced before the effective date of
the FIRM or before January 1, 1975, for FIRMS effective before that date,
"Existing construction" may also be referred to as "existing structures;"
9. "Flood or flooding" means a general and temporary condition of partial or
complete inundation of normally dry land areas from:
a. The overflow of inland or tidal waters; or
b. The unusual and rapid accumulation or runoff of surface waters from
any source;
10. "Flood Insurance Rate Map (FWM)" means the official map of a community
on which the Federal Emergency Management Agency has delineated both t�l
areas of special flood hazards and the risk premium zones applicable to the
city;
11. "Flood Insurance Study" means the official report provided by the Federal
Emergency Management Agency, The report contains flood profiles, water
surface elevation of the base flood, as well as the Flood Boundary-Floodway
map;
12. "Floodplain or food -prone ara' means any land area susceptible to bein,.
inundated by water from any source (see definition of flooding);
13. "Flood protection system" means those physical structural works for which
funds have been authorized, appropriated, and expended and which have been
constructed specifically to modify flooding in order to reduce the extent of the
areas within a community subject to a "special flood hazard" and the extent of
the depths of associated flooding. Such a system typically includes hurricane
tidal barriers, dams, reservoirs, levees or dikes. These specialized flood
modifying works are those constructed in conformance with sound
engineering standards;
14. "Functionally dependent use" means a use which cannot perform its intended
purpose unless it is located or carried out in close proximity to water. The
term includes only docking facilities, port facilities that are necessary for the
loading and unloading of cargo or passengers and ship building and ship
repair facilities, but does not include long-term storage or related
manufacturing facilities;
15. "Habitable floor" means any floor usable for the following purposes; which
includes working, sleeping, eating, cooking or recreation, or a combination
thereof A floor used for storage purposes only is not a "habitable floor".
16. "Highest adjacent grade" means the highest natural elevation of the ground
surface prior to construction next to the proposed walls of a structure;
17. "Levee" means a man-made structure, usually an earthen embankment,
designed and constructed in accordance with sound engineering practices to
contain, control, or divert the flow of water so as to provide protection from
temporary flooding;
18. "Levee system" means a flood protection system which consists of a levee or
levees, and associated structures, such as closure and drainage devices, which
are constructed and operated in accordance with sound engineering practices;
19. "Lowest floor" means the lowest floor of the lowest enclosed area (including
basement). An unfinished or flood resistant enclosure, usable solely for
parking or vehicles, building access or storage in an area other than a
basement area is not considered a building's lowest floor; provided that such
enclosure is not built to render the structure in violation of the applicable non -
elevation design requirement of Section 60.3 of the National Flood Insurance
Program regulations;
20. "Manufactured home" means a structure transportable in one or more
sections, which is built on a permanent chassis and is designed for use with o
without a permanent foundation when connected to the required utilities. Fo
flood plain management purposes the term "manufactured home" also
includes park trailers, travel trailers, and other similar vehicles placed on a sil
for greater than one hundred eighty (180) consecutive days. For insurance
purposes the term "manufactured home" does not include park trailers, travel
trailers, and other similar vehicles;
21, "Mean sea level" means for purposes of the National Flood Insurance
Program, the National Geodetic Vertical Datum (NGVD) of 1929 or other
datum, to which the base flood elevations shown on a community's flood
insurance rate map are referenced;
22. "New construction" means, for floodplain management purposes, structures
for which the "start of construction" commenced on or after the effective date
of a floodplain management regulation adopted by a community;
23. "Start of construction" means for other than new construction or substantial
improvement under the Coastal Barrier Resources Act (Pub, L. 97-348),
includes substantial improvement and means the date the building permit was
issued, provided the actual start of construction, repair, reconstruction,
placement, or other improvement was within one hundred eighty (180) days of
the permit date. The actual start means either the first placement of permanent

storage tank, that is principally above ground, as well as a manufactured
home;
25. "Substantial improvement" means any repair, reconstruction, or improvement
of a structure, the cost of which equals or exceeds fifty percent (501/0) of the
market value of the structure either;
a. Before the improvement or repair is started; or
b. If the structure has been damaged and is being restored, before the
damage occurred;
For the purpose of this definition "substantial improvement" is considered to occur when
the first alteration of any wall, ceiling, floor, or other structural part of the building
commences, whether or not that alteration affects the external dimensions of the
structure. The term does not, however, include either;
a. Any project for improvement of a structure to comply with existing
state or local health, sanitary, or safety code specifications which are
solely necessary to assure safe living conditions; or
b. Any alteration of a structure listed on the National Register of ffistoric
Places or a state inventory of historic places;
26. "Variance' means a grant of relief to a person from the requirements of this
chapter when specific enforcement would result in unnecessary hardship. A
variance, therefore, permits construction or development in a manner
otherwise prohibited by this chapter. For full requirements see Section 60.6 of
the National Flood Insurance Program regulations;
27. "Violation" means the failure of a structure of other development to be fully
compliant with the community's floodplain management regulations. A
structure or other development without the elevation certificate, or other
evidence of compliance required in Section 60.3(b)(5), (c)(4), (c)(10), (d)(3),
(e)(4), or (e)(5) is presumed to be in violation until such time as that
documentation is provided; and

SECTION 12-405 LANDS TQ WHICH SIB ECIA:L FLOOD HAZARD APPLIES
This chapter shall apply to all areas of special flood hazard within the jurisdiction of the

SECTION 12-406 BASIS FOR ESTABLISHING TEE AREAS OF SPECIAL -FA
HAZARD
The areas of special flood hazard identified by the Federal Emergency Management
Agency on its Flood Insurance Study for the city, with accompanying Flood Insurance
Rate Maps and Flood Boundary-Floodway Maps (FIRM and FBFM), and any revisions
thereto, are hereby adopted by reference and declared to be a part of this chapter. (Ord.
No. 367, 3/17/87)
A development permit shall be required to ensure conformance with the provisions of this
chapter. (Ord. No. 367, 3/17/87)
No structure or land shall hereafter be located, altered, or have its use changed without
full compliance with the terms of this chapter and other applicable regulations. (Ord. No.
367, 3/17/05)
This chapter is not intended to repeal, abrogate, or impair any existing easement,
covenants, or deed restrictions, However, where this chapter and another conflict or
overlap, whichever imposes the most stringent restrictions shall prevail. (Ord. No. 367,

In the interpretation and application of this chapter, all provisions shall be:
1. Considered as minimum requirements;
3. Deemed neither to limit nor appeal any other powers granted under state
statutes.

SECTION 12413 DUTIE S AND RESPONSIBILITIES OF TBE FLOODPLAIN
ADMMSTRATOR
Duties and responsibilities of the floodplain administrator shall include, but not be
limited to, the following:

Z. Review permit application to determine whether proposed building site will be
reasonably safe from flooding;
3. Review, approve or deny all applications for development permits required by
adoption of this chapter;
4. Review permits for proposed development to assure that all necessary permits
have been obtained from those federal, state or local governmental agencies
(including Section 404 of the Federal Water Pollution Control Act
Amendments of 1977, 33 U.S.C, 1334) from which prior approval is required;
5. Where interpretation is needed as to the exact location of the boundaries of tI
areas of special flood hazards (for example, where there appears to be a
conflict between a mapped boundary and actual field conditions) the
floodplain administrator shall make the necessary interpretations;
6. Notify, in riverain situations, adjacent communities and the state coordinating
agency which is the Oklahoma Water Resources Board prior to any alteration
or relocation of a watercourse, and submit evidence of such notification to the
Federal Emergency Management Agency;
7. Assure that the flood carrying capacity within the altered or relocated portion
of any watercourse is maintained;
8. When case flood elevation data has not been provided in accordance with
Section 12-406, the floodplain administrator shall obtain, review and
reasonably utilize any base flood elevation data and floodway data available
from a federal, state or other source, in order to administer the provisions of
Sections 12-416, 12-417 and 12-418 of this chapter; and
9When a regulatory floodway has not been designated, the floodplain
administrator must require that no new construction, substantial
improvements, or other development (including fill) shall be permitted within
Zones Al-30 and AE on the community's FIRM, unless it is demonstrated
that the cumulative effect of the proposed development, will not increase the
water surface elevation of the base flood more than one foot at any point
within the community.
A. Application for a development permit shall be presented to the floodplain
administrator on forms furnished by him and may include, but not be limited to,
plans in duplicate drawn to scale showing the location, dimensions, and elevation
of proposed landscape alterations, existing and proposed structures, and the
location of the foregoing in relation to areas of special flood hazard.
Additionally, the following information is required:
1. Elevation in relation to mean sea level, of the lowest floor, including
basement, of all new and substantially improved structures;
2. Elevation in relation to mean sea level to which any nonresidential structure
shall be floodproofed;
L The danger to life and property due to flooding or erosion damage;
2. The susceptibility of the proposed facility and its contents to flood damage
and the effect of such damage on the individual owner;
3. The danger that materials may be swept onto other lands to the injury of
others;
4. The compatibility of the proposed use with existing and anticipated
development,
5. The safety of access to the property in times of flood for ordinary and
emergency vehicles;
6. The costs of providing governmental services during and after flood
conditions
including maintenance and repair of streets and bridges, and public utilities and
facilities such as sewer, gas, electrical and water systems;
7. The expected heights, velocity, duration, rate of rise and sediment transport of
the flood waters and the effects of wave action, if applicable, expected at the
site;
8. The necessity to the facility of a waterfront location, where applicable;
9. The availability of alternative locations, not subject to flooding or erosion
damage, for proposed use; and
10. The relationship of the proposed use to the comprehensive plan for that area.

R Variances may be issued for new construction and substantial improvemeliff
to be erected on a lot of one-half acre or less in size contiguous to and
surrounded by lots with existing structures constructed below the base floo
level, providing the relevant factors in Paragraph 2 of Section 12-414 have
been fully considered. As the lot size increases beyond the one-half acre, t
technical justification required for issuing the variance increases.
G. Upon consideration of the factors noted above and the intent of this chapter
the appeal board may attach such conditions to the granting of variances as
deems necessary to further the purpose and objectives of this chapter as set

H. Variances shall not be issued within any designated floodway if any incre

1. Variances shall only be issued upon a determination that the variance is the
minimum necessary, considering the flood hazard, to atTord relief,

b. A determination that failure to grant the variance would result in
exceptional hardship to the applicant;
c. A determination that the granting of a variance will not result in
increased flood heights, additional threats to public safety, extra-
ordinary public expense, create nuisances, cause fraud on or
victimization of the public, or conflict with existing local laws or
ordinances; and
3. Any application to whom a variance is granted shall be given written
notice that the structure will be permitted to be built with the lowest floor
elevation below the base flood elevation, and that the costs of flood
insurance will commensurate with the increased risk resulting from the
reduced lowest floor elevation.
I Variances may be issued by a community for new construction and substantia]
improvements and for other development necessary for the conduct of a
functionally dependent use provided that:
1. The criteria outline in Subsections A through I of this section are met; and
2. The structure or other development is protected by methods that minimiz-4
flood damages during the base flood and create no additional threats to
public safety.
SECTION 12-416 PROVISIONS FOR FLOOD HAZARD REDUCTION;

1. All new construction or substantial improvements shall be designed or
modified and adequately anchored to prevent flotation, collapse or lateral
movement of the structure resulting from hydrodynamic and hydrostatic loads,
including the effects of buoyancy;
2. All new construction or substantial improvements shall be constructed by
methods and practices that minimize flood damage;
3. All new construction or substantial improvements shall be constructed with
materials resistant to flood damage;
4. All new construction or substantial improvements shall be constructed with
electrical, heating, ventilation, plumbing, and air conditioning equipment and

5. All new and replacement water supply systems shall be designed to minimize
or eliminate infiltration of flood waters into the system;
6. New and replacement sanitary sewage shall be designed to minimize or —
eliminate infiltration of flood waters into the system and discharge from the
systems into flood water; and
7. On -site waste water disposal systems shall be located to avoid impairment to
them or contamination from them during flooding.

SECTION 12-417 PROVISIONS FOR FLOOD HAZARD REDUCTION,, SPECIFIC
STANDARDS -
In all areas of special flood hazards where base flood elevation data has been provided as
set forth in Sections 12-406, Paragraph 8 of 12-413 or Subsection D of 12-418, the
following provisions are required:
Residential construction. New construction and substantial improvement of
my residential structure shall have the lowest floor, including basement,
elevated to or above the base flood elevation. A registered professional
engineer, architect, or land surveyor shall submit a certification to the
floodplain administrator that the standard of this subsection as proposed in
Subsection A of Section 12-414 is satisfied;
2. Nonresidential construction. New construction and substantial improvements
of any commercial, industrial or other nonresidential structure shall either
have the lowest floor, including basement, elevated to or above the base food
level or, together with attendant utility and sanitary facilities, be designed so
that below the base flood level the structure is watertight with walls
substantially impermeable to the passage of water and with structural
components having the capability of resisting hydrostatic and hydrodynamic
loads and effects of buoyancy. A registered professional engineer or architect
shall develop or review structural design, specifications, and plans for the
construction, and shall certify that the design and methods of construction are
in accordance with accepted standards of practice as outlined in this
subsection. A record of such certification which includes the specific
elevation, in relation to mean sea level, to which such structures are flood
proofed shall be maintained by the floodplains administrator; and
3. Enclosures. New construction and substantial improvements, with fully
enclosed areas below the lowest floor that are subject to the flooding shall be
designed to automatically equalize hydrostatic flood forces on exterior walls
by allowing for the entry and exit of floodwaters. Designs for meeting this
requirement must either be certified by a registered professional engineer or
architect or meet or exceed the following minimum criteria:
a. A minimum of two (2) opening having a total net area of not less than one
square inch for every square foot of enclosed area subject to flooding shall
be provided;
b. The bottom of all openings shall be no higher than one foot above grade;
C. Openings may be equipped with screens, louvers, valve, or other
coverings or devices provided that they permit the autoniatic entry and
exit of floodwaters; and
4. Manufactured homes:
b. All manufactured homes shall be in compliance with paragraph I of
this section;
All manufactured homes to be placed or substantially improved wit
Zones Al-30, AH and AE on the community's FIRM shall be elevat
on a permanent foundation such that the lowest floor of the
manufactured home is at or above the base flood elevation system in
accordance with the provision of this paragraph 4. 1
All subdivision proposals including manufactured home parks and
subdons shall be consistent with Sections 12-401, 12-402 and 12-
403 of this chapter,
b. All proposals for the development of subdivisions including
manufactured home parks and subdivisions shall meet development
permit requirements of Sections 12-407, 12-414 and the provisions of
Section 12-416 and 12-417.
c. Base Flood elevation data shall be generated for subdivision proposals
and other proposed development, including manufactured home parks
and subdivisions, which is greater than fifty (50) lots or five (5) acres,
whichever is lesser, if not otherwise provided pursuant to Sections 12-
406 or 12-413 (8) of this chapter.
d. All subdivision proposals including manufactured home parks and
subdivisions shall have adequate drainage provided to reduce exposure
to flood hazards.
e. All subdivision proposals, including manufactured home parks and
subdivisions, shall have public utilities and facilities such as sewer,
gas, electrical and water systems located and constructed to minimize

designated as shallow flooding. These areas have special flood hazards associated with
base flood depths of one to three (3) feet where a clearly defined channel does not exist
and where the path of flooding is unpredictable and where velocity flow may be evident.
Such flooding is characterized by ponding or sheet flow; therefore, the following
provisions apply:
All new construction and substantial improvements of residential structures have

lease as high as the depth number specified in feet on the community's FIRM (at
least two (2) feet if no depth number is specified);
2. All new construction and substantial improvements of nonresidential structure
have the following:
a. The lowest floor (including basement) elevated above the highest
adjacent grade at least as high as the depth number specified in feet on
the community's FIRM (at least two (2) feet if no depth number is
specified); or
b. Together with attendant utility and sanitary facilities be designed so
that below the base flood level the structure is watertight with walls
substantially impermeable to the passage of water and with structural
components have the capability of resisting hydrostatic and
hydrodynamic loads of effects of buoyancy;
3. A registered professional engineer or architect shall submit a certification t® the
floodplain administrator that the standards of this section, as proposed in
paragraph I of this Subsection A of Section 12-414, are satisfied; and
4. Require within Zones AH or AO adequate drainage paths around structures on
slopes, to guide flood waters around and away from proposed structures.

BACKGROUND.
In 2002, City staff performed a comprehensive inventory of all residential streets for the
development of a 10-year Street Overlay Program. Residential streets throughout the entire city
were inventoried and evaluated using a street management computer program. Sites identified
for repair were prioritized ranging from low, moderate to high priority. All repair programs
completed by the City since 2002 have followed this priority listing.
In May 2004, the street inventory was revised, updated and refined to reflect updated pavement
conditions. Currently, the Street Overlay Program identifies over 48 sites, extending nearly 1.5
million square feet of pavement, for repair (see Attachment A) at an estimated cost of over $ 1
million. Due to limitations in funding of approximately $ 115,000 per year, only 13 of such sites
were programmed for completion during FY 2004-2005. A map illustrating the location of
programmed street repairs is shown in Attachment B.
FY 2004-2005 STREET OVERLAY PROGRAM:
Since May 2004, changes to existing conditions have again prompted a review of pavement
repair schedule. First, because of the realignment of North Garnett Road — currently under
construction as part of the North Garnett Road Improvement Project — much of the Garnett
Frontage Road has been eliminated. The remaining portion of the road will be repaired as part of
North Garnett Road Improvements project, and thus, inclusion of such repairs in the Overlay
Program is unnecessary.
Remaining projects programmed for completion in FY 04-05 include repairs to street segments
in El Rio Vista, Lake Ridge and Broadmoor Heights subdivisions. The projects — listed in order
of decreasing priority — are as follows:

Due to unforeseen increases in asphalt costs, only projects 1 though 8 can be funded during this
fiscal year. Construction of Projects 1 through 7 will facilitate the completion of all scheduled
repairs in EL Rio Vista subdivision. Similarly, completion of Project S will allow the
completion of the only scheduled repair in Lake Ridge subdivision. A map illustrating the
location of recommended projects is included as Attachment C.
FUNDING SOURCE:
Funding for this project in the amount of $ 115,000 is included in the FY 04-05 Street Division
budget (Line Item 01-300-54210).
RECOMMENDATION
Staff request Council authorization for advertisement of the FY 2004-2005 Street Overlay
Project for completion of street repairs in El Rio Vista and Lake Ridge subdivisions.
