LOCATION The property is located southwest of the intersection of E. 96th Street North and N. 145th East Avenue. A general area map has been attached for your review. EXISTING LAND USE Undeveloped North: Residential South: Undeveloped/Residential East: Commercial Nest: Residential PRE' SENT ZONING AG (Agriculture Distriet) — Tulsa County DEVELOPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the City limits is made a part of the City. property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning, When a property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In order to develop the property, the land must be zoned for particular binds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Faster plan. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. ANNEXATION RE' VIEW PROCESS The annexation process is initiated when a property owner submits a petition to the City of Owasso requesting that the City bring the property into the City limits. The applicant must submit as part of the request a signed petition requesting the annexation, an accurate legal description and map of the property being requested for annexation and a certified 300' radius report so that staff may send legal notices to surrounding property owners. Upon receipt of all appropriate materials the staff initiates the review process which begins with a thorough analysis of the request. The primary consideration is the property's compliance with the Owasso Annexation Policy. The policy establishes a set of guidelines that define which properties are considered for annexation. The annexation request is then presented to the Owasso Annexation Committee for review and recommendation. The Annexation Committee is made up of staff, elected officials and citizens. The Committee reviews the petition for compliance with the Annexation Policy and establishes a recommendation to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the property is compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso City Council. The Owasso City Council will make the final determination to annex the property or refuse annexation. If the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. CONSIDERATIONS OF AN ANNEXATION The following annexation policy for the City of Owasso is provided as a guideline and should not be constructed as inflexible requirements for annexation. I . While there is no minimum tract size, properties of larger than 20 acres are preferable. 1 All properties should be contiguous to existing City Limits. 3. All properties should be annexed into the City limits as the lowest zoning classification, that is, Agricultural (AG). Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the City will be legal, but nonconforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not meet City standards will not be improved by the City until brought to the City standard and accepted by the City Council. Such public facilities must be improved at owner's expense by the establishment of a special assessment district or some other financing method. 5. Where a City limit boundary ends at a dedicated street, the boundary will not include the street right-of-way. This policy will establish consistency and allow City employees and citizens to know where the City boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. ANALYSIS Staff received a petition from Kellogg Engineering, requesting the City to annex approximately 34 acres of property. At this time it is our understanding the applicant is requesting this annexation petition in order to begin a process that will result in the development of residential property. The request is consistent with the Owasso 2015 Land Use Master Plan as it calls for residential development in the area. If the property is annexed into the City the applicant will be required to follow normal development procedures which would include rezoning, preliminary and final plat review. If annexed, any development proposed for the property would be required to meet the Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering standards as proscribed by Public Works including but not limited to paved streets and sidewalks. The property would be served water and sewer by the City of Owasso. In regards to the Owasso Annexation Policy the request is larger than 20 acres and it is contiguous to existing City limits. No public infrastructure or development currently exists on the property; all public improvements will be made by the developer. If annexed, the subject property will acquire an AG (Agricultural District) zoning designation. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. O ASSO ANNEXATION COMMITTEE At their October 26, 2005 meeting the Owasso Annexation Committee unanimously recommended approval of OA 05-09. ANALYSIS The applicant is requesting this review in order to facilitate commercial development on a 1.32 acre tract. The subject property is zoned CS Commercial Shopping Center District. According to the City of Owasso Zoning Code, uses allowed in CS districts include offices, studios, restaurants, convenience stores, shopping centers, service stations, etc. Since this is a one lot development there is no preliminary plat required. The proposed final plat satisfactorily meets the requirements established in the Owasso Zoning Code. Necessary utility easements have been established along the parameters of the proposed plat to accommodate essential utility placement and access. TECHNICAL ADVISORY COMMITTEE® The Owasso Technical Advisory Committee reviewed the final plat at the October 26, 2005 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and/or concerns. The following TAC recommendation was addressed: 1. Applicant must indicate a 20' easement on the west side to accommodate RWD-3 water line. 2. Applicant must provide standard language for water and electric in covenants. According to the Owasso Zoning Code, single family uses are included in Use Unit 6, and are allowed by right on property zoned RS®3. Whenever any subdivision of land is proposed, before any permit for the erection of a structure in such proposed subdivision shall be granted, the owner of the land or his agent shall apply for and secure both Planning Commission and City Council approval of a final plat for such proposed subdivision. The Final Plat review process gives the citizens of Owasso the opportunity to actively participate in the physical development and layout of the city. The development will be served by City of Owasso sewer and water by Rural Water District No. 3 — Washington County. Utility easements are established throughout the proposed addition so as to adequately accommodate utility services. Regional detention has been effectively addressed with the establishment of a detention facility located in the northeastern portion of the addition. The Final Plat meets Owasso Zoning Code Bulk and Area requirements. The lot and block specifications established in the plat layout are adequate for the development of single family homes. In a regional context, this proposed addition is in conformance with the Owasso 2015 Land Use Master Plan, as the area is forecasted for residential development. Already, there is an emerging pattern of relatively dense housing development occurring in the general area. TECHNICAL ADVISORY COMMITTEE. LOCATION The property is located on the east side of N 1291h East Avenue between E. 116th Street North and E. 126th Street North. A general area neap has been attached for your review. EXISTING LAND USE Undeveloped North: Residential South: Undeveloped/Residential East: Commercial West: Residential CONCEPT OF A PUD: The concept of a Planned Unit Development is to provide a creative alternative to conventional development where a particular tract is under common ownership or control and where a detailed development plan, outlining the development of the tract as a unit is proposed and submitted for public review. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete and coordinated plan of development for a larger parcel, rather than piecemeal individual changes using the variance process. The supplemental zoning district PUD must be approved by the City Council as a prerequisite to the Planned Unit Development. ANALYSIS OPUD 05-02 (Morrow Place) is a proposed planned unit development (PUD) comprised of 241.74 acres. The development concept behind the Morrow Place PUD is both commercial and residential. The applicant/owners of the property intend to develop both single family residential homes and commercial properties on the subject site. The PUD is divided into five various development areas, each with a unique set of development standards. The residential areas (A-C) proposed for development will vary in lot size and dwelling sizes in order to provide a greater variety of housing types. Although specific commercial uses are not known at this time, the configuration of the commercial area maximizes the highway and arterial street frontages. Commercial uses are highly restricted and limited to only those uses appropriate with the surrounding uses. Development area A (Residential single-family): Land Area: 67.08 acres Maximum Number of Dwelling Units: 271 Minimum Lot Area: 9,000 sf Development area l3 (Residential single-family): Land Area: 41.82 acres Maximum Number of Dwelling Units: 252 Minimum Lot Area: 7,200 sf Development area C (Residential single-family): Land Area: 31.84 acres Maximum Number of Dwelling Units: 133 Minimum Lot Area: 5,500 sf Development area C (Commercial): Maximum door Area Ratio:.75 The subject PUD application is part of a continuance of direction in the overall development scheme for the area. As the market has evolved, the property owners feel it is appropriate and feasible to develop the area for residential purposes, as prescribed by the Master Land Use Plans of both Tulsa County and the City of Owasso, The staff concurs that a mixed use development would be consistent with the development pattern taking hold in north Owasso along the Owasso Expressway and this pattern of growth is compatible with the Owasso 2015 Land Use Master Plan. According to the Owasso Zoning Code, the Planning Commission shall hold a public hearing on any PUD application and determine the following: 1. Whether the PUD is consistent with the Comprehensive Plan, 2. Whether the PUD is in harmony with the existing and expected development of surrounding areas. 3. Whether the PUD is a unified treatment of the development possibilities of the project site. 4. Whether the PUD is consistent with the stated purpose and standards of the PUD ordinance. a. To permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; b. To permit flexibility within the development to best utilize the unique physical features of the particular site; c. To provide and preserve meaningful open space; and d. To achieve a continuity of function and design within the development. COMPREHENSIVE PLAN CONSISTENCY: The Owasso 2015 Land Use Master Plan identifies the subject property and its surroundings as having a future land use of both residential and commercial. As previously stated it is the desire of the applicants/owners to develop the area for mixed use. FUTURE PLANNING ISSUES: Future planning issues must still be considered if the PUD is approved. If approved, the applicant must submit a preliminary plat, infrastructure plans, and a final plat that must be approved by the City of Owasso. A property owners' association is proposed and at the platting stage of the development, detailed covenants and restrictions incorporating all conditions of the PUD will be submitted. Sidewalks will be required along all public rights -of -way associated with the subject property. Perimeter sidewalks must be installed at the time of overall development, while the internal walks may be constructed as individual lots are developed. The applicant has identified the terrain of the area as relatively flat terrain. The existing soils on the site would appear to create no unusual development problems that are not typically encountered in development in and around the City of Owasso. On -site detention is required and will be further defined at the platting stage. Any future development on the property will be served water and sanitary sewer by the City of Owasso. SUBJECT: DATE: November 3, 2005 BACKGROUND: In 1997, residents of the Three Lakes Village subdivision initially requested assistance from the City of Owasso for the repair of existing residential streets and drainage infrastructure. The subdivision, constructed in 1978, was platted with private roadways, exempting the developer from constructing the infrastructure according to City standards. As a result, the poorly constructed infrastructure has notably deteriorated through the years restricting the use of the roadways. In July 2005, following numerous pleas for assistance by area residents, City Council approved funding for street infrastructure repairs estimated at approximately $210,000. Partial funding was obtained from the Oklahoma Department of Commerce (ODOC) through a "Community Development Block Grant" in the amount of $66,450. Following approval of the project, staff initiated the preparation of bid documents for the Three Lakes Roadway Improvements Project. The work included the removal and replacement of over 5,300 square yards of existing pavement (approximately one mile of roadway) complete with new curb and guttering. The Engineering Estimate prepared following the completion of design documents was $260,000 (base bid only). The notable increase in construction cost was due to a considerable raise in costs of construction materials and methods since preliminary cost estimates were prepared in 2004. SOLICI'T'AT'ION OF BIDS - Notice to Bidders was published in the Owasso Reporter on October 4, 2005 for a bid opening on November 3, 2005. A mandatory pre -bid meeting was held at Owasso City Hall on October 24, 2005. EVALUATION OF OPTIONS: Funding in the amount of $ 144,000 was included in Street Department Budget, Line Item 01- 300m54213-036. Additional funding was provided by the Oklahoma Department of Commerce (ODOC) "Community Development Block Grant" in the amount of $66,450 for a total of $210,450. Thus, supplementary funding in the amount $217,445 is required to properly fund a contract award in the amount of $425,895. Because of the unexpected deficiency in available funding, on November 4, 2005, city staff met to discuss potential options to address the problem. Three options emerged as viable: (1) Abandon project, (2) Refine Scope and Rebid project, and (3) Award contract to Horizon Construction Company. - Abandon Project: First option is to abandon the project and call off the reconstruction of roadway infrastructure in the Three Lakes Village due to excessive cost. Preliminary cost -benefit analysis reveals that, as bid, the investment necessary for reconstruction of Three Lakes Village Street Reconstruction Project Bidding Results Page 3 of 4 the roadways represents nearly 15% of the estimated value of all residences located within the affected area. Refine Scope and Rebid: Reevaluating the scope of work could yield savings by eliminating items without sacrificing the quality of the product. Suitable items for elimination include provisions made simply to accommodate the needs of residents while streets are under construction. For example, Item 17 (see Bid Schedule) in the amount of $7,000 relates to the installation of four temporary communal mailboxes at the entrance of The Three Lakes Village to allow the continuation of mail delivery while the streets are under construction. Additional cost -reducing options include alternate construction phasing, concrete street cross-section and replacement/relocation of existing utilities. Award Contract: Finally, last option could be to pursue the award of the contract to Horizon Construction Company in the amount of $425,895 but eliminate those Items responsible for the majority of the discrepancy. If chosen, this option may reduce project construction costs to approximately $310,000. AMENDMENT R: ENGINEERINGDESIGN SERVICES AGREEMEN WATER SYSTEM IMPROVEMENTS DATE: November 3, 2005 BACKGROUND: In April 2004, the City of Tulsa provided a letter of commitment to the City of Owasso for the construction of the North Water Loop. Such loop would extend Tulsa's water service along N. Memorial Drive to approximately E. 106th Street North, allowing the City of Owasso to connect at the N. Memorial Drive and E. 106th Street North intersection. Following the receipt of the letter, the City of Owasso changed the alignment of its transmission main to accommodate the new location of the Tulsa Master Meter. In June 2004, City Council approved a new contract for Engineering Design Services for Water System Improvements with the Benham Companies, Inc. (Benham) in the amount of $204,925 (.Attachment A). The scope of work included the design of water transmission and distribution system improvements (to connect to the Bailey Ranch elevated water storage tank) as follows; — Transmission line (30Winch) between E. 1061h Street North and N. Memorial Drive and the new Bailey Ranch elevated storage tank; — Transmission line (24-inch) between the storage tank and E. 99th Street North and N. Garnett Road; — A booster pump station to be located in the base of the Bailey Ranch storage tank; -- A master meter vault at E. 106th Street North and N. Memorial Drive and necessary interconnections to the existing service system. SCOPE OF WORD CHANGES - In February 2005, the City of Tulsa changed the alignment of the North Water Loop — and consequently to the proposed connection point to the Owasso transmission main — from N. Memorial to N. Sheridan Road to facilitate expeditious construction of the infrastructure. Accordingly, the City of Owasso once again changed plans to accommodate the newly proposed Tulsa Master Meter location at E. 106"' Street North and N. Sheridan Road. Water System Improvements Engineering Services Agreement Amendment No. 1 Page 2 of 2 In September 2005, following the start-up of the new Bailey Ranch elevated storage tank, City of Owasso staff initiated pilot testing to asses the feasibility of using the existing US Highway 169 water tower to serve the City's low pressure areas. Per the 2000 Water Master Plan, the US 169 tower was to be taken out -of -service requiring the construction of a new tower (under Phase III of the Water System Improvements to be completed by 2010) to service the low pressure areas. The pilot testing revealed that Phase III work could be eliminated, by constructing a new waterline under US Highway 169, resulting in significant savings to the City of Owasso. This new line will allow the separation of the two pressure zones by connecting the existing US 169 tower (via the newly constructed waterline located along the Owasso Expressway) to the City's low pressure system. AMENDMENT NO. 1 In October 2005, following the Owasso Public Works Authority's approval of the Water Supply Agreement with the Tulsa Metropolitan Utility Authority, Benham submitted Amendment No. 1 in the amount of $132,797 for work to be performed outside of the scope of work detailed in the original Agreement (see Attachment B). The additional work includes surveying, engineering and construction administration for the additional mile of 30-inch water transmission line (from North Sheridan to North Memorial Road) and the US Highway 169 waterline crossing (see Attachment C). It is worth mentioning that one additional Amendment (for approximately $50,000) is expected to be received for the performance of additional surveying and engineering work not included in the original scope of services. The work includes the design of an 8-inch service line (to parallel the 30-inch transmission main between North Sheridan and North Memorial Road) and additional hydraulic modeling to update the current Water Master Plan. It is expected that the service line will aid right-of-way negotiations and afford the opportunity to extend water service to an undeveloped area. The desired additional hydraulic modeling will assist in the planning for orderly and efficient water infrastructure development, expansion and upgrading — updating the now obsolete modeling performed under the Water Master Plan. Submit estimated Total PROJECT Cost including construction, utility relocations, and engineering costs. 9.4. GENERAL SERVICES DURING BIDDING AND CONSTRUCTION PHASE. Upon approval of the Final Design Documents, and upon City of Owasso, Oklahoma Upper Service Plane Water Systems Improvements Engineering Services Agreement Page 14 receipt of a Notice to Proceed, the ENGINEER shall provide the followi SERVICES. The Work performed during this phase of the SERVICEI shall include, but is not necessarily limited to the following tasks: 1. Provide assistance to the CITY during the bidding process, a. Prepare proposal and bid Documents and submit plans and proposal to be used in the bidding process. b. Conduct the pre -bid conference. C. Prepare any addenda. d. Prepare bid tabulations. e. Analyze bids and make recommendation for award of the construction Contract. 2. Conduct the pre -work conference and furnish advice to the CITY as requested. 3. Review and approve Contractor's shop Drawings and material testing submittals. 4. `!'isit the site of the various construction activities from time-to-fil throughout the construction period to ascertain the gone progress of the projects. 5. Provide general assistance to the the CONTRACTOR and CITY with the start-up and commissioning of the booster pump station. 6. Furnish "As -Built" drawings from Inspector's Notes within 45 days of receiving said notes. "As-Builts" will be provided on CD in computerized format. RESPONSIBILITIES OF THE AUTHORITY, The CITY shall provide the information and services as provided herein in a manner that causes no delays the performance o . SERVICES b e ENGINEER. . 1 INFORMATION, The CITY shall furnish, as requested and required by the ENGINEER and at no expense to the ENGINEER, information relative to the design and construction of the PROJECT. C.1.1 Records, reports, studies, plans, drawings, and any other da available in the files of the AUTHORITY, which may be useful in the wori involved under shallC.2 ACCESS. The AUTHORITY ENGINEER to enter upon public or private property as required for the ENGINEER to perform his SERVICES under this AGREEMENT. %-.3 STAFF ASSISTANCE. The CITY shall designate in writing one person to act as its representative with respect to the SERVICES to be provided under this AGREEMENT, and such person shall have complete authority to transmit instructions, receive information, and interpret and define CITY policies #:decisions with respect to materials, pertinent to the SERVICES covered by this AGREEMENT. Additional staff assistance may be provided as necessary to assist and expedite the PROJECT in those areas outside of the ENGINEER'S areas of responsibility, to specifically include- C3o1 Furnish legal assistance as required in the preparation, review and approval of Construction Documents. C.3.2 Furnish staff assistance to coordinate with the utility companies locating, exposing and relocating existing utilities and/or theirproposed future extensions. The CITY shall examine all studies, reports, sketches, estimates, Specifications, Drawings, proposals, and other Documents presented by the ENGINEER and the CITY shall render in writing all decisions pertaining thereto within a reasonable time so as not to delay the SERVICES of the ENGINEER. C.5 MISCELLANEOUS ACTIVITIES. The CITY shall be responsible for the conformance of construction contract documents, oversee and direct Contractors' assembly of bonds and affidavits, and approve and execute same. COMPENSATION. The CITY agrees to pay, as compensation for services set forth in Attachment B, the following fees, payable monthly as the work progresses; and within 30 calendar days of receipt of invoice. ENGINEER shall submit monthly invoices based upon services actually completed at the time of billing. D.5.2 If the CITY fails to make payments due ENGINEER within sixty days of the submittal of any progress payment invoice, ENGINEER may, after giving fifteen days written notice to CITY, suspend services under this AGREEMENT. D.5.3 If the project is delayed, or if ENGINEER's services for the PROJECT are depayed or suspended for more than ninety days for reasons beyond ENGINEER's control, ENGINEER may, after giving fifteen day's written notice to CITY, request renegotiations of compensation, or may terminate the AGREEMENT. The Water Systems Component Design project (hereinafter referred to as "PROJECT") shall consist of the design of ® a 2 million gallon elevated composite water storage tank, ® a 30minch water transmission line (to be called "Phase 1 Transmission Line") from East 106th Street North and North Mingo Road to said water storage tank, a 24-inch water transmission line (also a part of the "Phase 1 Transmission Line") from said water storage tank to North Garnett Load and thence south to connect to the existing CITY system, a booster pump station located in the base of the storage tank structure, a 30-inch wafter transmission line (to be called "Phase 2 Transmission Line") from East 106th Street North and North Sheridan Road to East 106th Street North and North Mingo Road," and a connection of the existing HWY-169 water tower to the CITY lower water pressure zone. 2. Add subparagraph B.2.2.6 as followl 1 "B.2.2.6 Phase 2 Transmission Line. The ENGINEER shall confirm the feasibility of connecting to the City of Tulsa transmission system at East 106th Street North and North Sheridan Road and revise and update the hydraulic analyses, model and computations associated with such connection. The ENGINEER will also coordinate with the CITY and City of Tulsa Public Works Department personnel to determine operating parameters and hydraulics necessary for the design of such transmission line and booster pump station. 3. So much of paragraph B.3.4 Plans and Specifications is changed to read as follows: "The ENGINEER shall complete the preparation of construction plans and specifications for the design selected in the Phase I - Design Report, amendments thereto, or related instructions from the CITY, specifically including the design of approximately 10,600 feet of 30-inch transmission line from East 106th Street North and North Sheridan Road to East 106th Street North and North Mingo Road, design of a booster pump station in the base of the elevated storage tower, and redesign of the valving and mode of operation of the transmission lines to said water tower. In addition, evaluate and make recommendations and prepare construction plans for the design of a new water line under HWY-169 to connect the existing HWY-169 water tower to the lower pressure zone. The overall PROJECT shall proceed in three phases and bid as three separate construction contracts. 4. Paragraph "D.3", previously changed from Paragraph "C.3" in Attachment D, is changed in its entirety to read as follows: "D.3 For the work under Phase No. 2 ATTACHMENT B, paragraph B.3 and amendments thereto, the CITY shall pay the ENGINEER a lump sum of $112,797.00 (One hundred thirty-two thousand seven hundred ninety-seven dollars)." 5. Paragraph DA is added as follows: "DA A Revised Engineering Fee Computation spreadsheet is enclosed herewith, which spreadsheet is a recapitulation of changes provided by this Addendum. For engineering services on all hales of fihe work, the CITY shall pay the ENGINEER a lump sum of $137,722.00 (Three hundred thirty-seven thousand seven hundred twenty-two dollars), which total amount shall not be exceeded without written addendum hereto." 6. The net effect of this amendment is to include an additional mile of 30-inch ransmission line to the project and to the associated engineering services including environmental information document revisions, archaeological studies, and right of way documents. All of services required of the ENGINEER in the preparation of the design, including surveying, bidding services, and construction administration, I common to other phases of the work heretofore enumerated, shall apply and become a part of the required services contemplated under this Amendment. 8. The undersigned specifically warrants and certifies that The BENHAM COMPANIES, LLC, is a successor company of THE BENHAM COMPANIES, INC., and the original signatory hereto and that said individual is an officer thereof and duly authorized to sign this amendment by resolution of the Board of Directors. The attached ordinance was drafted in accordance with direction provided by the Council following discussions during the September and October work sessions. In summary, the ordinance provides as follows: 1. Individuals appointed to boards and commissions with three year terms of service shall be limited to three consecutive terms of service not to exceed nine total years of consecutive service. 2. Individuals appointed to boards and commissions with one year terms of service shall be limited to nine consecutive terms of service not to exceed nine total years of consecutive service. 3. In.di.viduals appointed to the Owasso Economic Development Authority shall be limited to two consecutive terms of service not to exceed ten total years of consecutive service. 4, If an individual is appointed to fulfill the remainder of another individual's term of service, the remainder of that term shall count as one term for purposes of this ordinance. An individual who has served the maximum number of consecutive terms may be reappointed to a board or commission following the elapse of one year from the individual's final day of service on the board or commission. However, an individual who has served the maximum length of time on one board or commission may immediately be appointed to a different board or cornmissron. 6. Term limitations of service shall not be applicable to City of Owasso staff members who are appointed to boards and commissions pursuant to their position of employment. 7. The maximum number of years and terms an individual may serve pursuant to this ordinance shall begin to accrue for appointments made by the Council subsequent to the effective date of this ordinance. The number of years and terms served prior to that date shall not be counted in determining the length of time an individual may serve on a board or commission. In accordance with this request, staff has drafted a proposed ordinance for the council's consideration which restricts the length of service for board and commission members to two consecutive terms of office, with eligibility for subsequent appointment after two years of non - service. 1 A term limits ordinance restricting the eligible pool of persons who may seep appointment to a municipal board or commission raises potential constitutional questions. Possible implications are an infringement upon the fundamental constitutional rights of equal protection, liberty and the right of association, as well as procedural safeguards requiring that the council possess the authority to adopt an ordinance of this type. While there are no Oklahoma or federal judicial decisions addressing the constitutionality of term limits for those appointed to municipal boards and commissions, a number of courts have considered the constitutionality of term limits imposed by ordinance on municipal elected officials. These decisions have regularly upheld municipal term limits against substantive challenges asserted by both elected officials and the voting public under both the federal constitution and various state constitutions. [See Dutmer v. City of San Antonio, 937 F. Supp. 587 (W.D. Tex. 1996); Miyazawa v. City of Cincinnati, 825 F. Supp. 816 (S.D. Ohio 1993), aff'd 45 F.3d 126 (6th Cir. 1995); Rudeen v. Denarrusa, 136 Idaho 560, 38 P.3d 595 (2001); Roth v. Cuevas, 158 Misc. 2d 238 (Sup. Ct. NY Co.), aff'd 603 Ny.Y.S.2d 736 (App. Div. 1st Dept.) aff d 82 N.Y. 2d 791, 624 N.E. 689 (1993).] These decisions upheld the constitutionality of municipal term limits utilizing varied analytical approaches and legal reasoning. It is reasonable to assume that the framework for analyzing the constitutionality of an ordinance imposing term limits upon appointed board and commission members would not differ substantially or result in a different outcome than the cases cited above. A higher constitutional priority is generally imposed upon the right to seek elected office than the right to seek an appointment. Therefore, recognizing that the courts have traditionally upheld term limitations placed upon elective offices, it is reasonable and sound to conclude that an ordinance establishing term limits for appointed officials would also be judicially valid and defensible. The primary requirements for an ordinance of this type to be deemed constitutionally valid are twofold. First, the ordinance, on its face and in actual application, must be neither arbitrary or capricious. Second, the method utilized by the ordinance to achieve its goal must bear a rational relationship to the objective sought to be accomplished. These inquiries are generally satisfied if the law applies to all candidates equally and is designed to accomplish a legitimate governmental purpose. In this case, the proposed ordinance would be applied to all appointees across the board, and would thus satisfy the first prong of that requirement. In addition, the purposes of the ordinance, to broaden community access to public service opportunities and ensure that the appointment process is fundamentally inclusive, are clearly legitimate public purposes which satisfy the second prong of the rational basis test. Upon determination that an ordinance establishing term limits for boards and commission members can reasonably be anticipated to survive challenges to its constitutionality, a second legal and procedural issue should be considered: Does the council have the authority to impose a qualifications of eligibility requirement upon board and commission appointees? Evaluation of this issue is compelled by decisions from several state courts nullifying ordinances of this type on the grounds that the city council lacked proper authority to enact the ordinance. A review of these decisions, however, reveals that the courts rendering these rulings did so based upon limiting language found in that state's constitution. This type of prcclusionary language is typically found in what is labeled a "qualifications clause" or "universal eligibility clause." These clauses usually provide that every citizen, who is a legal resident of the state and a qualified elector, shall be eligible to hold any public office, and this has been interpreted to mean both elective and by appointment. (Specifically, the New Hampshire, Minnesota and New Mexico state constitutions, as well as others, contain provisions of this type and the courts of those states have held that its municipalities do not have authority to impose additional eligibility requirements upon public office holders.) Indeed, if a state's constitution contains a provision such as this, any legislative modification which alters or creates requirements to serve must be done by state constitutional amendment. Oklahoma's constitution does not contain a qualifications or public eligibility clause which would prohibit a municipality within this state from adopting a term limits ordinance. The Owasso City Charter specifically adopts and exercises the powers of home- rule granted by both the constitution I and statutes of the State of Oklahoma, and additionally reserves unto itself the fullest powers possible for a city operating under a home- rule charter. Accordingly, based upon the fact that the Oklahoma constitution contains no language legally precluding imposition of a term limits ordinance, and bolstered by the city's manifest appropriation of home -rule powers, it is reasonable to conclude that the council is empowered to implement term limit restrictions if it so chooses. Other Issues for Consideration The following are additional considerations and issues the council may wish to reflect upon in its evaluation of this proposed ordinance: ® Does the proposed ordinance address an issue of sufficient significance to warrant imposition of a uniform rule, or is the matter best considered on a case -by -case basis? Will the promulgation of a term limits restriction enhance and benefit the functionality and operation of the city's boards and municipalities? ® How might adoption of term limits affect composition of the boards and commissions from the perspectives of leadership, experience and the desire and willingness of individuals to continue service in excess of two terms? ® The proposed ordinance restricts board and commission appointees to two terms. Is this the desired length of maximum service? The ordinance additionally provides that an individual may be reappointed to a board or commission once two years have elapsed since he or she previously completed a term of appointment on that board or commission. Does the council wish to include a reappointment provision such as this within the proposed ordinance? If so, is the two year elapse time adequate or should it be lengthier? Should a person who concludes their service on one board or commission immediately be eligible for appointment to another board or commission? w If an ordinance of this type is adopted, should the ordinance dictate that the term limit be imposed upon the effective date of the ordinance, or at the beginning of an individual's next term of office? In other words, should the ordinance be made applicable to those already serving board and commission terms, or should the term limit requirement become effective only upon the next set of board and commission appointments? The above are issues for the council's consideration and discussion prior to making a determination regarding the desirability and efficacy of the proposed ordinance. ATTACHMENTS Proposed Ordinance M TO: THE HONORABLE MAYOR AND CITE' COUNCIL CITY OF O ASSO FROM: O1 CITY MANAGER BACKGROUND: Pursuant to direction from the City Council, I have researched several areas of information that relate to recent discussions regarding the question of implementing "term limits" on appointees to the City's Boards, Committees, and Commissions. Additionally, I have conducted interviews with eleven other cities to determine what practices are in place in similar municipalities. Attached for your review is a matrix of City appointments showing the Board or Commission, the length of term of the appointment, and the appointing authority. The matrix clearly indicates the majority of appointments are for a term of either three years or one year. Only the OEDA has a term significantly different from the majority and it is for five years. Based on discussions conducted during the creation of the OEDA, the reasons for the five year term were to: 1) build stability in the authority; 2) create a group that would represent to prospects a consistency of policy while their business was starting up in its Owasso location; and, 3) to build experience within the authority as the activities of the OEDA expanded. Also attached for your review is a list of municipalities contacted for the purpose of determining what, if any, was a. prevailing practice. It should be noted that such information is "data only" and that the reporting of a preponderance of the use of one or another approach does not include the rational behind these decisions. According to the interviews conducted, four cities have some form of "term limits" on appointed Boards and Commissions. The remaining seven cities do not use any form of limits on appointments; and, one city indicated, when asked if there were discussions about implementing term limits, that such an action was being contemplated. It should be noted that three of the cities interviewed also have term limits on elected members of the Council. Generally, those, cities that have term limits use a "two term" limit, defining that, as being allowed to serve two full terms (a portion of a term is not considered in the calculation). Thus, the move toward such limitations seems to be a recent phenomenon. Trustor, Sherry Bishop, requests amendment to the Declaration of Trust from Trustees. Presumably, this is done at the request of the Beneficiary. Step 2. Owasso Economic Development Authority Trustees vote to amend the Declaration (or deny such). Step 3. Trustees and Trustor execute amendment to Declaration of Trust. If vote in step 2 passes by a majority of the Trustees. Step 4. City Council passes Resolution re -accepting the beneficial interest in the Oklahoma Economic Development Authority. Resolution must be passed by a 2/3 vote. Step 5. Amended Declaration is appropriately filed. It should be noted that the above described process would require approximately two months. RAY CITY -_ IR ... �, j'� _ rt c DATE: November 4, 2005 BACKGROUND Since 1989 citizens of Tulsa County have utilized an "enhanced" 911 emergency telephone notification system. That system was made possible by a voter approved tax imposed on every telephone "land" line in the county. The tax funded the necessary technology and equipment in each of the county's cities. This "enhanced" system identifies the caller's address and telephone number immediately and allows for the dispatch of emergency services, even if the caller can't communicate with the E-911 operator. It is indisputable that this system has "saved" many lives. When compared to the original 911 system, the E-911 program is much advanced. Today however, there is a growing problem and a public safety concern. Traditional "land" lines arc being abandoned in favor of high-tech cellular phones. The number of "land" lines is decreasing rapidly, while the number of cell phones is increasing at an even faster pace. The teclulology to "pinpoint" the exact location of a caller using a cell phone is available, thus making the expansion of the enhanced 911 system to cell phones and important public safety issue (currently, there is no personal or location information available when a cell phone is used to call an emergency operator). When viewed in the context of "impact on services", the lack of an enhanced 911 system for cell phones is considered the most important public safety issue facing our cities today. Cell phone calls to 911 operators have increased to the point that they are now approximately 50% of all emergency calls made. The problem with existing technology is that it does not provide emergency dispatcher's with any location or phone number information. This problem is further compounded because cell phones operate on radio frequencies that often L6skip99 signals for hundreds of miles. Thus, a cell phone 911 call to Owasso emergency dispatchers could actually be coming :from the Kansas City or Oklahoma City area. When that occurs, there is absolutely no way to identify the location of the caller, absent the ability of the caller to speak (in many 911 calls the caller is injured or is unable to talk). E-911 Wireless Enhancements November 5, 2004 Page 2 of 2 During the last Oklahoma Legislative session, the legislature authorized the state's counties to levy a fifty -cent fee on each cell phone registered in that county for the purpose of implementing an "enhanced" 911 technology for cell phones. The legislation required all revenue from the fee to be specifically expended on the 911 cell phone location system. The fee, if approved by county voters, will remain in effect for an indefinite time period. The Tulsa County Commission (and 21 other counties) has called an election for Tuesday, December 13, 2005 to ask for voter approval of the E-911 cell phone fee. + QiJEST® The proposed Resolution (attached), if adopted, would formalize official support of voter approval of the cell phone fee question to be placed before the voters of Tulsa County on December 13, 2005. Today, more consumers are seeking wireless options as opposed to land line telephone services and, as a result, Emergency 911 could in essence become ineffective; and, WHERE AS, statewide, about one-half of the emergency calls received by Emergency 911 public safety agencies originate from a wireless phone. Wireless Emergency 911 calls do not provide enhanced information identifying the caller's name and location, nor is the technology in place to ensure the emergency call routes to the correct public service answering point; and, WHEREAS, unless an Emergency 911 wireless caller can identify their location to the dispatcher, the police, fire or emergency medical assistance will be delayed, thereby creating a unsafe environment for all citizens; and, WHERE, AS, the Federal Communications Commission has ordered wireless telephone companies to provide location information when an Emergency 911 call is received, however, the local public safety agencies do not have the technology necessary to receive, translate, and display the enhanced information, so that assistance can be dispatched to the wireless caller's location; and, WHERE AS, the Oklahoma Legislature has approved legislation calling for a county -wide vote for a 50 cent fee per month on wireless telephones to pay for enhanced wireless Emergency 911 equipment and services; and, WHERE AS, December 13, 2005 has been established as the date for the county -wide election; and, WHEREAS, the City of Owasso recognizes the importance of this proposition to the continuation of enhanced Emergency 911 services to its citizens. WirelessStraight Answers about 1 �rMINIMUM I iiiiiiiiii I III I I SIR IN FIRM I IN III, A: Wireless and cell phones don't work the same way as traditional land line phones when it comes to compatibility with the 9-1-1 emergency phone system. The landline 9-1-1 system uses traditional phone lines and computer databases that route calls to the right place, provide a caller's phone number and address, and the public service departments that service the caller's location whenever they call 9-1-1. Since the phone call emanates from a stationary location, the current 9-1-1 landline system is incredibly effective and accurate. Cell phones calls to 9-1-1 are not stationary, and because of this, finding someone in need is largely dependent on the ability of the caller to articulate the incident and location. Technology is available that can remedy this situation, but it costs money to develop, operate and implement. Q: Why is there such urgency for this measure? A: Since the proliferation and affordability of cellular technology, the number of wireless phone users in the Tulsa County area has grown enormously. An average of 1,000 people a month are also unplugging their traditional land line phones in favor of mobile technology. Currently, over 50 percent of 9-1-1 calls in the region come from wireless phones. It takes dispatchers three times longer to process wireless calls, due to the lack of information that would normally accompany a landline call. Incoming crisis calls without traditional enhanced 9-1-1 service are each a potential crisis themselves. m What axe I being asked to vote for on December 1.3? Ae On December 13, voters in twenty one counties will go to the polls to vote on the approval of a 50 cent monthly user fee on cell phone balls. The funding will be used to improve the enhanced 9-1-1 system to make the system more compatible with wireless phones, particularly with providing essential location information that is needed in an emergency situation. 11 Why does this phone service fee require A: The wireless initiative is a perfect example of intergovernmental and participatory public policy. It has involved multiple parties working in collaboration for the past few years. The Federal Communications Commission (FCC), which regulates interstate communications, requires wireless carriers to make Phase II location technology available for order by December 31, 2005. Phase II technology is the core technology that enables the system to route appropriately and give a latitude and longitude of the caller. State legislation passed in the spring allows the people to approve a user fee of 50 cents per subscriber per month. Governor Brad Henry signed the bill into law in June. A: The 50 cents that is collected from each wireless phone user per month goes to a dedicated fund that is used to upgrade the 9-1-1 network, the requisite databases and software that make up the system, equipment at each area answering point, training needed to operate the software, and GIS mapping and development. A: Since the enhanced 9-1-1 system came online in 1989, it has been funded by a three to five percent service charge on residential and business phone lines. Because of the variances in phone plans and residential and business rates, the average landline 9-1-1 service charge per month is approximately 63 cents. So, the 50 cents per month for wireless subscribers is comparable and even lower than what most people are paying now for landline. In some states, the service charge for wireless 9-1-1 is up to three dollars a month. Thirty-one states have established rates above 50 cents. Eight states are set at 50 cents, and the remaining states either have lower rates, or have not established a rate plan, or use alternative cost recovery mechanisms. Q: If the election is successful on December 13, how long will it be before znhanced 9-1-1 is c:ti A: It will take from 12 to 18 months to build -out and implement the new system. The deployment of wireless 9-1-1 requires the development of new technologies and upgrades to local answering centers, as well as coordination among many public safety agencies, seven wireless carriers, multiple technology vendors, equipment manufacturers and local landline carriers. N Qa How does "wireless enhanced 9®1®1" work? A: There are two primary location technologies that can be used with the wireless 9- 1-1 system. The first one is called GSM (Global System for Mobile communications), and it utilizes a global positioning system chip in the telephone that transmits latitude and longitude information through satellites and cell phone towers. The second method is called "triangulation," and it uses several wireless towers in the area working in unison to triangulate and estimate the location of the call by providing latitude and longitude coordinates. The latitude and longitude data works through a map that the dispatcher will have on a computer screen, which will pinpoint the caller's location and provide directions to responding police, fire and EMS units. QDoes A: Local governments, police and call -takers do not have the capability to track or follow citizens and cell phone users with this system. The only way that the location system is activated is when a 9®1®1 call is made. A: The FCC's Phase II rules require wireless carriers to provide location information within 50 to 300 meters nationally. Areas having implemented the system are experiencing greater accuracy. A: If the election fails, the current 9®1-1 system will likely deteriorate as more and more people switch to wireless phones. When people unplug their landline phones, the revenue stream that currently finances the system may get reduced to the point where it may no longer be feasible or financially viable for communities to offer enhanced 9-1-1 service. Also, since it takes dispatchers longer to process wireless calls, it will "slow down" the system, and more people and property will be placed in danger as emergency service responders will not be able to arrive in a timely fashion. QQ Where are 9-1-1 Calls Answered? A: There are answering points throughout the region. Generally, landline 9m 1®1 calls are answered by the municipality where the call originates. For wireless calls, the call generally goes to the nearest cell tower. Because of this, the call can sometimes go to a different municipality, and then need to be transferred, which lengthens the time to process the call. The new improved system will reduce the number of times this happens. �3 A: Regional police, fire and medical departments support this initiative in full because it will save lives and property and secures the safety of the citizens of Oklahoma. Emergency 9-1-1 dispatchers are particularly supportive because of the frustration and angst they feel when they cannot respond to a caller in need. Qm Until improvements are made, how should I respond if I have to call 9-1-1 from my cell phone? A: Emergency calls from wireless phones may not automatically route to the appropriate 9-1-1 call center, or provide all of the details that a call -taker needs. So, callers should be prepared to say what community they are in and, as much as possible, their specific location. Also, the caller must be patient in case the phone call needs to be transferred to the appropriate call center. When making a wireless 9-1-1 call you must tell the call -taker the city that you are calling from, the address of where the emergency is, or recognizable streets or landmarks that can help guide a rescuer. Additionally, as delay on arterials has increased, some motorists have decided to bypass the congested arterials and use neighborhood streets to get from one arterial to another or as a shortcut to their destination. When concerns regarding traffic speeds, pedestrian safety and cut -through traffic arise in residential areas, it is often frustrating for both residents and traffic engineers. Neighborhoods often request a quick fix solution such as enforcement, reduction in posted speed limits or the addition of stop signs. This type of fix often increases the pressure to implement haphazard solutions that may not be in the best interests of the neighborhood, the city or the traveling public. Traffic calming involves the application of engineering techniques to physically change the character of streets, improve pedestrian safety and encourage drivers to obey speed limits. A variety of physical devices can be used to alter the geometry of the street, along with more traditional traffic engineering techniques to slow traffic. Generally, a successful traffic calming plan is not a single device, but rather- a series of integrated improvements to slow traffic and/or direct traffic to more appropriate routes. The use of traffic calming devices must be carefully documented so that they are not used inappropriately or too frequently. A four -phased procedure is typically used by which traffic calming devices are requested, evaluated for appropriateness and implemented: • Documentation of the problem and the need for traffic calming devices; ® The collection of field reconnaissance and traffic study data; ® Selecting the proper device to correct the problem; and ® Monitoring the effectiveness of solving the problem once the devices) are installed. It is the intention of the City of Owasso Neighborhood Traffic Calming :Program to address traffic problems and concerns on local streets and applies to all residential subdivision streets in the City of Owasso. While not intended to make streets play areas for children or adults, the Program is intended to generally improve safety for pedestrians, bicyclists and others who travel along or across these streets. Current City Practices The residential speed limit in the City of Owasso is 25 miles per hour. Initial attempts to provide traffic calming has centered around stop sign installations to affect speeding and cut -through drivers on collector and local residential streets. Since February 1995, the city has administered the Policy of Residential Neighborhood Traffic Control, This policy sought to discourage all traffic from traveling at excessive speeds through neighborhoods. As more multi -way stop signs are installed, there are fewer and fewer reasonably spaced locations for sign installations. Additionally, stop signs have not allows been effective and may present a greater risk due to Page 2 Neighborhood Traffic Calming Program driver failure to stop. These guidelines provide city officials and residents with the opportunity to recommend, select, analyze and critique measures aimed at improving traffic conditions in and around local neighborhoods. Proposed Traffic CalminLT Implementation Plan The Institute of Transportation Engineers (ITE) defines traffic calming in the following manner: "Traffic calming is the combination of mainly. physical measures that reduce the negative effects of motor vehicle use, alter driver behavior and improve conditions for non -motorized street users. " Depending on the specific location and the residential street classification, the purpose of traffic calming is to restore streets to their intended function to provide combinations of mobility and accessibility. Experiences in other localities have shown that traffic calming is not a program that can be implemented under strict guidelines. Various solutions are often available and a successful program depends on staff and citizens that are willing to work together toward a common goal. Recommended Practices Based on cost, ease of construction and availability of materials, the speed hump is recommended to be the primary traffic calming device for existing residential and collector streets in Owasso. In general, speed humps have been found to reduce traffic speed, volumes and accidents. In addition, they discourage through traffic from using a local street as an alternative route to inconvenient or congested arterial and collector streets. Traffic Calmir_a Process Planning The traffic calming process is planned at the neighborhood level, but implemented on an uninterrupted street segment basis. Planning on a neighborhood -wide basis will help to identify if solving a problem on one street shifts it to another street. Additionally, an opportunity to plan for a comprehensive series of devices that will work together to improve the traffic operations of a neighborhood will be used. Public Involvement A. successful traffic calming program must involve the public and clearly be understood by all participants. Participation by those living along the affected street and adjacent registered neighborhood associations is essential. Homeowners living along the affected street segment will be asked to complete petitions that account for their participation and either affirm or not affirm their support for the installation(s). The requester of the traffic calming device(s) will solicit the neighborhood(s) for signatures and submit the petition. Additionally, registered homeowner associations that are directly affected will be ask to complete a statement that acknowledges adjacent streets to the traffic calmed street may see an increase in traffic and/or speed. Page 3 Neighborhood Traffic Calming Program Funding Traffic calming measures will be funded using approved capital fiends included in the annual budget. Warranted and approved traffic calming measures will be identified and prioritized for installation according to the established criteria. The application date on approved installations will serve as secondary criteria. Installation will commence and continue based on the availability of capital funding as outlined in the current and adopted budget. Authority and Scope The Director of Public Works will administer the traffic calming program. In accordance with established procedures, the Director will have responsibility to develop application forms, install or remove traffic calming devices. The effective date for the traffic calming program is January 1, 2004. Page 4 Neighborhood Traffic Calming Program Procedure ® Receipt of Traffic Calming Request (Application) Requests for traffic calming measures can be made by individual residents or neighborhood associations using an application available from the Public Works Department. In addition, City staff may identify an area as a problem and a sponsor resident must be determined prior to the project proceeding forward in the manner described below. ® Acknowledgment .Acknowledgement will be sent to the individual (contact person) making the inquiry. That person must reside on the requested street segment within the boundaries defined on the traffic calming application. The acknowledgement will confirm that a study is underway and will indicate an anticipated completion date. Define the study area/problem To be eligible for consideration, a street must serve areas that are primarily residential. On finding that the identified street meets this standard and is eligible for traffic calming, the Public Works Department Engineering Division staff will identify the limits of the street to be subject to the study process. ® Collect DataNerify Problem Engineering Division staff will commence with both data collection and review of existing operational and geometric characteristics of the street in question. Eligibility for a traffic calming installation will be verified by checking collected data to the warrants and a review of the operational and geometric characteristics of the street segment. Data to determine warrants for the installation of the speed hump will be collected by Engineering Division staff. A street will warrant traffic calming if it meets the following criteria: ® The street shall not have more than one traffic lane in each direction. ® The street shall have a regulatory speed limit of 25 mph or less. ® The 85th percentile speed on the street section must be at least 10 mph over the regulatory speed limit. The street has more than 500 vehicles in a 24 hour period. The average daily traffic must be less than 5,000 vehicles per day Develop Plan of Traffic Calming Measure If the street segment meets criteria and warrants for traffic calming, a sketch plan of the proposed traffic calming measure to be utilized will be prepared by Engineering Division staff. If the requested street does not meet criteria and warrants, the requestor will be notified through the U. S. Postal Service. No further study action will be taken. Page S Neighborhood Traffic Calming Program ® Notification/Evidence of Support Upon determination that a street meets the criteria for speed hump installation, the Public Works Department will notify the applicant of the status of their request. The applicant will be informed of the requirement for a support petition, verification statement and Homeowners Association endorsement. The Public Works Department will supply forms to the applicant, along with the sketch plan for the installation and a map to be used to show households and businesses that are to be included in the petition area Petition The applicant(s) or other neighborhood representatives will be required to circulate a petition before the City takes any action to implement the speed hump installation plan. A petition from adjacent residents and business owners is required. The petition must document that at least two- thirds (67%) of all households and businesses adjacent to the project support the installation of speed humps. All properties within the affected area must be accounted for, either by signature and indication of preference (in favor or oppose) or by written statement by the contact person why a specific property was not represented. Requests with either no petition or with a petition that does not account for all properties will be considered incomplete and will not further the process. Verification Statement A verification statement confirming the signatures on the speed hump petition are valid and represent at least two-thirds (67%) of the households/businesses adjacent to the project street is required from the applicant. Both property owners and renters are allowed to sign the petition. Each household and business address is entitled to one signature. If both the owner of a property and tenant submit a signature, the owner's signature will override the tenant's If the petition is found to be invalid the complainant(s) will be given an opportunity to re -process the petition and submit it a later date. If a sufficient petition cannot be obtained the City will discontinue the traffic calming efforts at the location. _Homeowners Association Endorsement Registered neighborhood associations adjacent to the street segment area will be asked to sign a statement endorsing the traffic calming installation. If the subdivision does not have a homeowners association, then this endorsement is not applicable. The applicant will deliver the completed forms to the Public Works Department. Each form will be authenticated by Engineering Division staff. ® Ranking Traffic Calming Sites After meeting operational, geometric and general warrant criteria, traffic calming projects will be prioritized on a citywide basis. This action ensures proper allocation of city resources and it ensures an equitable process to citizens. Page 6 Neighborhood Traffic Calming Program Projects will be ranked for funding and installation according to assigned points on the basis of: ® 85th percentile speed, ® 24-hour traffic volume, ® Total number of reported crashes over a two-year period, and ® Proximity to special traffic generators. The street segment installation accumulating the greatest number of points will be considered to have the highest priority. Among project installations with the same rank, higher priority will be given to the application with the earliest application date subsequent to the effective date of the traffic calming program. Page % Neighborhood Traffic Calming Program Speed Hump Installation► and Removal Criteria Speed Bump Location Considerations ® The street shall provide access (via a driveway or on -street parking) to abutting residential and/or commercial properties (residential local or collector streets). Residential properties include multiple dwellings such as apartment complexes ® The street shall not have more than one traffic lane in each direction. ® The street shall have a regulatory speed limit of 25 mph or less. ® The 85th percentile speed on the street section must be at least 10 mph over the regulatory speed limit. ® Speed humps should not be located in a horizontal curve, on vertical curves where visibility of the hump is restricted, or on the approaches to these curves. ® For speed hump installation, the street should have curb and gutter. Considerations may be given to streets without curb and gutter. In such cases, special care should be used to accommodate drainage and prevent vehicle run-arounds. ® Street segment boundaries identified for traffic calming should be uninterrupted segments of street (i.e., no stop signs). If an applicant does identify a street segment with interrupted points, then the project plan may direct the existing interrupted points be removed. ® Speed humps will not be located in front of a driveway or within an intersection. Speed humps shall be kept a minimum of 100 feet from the near curb line of an intersecting street. ® Speed humps will not be located over manholes or adjacent to a fire hydrant. ® Speed humps located near drainage inlets will be placed immediately downstream of the inlet. Speed humps will be located as near as practical on property lines to minimize the intrusion of the speed hump on abutting property frontages. ® To the extent possible, speed humps will be located near existing mid -block street lighting. A speed hump will not be located in front of a property if the occupant objects to its placement or, in the case of multiple dwellings, if a majority of the households on the property object to its placement, Fulfillment of this requirement is the responsibility of the applicant (contact person). The average daily traffic trust be less than 5,000 vehicles per day to qualify for speed humps. Speed Dump Spacing and Location ® Speed humps will typically be placed 200 to 600 feet apart. Other spacing may be used upon based on engineering judgment. ® On single short blocks (300 to 500 feet), a single speed hump will be positioned near the mid -point. On single blocks of moderate length (500 to 1,000 feet), a two speed hump configuration at third points will be used. Page 8 Neighborhood Traffic Calming Program ® On very long blocks (1,000 to 1,600 feet), three speed humps will be placed on approximate quarter points. ® On lengthy continuous street segments or segments comprised of a number of blocks, desirable interior speed hump spacing will be 400 to 600 feet. ® A street segment or block must be at least 300 feet to qualify for speed hump installation. Speed Hump Removal Citizens may request a street segment be reviewed for the possible removal of some or all of the existing humps. An application will be available from the Public Works Department. The affected area will be determined by Public Works Department Engineering Division staff and will include primarily those properties facing or abutting the street segment on which speed humps are located. A property will be considered part of the affected area if its only ingress and egress route requires traveling over existing speed humps requested to be removed. The removal request must originate from a resident, business, or entity whose property is within the affected segment area. The affected area will be determined by Public Works Engineering Division staff and will include primarily those properties facing or abutting the street segment on which speed humps are located. A property will be considered pant of the affected area if its only ingress and egress route requires traveling over existing speed humps requested to be removed. Notification / Evidence of ,Support Subsequent to the application for speed hump removal on a segment, a map of the affected area will be prepared and a petition packet sent to the applicant (contact person) for documenting support for the removal. All properties within the affected area must be accounted for, either by signature and indication of preference (in favor or oppose) or by written statement by the contact person why a specific property was not represented: There muss_ be at least a 67 percent evidence of support to further the process. Requests with either no petition or with a petition that does not account for all properties will be considered incomplete and will not further the process. The specific street segment indicated on the removal application will be the basis to identify the speed humps for removal. Final determination for the removal will be at the discretion of the City of Owasso Ptiblic Works Department staff. Page 9 Neighborhood Traffic Calming Program Eased on engineering judgment, the review process may recommend removal of none, some, or all of the speed humps. Factors considered, but not limited to, are: a. Existing speed hump locations and spacing b. Stop/yield signs along the segment c. Historical and existing traffic speed and volume information d. Collision History e. Presence or absence of sidewalks, schools and parks If speed studies conducted along the requested segment or portions of the segment show the 851h percentile speed is greater than or equal to 10 mph over the posted speed limit, then no hump removal will occur along the segment or portion of the segment represented by the study. In addition, the city reserves the right to remove any traffic calming measure that is potentially unsafe and impairs the public safety and welfare. Design Standards, Construction, and Maintenance The City of Owasso Public Works Department will prepare and maintain current design standards and installation and removal procedures for speed humps and other traffic calming devices in accordance with current design practices and criteria. Design and construction or removal of traffic calming devices along with associated pavezrient markings and signs will be the responsibility of the Public Works Department.
