Agenda. All matters listed under "Consent" are considered by the City Council to be

D. Action relating to Council acceptance of Ordinance No. 779, an ordinance providing
for the rezoning of approximately 35.3 acres, more or less, located to the south and
west of the southwest comer of E 96th Street North and N 129th East Avenue, along the
east side of Highway 169.

Tuesday, March 9, 2004
The Owasso City Council met in a special meeting on Tuesday, March 9, 2004 in the Lower
Level Conference Room at Owasso City Hall, 1 1 1 N. Main Street, per the Notice of Public
Meeting and Agenda posted on the City Hall bulletin board at 4:00 PM on Friday, March 5,
2004.

Mayor Cochran called the meeting to order at 6:00 PM.

Mr. Carr answered questions about both items. It was explained that the interlocal paving
agreements would be placed on the March 16, 2004 City Council agenda for action.

Mr. Wiles presented the CDBG 2001 Closeout, the recommendation for the CDBG 2004
Program (Skate Park Restroom), as well as the written legislative consortium update. Mr. Wiles
explained that both CDBG items would be placed on the March 16, 2004 City Council agenda.

Mr. Ray reviewed the above items and discussion was conducted. No action on any of the above
items was taken.

The Owasso City Council met in regular session on Tuesday, March 16, 2004 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall

ITEM 1. CALL TOO ER
Mayor Cochran called the meeting to order at 6:35 p.m.

C. Action relating to Council acceptance of the Owasso Professional Square
stormwater drainage system.
Mr. Cataudelia moved, seconded by Mr. Thoendel, to approve the Consent Agenda with Claims
totaling $456,087.95 and payroll claims totaling $252,705.93; and for Council acceptance of the
Owasso Professional Square stormwater drainage system.

ITEM 6. PUBLIC HEARING. A Public Hearing inviting and hearing citizen comments
regarding the work performed under Community Development Block Grant FYO I.
Mr. Wiles presented the item. After explaining that a Public Hearing was a final requirement for
the closeout of the FY0 I project, Mr. Wiles opened the floor for public comment. There were no
questions or comments from the public.
ITEM 7. PUBLIC HEARING. A Public Hearing receiving recommendations and any citizen
input on community development needs within the City of Owasso for the FY04
project.

ITEM 8. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST
FOR COUNCIL ACCEPTANCE OF THE COMPLETED SIDEWALK
IMPROVEMENT PROJECT UNDER THE 10286 CDBG 2001 SMALL CITIES
GRANT AND AUTHORIZATION OF THE MAYOR TO EXECUTE ALL
NECESSARY CLOSEOUT DOCUMENTS.
Mr. Wiles presented the item. Ms. Kimball moved, seconded by Mr. Thoendel, to accept the
completed FY01 Sidewalk Improvement Project and authorize the Mayor to execute all
necessary closeout documents.

CITY'S INTEREST IN PARTICIPATING IN THE CDBG SMALL CITIES SET
ASIDE PROGRAM O 2004.

authorize the Mayor to execute a letter of intent to the Oklahoma Department of Commerce
advising them of the city's interest in participating in the CDBG Small Cities Set Aside Program
for 2004.

Mr. Wiles presented the item. Ms. Kimball moved, seconded by Mr. Colgan, for Council to
approve Ordinance 777, an ordinance amending Section 650 of the zoning code — Location of
Sexually- Oriented Businesses. The ordinance increases the required distance between a
sexually-oriented business and churches, schools, and parks from 500 feet to 1,000 feet; between
a sexually-oriented business and residentially zoned areas from 300 feet to 1,000 feet; and
between a sexually- oriented business and nonarterial streets providing access to residentially
zoned areas from 300 feet to 1,000 feet.

adoption of the Owasso Historical Museum Policies and Procedures document and authorization
of the Mayor to execute all necessary documents.

CLOSING OF BURIAL SPACES IN FAIRVIEW CEMETERY.

adoption of Resolution No. 2004-04 with an effective date of May 15, 2004, and authorization of
the Mayor to execute all necessary documents.

BOARD OF COMMISSIONERS OF TULSA COUNTY, PERTAINING TO THE
OWASSO DOWNTOWN NEIGHBORHOOD PROJECT.

approval of the Vision 2025 Capital Improvement Agreement pertaining to the Owasso

approval of the Vision 2025 Capital Improvement Agreement pertaining to the Owasso Water
System Project and authorization of the Mayor to execute all necessary documents.

ITEM20. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF AN INTERLOCAL AGREEMENT
WITH TULSA COUNTY FOR STREET IMPROVEMENTS.
Mr. Carr presented the item. Mr. Thoendel asked how Staff arrived at the priorities for this
project. Mr. Carr stated that the magnitude of the project and the expense of the project, among
other things, were used to determine priorities. Mr. Colgan moved, seconded by Mr. Cataudella,
for Council approval of the Interlocal Agreement with Tulsa County for pavement overlay

projects in Three Lakes Industrial Park, Three Lakes Village, and The Village of Silver Creek
and authorization of the Mayor to execute the Agreement.

ITEM 21 CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
RE-QUEST FOR COUNCIL APPROVAL OF FINAL PAYMENT AND
ACCEPTANCE OF THE FY03-04 STRE.ET REPAIR PROJECT.
Ms. Stagg presented the item. Mr. Cataudella congratulated Ms. Stagg and her staff for coming
in under-budget on this project. Mr. Cataudella then moved, seconded by Mr. Thoendel, for
Council acceptance of the FY 0304 Street Repair Project, a revised total contract amount of
$94,172.92, release of retainage and authorization for final payment to Magnum Construction,
Inc. in the amount of $9,417,29.

Mr. Ray announced that the new Fire Truck has been delivered and is fully operational at this
time.
Mr. Ray also announced the 'Community Built Playground Project' has been approved for 501 ®C
status.
Mr. Ray extended best wishes to departing Golf Director, Russell Carlson. He also introduced
Assistant Golf Pro Corey Burd, who will be assuming the responsibilities of Golf Director until a
new Director can be chosen.

wonderful job during his time with the City.

BACKGROUND:
The capital projects election, conducted in October of last year, resulted in Owasso citizens
approving the permanency of the third penny sales tax, as well as the adoption of a proposed
Four Tier project priority list. Contained within the Tier One projects is the replacement of the
storm siren system.
EXISTING SYSTEM.
The City of Owasso presently has an emergency storm siren notification system consisting of 16
sirens at various locations throughout the city. The current storm siren system was manufactured
by Federal Siren Corporation and is a one -way radio wave operated system. The current system
has only one notification tone, is increasingly unreliable and costly to repair, and requires manual
monitoring at each siren location in order to verify their working condition. The system is over
twenty -five years old and was purchased – used – from the City of Tulsa.
BID PROCESS:
In November of 2003, bid specifications were developed by staff after visiting several
municipalities in the Tulsa area. The bid specifications included:
• A battery back -up system in order to provide the ability to sound the sirens in the event of
a power- outage, as well as the continued ability to sound the sirens for a period of up to
fourteen (14) days without power.
• Ability to activate only one siren, a group of sirens in a particular area, or the entire siren
system.
• Remote activation capability.
• Both tone and voice notification options.
• Alternates for both wooden and concrete poles.
® Alternates for a total of 14 or 20 sirens.
® Installation and training.
® A 2 year warranty.

VIEW OF BIDS:
Upon review of the submitted bids, it became obvious that the low bidder — Total Radio — had
made an error when submitting their bids. A review of all the other bids submitted indicates that
higher prices were quoted for concrete poles versus wooden poles. Total Radio, upon being
contacted by staff, acknowledged the error but remains committed to honor their bid. Therefore,
the option of concrete poles becomes much more attractive both fiscally and aesthetically. The
bid submitted by Total Radio was $205,194 for fourteen (14) sirens on concrete poles.
SIREN LOCATIONS;
Upon the review of the Total Radio bid, staff began a process of pinpointing exact locations of
the proposed sirens. Total Radio's bid, utilizing an ATI siren system, actually exceeded
specifications, thus causing the need to review the proposed locations in order to ensure
consistent and over- lapping coverage while preventing over - saturation. Upon completion of this
process, staff also had an independent party review the siren locations.

A copy of the proposed siren location map is attached for your information and review.
Although existing sirens are located at various locations throughout the city, the locations are not
the most desirable. The new sirens are proposed to be located at major arterial intersections in
Owasso — with one exception being the Owasso Sports Park. This allows the City to utilize
existing rights-of-way for the placement of the poles, as well as allowing for easier access when
maintenance of the system is required.
NUMBER OF SIRENS:
A total of 14 sirens would be needed to provide complete coverage of all areas within the city
limits of Owasso, while also providing coverage into areas of anticipated growth immediately
adjacent to the city limits. Installation is required within 90 days of delivery of the equipment
from the manufacturer.
VIEW OF REFERENCES:
Staff contacted several of the references provided by Total Radio. The ATI siren system is in

contacted gave the ATI system positive comments and recommendations.
FUNDING:
Funding for the project is available through the Capital Improvements Fund. The total amount
allocated for this project is $250,000.
ADDITIONAL, COMMENTS:
® The City of Tulsa is currently reviewing the possibilities of replacing their siren system
and is interested in reviewing the ATI system should Total Radio receive the contract
award.
® The success of this process can be attributed to Mr. Cliff Motto and Mr. Roger Voss.
Without their tenacity in the development of the specifications, as well as their detailed
review, reaching this point would not have been possible.
® During the installation of the sirens, the existing system will continue to function and
there will be no "down time" regarding the ability to sound sirens in the city.

work. No alternates were included. The Engineering Estimate prepared by the Benham Group
in March 2004 is $2,075,600.00. A composite tank with a concrete center column and steel
water storage bowl is designed (see Attachment B).
Two bids were received on March 18, 2004 as summarized in the attached Bid Tabulation (see
Attachment Q. The apparent low base bid was submitted by Landmark Construction (The
Woodlands, Texas) in the amount of $1,860,000.00. Landmark Construction has met all
requirements of the bid process (see Attachment D).
Funding for the project will be provided by Vision 2025.

SUBJECT: SALE OF SURPLUS INTOXILYZER

BACKGROUND:
The Owasso Police Department obtained an Intoxilyzer Model 500D through a State of
Oklahoma traffic safety grant in 1995. The grant period expired several years ago and
the ownership of the instrument was transferred from the State of Oklahoma to the City
of Owasso. Since that time, the police department has received and is currently using a
new and updated model intoxilyzer that is much more efficient as it will print out the
required affidavits based on the information the operator types in to perform a test, The
old unit, although serviceable, is not compatible with the new software programs used by
the State and officers using the instrument must fill out the affidavits by hand. The old
analysis instrument can not be upgraded to use the software that the new instruments are
using and has been declared surplus by the City Manager due to its value being less than
$500.
Currently the City of Collinsville Police Department does not have an intoxilyzer and
none of their officers are trained intoxilyzer operators. As a result, their officers must
transport their suspected drunk drivers to Owasso for the intoxilyzer testing by Owasso
officers. Chief Charles Annis of the Collinsville Police Department has requested that
their department be allowed to purchase the old intoxilyzer for use in Collinsville.
COST SAVINGS:
When Owasso officers conduct the breath test, they are also subpoenaed to appear in
court for the prosecution of the case. This usually involves the expenditure of overtime.
Drunk driver suspects also have the right to appeal the loss of their driver's license to the
Department of Public Safety and those hearings are held at the DPS office in Jenks,
Oklahoma. When a suspected drunk driver requests a trial or drivers' license hearing, the
arresting officer, the officer conducting the chemical test (intoxilyzer) and the officer that
maintains the instrument all receive subpoenas. If ownership of the instrument is
transferred to the City of Collinsville, they will conduct their own tests and relieve
Owasso officers of the responsibility of attending court and DPS hearings on Collinsville
cases thus eliminating the overtime expense for our officers.
RECOMMENDATION:
The staff recommends that the Intoxilyzcr Model 5000-D Serial Number 64-002143 be
sold to the City of Collinsville for the amount of ten dollars.

Presented for the Council's consideration is Resolution No. 2004-05, a resolution
resolving the necessity of instituting and prosecuting condemnation procedures to acquire
Permanent Right of Way, Waterline Easement and Temporary Construction Easement at
9497 East 86th Street North necessary for the 86th and Mingo Intersection Improvement
Project from Strawdey Clinton McCarty.

On November 17, 2003, there was communicated to Strawdey Clinton McCarty, a
conditional offer to purchase a portion of the Permanent Right of Way necessary for the
86th and Mingo Intersection Improvement Project. The City at that time as well as
presently needs 43,208.55 square feet of Permanent Right of Way, 6800.00 square feet
for Waterline Easement and approximately 6800 square feet of Temporary Construction
Easement for the project. The City conditionally offered the sum of $15, 300.00. This
offer represented the appraised amount of the Permanent Right of Way and damage to the
remainder as established by the Appraiser in his report rendered November 18, 2002, as
reviewed and approved by a Review Appraiser on April 28, 2003. The City subsequently
endeavored to communicate by letter as well as by telephone with Mr. McCarty regarding
acquisition of the additional Waterline Easement and Temporary Construction Easement',
however, Mr. McCarty to date has failed and refused to communicate with City
representatives regarding this matter.
It is submitted that the City of Owasso is in need of proceeding with this acquisition. The
86th and Mingo Intersection Improvement Project as originally planned presented a much

needed improvement. As originally intended this project would provide a more efficient
and safe vehicular movement in the 86t" and Mingo intersection area. The need has only
heightened with the imminent closing of 76th Street North anticipated to occur within
days. Additionally, the Water System Improvements Project evolving as a result of
Vision 2025 funding likewise necessitates immediate attention to acquisition of waterline
casements needed in this area.
Based upon the foregoing, it is submitted that at this time Condemnation is the only
available mechanism to obtain the needed property and property interests. A public
purpose for the sought property and property interests is unquestionable. Further, the
representatives of the City have offered to Mr. McCarty a fair price for the property as
well as have tried to communicate offers relating to the property interests sought. It is
submitted that a resolution of necessity authorizing the institution and prosecution of a
condemnation action is appropriate.
It is recommended by staff that the Council adopt Resolution No. 2004-05. Should you

offer represented the appraised amount of the Permanent Right of Way and damage to the
remainder as established by the Appraiser in his report rendered October 31, 2002, as
reviewed and approved by a Review Appraiser on April 28, 2003. The City subsequently
communicated by letter as well as by telephone with Mr. Ogan regarding acquisition of
the additional Waterline Easement and Temporary Construction Easement. During
telephone conversations, Mr. Ogan had indicated a willingness to grant a Waterline
Easement for a tap and payment of $209,510.00 for the Permanent Right of Way.
Clarification was sought on the tying aspect of the counter-offer. Additionally, attempts
to discuss acquiring lessor interests in the Permanent Right of Way than fee simple to
minimize costs as well as interference with the landowners' use were not successful.
It is submitted that the City of Owasso is in need of proceeding with this acquisition. The

RESOLUTION No. 2004-06
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OWASSO,
OKLAHOMA, RESOLVING THE NECESSITY OF INSTITUTING AND
PROSECUTING CONDEMNATION PROCEDURES TO OBTAIN PERMANENT
RIGHT-OF-WAY, WATERLINE EASEMENT AND TEMPORARY
CONSTRUCTION EASEMENT
WHEREAS. The City of Owasso, by and through officers and agents thereof, has
endeavored to obtain Permanent Right-of-Way, Waterline Easement and Temporary
Construction Easement, copies of same attached hereto and marked Exhibit "N', deemed
necessary for the 8e' North and Mingo Intersection and Widening Project from Ronald
Lee and Gwendolyn Jean Ogan, husband and wife;
WHEREAS: In connection with such efforts to obtain the needed Permanent Right-of-
Waterline Easement and Temporary Construction Easement consensually, the City of
Owasso, by and through officers and agents thereof, has made bona fide good faith offers
to purchase same; and,
WHEREAS- The above - referred landowners have not acceted such offers and by
reason thereof Condemnation proceedings as provided for under the Constitution and
Statutes of the State of Oklahoma are necessary.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OWASSO, OFIAHOMA, THAT: Officers and agents of the City of
Owasso, Oklahoma, are hereby authorized to initiate and prosecute to the conclusion
thereof condemnation proceedings against Ronald Lee and Gwendolyn Jean Ogan,
husband and wife, to obtain the necessary Permanent Right-of-Way, Waterline Easement
and Temporary construction Easement as set forth in Exhibit "A" hereto as well as any
additional relief to which the City of Owasso, Oklahoma, may, by law, be entitled to,
APPROVED AND ADOPTED this 6"' day of April, 2004, by the City Council of the
City of Owasso, Oklahoma.
