Fire Act Grant through the Federal Emergency Management Agency (FEMA) in the
amount of $61,295.00.

N. 129th East Avenue and E. 96th Street North with CH2MH11I, Inc. and authorize the
Mayor to execute said amendment No. I of the agreement.

Verification has been made by staff that each of the above addresses are within the
boundaries of Ward 5 and a copy of each letter of interest was provided to the City
Council on the day that it was received.
The agenda provides an opportunity for the Council to select from the candidates a
person to fill the Ward 5 vacancy. Such selection requires a valid motion and second,
and a majority vote of the remaining Councilors.
Should the Council fill the vacancy by such action, the oath of office will be administered
to the selected candidate under the next agenda item.

Dear City Manager Ray and City Councilors,
The purpose of this correspondence is to express my interest in serving on the City
Council representing Ward 5. 1 have been a citizen of Owasso for almost 9 years. My
philosophy has always been to give back to my community by serving in any way that I
can.
Currently I serve on the boards of Owasso Comm-unity Resources, Business and
Professional Women, Owasso Toastmasters, the Owasso and Tulsa Metro Chambers of
Commerce. I am an active member of Owasso Rotary and on the Owasso Golf Advisory
Board. In 2002, 1 served as Owasso United Way Chairperson.
My experiences with these many organizations have given me an opportunity to know
other active .--ope in Owasso and Tulsa, and to know a cross section of the population
living in Owasso. This could be of value to an effective city councilor by giving a broad
base of input from many citizens of Owasso.
I know that one of the main duties of the City Council is to make objective decisions
based on what is best for the city. These divisions may be difficult to make at times, but
always the consideration should be for the good of the whole community.
I believe that my decision making skills, my love for and involvement in the community,
my experiences as a business owner, and my willingness to make a commitment to work
hard would make me a successful candidate for the City Council.
Owasso is at a critical point in its growth. Crucial decisions must be made to avoid as
many growth problems as possible and to take of advantage of as many opportunities as
we can for the communities success. I feel I could be an asset to the City Council. I look
forward to hearing from you.

Tuesday, January 6, 2004
The Owasso City Council met in regular session on Tuesday, January 6, 2004 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 5:00 p.m. on Friday, January 2, 2004.
ITEM I . CALL TOO RDER
Mayor Cochran called the meeting to order at 6:32 p.m.
The invocation was offered by Sr. Pastor Derk Madden of Westport Mennonite Brethren Church,
Carroll Harris, Commander of VFW Post 7180, led the flag salute.

Mr. Ray introduced Joe Harris, an employee in the Public Works Street Department, as the City
of Owasso Employee of the Month for January 2004.
A. Approval of Minutes of the December 16, 2003 Regular Meeting.
& Approval of Claims.
D. Action relating to Ordinance No. 771, an ordinance approving an annexation
request for 0.77 acres, more or less. The subject property is located in the
southwest comer of East 116th Street North and US Highway 169 intersection.
E. Action relating to Ordinance No. 772, an ordinance approving an annexation
request for 0.94 acres, more or less. The subject property is located in the
northeast corner of East 103 Street North and US Highway 169 intersection.
F. Action relating to Ordinance No. 773, an ordinance approving a request to
establish a Planned Unit Development on property located on the west side of
North 145'h East Avenue 1/2 mile south of East 116th Street North.
Mr. Ray announced an addendum to the Claims List in the amount of $1,590,000.00 for purchase
of 80 acres of land from the Owasso Land Trust. This purchase was approved by Council on
January 21, 2003. Mr. Cataudella moved, seconded by Ms. Kimball, to approve the Consent
Agenda with claims totaling $1,771,124.22 (including addendum), and payroll claims for two
pay periods totaling $511,588.20; and to approve Ordinances No. 769, No. 770, No. 771, No.
772 and No. 773.

STREET NORTH AND NORTH 129TH EAST AVENUE INTERSECTION.
Mr. Cross presented the item. Ms. Kimball moved, seconded by Mr. Thoendel, to accept the
sanitary sewer system for Remington Park subdivision,

Greens.
ITEM 11. NEW BUSINESS
Ms. Beverly Corey, representing Elm Creek property owners, requested help from the City
regarding traffic problems and code enforcement in the Elm Creek subdivision. She also asked
for information on City Ordinances regarding landlord's responsibilities for rental properties.
Mayor Cochran asked Mr. Ray to initiate a study of this area.
Mr. Ray directed Chief Yancey to visit with Ms. Corey regarding traffic issues. He also directed
Mr. Cates and Mr. Wiles to contact Ms. Corey to schedule a neighborhood meeting.

At the December 16, 2003 meeting, the Owasso City Council approved an annexation request of
property located in the northeast comer of the East 103'd Street North and U.S. Hghway 169
intersection, containing approximately 0.94 acres.
On January 6, 2004, the Owasso City Council approved Ordinance 772 that formally annexed the
subject property.
Ordinance 772 contained an incorrect legal description. In response, staff is attaching Ordinance 772
Nunc Pro Tunc that will formally adopt the City Council's action • December 16, 2003. Ordinance
772 Nunc Pro Tunc contains the proper legal description for the subject property.

The funds obtained through this grant will be utilized to purchase a vehicle exhaust
extraction system to be, installed in the apparatus bays of Station #1. Installation of this
system will help meet two standard recommendations for 1-11c fire station, the NFPA
Standard, recommending automatic exhaust extrication and the health department
recommendations for air quality in the patient compartment of the ambulances.
Research has been conducted on vendors that can supply a vehicle exhaust extraction
system in which 100% extraction efficiency is assured, as is required under the terms of
the FEMA grant. In order to deliver a rapid response during an emergency situation,
numerous requirements would need to be met by the system. The system will need to
automatically disconnect from the vehicle after it has exited the building and provide for
automatic exhaust removal and system shut down after use.

Vendors of these type of systems were contacted, ARI Hetra, The AX, and Air
Technologies. The Nederman System utilized and installed by ARI Hetra and The AX
did not meet the FEMA requirements of 100% extraction and neither company is located
in Oklahoma which could delay any warranty or service work.
Air Technologies of Broken Arrow specializes in the installation of Plymo-Vent Systems
and is the only authorized dealer of the Plymo-Vent System in this region. This system
meets all of the FEMA grant requirements and has been installed in over 40 Oklahoma
Fire Stations.
The staff recommends Council approval to accept the FEMA Grant in the amount of
$61,295.00 and authorize a sole source purchase for the vehicle exhaust extraction
equipment from Air Technologies of Broken Arrow.

On April 1, 2003 the Fire Department submitted a grant application to the Office of
Homeland Security. The application was for a $12,000,00 grant to be utilized for the
purchase of firefighting equipment. The Fire Department was notified of the grant award
on August 1, 2003, All final grant documents were forwarded to the Office of Homeland
Security on December 15, 2003,
The grant of $12,000,00 will purchase four new self- contained breathing apparatus
(SCBA) and two spare bottles that meet all specifications and recommendations of the
NFPA and Owasso Fire Department. Currently, the Fire Department has nine SCBA's
that were purchased three years ago and placed into service. NFPA standards
recommend that an SCBA should be provided for every seat in a fire engine.
The Fire Department must purchase the equipment, provide proof of receipt, and then
process the proper documentation for reimbursement through the Homeland Security
office. The Office of Homeland Security should reimburse the City of Owasso
$12,000.00 within 30 days. A supplemental appropriation will be needed in the Fire
Capital Fund for the amount of $12,000.00.
The staff recommends Council accept this grant in the amount of $12,000.00 from the
Office of Homeland Security in order to purchase four new self- contained breathing
apparatus and two spare bottles.

Also, in April 2003, the Fire Department applied for the Fire Act Grant through the
Federal Emergency Management Agency (FEMA). This grant application has been filed
electronically with FEMA for the past four years; however, this is the first year Owasso
Fire Department has received the award. This grant will be utilized to fund a Plymo-Vent
System for Station #1 located at 8900 North Garnett Road at an approved project cost of
$68,105.00. FEMA has awarded 90% of the project cost ($61,'!05.00) and the City will
be required to match 10% of the project cost ($6,810.00).
In order for the City of Owasso to utilize funds from the Homeland Security and FEMA
Grants, a supplemental appropriation to the Fire Department General Fund is needed.
The supplemental appropriation would increase both the revenues and the expenditures of
the General Fund by $73,295.00. The City match of $6,810.00 for the FEMA grant
would require a supplemental appropriation in the Fire Capital Fund.

The capital projects recommended by the Capital Improvements Committee were approved by the
City Council and information describing the project priorities was widely distributed to the public
before the election. Resolution No. 2004-01 would establish the "Tier I" projects as the initial
priority determination for utilizing the third penny sales tax. The published "Tier I" projects
include: 129"' East Ave., 76'h to 96th; the Interchange at 96th Street North, Hwy 169 and N. 129th
East Ave.; Additional Fire Stations; the Sports Park Expansion; a Storm Siren System; and the

All future additions or changes to these project priorities will be restricted by the procedures
established in Resolution No. 2003-14 approved by the City Council on September 2, 2003. The
amendatory procedure requires a recommendation by the Capital Improvements Committee, a public
hearing by the City Council, and adoption of a resolution determining the project priorities.

Amendment to Priority Determination for utilization of the proceeds of the excise tax levied by
Ordinance No. 163, shall be accomplished in the following manner, to wit:
A. The proposal for amendment to the Priority Determination shall be presented to the
Capital Improvements Committee, in a regular or special meeting thereof, called,
noticed and held in accordance with the provisions of the Oklahoma Open Meeting
Act, 25 O.S. 301, et req. The Capital Improvements Committee, in such public
meeting, shall consider all matters deemed relevant by it to the proposed
amendment to Priority Determination and at the conclusion of such consideration it
shall make a recommendation thereon to the City Council.
Prior to the City Council consideration of the Capital Improvement Committee's
recommendation and the proposed amendment to the Priority Determination. The
City Council, during a regular or special meeting thereof called, noticed and held in
accordance with the provisions of the Oklahoma Open Meeting Act, 25 O.S. 301 et
req., shall conduct a public hearing thereon. In addition to such notice as may be
required under the provisions of the Oklahoma Open Meeting Act, 25 O.S. 301 et
req., notice of such public hearing shall be published once in a newspaper of general
circulation not less than five (5) calendar days prior to such public hearing.
C. During the course of the public hearing, the City Council shall receive and consider
such information as deemed by the City Council relevant to the proposed
amendment to Priority Determination.
D. At the conclusion of the public hearing, the City Council shall, after discussion on
the proposed amendment, continue the matter for a period of not less than two (2)
weeks to a date, time and place certain for continued consideration of same. At such
time, the City Council shall take such action as it deems appropriate on the
proposed amendment. Any action taken shall ultimately be set forth by way of
Resolution. The date of adoption of said Resolution of the proposed amendment to
Priority Determinations shall be deemed the effective date.

Various changes to the original scope of work are proposed (see Attachment A). Details and
reasons for each change are shown below.
SCOPE OF WORK CHANGES®
U.S. Highway 169 Interchange Modifications: Following completion by the design engineer of a
Conceptual Design Report in December 2002, recommended improvements to the interchange at
U.S. Highway 169 included extensive widening and ramp modification that were not anticipated
in the original scope of work. The original engineering agreement stated that the fee to complete
the design of the interchange improvements were to be negotiated after the completion of the
Conceptual Design Report and recommendations had been agreed upon by the City of Owasso
and Oklahoma Department of Transportation (ODOT). It was anticipated that improvements
could range from signalization to a complete reconstruction of the ramp. The configuration
shown on Attachment B was approved by ODOT and the Federal Highway Administration. The
final selected alternative includes a six (6) lane signalized intersection.
CH2MHi11 thought it to be impractical to scope this portion of the project and include fees in the
original agreement. This concept was proposed at that time to save the City the expense of a
design fee for an entire interchange modification in the event that a simple widening and

signalization would have accomplished the design objectives. As a result, the original scope of
service included only the study and recommendation of alternatives for the interchange.
Additional engineering costs proposed with this amendment are associated with the design of the
U.S. Highway 169 interchange, including additional surveying and aerial photography.
Extension of E 96th Street North Improvements: As an additional result of the above
intersection modifications, the Conceptual Design Report also indicated a need to widen E. 96tH
Street North and N. 129th E. Avenue farther north and east, respectively. In the original scope of
services, the intersection improvements were limited to 600 feet in each direction. The
Conceptual Design Report determined that the project should be extended approximately 800
feet north, 1,000 feet west and 3,000 feet east to more appropriate termination points. Additional
engineering costs are associated with additional survey, aerial topography, geotechnical, design,
right-of-way services and construction services.
Additional Traffic Signals: The Conceptual Report stated a need for additional signalization to
facilitate pedestrian and vehicle flow on N. 129th E. Avenue at the Owasso High/Middle School
complex and Sixth Grade Center. Additionally, the signal at the Sixth Grade Center requires the
design of a new two-way driveway to access the newly constructed school parking facilities.
Additional engineering services are associated with the signalization of these two locations.
Home Depot Package: In May 2003, construction of Home Depot prompted early construction
of improvements to a portion of N. 1291h East Avenue and the intersection at E. 96th Street North.
This construction forced accelerated completion of the design and resulted in additional fees for
bidding and construction services.
Although basic design was included in the original scope of work, fast-phasing of construction
resulted in additional engineering work that was not included in the scope. These added work
items include pavement transitions, temporary pavement marking and signage, drainage
adjustments, and modifications to the vertical profile on both E. 96th Street North and N. 1291h
East Avenue. Additionally, design modifications will also be required at a later date to
incorporate the ultimate road configuration for loop detectors and wiring diagrams. Added
engineering and construction services also includes coordination with the Home Depot
consulting engineer, attendance to meetings and bid conferences.
Break Improvements into Two Separate Projects: In November 2003, following the start of
construction at the intersection of E. 96th Street North and N. 1291h E. Avenue and the new
service road across from the U.S. Highway 169 ramp, city staff felt that permanent reconstruction
of the interchange should take first priority of the remaining engineering contract items. Staff
believes that these improvements are needed in the immediate future to better manage traffic and
facilitate traffic movements.
During constriction of Home Depot, a service road was constructed immediately across from the
U.S. Highway 169 interchange to service the commercial area (including Walgreen's, Oklahoma

National Bank and Home Depot). This service road enables vehicles to travel across E. 96th
Street North to the commercial area south of the ramp (crossing six (6) lanes of traffic).
Temporary traffic signals have been installed as an interim measure to assist in the flow of
traffic. However, due to the proximity of the N. 1291h East Avenue intersection, signals at both
intersections must be synchronized to effectively manage traffic. As a result, installation of
permanent signals and completion of improvements at the ramp are critical, A separate set of
contract documents and design plans are to be prepared to enable this portion of work to proceed
prior to work on North 1291h E. Avenue.
As originally provided in the scope of services, design plans and specifications for widening N.
129th E. Avenue from the termination point south of Home Depot to E. 76th Street North will be
completed. A separate set of contract documents and design plans will be prepared.
The additional scope of services proposed in this amendment is associated with dividing the
project into two (2) separate projects for bidding and construction.

PLANNING COMMISSION
The Owasso Planning Commission, at the fanuary 12, 2004 regularly scheduled meetirill
voted unanimously, 3-0, to approve 2, « :» amendment.
RECOMMENDATION
Staff recommends approval of OPUD 18-A, to incorporate the subject property into the
Coffee Creek PUD 18 under the zoning guidelines outlined for the CG (Commercial
General) designation.

This project involves construction of six-feet-high, prefabricated concrete fencing along the east
and north property lines at Fairview Cemetery. In April 2003, contract documents and
specifications were finalized by Public Works.
Council awarded the construction contract to Premier Crete Products, LLC for the amount of
$65,700.00 on May 8, 2003. Final inspection was conducted on November 12, 2003 and all
items identified at the final inspection requiring correction to meet city standards have been
completed. The contractor provided a one-year maintenance bond for the work as part of the
Contract Documents.
Progress payments have been made in the amount of $52,560.00. Pay Application No. 2 in the�
amount of $13,140.00 was submitted on December 11, 2003 by the contactor as request for final
Ir�ayment.
Funds for this project are included in the FY 2002-2003 Cemetery Care Fund (Line Item 22 -190-
54200).

Staff recommends Council acceptance of the Fairview Cemetery Fencing Project and
authorization for release of retainage and final payment to Premier Crete Products, LLC in the
