The subject property is located on the northeast comer of East 106th Street North and North 145th East Avenue and contains approximately 36.56 acres, more or less. ITEM 11. Location Map B. Maintenance Bonds ATTACHMENTS: Staff recommends Council acceptance of the Sawgrass Park II streets and storm drainage systems. RECOMMENDATION: Final inspection for the streets and stOlID drainage systems were conducted on August 29, 2005. All items identified at the final inspection requiring cOlTection to meet city standards have been completed. The constmction contractor has provided the required one-year maintenance bond for the storm drainage system, and the developer has provided the required two-year maintenance bond for the streets. FINAL INSPECTIONS: The subject residential development is located northeast of the East 96th Street North and North Garnett Road intersection (see attached map). Design for the streets and stOlID drainage system were reviewed and approved in December 2004. Exchange Bank has been the sponsor for Fireworks at the Owasso High School football games for several years. The sponsors have met with representatives of the Fire Department to coordinate the event and address safety concerns. At this time, all requirements established by the Fire Depmiment have been addressed by the sponsors. BACKGROUND: The staff has received a request from Exchange Banle for an item to be placed on the City Council agenda for consideration to approve the discharge of fireworks before each home football game at the Owasso High School. City Code requires approval from the City Council for any public display of fireworks within the city. Attached is a copy of that section of the Code. Mr. Seaton was told that the fence was appropriately located. Upon additional review by staff, it was determined that the right-of-way width in that area is irregular and thus the fence was located in the right-of-way. Mr. Seaton was contacted by staff and informed of the city's enor in determining the proper location of the fence. Mr. Seaton was further informed that staff would be contacting the property owner. Subsequently, staff requested to meet with Mr. Seaton and scheduled a meeting with the City Manager on August 11, 2005. In January of this year, the debris was removed from Mr. Seaton's yard. Also in January, staff met with the neighbors of Mr. Seaton and informed them that the fence was appropriately located. In December, the neighboring property owner contacted Councilor Kimball who refened them back to the staff. This contact was followed by a meeting with both the Community Development and Police Depmiments about several concerns ranging from the location of the fence, the number of dogs permitted in the city limits, to preventing Mr. Seaton from spraying their dogs with mace and peering over the fence. City staff has had several contacts with Mr. Seaton over the last several months. Initially, Mr. Seaton was contacted by the Code Enforcement Officer regarding an excessive accumulation of debris contained within his rear yard. ShOlily thereafter, Mr. Seaton contacted the Code Enforcement Officer regarding a neighboring property owner's driveway not being a paved surface. This contact was followed by Mr. Seaton also contacting staff about his neighbor's fence being constructed too close to the Atlanta street side. BACKGROUND: On August 23, 2005, the office of the City Clerk received a letter dated August 19, 2005 from Mr. Francis Seaton, 301 N. Atlanta. Mr. Seaton has requested to appear before the City Council at the September 6, 2005 meeting and seek action regarding the removal of a privacy fence. A copy ofMr. Seaton's letter is attached for your review. August 2005 DATE: CITIZEN REQUEST FOR PLACEMENT ON CITY COUNCIL AGENDA SUBJECT: TIMOTHY ROONEY ASSISTANT CITY MANAGER FROM: HONORABLE MAYOR AND CITY COUNCIL CITY OF OW ASSO TO: MEMORANDUM ATTACHMENTS: 1. Copy ofletter submitted by Mr. Seaton, dated August 19,2005 With the above items identified, the City could pay to have the fence relocated or opt to leave the fence where it is with the understanding that if the portion of right-of-way is ever needed to be accessed, the fence would be relocated at that time at the city's expense. CONCLUSIONS: When reviewing the above history, several conclusions can be anived at: @ There is an ongoing dispute between Mr. Seaton and his neighbor. @ The City provided Mr. Seaton's neighbor with inaccurate infOlmation regarding the appropriate location of the fence. @ The City does not feel that the fence in its current location violates the law nor obstructs visibility at that intersection. Shortly after that incident, Mr. Seaton called to cancel his meeting with the City Manager. The letter requesting to be placed on the City Council agenda is the last conespondence from Mr. Seaton. Several days before the scheduled meeting with the City Manager, Mr. Seaton was witnessed by residents of the nearby apartment complex pouring contents of an antifreeze container on a tree along the south side of his neighbor's home, along the north side of Third Street. The tree is not on the neighbor's propeliy but is located in the right-of-way. The Police Department attempted to make contact with Mr. Seaton immediately following the incident but Mr. Seaton did not answer the door. ATTACHMENTS: 1.
