OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, May 3, 2011 The Owasso City Council met in regular session on Tuesday, May 3, 2011 in the Council Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 6:00 p.m, on Friday, April 29, 2011. ITEM 1. CALL TO ORDER Mayor Bonebrake called the meeting to order at 6:31 p.m. ITEM 2. INVOCATION The invocation was offered by Reverend Bruce McCarty of Owasso First Assembly of God. ITEM 3. FLAG SALUTE Councilor Sinex led the flag salute. ITEM 4. ROLL CALL PRESENT ABSENT Doug Bonebrake, Mayor None Jon Sinex, Vice Mayor Steve Cataudella, Councilor Wayne Guevara, Councilor Bryan Stovall, Councilor A quorum was declared present. ITEM 6. ELECTION OF MAYOR Mayor Bonebrake called for a nomination for the position of Mayor. Mr. Stovall moved, seconded by Mr. Cataudella, to nominate Doug Bonebrake for Mayor. ELECTION OF VICE-MAYOR May 3, 2011 Mayor Bonebrake called for a nomination for the position of Vice Mayor. Mr. Cataudella moved, seconded by Mr. Bonebrake, to nominate Bryan Stovall for Vice Mayor. YEA: Stovall, Cataudella, Bonebrake, Brown, Ross NAY: None Motion carried 5-0. ITEM 8. PRESENTATION OF THE CHARACTER TRAIT OF BOLDNESS Michele Dempster, a member of the Owasso Character Council, presented to the City Council "Boldness," the Character Trait of the Month for May, 2011. ITEM 9. PRESENTATION OF THE MAYOR'S PROCLAMATION Mayor Bonebrake presented a proclamation to declaring Thursday, May 12, 2011 to be RED (Renew, Energize, and Donate) Day in the City of Owasso. ITEM 10. PRESENTATION OF CHARACTER CERTIFICATE TO MR. RANDALL BOBBITT Mayor Bonebrake and Mr. Ray recognized Mr. Bobbitt and P&K Equipment for the character trait of Generosity. ITEM 11. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR CITY COUNCIL APPROVAL OF THE CONSENT AGENDA A. Approval of Minutes of the April 19, 2011 Regular Meeting. B. Approval of Claims. C. Approval of Ordinance No. 986, approving OA 11-02, detaching from the City of Owasso, Oklahoma, additional lands and territory of Section 6, Township 21 North, Range 14 East of the I.B, and M, Tulsa County Mr. Cataudella moved, seconded by Mr. Stovall, to approve the Consent Agenda with claims totaling $136,522.68. Also included for review were the healthcare self-insurance claims report and payroll payment report for pay period 04/23/11. Proposed Utility Easement Closure - Lake Valley IV Mr. Lehr presented information regarding A) the review of bids for the dredging of Three Lakes Pond; B) proposed ordinances 953 nunc pro tunc and 962 nunc pro tunc, both correcting errors in the legal description of Ordinances 953 and 962; C) the proposed re-zoning of approximately 2.4 acres located in the general area of 8523 N 125th E Ave; and D) a proposed utility easement closure for Lake Valley IV. Mr. Lehr further explained that each item would be placed on the May 17, 2011 City Council agenda for consideration and appropriate action. ITEM 3: DISCUSSION RELATING TO CITY MANAGER ITEMS A. Proposed resolution related to the Garnett Regional Detention assessment rate B. Discussion relating to the 76th Street Sanitary Sewer Interceptor C. Proposed Amendments to the Owasso Code of Ordinances - Part 9, Business Licensing, Solicitors and Mobile Food Vendors; and Part 9, Business Licensing, Massage Parlors D. Proposed appointments to Citizen Boards and Commissions E. Presentation related to the Annual Water Quality Report F. City Manager Report 1.Sales Tax Report A.) Ms, Bishop presented information relating to the Garnett Regional Detention assessment rate and noted that staff intends to place a Resolution officially adopting an assessment rate on the May 17, 2011 Meeting Agenda; B.) Mr. Stevens presented information related to the 76th Street Sanitary Sewer Interceptor assessment rate and noted that staff would be bringing further information relating to this item at a later date; C) Ms. Lombardi presented proposed amendments to Part 9, Business Licensing of the Owasso Code of Ordinances relating to Solicitors, Mobile Food Vendors, and Massage Parlors. Ms. Lombardi noted that the proposed Owasso City Council May 10, 2071 changes would be reviewed again at the June Work Session meeting; D.) Mr. Ray presented information relating to appointments to Citizen Boards and Commissions and noted that further discussion would be held at future Work Session meetings; E.) Mr. Stevens provided information related to the Annual Water Quality Report; F.) Mr. Ray presented the budget goals for the FY 2011-2012 Budget Proposal. Discussion was held. Mr. Ray provided information on the most recent sales tax receipts. Mr. Ray noted that staff would be bringing information relating to a proposed OWRB Loan for the Santa Fe Lift Station before the Council. Mr. Ray presented information relating to the casting of the City's ballot in Oklahoma Municipal Assurance Group (OMAG) Board elections. ITEM 4: REPORT FROM CITY COUNCILORS No Report. To be eligible for retirement benefits through OMRF an employee must have a minimum of five years of employment. Once an employee has five years of service the employee is considered vested and upon leaving employment with the City has three retirement options depending upon age. The first option, Normal Retirement, is available to a vested employee age 65 or older. The second option, Early Retirement, is available to a vested employee between ages 55 and 65, and the third option is Deferred Retirement. Deferred Retirement is an option available to vested employees under the age of 55. This allows an employee to "defer" retirement benefits to a future date, at which time the employee would begin receiving monthly retirement benefits. • F. Robert Carr, Jr resigned from the City of Owasso on October 20, 2004. At the time of his resignation Mr. Carr had been an employee of the City of Owasso and a participant in the OMRF retirement plan for eleven years. Mr. Carr has submitted an Application for Early Retirement effective June 1, 2011 and meets the required age prerequisite for Early Retirement, RECOMMENDATION: Staff recommends approval of F. Ray City Manager SUBJECT: Oklahoma Municipal Assurance Group (OMAG) Board of Trustees Election and Submission of Ballot DATE: May 13, 2010 BACKGROUND: The Oklahoma Municipal Assurance Group (OMAG) is an Oklahoma "Interlocal Cooperation Agency" formed in 1977 by the Oklahoma Municipal League and approximately 35 individual cities. The group was created in response to a crisis created by the withdrawal of municipal insurance coverage by most Oklahoma insurance companies. Finding themselves without liability coverage prompted the cities to join together to form what is termed as a "modified self insurance" program for its members. Since its formation, the agency/trust has evolved into a full service insurance provider for its members and currently offers liability, property, workers compensation, auto, and specialty insurance coverage to its members. Although the City of Owasso no longer purchases insurance from OMAG, the city remains a full member with voting rights. As an Interlocal Cooperative Agency, OMAG is governed by a Board of Trustees elected by the membership. Elections are held annually for a prescribed number of trustees. There are seven trustees serving terms of three years. Trustees must be elected from the officers and staff of member cities through a nomination and election process detailed in the organization's by-laws. This year, there are three (3) trustees with terms ending on June 30, 2011. The nominating process has produced ten (10) candidates for those three positions (see attachment). As a member of OMAG, Owasso may cast votes for three of the ten candidates. Members of OMAG must have their ballots returned by May 31, 2011 in order for their vote to be included in the final count. Upon completion of the count, the three nominees with the highest vote totals will be declared winners and will be seated effective July 1, 2011. The staff has reviewed the biographical sketches of the 10 nominees and feels comfortable in making a recommendation to the Council regarding the election. PROPOSED ACTION: Staff recommends Council approval of an OMAG ballot that casts Owasso's votes for Ms. Janice Cain (City Administrator, City of Marlow), Ms. Pam Polk (City Manager, City of Collinsville), and Mr. Craig Stephenson (City Manager, City of Ponca City); and that the Mayor be authorized to execute the official ballot on behalf of the city. On December 7, 2009 Ordinance #953 was recorded in Tulsa County. These two ordinances relate to a project known as the Encore at Elm Creek, an +/-18 acre planned unit development comprised of commercial and multi-family residential uses located at the northwest corner of 1 16th Street North (SH-20) and 145th East Ave. Ordinance #953 involved the annexation of the property and Ordinance #962 recorded the zoning on the property as OPUD 09-01, with underlying zoning of multi-family residential and commercial general zoning districts. On December 9, 2009 the Tulsa County Assessor's office brought to the attention of the City Planner an error with Ordinance #953 (Annexation Ordinance). The utility easement closure request involves a portion of a larger utility easement as described and referenced in Book 1841, Page 878, which also covers Lake Valley II and Lake Valley IV. The right-of-way closure request simply involves the closure of a platted but unopened portion of East 1 10th Street North (see Exhibit "A-2"). On April 11, 2011 the Owasso Planning Commission reviewed and approved the Conditional Final Plat for Lake Valley IV Extended, and the City Council subsequently approved the same request on April 19, 2011. The request was approved subject to addressing the Technical Advisory Committee (TAC) comments, one of which was to officially close the right-of-way and utility easement described above. This process will ensure that the future owners of the lots within Lake Valley IV Extended will have clean titles to their property. The right-of-way exists in paper form only and does not exist physically. TO: The Honorable Mayor and City Council City of Owasso FROM: Roger Stevens Public Works Director SUBJECT: Recommendation for Contract Award Three Lakes Pond Maintenance Project DATE: May 13, 2011 BACKGROUND: The Three Lakes Pond was constructed in 1977 as part of Three Lakes Addition, and serves as an integral part of the City of Owasso stormwater detention system, along with the vacant land surrounding the pond. The pond is owned by the Three Lakes Home Owners Association and is located south of E. 86th Street North behind the retail area containing Blockbuster, Shell Gas Station, Goodwill Store, and Homes Unlimited offices. In 2005, the Owasso Stormwater Master Plan, completed by Meshek and Associates, recommended improvements to the Three Lakes pond due to inadequate detention storage necessary for fully urbanized conditions. Over time, the footprint of the pond has been reduced due to bank degradation and silt deposits from upstream erosion. As a result, the pond's detention volume and flood plain storage has been significantly reduced. In 2010, City staff met with the Three Lakes Home Owners Association and acquired a temporary construction easement. Once the easement was obtained, the City of Owasso Engineering Division began a design to address the removal of silt and re-establishment of the pond bank in order to increase detention volume and flood plain storage. ENGINEERING AND DESIGN: The project is divided into three phases due to the Engineer's estimate that the total project, as recommended in the Stormwater Master Plan, has an approximate cost of $700,000. In order to address the initial phase of improvements, the Engineering Division determined the base bid for Phase I should include the removal of 3.5 feet of silt from the northeast section of the pond. In addition, four alternate bids were designed that would remove additional silt in one foot increments to further reduce the possibility of algae growth and other aquatic plants. Phases 11 and III will address continued removal of silt from the remaining areas of the pond, as well as the expansion of the pond itself. The engineering estimate included $118,357 for the Base Bid and $72,638 for the four alternate bids, for a total engineering estimate of $190,995. SOLICIATION OF BIDS: In March 2011, the engineering design was completed, and an advertisement for bids was published in accordance with state statutes. The bid opening occurred in April with a total of six contractors submitting bids. At that time, the City contracted with SCI to provide an analysis of needs for GIS and developed the first system utilized by City Staff. The purpose of the City's GIS project was to take large amounts of data and associate it with parcels or GPS coordinates to provide the ability to view the data in the form of a map. GIS TODAY: The ability to view layers of data on a map provides many benefits to staff. It provides a snapshot of the City's assets, or historic data, allowing staff to analyze trends and future needs. For example, Public Works can view the sewer infrastructure on a map. More importantly, however, is the ability through GIS to view the locations of repairs to the sewer system to allow for better planning for upgrades to the system as some of the infrastructure ages and needs to be replaced. GIS provides the ability to upload data to allow departments to view trends and provide the resources to respond to the trends in a more efficient and effective manner. One of the greatest benefits of a GIS system is the ability to view unrelated bits of data on a map. For example, if the police department were to experience a significant number of accidents at an intersection viewed that data on a map compared to road repairs in the area, the result might show staff a relationship between the two. Perhaps road conditions are contributing to the accidents and needs to be addressed. Staff is pleased to have the opportunity to demonstrate enhancements to the City's GIS system that make it easier and quicker for staff to access vital GIS data each day, and assist in the work that needs to be completed by the City. In addition to the City's utilization of the GIS system, the public can also benefit from access to the City's GIS. The GIS viewer is available online and can be accessed to benefit citizens, developers, as well as, prospective businesses. The CIS viewer has recently been upgraded and is now much easier for staff and the public to access data that improves their quality of life by making maps of Owasso data much more useful and easier to generate.
