6. Consideration and appropriate action relating to a request for Council approval of the
Consent Agenda. All matters listed under "Consent" are considered by the City Council to
be routine and will be enacted by one motion. Any Councilor may, however, remove an
item from the Consent Agenda by request. A motion to adopt the Consent Agenda is non-
debatable.

9. Consideration and appropriate action relating to a request for Council approval of rezoning
request OZ 05-03.

between E. 98"' Street North and E. 101" Street North.
10. Consideration and appropriate action relating to a request for Council approval of the final
plat for Ator Center.

Ordinance No. 815.

current Flood Damage Prevention Ordinance by including a reference to the date of the
effective Flood Insurance Rate Map.

MINUTES OF REGULAR MEETING
'Tuesday, June 7, 2005
The Owasso City Council met in regular session on Tuesday, June 7, 2005 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall
bulletin board at 5:00 p.m. on Friday, June 3, 2005.
ITEM 1. CALL TO ORDER
The meeting was called to order at 6:32 p.m.
ITEM 2. INVOCATION
The invocation was offered by Pastor Charlie Curran of First Christian Church of Owasso.
ITEM 3. FLAG SALUTE
Councilor Susan Kimball led the flag salute.

ITEM 5. PRESENTATION OF CHARACTER TRAIT OF JUSTICE, FOLLOWED BY A
PUBLIC SERVICE ANNOUNCEMENT
Mr. Richard Willhour, a member of the Owasso Character Council, presented to the Council the
character trait of Justice, character trait of the month for June, 2005.

Mr. Ray presented the June, 2005 Employee of the Month Award to Julie Stevens and Jessica
Hunt for their efforts in heading the City of Owasso Relay for Life team and Cindy Miller for
heading the Fraternal Order of Police Relay for Life team.
ITEM 7. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF THE CONSENT AGENDA
A. Approval of Minutes of the May 17, 2005 Regular Meeting and the May 31,
2005 Special Meeting.
B. Approval of Claims.
C. Action relating to a request for Council approval of Disability Retirement for
employee Effie Grimes.
D. Action relating to a request for Council approval of the FY 2005-2006
contract with the International Association of Firefighters.
E. Action relating to Council acceptance of Ordinance No. 813, an ordinance
approving the annexation of approximately 35 acres, more or less. The
subject property is located east of the Owasso Expressway, between East 98t1'
Street North and East 101St Street North.
F. Action relating to Council authorization to give notice, equalization, and levy
of assessments against properties within the Tulsa County Sewer
Improvement District No. 6 (Pleasant View Estates Addition) sufficient to pay
the interest, principal, and reserve due on the outstanding indebtedness
represented by the District Bonds.
Mr. Cataudella moved, seconded by Mr. Colgan, to approve the Consent Agenda with claims
totaling $107,752.89, self-insurance medical claims & fees totaling $50,912.03, and payroll
claims for two pay periods totaling $556,753.92.

ITEM 5. PUBLIC HEARING. A Public Hearing held for the purpose of presenting the City
of Owasso Fiscal Year 2005 -2006 Annual Budget Proposal.
Mr. Ray presented budgetary goals for the 20052006 Annual Budget. He then opened the floor
for citizen comment or questions. There were no comments from the floor.

ITEM 9. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL, OF ORDINANCE NO. 814
Mr. Niles presented the item. Ms. Kimball moved, seconded by Mr. Cataudella, for Council
approval of Ordinance 814, an ordinance amending the City of Owasso Code of Ordinances by
repealing the current license requirements of electrical, mechanical, and plumbing contractors
and adopting the recognition of a State of Oklahoma issued license as the only required license
needed to perform contract work within the City of Owasso.

ITEM 10. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL ADOPTION OF RESOLUTION NO. 0
Mr. Niles presented the item. Mr. Colgan moved, seconded by Mr. Cataudella, for Council
adoption of Resolution No. 2005 ®09, a resolution amending Resolution No. 199902, relating to
the establishment of permit fees under the jurisdiction of the Building Inspector's office for
Mechanical Permits, Electrical Permits, and Plumbing Permits.

Mr. Ray presented the item. Mr. Kenneth Yates, who had requested to address the Council,
asked Mr. Ray for clarification of several issues concerning this Development Agreement.
Mr. Cochran moved, seconded by Mr. Cataudella, for Council approval of the proposed
Development Agreement between the City of Owasso and Tracy Construction, Incorporated for
the construction of an appropriately designed detention facility and drainage system for the entire
Silver Creek development area.

Councilor Kimball thanked all City employees who participated in and helped with Relay for
Life. She also thanked the Public Works' staff for having the cemetery looking so nice for
Memorial Day.
Ms. Kimball announced that the first Art in the Park was scheduled for next Monday at 6:30 pm.

The Owasso City Council met in a special meeting on Tuesday, June 14, 2005 in the Council
Chambers at Old Central, 109 N. Birch Street, per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 4:00 PM on Friday, June 10, 2005,
ITEM 1: CALL TO ORDER.
Councilor Kimball called the meeting to order at 6:05 PM.

ITEM 2: DEMONSTRATION AND TRAINING ON THE USE OF AN ELECTRONIC CITY
COUNCIL VOTING SYSTEM
Ms. Willson provided a demonstration of the electronic voting system. It was explained that the
new voting system would be utilized at the next regular meeting of the City Council.
Mr. Ray and Ms. Bishop reviewed the details regarding the above items. It was explained that
this item would be placed on the June 21, 2005 City Council agenda for approval.
ITEM 4: COUNCIL BRIEFING ON THE STATUS AND PROGRESS OF THE GIS
SYSTEM
Mr. White provided an update of the GIS system to the Council. No action was taken.
ITEM 5: DISCUSSION RELATING TO GRANT REQUESTS
Mr. Rooney reviewed this item and explained that this was the first grant request that would
follow the new process of providing the Council information about the requests prior to

submitting the application.

were in favor of the motion and the Council entered into Executive Session at 7:59 PM.
The Council exited Executive Session at 8 :28 PM.

the meeting was adjourned at 8:30 PM.

The subject property is currently undeveloped and is used for agricultural purposes. Properties
to the north, east and west of the site are used for single-family residential purposes. Property to
the south is undeveloped.
The subject property is currently zoned for AG (Agricultural). Land to the north, cast and west
is zoned RS (Tulsa County-Residential Single-Family). Property to the south is zoned AG
(Agriculture).
The applicant is also proposing a Planned Unit Development (PUD) involving the 166.28 acr,-i
tract. The proposed OPUD 05-01 will take the underlying RS-3 zoning designation to guide th'§
development of single-family homes. A general area map and a complete legal description of th"-..
property have been attached for your information and review.

The concept of a Planned Unit Development is to provide a creative alternative to conventional
development where a particular tract is under common ownership or control and where a detailed
development plan, outlining the development of the tract as a unit is proposed and submitted for
puM lic review. The use of a PUD technique is a way to amend a zoning ordinance in accordance
with a complete and coordinated plan of development for a larger parcel, rather than piecemeal
individual changes using the variance process. The supplemental zoning district PUD must be
approved by the City Council as a prerequisite to the Planned Unit Development.
USES PERIMITTED — The Owasso Zoning Code allows f ®r all types of residential uses and 29
types of commercial uses within a residential planned unit development. The applicant requests
only one use — single-family residential,
BULK AND AREA REQUIREMENT S — The Owasso Zoning Code allows one dwelling un
per 8,400 square feet in an RS-3 PUD, This requirement would allow up to 862 dwelling uni
on the 166.28 acres. The applicant requests 500 dwelling units.
Within an RS-3 PUD, the minimum allowable lot size requirement is 800 square feet, and the
minimum allowable lot width is 20 feet. The applicant requests a minimum lot size of 5,000
square feet and a minimum lot width of 50 feet.
BUILDING HEIGHT AND YARDS — There is no set maximum building height or minimum
yard size set by the Owasso Zoning Code. The applicant requests a maximum building height of
two stories and a minimum rear yard size of 15 feet and minimum side yard size of 5 / 5 feet or
0 / 10 feet.

OPUD 05-01 (Crown Colony 11) is a proposed planned unit development (PUD) comprised of
166.28 acres. The development concept behind the Crown Colony 11 PUD is residential. The
applicant/owners of the property intend only to develop single family residential homes on the
subject site.
COM]PREHENSIVE PLAN CONSISTENCY-:
The Owasso 2015 Land Use Master Plan identifies the subject property and its surroundings as
having a future land use of residential. As previously stated it is the desire of the
applicants/owners to develop the area for residential single-family use.
The E. 76h Street North corridor has been identified as a non-commercial corridor west of North
119th East Avenue. Again, this PUD proposes a residential component that is part of a
development concept for the area that calls for single-family development. Similar residential
developments along E. 76'h Street North have developed, such as Crown Colony.
Future planning issues must still be considered if the PUD is approved. If approved, the
applicant must submit a preliminary plat, infrastructure plans, and a final plat that must be
approved by the City of Owasso.

Sidewalks will be required along all public rights-of-way associated with the subject property.
Perimeter sidewalks must be installed at the time of overall development, while the internal
walks may be constructed as individual lots are developed.
The applicant has identified the terrain of the area as relatively flat terrain. The existing soils on
the site would appear to create no unusual development problems that are not typically
encountered in development in and around the City of Owasso. On-site detention is required and
will be further defined at the platting stage.
Any future development on the property will be served water and sanitary sewer by the City of
*wasso.
The Owasso Planning Commission considered the application at a public hearing conducted on
April 11, 2005. At that public heating, the Planning Commission unanimously recommended
that the City Council approve OZ 05-01 without condition.
The Owasso Planning Commission also considered OPUD 05-01 at a public hearing conducted
on April 11, 2005, At that public hearing, the Planning Commission unanimously recommended
that the City Council approve OPUD 05-01 subject to the following conditions:
1. The developer constructs fencing adjacent to residential owned property,
2. City, county and developer meet regarding access concerns.

The staff was recently requested to conduct a survey of municipal screening requirements
between single-family subdivisions in Oklahoma communities. To date, the staff has contacted 20
different municipalities throughout the state (by telephone and em"), and received responses
from 14 of those municipalities.
Seven communities responded that they do have a policy of not requiting screening between single-
family subdivisions regardless of density. Those communities are: Catoosa, Collinsville, Enid, Norman,
Sand Springs, Shawnee, and Skiatook.
single-family developments and existing lower density single-family developments. Those communities
are: Oklahoma City, Ponca City, and Stillwater.
One community, Edmond, responded that while there is no policy for a guide, and that PUD's are
conditioned on a case-by-case basis, there is a previous example of the Planning Commission requiring
a screening fence for a higher density development where it bordered an existing lower density
development.
Three communities responded that they do not have a policy either way, and that they do not have an
applicable example with which to respond to the question. Those communities are: Broken Arrow,
Jenks, and Sapulpa.
Six communities chose not to respond: Bartlesville, Bixby, Claremore, Lawton, Mdwest City, and
Tulsa.

ANALYSIS
Staff received a petition from Northeast Investments, L.L.C., requesting that the 2015 Land Use
Master Plan be revised to allow for Commercial use for the entire 35 acre tract. Currently the
western and northern portions of the 35 acre tract adjacent to the service road are planned for
commercial development while the remaining acreage is planned for residential development.
The Owasso 2015 Land Use Master Plan calls for commercial development on approximately
half of the 35 acre tract and residential development of the remaining area. On May 179 2005 the
council unanimously approved an amendment to the 2015 Land Use Master Plan to allow for
commercial and transitional use of the 35 acre tract.
Staff published legal notice of the annexation petition in the Owasso Reporter and letters of
notification were mailed to property owners within a 300' radius.

The item that FEMA wants Owasso to include in its flood ordinance is a reference to the scientific data
that forms the basis of how the Owasso floodplain is regulated. This data is encapsulated within a
report called "The Flood Insurance Study for Tulsa Coun nd Incorporated Areas dated
April 16, 2003.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO,

Section One: That Part 12 -- Planning, Zoning and Development, Section 12405, of the
Code of Ordinances of the City of Owasso, Oklahoma, is hereby amended to read as follows, and
the same being codified as set forth below, to -wit:

The provisions of this chapter shall apply to and govern the placement of structures and
improvements and man -made changes of land, and the issuance of building permits or occupancy

Code of Ordinances of the City of Owasso, Oklahoma, is hereby amended to read as follows, and
the same being codified as set forth below, to -wit:
SECTION 12 -406. BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD
HAZARD
The areas of special flood hazard identified by the Federal Emergency Management Agency in a
scientific and engineering report entitled, "The Flood Insurance Study for Tulsa County,
Oklahoma and Incorporated Areas," dated April 16, 2003 with accompanying Flood Insurance
Rate Map (FIRM) are hereby adopted by reference and declared to be a part of this chapter.
Copies for public review shall be available in the Community Development Department of the
City.
Section Three: The provisions of this ordinance shall become effective thirty (30) days
from the date of first publication as provided by law.

A. The flood hazard areas of the city are subject to periodic inundation which
results in loss of life and property, health and safety hazards, disruption of
commerce and governmental services, and extraordinary public expenditur
•for flood protection and relief, all of which adversely affect the public healt
safety and general welfare. I
k!". These flood losses are created by the cumulative effect of obstructions in
floodplains which case an increase in flood heights and velocities, and by the
occupancy of flood hazard areas by uses vulnerable to floods and hazardous to
other lands because they are inadequately elevated, flood proofed or otherwise
protected from flood damage. (Ord. No. 367,3/17/87)
Unless specifically defined below, words or phrases used in this chapter shall be
interpreted to give them the meaning they have in common usage and to give this chapter
its most reasonable application. The following terms as used herein will mean:
I . "Appeal" means a request for a review of the flood plain administrator's
interpretation of any provision of this chapter or a request for a variance;
4, "Base flood" means the flood having a one percent (1%) chance of being
equaled or exceeded in any given year:
5. "Critical feature" means an integral and readily identifiable part of a flood
protection system, without which the flood protection provided by the entire
system would be compromised;
6. "Development" means any man-made change in improved and unimproved
real estate, including but not limited to buildings or other structures, mining,
dredging, filing, grading, paving, excavation or drilling operations;

8. "Existing construction" means for the purpose of determining rates, structures
for which the "start of construction" commenced before the effective date of
the FIRM or before January 1, 1975, for FIRMS effective before that date,
"Existing construction" may also be referred to as "existing structures-"
9. "Flood or flooding7 means a general and temporary condition of partial or
complete inundation of normally dry land areas from:
a. The overflow of inland or tidal waters; or
b. The unusual and rapid accumulation or runoff of surface waters from

10. "Flood Insurance Rate Map (FIRM)" means the official map of a community
on which the Federal Emergency Management Agency has delineated both the
areas of special flood hazards and the risk premium zones applicable to the
city;
11. "Flood Insurance Study" means the official report provided by the Federal
Emergency Management Agency, The report contains flood profiles, water
surface elevation of the base flood, as well as the Flood Boundary-Floodway
map;
12. "Floodplain or food-prone area" means any land area susceptible to being
inundated by water from any source (see definition of flooding);
21, "Mean sea level" means for purposes of the National Flood Insurance
Program, the National Geodetic Vertical Datum (NGVD) of 1929 or other
datum, to which the base flood elevations shown on a community's flood
insurance rate map are referenced;
22. "New construction" means, for floodplain management purposes, structures
for which the "start of construction" commenced on or after the effective date
of a floodplain management regulation adopted by a community;
24. "StructurC means a walled and roofed building, including a gas or liquid
storage tank, that is principally above ground, as well as a manufactured
home;
25. "Substantial improvement" means any repair, reconstruction, or improvement
of a structure, the cost of which equals or exceeds fifty percent (501/0) of the
market value of the structure either;
a. Before the improvement or repair is started; or
b. If the structure has been damaged and is being restored, before the
damage occurred;
For the purpose of this definition "substantial improvement" is considered to occur when
the first alteration of any wall, ceiling, floor, or other structural part of the building
cS mmences, whether or not that alteration affects the external dimensions of the
structure. The term does not, however, include either;
a. A for improvement of a structure to comply with existing
state or local health, sanitary, or safety code specifications which are
solely necessary to assure safe living conditions; or
b. Any alteration of a structure listed on the National Register of Historic
Places or a state inventory of historic places;
26. "Variance" means a grant of relief to a person from the requirements of this
chapter when specific enforcement would result in unnecessary hardship. A
variance, therefore, permits construction • development in a manner
otherwise prohibited by this chapter. For full requirements see Section 60.6 of
the National Flood Insurance Program regulations;
28. "Water surface elevation" means the height, in relation to the National
Geodetic Vertical Datum (NGVD) of 1929 (or other datum, her specified), of
floods of various magnitudes and frequencies in the floodplains of coastal or

This chapter is not intended to repeal, abrogate, or impair any existing easement,

reasonably safe from flooding;

4. Review permits for proposed development to assure that all necessary permits
have been obtained from those federal, state or local governmental agencies
(including Section 404 of the Federal Water Pollution Control Act
Amendments of 1977, 3 3 U, S. C, 13 34) from which prior approval is required;
S. Where interpretation is needed as to the exact location of the boundaries of the
areas of special flood hazards (for example, where there appears to be a
conflict between a mapped boundary and actual field conditions) the
floodplain administrator shall make the necessary interpretations;
6. Notify, in riverain situations, adjacent communities and the state coordinating
agency which is the Oklahoma Water Resources Board prior to any alteration
or relocation of a watercourse, and submit evidence of such notification to the
Federal Emergency Management Agency;
7. Assure that the flood carrying capacity within the altered or relocated portion
of any watercourse is maintained;
8. When case flood elevation data has not been provided in accordance with
Section 12-406, the floodplain administrator shall obtain, review and
reasonably utilize any base flood elevation data and floodway data available
from a federal, state or other source, in order to administer the provisions of
Sections 12-416, 12-417 and 12-418 of this chapter; and
1. Elevation in relation to mean sea level, of the lowest floor, including
basement, • all new and substantially improved structures;
2. Elevation in relation to mean sea level to which any nonresidential structure
shall be floodproofed;
3. A certificate from a registered professional engineer or architect that the
nonresidential floodproofed structure shall meet the flood proofing criteria of
Paragraph 2 of Section 12-417,-
4. Description of the extent of which any watercourse or natural drainage will be
altered or relocated as a result of proposed development; and
5. Maintain a record of all such information in accordance with Paragraph I of
Section 12413.
B. Approval or denial of a development permit by the floodplain administrator shall
be based on all of the provisions of this chapter and the following relevant factors:

and the effect of such damage on the individual owner;
3. The danger that materials maybe swept onto other lands to the injury of
others;
4. The compatibility of the proposed use with existing and anticipated
development,

A. The appeal board, which is the board of adjustment of the city, shall her and
render judgment on requests for variances from the requirements of this
chapter.
B. The appeal board shall hear and render judgment on an appeal only when it is
alleged there is an error in any requirement, decision, or determination made
by the floodplain administrator in the enforcement or administration of this
chapter.
C. Any person or persons aggrieved by the decision of the appeal board may

appeal such decision in the courts of competent jurisdiction.
D The floodplain administrator shall maintain a record of all actions involving

an appeal and shall report variances to the Federal Emergency Management
Agency upon request.
E. Variances may be issued for the reconstruction, rehabilitation or restoration of
structures listed on the National Register of Historic Places or the state
inventory of historic places, without regard to the procedures set forth in the
remainder of this chapter.
G. Upon consideration of the factors noted above and the intent of this chapter,
the appeal board may attach such conditions to the granting of variances as it

deems necessary to further the purpose and objectives of this chapter as set
out in Section 12-402 hereit.
H. Variances shall not be issued within any designated floodway if any increa

minimum necessary, considering the flood hazard, to afford relief,

a. Showing a good and sufficient case;
b. A determination that failure to grant the variance would result in
exceptional hardship to the applicant;
c. A determination that the granting of a variance will not result in
increased flood heights, additional threats to public safety, extra-
ordinary public expense, create nuisances, cause fraud on or
victimization of the public, or conflict with existing local laws or
ordinances; and
3. Any application to whom a variance is granted shall be given written
notice that the structure will be permitted to be built with the lowest floor
elevation below the base flood elevation, and that the costs of flood
insurance will commensurate with the increased risk resulting fr -om the
reduced lowest floor elevation,

SECTION 12-416 PROVISIONS FOR FLOOD HAZARD REDUCTION,
GENERALSTANDARDS
construction and substantial improvements:
1. All new construction or substantial improvements shall be designed or
modd and adequately anchored to prevent flotation, collapse or lateral
movement of the structure resulting from hydrodynamic and hydrostatic loads,
including the effects of buoyancy;
2. All new construction or substantial improvements shall be constructed by
methods and practices that minimize flood damage;
3. All new construction or substantial improvements shall be constructed with
materials resistant to flood damage;
4. All new construction or substantial improvements shall be constructed with
electrical, heating, ventilation, plumbing, and air conditioning equipment and

5. All new and replacement water supply systems shall be designed to minimize
or eliminate infiltration of flood waters into the system;
6. New and replacement sanitary sewage shall be designed to minimize or
eliminate infiltration of flood waters into the system and discharge firom the
systems into flood water; and
7. On-site waste water disposal systems shall be located to avoid impairment to
them or contamination from them during flooding.

SECTION 12-417 PROVISIONS FOR FLOOD HAZARD REDUCTION, SPECIFI
STANDARDS I
In all areas of special flood hazards where base flood elevation data has been provided as
set forth in Sections 12-406, Paragraph 8 of 12-413 or Subsection D of 12418, the
following provisions are required:
3. Enclosures. New construction and substantial improvements, with fully
enclosed areas below the lowest floor that are subject to the flooding shall be
designed to automatically equalize hydrostatic flood forces on exterior walls
by allowing for the entry and exit of floodwaters. Designs for meeting this
requirement must either be certified by a registered professional engineer or
architect or meet or exceed the following minimum criteria:
a. A minimum of two (2) opening having a total net area of not less than one
square inch for every square foot of enclosed area subject to flooding shall
be provided;
b. The bottom of all openings shall be no higher than one foot above grade.;
C. Openings may be equipped with screens, louvers, valve, or other
coverings or devices provided that they permit the automatic entry and
exit of floodwaters; and
3
b. All manufactured homes shall be in compliance with paragraph I of
this section;
c. All manufactured homes to be placed or substantially improved within
Zones Al -3 0, AH and AE on the community's FIRM shall be elevated
on a permanent foundation such that the lowest floor of the
manufactured home is at or above the base flood elevation system in
accordance with the provision of this paragraph 4.
a. All subdivision proposals including manufactured home parks and
subdivisions shall be consistent with Sections 12401, 12-402 and 12-
403 of this chapter,
b. All proposals for the development of subdivisions including
manufactured home parks and subdivisions shall meet development
permit requirements of Sections 12-407, 12-414 and the provisions of
Section 12416 and 12-417.
c, Base Flood elevation data shall be generated for subdivision proposals
and other proposed development, including manufactured home parks
and subdivisions, which is greater than fifty (50) lots or five (5) acres,
whichever is lesser, if not otherwise provided pursuant to Sections 12-
406 or 12-413 (8) of this chapter.
d. All subdivision proposals including manufactured home parks and
subdivisions shall have adequate drainage provided to reduce exposure
to flood hazards.
e. All subdivision proposals, including manufactured home parks and
subdivisions, shall have public utilities and facilities such as sewer,
gas, electrical and water systems located and constructed to minimize

SUPPLE MENTAL APPROPRIATIONS
FISCAL YEAR END
The City of Owasso operates under the provisions of the Municipal Budget Act. In accordance
with the Budget Act, all funds of the City with revenues and expenditures are required to have
annual budgets. Expenditures may not legally exceed the appropriation or budget within a
department or a fund.
The City Manager has the authority to transfer appropriations between line items within a
department or to transfer appropriations between departments within the same fund. A supplement
or increase in total appropriations in a fund requires City Council approval.
The trust authorities (OPWA and OPGA) are required to prepare an annual budget and submit a
copy to the City as beneficiary of the trust. However, there are no further requirements such as a
legal restriction on spending. Staff is not requesting year -end appropriations for the OPWA or for
the OPGA.
Staff is requesting three supplemental appropriations for City Council consideration.
GENERAL FUND. Under the pledged revenue requirements of the OPWA bond indentures, the
City transfers all of its sales tax collections to the OPWA Sales Tax Fund, and then the OPWA
transfers two cents of the sales tax back to the General Fund. Because the sales tax revenue in the
General Fund is over budget, the transfer to the OPWA will exceed budget also. The final sales
tax collection was received on June 10 h from the Oklahoma Tax Commission. The total sales tax
revenue for the year is $11,253,360, which is $543,360 over budget. The transfer from the
General Fund to the OPWA Sales Tax Fund will exceed budget by the same amount.
Staff will request a budget amendment for the General Fund increasing estimated revenues and
increasing the appropriation for expenditures by $543,360.

State statutes require adoption of an annual budget by the City Council through a resolution.
Resolution No. 2005 -10 with Attachment "A" (budget summary) provides for the adoption of a fiscal
year budget for the General Fund and other funds of the city.
The Municipal Budget Act authorizes an alternate method of budgeting for grants and capital projects
that extend beyond a single fiscal year. The existing budgets may be reappropriated to the same
project in the succeeding fiscal year without specifying the exact dollar amount. For example, this
allows the budget for the Garnett Street widening project to roll forward into the new fiscal year when
the amount of the unexpended budget will be unknown until after the end-of-year invoices are
received. If approved by Council, wording in Resolution No. 2005-10 will reappropriate funds for all
incomplete projects in the Capital Improvements Fund and the Capital Projects Grant Fund.

WHEREAS- It is the intent of the Owasso City Council to adopt an operating budget for
fiscal year 2005-2006; and
WHEREAS. The adoption of such budget is vital to the continuation of services to the
citizens of Owasso; and
WHEREAS- Public access to the adopted budget is desired; and
WHEREAS: Certain publication and filing requirements are mandated by State
Statutes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY C04NCIL OF TAE CITY OF
OKLAHOMA:
THAT- The revenues, expenditures and transfers as shown on Attachment "A"
shall be appropriated for each fund; and
THAT. The encumbrances and unexpended appropriation balances for the Capital
Improvements Fund and the Capital Projects Grant Fund for Fiscal Year
2004-2005 be and the same are hereby reappropriated to the same funds,
accounts and for the same purposes for Fiscal Year 2005 -2006 unless the

BACKGROUND
Following a review of the existing Residential Street Overlay Program priority listing, in June
2005, Council approved the FY 04 -05 Street Overlay Program for the repair of eight sites
extending over 150 thousand square feet of pavement in the El Rio Vista subdivision. Projects
sites — listed in order of decreasing priority — were identified as follows:

The Engineering Estimate prepared by Public Works staff in May 2005 is $129,800. Because
additional funding is available in FY 04 -05 budget (resulting from savings in other programs),
Council authorized staff to increase unity quantities, via a future quantity adjustment, to
maximize utilization of available funding. The change to the contract will be in conformance
with the Oklahoma Competitive Bidding Act because readvertising for bids on additional work is

not necessary when a construction contract contains unit pricing and a proposed change order
pertains to the unit price. It is anticipated that such changes will allow the repair of identified
sites in the Lakerid�e subdivisiong in accordance with the �roram priority listing

On June 22, 2005, four local contractors submitted bids as summarized below. A complete
tabulation per project site is included as Attachmcnt C.

Becco Contractors Inc. $ 126,266.25
APAC- Oklahoma Inc. $ 136,004.45
Becco Contractors Inc. submitted the apparent low bid of $126,266.25. Engineering Division
staff examined the submitted bid package and no omissions or errors were discovered. Becco
Contractors Inc. has successfully completed work for the city, including construction of
improvements at East 86"' Street North and North 145'h East Avenue, East 86"' Street North
(from 129t" to 145th East Avenue) and East 96th Street Forth and US HWY 169 interchange.
Additionally, Bccco Contractors Inc. is the contractor for the work at Forth Garnett Road and
East 96"' Street forth currently underway.
PROJECT FUNDING:
Funds for this project were included in the FY 04 -05 Streets Division Capital Outlay budget
(Line Item 01- 300 - 54210) in the amount of $145,000.00. Because the proposed contract award
would not occur until FY 05 -06, it will be necessary to amend the FY 05 -06 Streets Division
Capital Outlay budget to allow for the carryover of unutilized funds from FY 04 -05.
RECOMMENDATION:
Staff recommends Council award the FY 04 -05 Street Repair contract to Becco Contractors Inc.,
of Tulsa, Oklahoma, in the amount of $126,266.25. Additionally, staff recommends Council
approval of an amendment to the FY 05 -06 Streets Division Capital Outlay Budget, increasing
expenses by $126,266.25.
