12. Consideration and appropriate action relating to a request for Council adoption of a policy
statement pertaining to an Employee Pay Plan.

Staff will recommend Council adopt a policy directing the City Manager to establish a pay
plan which sets forth grades and ranges of pay for employees authorized by the City of
Owasso, with the intention that the City Manager, as Chief Administrative Officer, utilize
the pay parameters for compensation for employees.

13. Consideration and appropriate action relating to a request for Council approval of
annexation request OA 04-02 from the Free Will Baptist Church, a request for the
annexation of approximately 42 acres, more or less. The subject property is located in the
northwest comer of East 106"' Street North and U.S. 169.

14. Consideration and appropriate action relating to a request for Council approval of

and cast of the intersection of North Garnett Road and East 116"' Street North.

Tuesday, April 6, 2004
The Owasso City Council met in regular session on Tuesday, April 6, 2004 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall
bulletin board at 5:00 p.m. on Friday, April 2, 2004.
ITEM 1. CALL TOO EIS.
The meeting was called to order at 6:32 p.rn.
The invocation was offered by Mike Culbreath, Executive Pastor of Rejoice First Freewill
Baptist Church.
ITEM 3. FLAG SALUTE
Councilor Craig Thoendel led the flag salute.

Mr. Ray Haynes introduced Culture as the Character Trait of the Month for April, 2004.
Mr. Ray presented a Character Certificate for Dependability to Tom Kimball in recognition of
Mr. Kimball's unfailing dependability in devoting time and resources to help make Owasso a
premier community.

REQUEST FOR APPROVAL OF THE CONSENT AGENDA,
A. Approval of Minutes of the March 9, 2004 Special Meeting and the March 16,
2004 Regular Meeting.
B. Approval of Claims.
C. Action relating to Council acceptance of Ordinance No. 778, an ordinance
providing for the annexation of approximately 29.8 acres, more or less,
located in the 12300 block of North Garnett Road, immediately north of
Country Estates V.
D. Action relating to Council acceptance of Ordinance No. 779, an ordinance
providing for the rezoning of approximately 35.3 acres, more or less, located
to the south and west of the southwest comer of E. 96th Street North and N.
129th East Avenue, along the east side of Highway 169.
Mr. Cataudella moved, seconded by Mr. Thoendel, to approve the Consent Agenda with claims
totaling $216,994.30 and payroll claims totaling $250,206.49; and for Council acceptance of
Ordinances No. 778 and 779, as stated above.

ITEM 8. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL TO AWARD A CONTRACT FOR THE
INSTALLATION • OR SIRENS.
Mr. Rooney presented the item. Mr. Cataudella asked if an estimated completion date had been
established. Mr. Rooney answered that a 90 day time period for installation of all sirens was
expected. Mr. Cataudella moved, seconded by Mr. Colgan, for Council to award the contract for
the storm siren installation project to Total Radio of Tulsa, Oklahoma in the amount of
$205,194.00.

REQUEST FOR COUNCIL APPROVAL TO AWARD A CONTRACT FOR
CONSTRUCTION OF AN ELEVATED C TANK AS PART
WATER OF THE
Mr. Carr presented the item. Mr. Thoendel asked if a time -line had been established for this
project. Mr. Carr answered that they hoped to be operational by June 2006. Mr. Colgan moved,
seconded by Mr. Cataudella, for Council to award the contract for construction of an elevated
water storage tank to Landmark Construction, port North, Texas, in the amount of
$ 1,860,000.00.

ITEM 10. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A

Chief Yancey presented the item. Mr. Thoendel moved, seconded by Mr. Cataudella, for
Council authorization of the sale of an Intoxilyzer Model 5000 -D, Serial Number 64- 002143 to
the Collinsville Police Department for the sum of ten dollars ($ 10.00).

ITEM 13. PORT PROM CITY MANAGER
Mr. Ray stated that Mr. Wiles, Community Development Director, has initiated a new sign
abatement program.
Mr. Ray also announced that the response to the 'Timmy and Cindy' project has exceeded
expectations. There have been numerous requests for sponsoring new statues.
In closing, Mr. Ray said the FY 2004/05 budget process is going smoothly and Staff expects
preliminary budget to be delivered to Council on time.

At the April 15, 2003 meeting, the Owasso City Council approved the request for the closure of a
17.50' utility casement on property located at 3 01 E. 5h Avenue.
On April 159 2003, the Owasso City Council approved Ordinance 750 that formally approved the
easement closure.
Ordinance 750 contained an incorrect legal description. In response, staff is attaching Ordinance 750
Nunc Pro Tunc that will formally adopt the City Council's action of April 15, 2003. Ordinance 750
Nunc Pro Tunc contains the proper legal description for the subject property.

WHEREAS, on April 15, 2003 Ordinance number 750 was passed closing to the public use a
portion of a certain utility casement. The legal description on said ordinance was erroneous which in effect
closed only a portion of the utility easement and not the full width of the utility easement. The correct legal
description for Ordinance 750 is as follows:

In conjunction with the ongoing Centennial Celebration within the City of Owasso, it has
been suggested that it would have ceremonial significance to have an official of the State
of Oklahoma administer the oath of office to Members of the City Council of the City of
Owasso. In that regard, arrangements are being made for Susan Savage, Secretary of
State, State of Oklahoma, to perform such act.
Under Oklahoma law only certain state officers are authorized to administer oaths. 51
O.S. Sec. 21. The Secretary of State, a member of the Executive branch of state
government, Okla. Const., Art.6, Sec. 17, and a public officer, id., 51 O.S. See 1 et seq.,
is nevertheless not authorized by state law to administer oaths. However, under the
Charter of the City of Owasso, Oklahoma, "[a]ll officers authorized by federal or state
law, the mayor,..., and such other officers as the [Clouncil may authorize(emphasis my
own),...may administer oaths or affirmations on any matter pertaining to the affairs and
government of the [C]ity ". A copy of the quoted Charter provision is attached for your
convenience.
Based on the foregoing, I am of the opinion that the Secretary of the State of Oklahoma, a
public officer, may be authorized by official act of the City Council of the City of
Owasso, Oklahoma, to administer the oath of office to an official or officer of the City of
Owasso, Oklahoma.
Staff recommends that the City Council authorize Secretary of State Susan Savage to
administer the oath of office to Members of the Owasso City Council.
Charter
Section 8 -7 Holding More Than One Office.
Except as may be otherwise provided by this charter or by ordinance, the same person
may hold more than one office in the city government. The city manager may hold more
than one such office, through appointment by himself, by the council, or by other city
authority having power to fill the particular office, subject to any regulations which the
council may make by ordinance; but he may not receive compensation for service in such
other offices. Also the council by ordinance may provide that the city manager shall hold
ex officio designated offices subordinate to the city manager as well as other designated
compatible city officer, not withstanding any other provision of this charter.
Section 8-8 Bonds of Officers and Employees.
The city manager, the city treasurer, and such other officers and employees as the council
may designate, before entering upon their duties shall provide bonds for the faithful
performance of their respective duties, payable to the city, in such form and in such
amounts as the council may prescribe, with a surety company authorized to operate
within the state. The city shall pay the premiums on such bonds.
Section 8 -9 Oath or Affirmation of Office.
Every officer of the city, before entering upon the duties of his office, shall take and
subscribe to the oath or affirmation of office prescribed by the state constitution. The oath
or affirmation shall be filed in the city clerk's office.
Section 8 -10 Who may Administer Oaths and Affirmations.
All officers authorized by federal or state law, the mayor, the city manager, the city cleric,
the municipal judge or judges, and such other officers as the council may authorized, may
administer oaths and affirmations in any matter pertaining to the affairs and government
of the city.
Section 8 -11 Removal, Etc., of Officers and Employees.
The power to lay off, suspend, demote, and remove accompanies the power to appoint or
elect; and the city manager, the council, or other appointing or electing authority at any
time may lay off, suspend, demote, or remove any officer or employee to whom he, the
council, or the other appointing or electing authority respectively may appoint or elect a
successor.
Section 8 -12 Acting Officers and Employees.
The appointing or electing authority who may appoint or elect the successor of an officer
or employee, may appoint or elect a person to act during the temporary absence,
disability, or suspension of such officer or employee, or, in case of a vacancy, until a
successor is appointed or elected and qualified, unless the council provides by general
ordinance that a particular superior or subordinate of such officer or employee shall act.
The council by general ordinance may provide for a deputy to act in such cases.

BACKGROUND:
At the March 17, 2004 City Council meeting, Ms. Diane Berryhill expressed concerns to the City
Council regarding drainage issues that were directly affecting her property. As a result of the
concerns expressed by Ms. Berryhill, Mayor Cochran directed the City Manager to review the
concerns and prepare a report to the City Council.
The report is attached for your information and review. It should also be noted that the City
Manager has visited the Berryhill property on four occasions since the March 17, 2004 meeting
during various rainfall events.
Final cost estimates for the alternatives are being figured at this time and will be available
Tuesday evening. The City Manager will be available to answer any questions you may have
regarding the report and its findings /recommendations. Ms. Berryhill has also requested to
address the Council at the April 20, 2004 meeting (See Agenda Item #8), and as a result, should
also be available should you have any questions.

Residents of Elm Creek Estates (First Addition) in the vicinity of the 84th Street cul-de-sac have
expressed serious concerns about flood hazards related to an inadequate drainage system
receiving stormwater runoff from a commercial area to the south and west of 86'h Street North
and 1291h East Avenue (see Attachment A). The resident of 12525 E. 84th Street N. has stated
publicly that during heavy rains, the water comes through her fence like a waterfall. Preliminary
hydrologic calculations indicate that flows from the commercial area have a high probability of
exceeding the capacity of the receiving catch basin and 18-inch pipe at least once in any given
year. Flow that exceeds the capacity of the 18-inch pipe currently passes overland between two
residential structures.
The drainage area of concern originates at a high point on 129'1' East Avenue approximately 200
feet south of the intersection and includes nearly 16 acres of commercial property (see
Attachment A). Runoff from the commercial property (Elm Creek Commercial Comer) collects
in a small catch basin drained by an 18-inch pipe at a point directly north of the residential
property near the 84th Street cul-de-sac (see Attachment B). Discharge from the catch basin
combines with residential flow from 84th Street North in a junction box beneath curb inlets at the
west end of the cul-de-sac. The combined flow then meanders through residential property and
eventually discharges into Elm Creek Tributary A.
Based on record drawings, the 18 -inch pipe was designed to carry 40.65 cfs in a 100 -year event.
Under existing conditions the 15.7-acre commercial area generates over 146 cfs in a 100-year
event. In fact, the one-year peak flow from the commercial area exceeds the 100-year design
capacity of the 18-inch pipe by over 7 cfs. The record drawings indicate the pipes downstream of
the 18-inch pipe were sized to carry runoff from residential drainage areas plus additional runoff

Three alternatives were considered:
Increase the capacity of the existing closed conduit system that meanders through over
4000 linear feet of residential property before discharging into Elm Creek Tributary A.
Construct a detention facility on the southern portion of the old First Baptist Church
property. This alternative could involve either purchasing or receiving in donation a
portion of the land south of the old First Baptist Church.
Divert excess flows from the 15.7-acre commercial property westward away from the
residential property to a discharge point on Elm Creek Tributary A. Approximately
1400 linear feet of large diameter pipe will be required to carry flows in excess of the
1 8 -inch pipe capacity for runoff events up to and including a 100 -year storm.
Preliminary considerations indicate some form of diversion to be the most attractive alternative.
Diverting excess flow from Elm Creek Commercial Comer can likely be achieved with no
significant impact on the proposed receiving channel and private property along Elm Creek
Tributary A. The proposed discharge point is approximately 1400 feet west of the existing catch
basin along an open path directly north of an existing fence line (see Attachment C). Although
the proposed pipe alignment is clear of major obstructions; two street crossings, as well as public
and private utilities, will likely be encountered during installation of the storm pipe.
Location of existing utilities should be investigated prior to committing to any alternative.
Access to private property will be limited to existing utility easements and temporary
construction easements may be required in some locations to store materials and equipment. A
thorough investigation of available easements is recommended. Both geotechnical and traffic
considerations determine whether the street crossings would be bored or open cut.
Final hydraulic design of the conduit would involve a determination of upstream and downstream

inverts, a determination of the likely flows anticipated to be diverted to this pipe, pipe diameter
and details of terminal structures. Should a combined detention facility for both the Church
property and the excess commercial runoff prove economically feasible (based on price or
donation of property), the anticipated total flows from that project would be added to the
proposed diverted flows and must be accounted for in the design.

I am writing today to confirm our past discussions pertaining to the drainage project presently underway in the Windsor Lake II and
Nottingham subdivisions.
Based on our discussions over the past couple of months, and according to the approved engineering design for the project, the following list of
requirements are to be met:
1) The new line is to be installed upon a 6 -inch gravel base.
2) The new line is to be covered with a minimum of 6- inches of gravel.
3) The new line is to originate at the concrete outlet, located on my property, and be routed parallel with my South property line.
4) One of my trees was to be removed to accommodate equipment and the new line.
5) The area inlet located upon my property is to be installed in the low point and so that the top of the grating will be located 2 to 3 inches below the
natural grade of my yard.
Unfortunately, the contractor has been permitted to install the system without meeting the requirements listed as No. 1, No. 2, & No. 4. Work is already
underway to violate No. 3. And hopefully you can understand that I am concerned that the requirements for item No. 5 may also be ignored.
As you will recall, we most recently met at my property on Monday March 8th to discuss the project. Following a rain storm that occurred on March
4th, two of the 3 joints of pipe had floated out of the trench. During our meeting you indicated to me that the contractor would be required to remove
the pipe, reexcavate the trench, and reset the line. Work resumed on March 10th and this did not occur. In fact the line was left as is, with no bedding
or gravel fill. As a result of the sudden rise, the first three joints of line now have an approximate grade of 7 %.
During that same meeting we discussed the routing of the line located on my property. You indicated that neither the contractor or the City was willing
to incur the cost associated with relocating a telephone pedestal. You also told me that the line would be routed up close to the pedestal. The design
you reviewed with me clearly shows the line to be routed parallel, and approximately 5 feet along the side of my property line. The current routing of
the line drifts out at least 15 feet.
During the same March 8th meeting we discussed the removal of trees and tree stumps on my property. Obviously, I expect that any trees that have
been fell to also have the tree stumps removed. I also am concerned about the threat of removing or damaging more of the trees (presently 2 trees
have been cut and a 3rd is now in jeopardy of falling). These willow trees serve an important function, as they draw a great deal of the water up from
the area, helping to dry the soil. Without the benefits of the trees, I am concerned that I will have even more water to contend with.
During the same March 8th meeting you confirmed that the area inlet would be located at the low point in the natural grade of the yard, and that the
grate would be 2 to 3 inches below the natural grade. In order to accomplish this task, it would appear to me that the telephone pedestal will need to
be relocated, since it is located within 1 foot of the low point in my yard.
Jeff, please understand that I am concerned about the final installation of this project, as the residents in this area are the ones who have to live with it.
Obviously the project has turned into a bigger job than either the City or the contractor anticipated, overrunning any of the original estimates of time,
today representing the 20th day since construction began. Albeit a difficult project, there remains no excuse for substandard installation. Doing the
right thing is seldom the easy way, and I do appreciate the difficulty that it presents. I am requesting that you, as the City's representative and
supervisor on this project, please see that it is installed as designed.
Please let me know directly, through return email or other written correspondence, if you see that I have misinterpreted any of our past discussions or
any of the construction plans that you are working with.

Dear Mr. Bain:
I write today to insist that you stop construction on my property immediately, and reinstall the
project as designed. 'The City of Owasso, by way of the contracted construction company
Magnum Construction, has installed the storm water drain line such that a pond will now form in
my yard. This pond will cause damage to my property, resulting in loss of property value.
The present installation of the system will have the top of the area inlet grating at an elevation of
no less than 7 inches higher than the low point of natural grade in my yard. By your own
explanation, the inlet grating was to be 2 to 3 inches below the lowest point in my yard, which
would mare the system approximately 9 to 10 inches higher than acceptable.
The contractor has also failed to install the area inlet in the location that the City had agreed to.
The area inlet was to be installed such that it would be in alignment with the natural course of
water flow across my property, which logically is also the low point on the property. The area
inlet box is presently located 8 to 10 feet West of this point, towards the center of my yard.
The contractor has also rendered the area inlet box useless by cutting 8 inches off the top, leaving
less than 1 inch between the "top of pipe" and "top of box ". By doing so, there is no way to
provide adequate cover over the pipe such that grass will grow. With any significant overland
flow, the line will readily wash out and be exposed.
As you know, I have expressed by concerns about the substandard installation of this project
before. For your convenience, I am including a copy of my most recent communication (e-mail
sent March 15, 2004) in which I encouraged you to reconsider the project to date and that you
require the project to be installed correctly and as designed. Unfortunately, it appears that the
City did not heed these concerns, and is now in a position where it must take corrective action
that will be even more costly.
Your immediate written response to this letter is requested. I am most interested in settling this
matter in the most expedient manner possible, and would welcome the opportunity to discuss
possible solutions.

The rain that occurred Sunday morning (3/28/04) has served to enunciate the concerns that my
neighbors, my wife, and I have had about the practical utility of the drainage system that has recently
been installed along the Windsor bake and Notingham subdivisions. I have attached a two image files
which will give you a good idea of what has happened (The image files are large so I have limited it to
two with this email, if you would like to see more, please let me know), You will see that much of the
line is now exposed, including the "goose-necked" portion near the South end, You will also see that the
area inlet located upon my property has failed to serve its intended role. The line and fill running West
to East across my property has indeed served as a dam, and as you can see in the photos, the turbulent
flow resulted in most of the cover being washed away and the pipe and inlet box being exposed,
As Melissa verbally expressed to Mr, Ray, Mr, Thoendel, Ms, Stagg, and Mr. Bain this past Monday,
and as I have documented in prior written communications, the current installation is inadequate,
requiring that water run up hill in order to function. Obviously this is not going to occur.
This project is now in its 34th day since construction began, and frankly we are worse off today than
when the contractor began the work. I am extremely disappointed in what has transpired to date and
very interested in getting a workable solution installed as soon as possible. To this end, I am
requesting that Mr. Ray, and any appropriate City staff, meet with me this week, as soon as possible, to
discuss, formulate, and commit to an acceptable solution. I can only hope that each of you would give
me and my family the benefit of understanding in this matter. I can't help but be convinced that if
this was your property that each of you would also find this situation to be completely unacceptable.
My wife and I can make ourselves available any day but Tuesday and Friday, March 30th and April
2nd. If it is acceptable with you, I would like to meet at my home, and can meet in the evening if any of

The following are my basic expectations:

2) Sufficient cover is to be provided so that the pipe manufactures minimum cover specification can be met.
3) The yard is to be regraded such that a minimum of 2.0% grade is achieved.
A) Quality top soil is to be used for fill material (the excavated clay should be removed).
5) Bermuda grass sod is to be applied and sufficiently anchored so that it can establish roots and stabilize the soil.
6) The three tree stumps are to be removed or ground to a level not less than 6- inches below the surface.
7) Any fences impacted by the re- grading of the yard are to be raised and reset accordingly.
8) Damage to fencing material, in- ground sprinkler system, french drains, or other existing systems are to be repaired to original condition.

During a phone conversation with Ms. Stagg and Mr. Carr earlier today, I informed them again that the
grate was not at the low point in the yard and that this had been confirmed by both a registerd Civil
Engineer and a registered Surveyor. My suggestion to them was that the City of Owasso stop spending
taxpayer's dollars until a mutually acceptable design has been developed.
I have also recently been made aware that the City is also responsible for replacing the 3 ) trees that were
destroyed. I respectfully request that 3 mature willow trees be planted, or that cash payment be made to
me instead. I will secure estimates for the trees from a local nursery. Please have the appropiate
member of staff contact me concerning payment.

INTRODUCTION:
Presented for the Council's consideration is Resolution No. 2004 ®05, a resolution
resolving the necessity of instituting and prosecuting condemnation procedures to acquire
Permanent Right of Way and Temporary Construction Easement at 9497 East 86th Street
North necessary for the 86th and Mingo Intersection Improvement Project from Strawdey
Clinton McCarty.
On November 17, 2003, there was communicated to Strawdey Clinton McCarty, a
conditional offer to purchase a portion of the Permanent Right of Way necessary for the
86th and Mingo Intersection Improvement Project. The City at that time as well as
presently needs 43,208.55 square feet of Permanent Right of Way and approximately
6800 square feet of Temporary Construction Easement for the project. The City
conditionally offered the sum of $15, 300.00. This offer represented the appraised
amount of the Permanent Right of Way and damage to the remainder as established by
the Appraiser in his report rendered November 18, 2002, as reviewed and approved by a
Review Appraiser on April 28, 2003. The City subsequently endeavored to communicate
by letter as well as by telephone with Mr. McCarty regarding acquisition of an additional
Waterline Easement and Temporary Construction Easement, however, Mr. McCarty to
date has failed and refused to communicate with City representatives regarding this
matter.
It is submitted that the City of Owasso is in need of proceeding with this acquisition. The
86th and Mingo Intersection Improvement Project as originally planned presented a much
needed improvement. As originally intended this project would provide a more efficient
and safe vehicular movement in the 86t" and bingo intersection area. The need has only
heightened with the imminent closing of 76"' Street North anticipated to occur within
days.
Based upon the foregoing, it is submitted that at this time Condemnation is the only
available mechanism to obtain the needed property and property interests. A public
purpose for the sought property and property interests is unquestionable. further, the
representatives of the City have offered to Mr. McCarty a fair price for the property as
well as have tried to communicate offers relating to the property interests sought. It is
submitted that a resolution of necessity authorizing the institution and prosecution of a
condemnation action is appropriate.
It is recommended by staff that the Council adopt Resolution No. 2004-05. Should you

WHERE,AS. The City of Owasso, by and through officers and agents thereof, has
endeavored to obtain Permanent Right-of-Way and Temporary Construction Easement,
copies of same attached hereto and marked Exhibit "A', deemed necessary for the 86eh
North and Mingo Intersection and Widening Project from Strawdey Clinton McCarty;
WHEREAS. In connection with such efforts to obtain the needed Permanent Right-of-
Way and Temporary Construction Easement consensually, the City of Owasso, by and
through officers and agents thereof, has made bona fide good faith oilers seeking to
purchase same; and,
WHEREAS- The above - referred landowners have not accepted such offers and by
reason thereof Condemnation proceedings as provided for under the Constitution and
Statutes of the State of Oklahoma are necessary.
NOW, THEREFORE, BE IT RE, SOLVED BY THE CITY COUNCIL OF THE
CITY OF OWASSO, OKLAHOMA, THAT: Officers and agents of the City of
Owasso, Oklahoma, are hereby authorized to initiate and prosecute to the conclusion
thereof condemnation proceedings against Strawdey Clinton McCarty, to obtain the
necessary Permanent Right-of-Way and Temporary Construction Easement as set forth in
Exhibit "A' hereto as well as any additional relief to which the City of Owasso,
Oklahoma, may, by law, be entitled to.

Street North and Mingo necessary for the 86th and Mingo Intersection Improvement
Project from Ronald Lee and Gwendolyn Jean Ogan.
On November 17, 2003, there was communicated to Ronald Lee and Gwendolyn Jean
Ogan, a conditional offer to purchase a portion of the Permanent Right of Way necessary
for the 86th and Mingo Intersection Improvement Project. The City at that time as well as
presently needs 29,930.00 square feet of Permanent Right of Way and approximately
8500 square feet of Temporary Construction Easement for the project. The City
conditionally offered the sum of $46,400.00. This offer represented the appraised amount
of the Permanent Right of Way and damage to the remainder as established by the
Appraiser in his report rendered October 31, 2002, as reviewed and approved by a
Review Appraiser on April 28, 2003. The City subsequently communicated by letter as
well as by telephone with Mr. Ogan regarding acquisition of the additional Waterline
Easement and Temporary Construction Easement. During telephone conversations, Mr.
Ogan had indicated a willingness to grant a Waterline Easement for a tap and payment of
$209,510.00 for the Permanent Right of Way. Clarification was sought on the tying
aspect of the counter- offer. Additionally, attempts to discuss acquiring lessor interests in
the Permanent Right of Way than fee simple to minimize costs as well as interference
with the landowners' use were not successful.
It is submitted that the City of Owasso is in need of proceeding with this acquisition. The

OKLAHOMA, RESOLVING THE NECESSITY OF INSTITUTING AND
PROSECUTING CONDEMNATION PROCEDURES TO OBTAIN PERMANENT
RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT
WHEREAS: The City of Owasso, by and through officers and agents thereof, has
endeavored to obtain Permanent Right-of-Way and Temporary Construction Easement,
copies of same attached hereto and marked Exhibit "A", deemed necessary for the 86"'
North and Mingo Intersection and Widening Project from Ronald Lee and Gwendolyn
Jean Ogan, husband and wife;
WHEREAS: In connection with such efforts to obtain the needed Permanent Right-of-
Way and Temporary Construction Easement consensually, the City of Owasso, by and
through officers and agents thereof, has made bona fide good faith offers to purchase
same; and,
WHEREAS: The above-referred landowners have not accepted such offers and by
reason thereof Condemnation proceedings as provided for under the Constitution and
Statutes of the State of Oklahoma are necessary.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OWASSO, OKLAHOMA, THAT: Officers and agents of the City of
Owasso, Oklahoma, are hereby authorized to initiate and prosecute to the conclusion
thereof condemnation proceedings against Ronald Lee and Gwendolyn Jean Ogan,
husband and wife, to obtain the necessary Permanent Right-of-Way and Temporary
construction Easement as set forth in Exhibit "A" hereto as well as any additional relief
to which the City of Owasso, Oklahoma, may, by law, be entitled to.

At the direction of the City Manager, the Human Resource Staff began exploring options for
developing a systematic and well- defined method of establishing pay. Attempts have been made
in the past to implement a pay plan; however, adequate resources have not previously been
available to see such a project to completion. In an effort to ensure both the quality and
comprehensive nature of the final product and to keep this much needed project on track for
completion, an outside consultant was contracted.
Establishing a pay plan allows the City to maintain fair, consistent, equitable and competitive
compensation practices, while providing parameters for administration. A pay plan also allows
for management of the publics' resources while achieving the overall goal of recruiting and
retaining talented employees. The developed pay plan incorporates the philosophy of paying
what a job is worth with the belief that employees should be recognized and rewarded based on
individual job performance, a concept that, while unique to government, is nevertheless
producing better than expected results in the City's non - contractual work force.
The developed pay plan consists of ranges, with each range consisting of a minimum, maximum,
and a mid- point. The ranges are separated vertically and horizontally. Each position is placed
into the pay plan according to "job value."
In order to establish what a job is worth, the City's consultant conducted a survey of similar
positions in cities of comparable population. The ten cities selected were Ada, Altus, Bethany,
Chickasha, Claremore, Del City, McAlester, Sand Springs, Sapulpa, and Yukon. An annual
maximum average was calculated and used to place surveyed positions into the pay plan. Due to
Owasso's tremendous growth, the resulting workload, and the desire to be competitive in the
Tulsa area, positions were placed in the pay plan based on the mid-point which correlated with
the maximum average salary for comparison cities. Positions that were not a pail of the survey
were placed into the pay plan in relationship to similar positions surveyed, or by point factoring.
Point factoring entails arriving at a "job value" by evaluating a position based on components
such as know-how, problem solving, accountability, and level of responsibility.
Under the developed plan employees will be eligible for increases in pay based on their
performance between the minimum and maximum. A mid-point has been established for hiring
purposes. The mid-point provides a guide for hiring based on qualifications and experience.
Training rates are also a part of the developed pay plan. The training rates can be utilized when a
new hire does not completely meet the minimum qualifications, but otherwise possesses those
characteristics valued by the City. The training rate can be used to provide a period of time for
evaluation of the newly hired employee's ability to perform the basic requirements of the
position. The training rate allows the hiring of individuals who may be the "fight" person based
on character attributes and allow them time to gain the necessary experience or knowledge for the
position.
A well developed total compensation program should reflect the strategic goals of the City and
the varying needs of the employees, which ultimately increases productivity and improves
customer satisfaction. A pay plan is just one part of the total compensation program. The
developed pay plan has been created based on the City's commitment to motivating, recognizing,
and rewarding employee contribution and performance. However, with any program there are
issues of concern.
One issue involves employees who are currently being paid less than the new minimum pay for
their position. Once the pay plan is implemented, employees being paid less than the minimum
pay for their job will receive an increase in pay on July 1, 2004, placing them at the minimum
pay for their range. Placing current employees into the correct pay range will cost around
$65,400 which will be included as part of the 2004-2005 budget approval. Twenty-nine
employees are currently paid below the new minimum pay for their position.
Another issue involves employees who are currently paid more than the new maximum pay for
their position. The current staff position is that employees who are at or above the maximum pay
for their job would not be eligible for future increases, unless a cost of living increase is granted.
This issue affects four employees who are currently at or above the maximum pay for their range.
The developed pay plan provides a compensation program flexible enough to adjust to changing
economic conditions and individual needs, while maintaining fair, consistent, and equitable
compensation practices in alignment with the City's core values and management philosophy.
This flexibility results in an increased ability to attract, retain, and motivate qualified and
effective individuals.
Staff recommends City Council approving the purposed pay plan policy requiring the City
Manger to establish a pay plan which sets forth grades and ranges of pay for employees
authorized by the City of Owasso, with the intention that the City Manager as Chief
Administrative Officer utilize the pay parameters for compensation for employees of the City of
Owasso.

Note: it Is clearly tile intent of this request and the recommendation that tile Council policy
would be to require a pay plan and that the development and administration of such plan is the
responsibility of the City Manager.

The subject site's current zoning is AG (Agricultural District) — Tulsa County. The subject
property is surrounded by AG (Agricultural District) — Tulsa County on all sides except for Hwy
169 to the east.
Staff has received a petition from the First Free Will Baptist Church, requesting that the City of
Owasso annex approximately 42 acres of property. At this time it is our understanding the
applicant is requesting this annexation petition in order to begin a process that will result in the
development of facilities to the site which would include an addition to the existing church,
private faith-based school and day care and the addition of senior housing and sports fields.
If the property is annexed into the city the applicant will be required to follow normal
development procedures which would include rezoning, preliminary and final plat and site plan
review. If annexed, any development proposed for the property would be required to meet the
Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site
engineering standards as proscribed by Public Works including but not limited to paved streets
and sidewalks. The property is currently inside the City of Owasso sewer service area and water
is served by the Rural Water District #3 of Washington County.
The Owasso 2010 Land Use Master Plan calls for high intensity commercial and institutional
(school) development to occur in that general area.

On February 25, 2004 the Owasso Annexation Committee convened to consider the request, the
Committee consists of City department directors, representatives of the Owasso City Council,
Planning Commission, the Owasso school board and citizens at large. The Owasso Annexation
Committee concluded that the request is consistent with the Owasso Annexation Policy and
thereby unanimously recommended approval of the request.
On March 8, 2004 the Owasso Planning Commission held a public hearing to consider the
request. At that meeting the Commission unanimously recommended approval of the request for
annexation. There were no comments from the general public.
Staff recommends approval of OA 04-02 to annex the subject property into the city limits of
Owasso.

Called into Church In Action business conference by Pastor Leonard Pirtle.
Pastor Pirtle gave an overview of the new gym expansion project. We want to add a 35'
x 120' expansion to existing gym. We still have 13 acres available that we could
purchase. We need to add two Sunday School times, and three worship hours (the new
worship time at 9:45 a.m. in the gym.) We are presently $1.4 million in debt now; we
want to retire our debt, not add to it.
Pastor Pirtle presented Casey Cariker as staff growth campaign coordinator; and Ron
Hall as the Steering Committee Chairman.
Pastor Pirtle led in prayer for wisdom in our decision.
Casey Cariker presented the fact that reaching people was our master plan; and that we
need to be best stewards of our facility. Sunday, October 5, 2003 will be our kick-off
Sunday to this campaign.
Our objectives should be:
1) Higher in Worship (by renovating the gym so we can add a third service during
the 9:45 a.m. service.)
2) Deeper in Discipleship (by preparing to add a second Sunday School at 11 a.m.;
we will be able to disciple 200-300 more adults each week)
3) Stronger in Fellowship (by building an expansion west of our gym; allowing
Wednesday night dinners; Prime-timers fellowships; and wedding receptions)
4) Wider in Partnership (by partnering with our school ministries for a new lunch
expansion and bleacher space; youth ministries and gym renovations; and
children's renovation)
5) Greater in Stewardship (by continuing to teach Biblical stewardship through our
preaching, teaching and classes like Financial Peace University)
Ron Hall reminded us how our church has progressed, and grown since our move from
our Atlanta location. We have made an investment in eternity for our families. Our
objective is to reach and develop more people.
Pastor Pirtle gave an update on our new maintenance director., Troy Wilstead. We were
reminded that growth is still coming! And we need to take care of our buildings.
Pastor Pirtle gave us some items to consider: (See attached sheet)
1) Contract with Brewer Construction Co. to add a 35'x120' extension to our
existing gym. Cost not to exceed $360K total.
2) Conduct a "faith raising" program to pay for the project through cash gifts and
commitments. The campaign would run October 5-November 16, 2003; with all
funds turned in by January 2005.
3) Seek annexation for all 42 acres with the City of Owasso. (Pastor Pirtle and the
General Board will pursue and handle.)

35.46 acres of property. At this time it is our understanding the applicant is requesting this
annexation petition in order to begin a process that will result in the development of a single-
family subdivision similar in nature to the currently developing Remington Estates. In fact the
applicant is intending to connect any proposed development to Remington Estates.
The Owasso 2010 Land Use Master Plan calls for residential development in that general area.
Residential development on the subject property would have the ability to connect and be
accessed from two directions, north through Remington Estates and east on E. III" St. N.
through Fox Meadows.
Staff- published legal notice of the annexation petition in the March 18, 2004 edition of the
Owasso Reporter and letters of notification were mailed to property owners within a 300' radius.

BACKGROUND.
The Owasso Community Foundation, Inc. is a non - profit group of organized individuals created
for the purpose of constructing a one -of a kind playground in Owasso. It is proposed at this time
that the playground will be encompassed by a picket fence as well as a 7' wide asphalt walking
trail, in addition to the several interconnected large structures that create the main play structure
itself The playground would meet all National Playground Safety Standards, would be ADA
compliant, and upon its completion be donated to the City of Owasso.
The Owasso Community Foundation Board of Directors is comprised of the following
volunteers:
Ms. Robin Thoendel — President
Ms. Kenna Cataudella — Bice President
Mr. Tim Rooney — Secretary
Mr. Fred Costin — Treasurer
Ms. Donna Pepper
Currently, these individuals are visiting with church and civic groups, major retailers, financial
institutions, and others in order to create community involvement and commitment to the
planned park. Sponsorships for pieces of equipment, monetary donations, and volunteers to head
the various committees and for playground installation are all needed to bring this dream to a
reality as this will be the largest Community Build project in the State of Oklahoma. A copy of
the conceptual Community Build Park plan is attached for your information and review.
CI'T'Y COMMTI'MENT:
In order to assist the Owasso Community Foundation's efforts in soliciting the above described
commitments, it is important for the City to outline, publicly, its commitments to this endeavor:
Land — An approximate area of 3 acres located at the Owasso Sports Park. The specific
area is in the northwest comer of the park on the north side of the drainage area that
dissects the park. A site map is attached for your information and review.
Funding — Funding in the amount of $200,000 from the Vision 2025 election has been
earmarked for this project.
Maintenance — Upon donation, ongoing maintenance and upkeep of the park would be
provided by the City of Owasso park personnel.

TO ASSIST IN CREATION AND MAINTENANCE OF A COMMUNITY
BUILD PARK FOR THE CITIZENS OF OWASSO, OKLAHOMA
WHEREAS, the Owasso Community Foundation, hie., is an organized, non - profit

BACKGROUND

In November of 2003, Ms. Linda Sullivan presented the purpose of the Citizen Corps program to
the City Council at a work session. The program allows for the creation of a council comprised
of community leaders, citizens, and other interested persons to meet monthly to assist the local
city government in the promotion of emergency preparedness for its citizens. As you may recall,
the City of Tulsa is very active in this arena.
Shortly after the November work session, Ms. Sullivan drafted the necessary paperwork to form
the Owasso Citizen Corps Council. Recently, Ms. Sullivan was notified that the application was
approved, thus entitling the group to receive $1,000 from the state in order to start programs of
education in our community regarding emergency readiness. In order to receive the funds, the
Owasso Citizen Corps Council must be formed.
The City of Owasso, being the local government entity and "sponsoring agency", must formally
appoint the Citizen Corps Council. Ms. Sullivan submitted a list of names on April 15, 2004 of
interested citizen volunteers, as well as a staff representative, willing to serve. Those individuals
are as follows:

Pursuant to direction of the City Manager, there is presented for the Council's consideration a
proposed contract relating to the lease of a portion of "Old Central" to Owasso Community
Resource Center, Inc ("OCR "). This Lease, if approved, will have the effect of terminating the
existing Lease between the City and OCR as relates to OCR's occupancy of "Old City Hall ".
On September 18, 2001, the City Council approved an agreement with Volunteer Network of
Owasso providing for the lease of the soon to be vacated "Old City Hall ". Copies of the Building
Lease as well as the Memorandum then presented to the City Council are attached for your
convenience. The successor to Volunteer Network of Owasso, Owasso Community Resource
Center, Inc., has occupied and presently occupies "Old City Hall" for the conduct of its
community outreaching and outsourcing programs.
As a part of the City of Owasso Capital Improvement Program the creation of two fire stations to
serve the needs of the citizenry was established as a priority. It was envisioned that a new station
would be located in the northeast quadrant of the City and another would be located in the area
now known as Original Town. It was determined that the most efficient and expeditious approach
to creation of a station serving the "Original Town" area would be the renovation of "Old City
Mall" to serve as a fully staffed and operational fire station. This necessitated analysis of options
relating to the OCR's continued occupancy of "Old City Hall ".
The analysis concerning the continued occupancy of Old City Hall by OCR resulted in a
determination that a negotiated relocation of OCR operations to the Old Central would be in the
best interests of the citizens, all factors considered. Linder the terms of the Building Lease, OCR
has a right to occupy the premises until February 1, 2005, The City of Owasso needs access and
utilization of the property prior to such time. The City would have a reimbursement obligation for
early termination of the Building Lease. OCR would need to secure additional alternative space to
in the City of Owasso to continue its operations here. Accordingly, representatives of the City and
OCR began negotiating a termination of one lease at Old City Hall, relocation of OCR to Old
Central and creation of a lease relating to Old Central.
As a result of the negotiations between the representatives and the City and OCR, a proposed lease
arrangement was tentatively agreed upon. The salient factors of the Lease are as follows,
1. Location - First floor of Old Central -1609 square feet;
2. Term-Five (5) years with one (1) option to renew for five (5) years on renegotiated rental
rate; Lease may be terminated on six (6) months written notice;
3. Rental- commencement of Lease through the twentieth month - $480.00 per month;
commencement of twenty -first month of Lease through the fortieth month - $720.00 per
month; commencement of forty -first month of the lease through the sixtieth month -
$960.00 per month; and, each month thereafter during remaining primary term - $960.00
per month;
4. Utilities- Lessee pays 11.10 % of water, trash, sewer, gas, heat and electricity charges
attributable to the first floor of the facility;
5. Credit -The Lessee shall have a credit of $36,000.00 for improvements at Old City Mall.
Up to $24,000.00 of the credit may be used for renovations and $12,000.00 (plus any
unused renovation credit) may be used to offset rental obligations. The credit provided for
must be used prior to the expiration of the initial term or it is extinguished; and,
6. Maintenance — Lessee will maintain its portion of the premises in a clean and orderly
manner.
It is submitted that the foregoing sets forth the negotiated provisions of the Lease. The remaining
portions of the proposed Lease are provisions that are intended to be utilized in the prototype lease
previously prepared for Old Central. A copy of the proposed Lease is attached for your
convenience.
If the Council approves the proposed Lease such will be forwarded to representatives of OCR for
formal action by its Board of Directors. Staff does not anticipate any problems on the part of the
Board of Directors of OCR with the proposed Lease Agreement.
It is Staffs' recommendations that the City Council approve the Lease as presented and authorize
the Mayor to execute such Lease. please do not hesitate to contact Mr. Ray or me with any
questions.

THIS INDENTURE OF LEASE, made in duplicate, this 18"' day of September, 2001, by and between
THE CITY OFOWASSO, OKLAHOMA (CITY) and VOLUNTEER NETWORK OWASSO (VNO),
WITNESSETH: That CITY, for and in consideration of the rents, covenants and agreements hereinafter
contained, does and by these presents, demise, lease and rent, for a period of three years from the first day of
February, 2002, to VNO the following described property, to wit:
The tipper floor of the city building (BUILDING) located at 207 S Cedar, to include the office and
common areas on the tipper floor; and access to the conference room on the lower floor, such
conference room to be scheduled through the City of Owasso Managerial Department.
VNO, for and in consideration of the use and possession of said premises for said period, does hereby
agree to pay unto CITY the sum of Seven Thousand Two Hundred and no /100 Dollars ($7200) for the first year.
Rental rate shall be reviewed annually and may be increased in each subsequent year, provided that VNO be
given at least 90-days notice of the increase, Said sum shall be paid in the following amounts and at the time
herein designated, to-wit:
On the first day of February, 2002, the sum of Six Hundred and no/100 Dollars ($600) and on the first day
of each and every month thereafter the sum of Six Hundred and no/100 Dollars ($600) until the total sum of
Seven Thousand Two Hundred and no/00 Dollars ($7200) shall have been fully paid.
VNO further agrees to pay one half (1/2) of the cost of the gas, electricity and city utilities for the building
each month.
In further consideration for the use and possession of said premises, it is understood and agreed that VNO
will make certain improvements to the building so that the building meets requirements set forth under the
Americans with Disabilities Act.
It is understood and agreed that the property herein leased will be used as a Family Resource Center only,
and for no other object or purpose, and this lease shall only be sublet to other non-profit agencies sharing
occupancy within the Family Resource Center.
VNO further agrees to keep and maintain all portions of BUILDING let to VNO by the terms of the
contract, in as good a state of repair as the same is turned over to them, natural wear and tear alone excepted.
VNO further agrees to be responsible for cosmetic maintenance items such as painting and carpeting, while
CITY agrees to maintain the exterior of the building and premises, including lawn maintenance, and to maintain
the electrical, plumbing, heating and air conditioning components of the building, provided that VNO shall pay the
first $300 per occurrence on maintenance costs specific to the upper floor of the building and the first $150 on
repairs that benefit both upper and lower floors of the building.
Provided that CITY is in full compliance with its obligations under the lease, VNO further agrees to hold
free and harmless and does hereby release said CITY from any and all damages except those that occur to the
contents of any portion of the leased premises due to a negligent or intentional act attributable to it. VNO shall
not be liable for any damages to the premises except those caused by a negligent or intentional act attributable
to it.
VNO agrees to not use said BUILDING, or any portion thereof, for any purposes that will increase the
insurance rate or risk on said BUILDING, or for any purpose prohibited by the Statutes of the State of
Oklahoma or the ordinances of the City of Owasso, Oklahoma.
IT IS UNDERSTOOD AND AGREED that time is the essence of this lease, and should VNO default
more than thirty days in the payment of any installment on the principal sum herein named, the total principal
sum shall become immediately due and payable and CITY shall be entitled to the possession of the premises, at
CITY'S option, and the property of VNO therein contained, and may sell and dispose of said leasehold and said
property of said VNO at public auction, and VNO shall be liable to CITY for the remaining sum unpaid and the
expenses incident to the collection thereof.
SPECIAL CONDITIONS:
Righ—Lof —Teirnination: It is understood and agreed, that either party may request termination of the lease
and. that for good cause, parties may mutually agree to terminate the lease, provided that parties are given at
least 90-days notice of the termination. It is further understood and agreed that VNO will not be obligated for
any further rents or utility costs after a mutually agreed termination.
VNO further agrees that the expiration of the time given in this lease is as follows, to-wit:
The first day of February 2005, without notice from VNO, to give possession of said portion of said
BUILDING to CITY, provided that VNO be offered first right of refusal in the event CITY continues to offer
the building for lease. No later than six months before the expiration of this Building Lease, the parties will
agree whether the Building Lease will be extended for an additional year. Thereafter, the Building Lease may,
by mutual consent six months before the end of any lease period, be extended from year to year. In the event
of fire, destruction of the building on said premises by fire shall work a termination of this Building Lease.
Should it become necessary for VNO to employ an attorney to enforce the terms of this Building Lease, CITY
agrees to pay a reasonable attorney's fee.

The City Council concluded several months ago that leasing the "old" City Hall building or a
portion of the facility would be preferable to selling the property. City staff supports this
approach over the short -term simply because the City must maintain its Storm Emergency Center
located in the basement of the building. We also need storage space for municipal records that
must be retained for seven to ten years.
Volunteer Network Owasso approached the City last spring with a proposal to lease the first
floor of City hall for a family resource center. A proposed lease was submitted by VNO in May
as a result of a venture grant secured through the Tulsa Area United Way. The proposed lease
agreement received considerable discussion during the August City Council Workshop.
In addition to making several revisions to the lease agreement, the City Council requested that
the City Manager place a notice in both the Tulsa World and the Owasso Reporter inviting other
interested parties to submit proposals for leasing the first floor of City Fall. The deadline for
submitting proposals, September 5 "', passed without a single bid.
The attached VNO lease addresses all of the issues raised in the August 14 "' Council
Workshop. Those revisions are outlined as follows;
1) Utility Costs -- the term "city utilities' was added to the lease to ensure that VNO is
obligated to pay one -half (1/2) of all building utility costs each month.
2) Building Maintenance — language was added to require that VNO contribute to the
cost of maintaining the building. VNO will pay the first $300 per occurrence on
maintenance and repair for the upper floor or $100 for repairs that benefit both upper
and lower floors.
3) Fold- harmless provision — paragraph 8 was added to the lease to clarify a liability
issue raised by the City Council. The City is released from any and all damages to
the premise and contents unless City is found to be negligent or commits an
intentional act.

4) Thirty-day default — VNO is in default of the lease terms if payment is more than 30
days past due.
5) Lease Termination -- VNO will not be obligated to pay any further rent or utility cost
should a mutually agreed upon termination notice be executed by the parties.
6) Building Renovation — VNO will be reimbursed for the pro-rated costs of renovating
the building should the City decide to terminate the lease within three years. Should
VNO terminate the lease, the City is not obligated to pay for the building
modifications.
7) Lease Renewal —The parties will meet in six months after each year to determine
whether or not the lease should be extended for an additional year,
8) Reporting Requirements — The City and VNO have agreed that VNO will submit
quarterly financial reports to the City along with copies of any activity reports
required by the Tulsa Area United Way.
Staff believes that the residents of this community would benefit from the service that can be
provided by the proposed VNO Family Resource Center. We think that a centralized, convenient
location for social service programs will improve the delivery of these services to residents
seeking family support from the participating non-profit agencies.
We think the proposed lease provides the parties with some mutual benefits over the short-
term. The lease will give the City the flexibility to use the lower floor of the building over the
next three years while minimizing the cost of maintaining the facility.
The bottom-line for the City Manager is simply that Family Resource Centers are proving to
be very popular in other communities. It will be up to VNO to make it work in Owasso. I think
it is well worth the effort to find out one way or another if the concept can work in our
community.

that the city will not unreasonably withhold approval of such alteration or modifications. It is agreed that Volunteer Network Owasso
will be responsible for all costs related to subject renovations, however, in the event that the City of Owasso terminates the lease prior
to the culmination of three years, the City of Owasso agrees to reimburse Volunteer Network Owasso for its prorated amount of
expenses incurred in modffj�ing the building. In the event that Volunteer Network Owasso terminates the lease prematurely, the City
of Owasso is not obligated to reimburse VNO for the renovation costs incurred.

(n September of 2001, Volunteer Network Owasso (VNO) applied for venture grant fanding
from the Tulsa Area United Way to help establish a Family Resource Center for Owasso. In
January of 200 1, Volunteer Network Owasso was notified that their application for venture
grant funding was approved contingent upon establishing a lease with the City of Owasso.
As the lead agency and tenant, VNO will bear the financial responsibility for the center and
will sublease to the participating non-profit agencies. The venture grant from United Way will
be administered through Volunteer Network Owasso, however, the monies for the center will
be maintained in a separate bank account and budget separate from Volunteer Network
Owasso's operating budget. All funds for the center will be strictly designated for costs
associated with the center and for the benefit of all participating agencies. VNO will also
provide a quarterly fimncial report to the Owasso City Treasurer concerning the center's
fhaancial operations.

Resources, Inc,, whose address of record is, 207 S. Cedar, Owasso, OK 74055, hereinafter called
"Lessee", (whether one or morel.
W I T N E S S E T H:
That Lessor hereby Leases to Lessee, and Lessee hereby Leases from Lessor, for the
purpose of office use and for no other purposes, those certain premises, with the appurtenances
thereunto belonging, situated in the County of Tulsa, State of Oklahoma, and more particularly
described as follow, to-wit:
The portions of the first floor of the building located on Lots I through 6, Block 9,
Original Townsite of Owasso, OK, consisting of approximately 1,609 square feet, as depicted on
Exhibit "A" hereto,
upon the following terms and conditions.
TERM: The primary term of this Lease shall be for a period of Sixty (60) months,
commencing on execution of this Lease. If Lessee shall not then be in default, Lessee shall have
an option to renew this Lease upon the same terms and conditions except the for rental to be paid
hereunder. The Lessee shall notify the Lessor in writing not less than 90 days prior to expiration
of the initial term of Lessee's desire to renew. Lessor and Lessee shall, in good faith, negotiate
and arrive at a fair and reasonable rental for the renewal term; provided, that until such rental for
the renewal term is agreed upon, the monthly rental amount in effect on the last month shall
continue and be paid.
Either party may terminate this Lease by giving not less than six (6) months prior written
notice to the non-terminating party. In the event the Lessor is the terminating party and such
termination is without cause, then, in such event, the Lessor shall pay unto the Lessee any
unused credit that is provided for in the succeeding paragraph.
R-ENT: Rental shall be payable in the following manner, commencement of Lease
through the twentieth month - $480.00 per month; commencement of twenty-first month of
Lease through the fortieth month - $720.00 per month; commencement e'nt of forty-first month of
the lease through the sixtieth month-$960.00 per month; and, each month thereafter during
remaining primary term - $960.00 per month. Such monthly payments shall be due and payable
on or before the day of each month.
The Lessor will recognize a credit owing unto Lessee in the amount of $36,000.00 for
capital improvements to Old City Hall. Of such credit, up to $24,000.00 may be used for
renovations and $12,000.00 (plus any unused renovation credit) may be used to offset rental
obligations other-wise due hereunder. Lessee may apply the rental credit at such times and in such
amounts determined by the Lessee in its discretion provided, such credit must be exhausted on or
before the expiration of the initial term of the Lease. The credit may not be used to offset any of
the Lessee's utility costs. Any amount of credit remaining at the conclusion of the primary term
shall be extinguished and the credit herein provided for shall be deemed satisfied.
USE: Lessee shall not use, or permit said premises or any part thereof to be used for any
purpose or purposes other than the purpose or purposes for which the said premises are hereby
Leased. Lessee shall provide Lessor a certificate of liability insurance showing Lessor as an
additional insured and shall at Lessee's sole costs and expense, comply with any and all
requirements pertaining to said premises, of any insurance organization or company necessary
for operation of said premises.
RIGHT OF VISITATION BY LESSOR; It is further agreed between the parties
hereto, that the Lessor or its designated employees or agents, may at all reasonable times enter
said premises to examine the condition of same, though under no obligation to do so.
ABANDONMENT® Lessee shall not vacate, or abandon the premises at any time during
the term; and if Lessee shall abandon, vacate or surrender said premises, or be dispossessed by
process of law, or otherwise, any personal property belonging to Lessee and left on the premises
shall be deemed to be abandoned, at the option of Lessor.
PAYMENT OF UTILITY SERVICES BY LESSEE® Lessee shall pay its
proportionate share for all water, trash, sewer gas, heat, light, telephone service, power and all
other service if any, supplied to said premises. The amount of the payment has been determined
by dividing the total square footage of the first floor of Old Central by the square footage of
space leased to the Lessee. Such percentage amount is established at 11.10 %.
ALTERATIONS: Lessee, upon obtaining Lessor's consent, shall have the right, at
Lessee's sole expense, to make any and all alterations, additions, and changes, on said premises,
as may be lawful, and as may be necessary for the purpose of conduct of the business for which
said premises are Leased. Any additions to, or alterations of the said premises, except movable
trade fixtures and such equipment as machinery, shall become at once a part of the realty and
belong to Lessor.
USE I'LLU'TION CONTROL AND INDEMNIFICATION: Lessee agrees not to
use, or permit the use of, the premises in any manner or for any purpose that may be contrary to
the laws of the United States of America, the State of Oklahoma or of any unit of regional,
county or local government, or contrary to the lawful rules, or regulations, or ordinances of any
board, commission, or department having the right to make or issue the same, and agrees to
comply with all federal, state, and local solid- waste, air, water - pollution, and all other
environmental control laws ordinances, and regulations and to further comply with the terms,
conditions, requirements, and provisions of any permits issued by governmental agencies
covering the premises.

Lessee further hereby indemnifies and agrees to defend and hold harmless Lessor, its
trustees, officers, agents and employees, from all costs or expenses incurred by Lessor to clean
up or remediate any condition on the premises created directly or indirectly as a result of
Lessee's operations hereunder or to clean up or remediate any condition on the premises arising
directly or indirectly out of any breach of federal, state or local laws.
Lessee f ] rther agrees that no use shall be made or permitted to be made of the said
premises, nor parts thereof which will increase the existing rate of insurance upon the
improvements or buildings located upon said premises, or cause a cancellation of any insurance
policy covering said premises or any part thereof, Lessee shall, at Lessee's sole costs and
expense, comply with any and all requirements pertaining to said premises, of any insurance
organization or company necessary for the maintenance of reasonable fire and public liability
insurance covering said premises and appurtenances.
LIENS: Lessee agrees that Lessee shall save and keep the premises herein demised free
from any and all mechanics and material liens, and all other liens arising from the fulfillment of
Lessee's obligations hereunder, and Lessee agrees to indemnify and save Lessor harmless from
any and all such liens, costs, expense, attorney's fees, loss or damage, resulting from the filing of
any such lien or liens, and, in the event of any such mechanics' or material liens attaching
thereto, or any such liens or any character, said Lessee shall pay and fully discharge the same
within thirty (30) days after- written notice to do so by the Lessor. Provided further, that the
Lessor shall have full authority to discharge and pay off all mechanics' and materialmen's liens,
and other liens, arising out of any default of payment by the Lessee, and for such payment, if
any, by Lessor, said Lessor shall be reimbursed by the Lessee, upon demand for such payment,
with interest at the rate of 8 per cent (8 %), per annum.
ILLEGAL, USE AND PUBLIC NUISANCE® Lessee agrees not to use, or permit the
use of, the premises herein demised for any purpose that may be contrary to the laws of the
United States of America, or laws of the Mate of Oklahoma, or contrary to the lawful rules,
regulations, or ordinances of any board, commission or department having the right to make the
same. Lessee further agrees to operate said premises in such a manner as not to permit said
premises to become a public nuisance, or to be obnoxious to the owners and /or occupants of
adjoining property.
MAIN'T'ENANCE AND REPAIRS BY LESSEE® Lessee shall be responsible for the
maintenance of the interior portions leased by it. Lessee agrees not to commit any waste in or on
said premises or any part thereof, and agrees to pay and indemnify the Lessor for any and all
injuries and damages to any improvements, or any portion thereof, on the premises herein
Leased, which may be committed by Lessee, Lessee's employees, invitees, customers or guests,

either by accident, negligence, or which may arise otherwise, through or be caused by, or
contributed to, the negligence of Lessee, their agents, servants, employees, invitees, customers or
guests. Provided further, however, that the obligation of the Lessee to make any repairs herein
provided shall only arise after Lessee has been notified, in writing, by the Lessor of the necessity
therefor.
DAMAGES AND INJURY BY TRESPASSERS: It is agreed, Lessee shall at all times,
be liable for repairs and maintenance for any and all damages or injury to the premises leased
and/or that portion of the building that Lessee has access to occasioned by any person, or
persons, other than Lessor, its agents or servants, while upon the premises.
APPONTMENT OF RECEIVER FOR LESSEE: The appointment of a receiver, or a
trustee, to take possession of or substantially all of the assets of Lessee, or a general assignment
by Lessee for the benefit of creditors, or any action taken or suffered by Lessee under any
insolvency or bankruptcy act shall constitute a breach of this Lease, and Lessor shall be entitled
to immediate possession of the premises.
TERMINATION OF LEASE ON ACCOUNT OF BREACH OF LESSEE: In the
event of any breach of this Lease by Lessee, then Lessor, in addition to other rights or remedies it
may have, shall have the immediate right of re-entry and may remove all persons and property
from the premises. Should Lessor elect to re-enter, as herein provided, or should it take
possession pursuant to legal proceedings or pursuant to any notice provided for by law, it may
either terminate this Lease or it may, from time to time, without terminating this Lease, re-let
said premises or any part thereof for such term or terms and at such rental or rentals and upon
such other terms and conditions as Lessor in its sole discretion may deem advisable, with the
right to make alterations and repairs to said premises; upon each such re-letting, Lessee shall be
immediately liable to pay to Lessor the amount, if any, by which the rent reserved in this Lease
for the period of such re-letting exceeds the amount agreed to be paid as rent for the demised
premises for such period of such re-letting.

MAINTENANCE _OF EXISTENCE. Lessee agrees to maintain Lessee's existence for
the term of this Lease and any extensions or renewals thereof, provided, that merger of Lessee
with any other firm or corporation, shall not work a forfeiture of the Lease, but shall bind such

PEACEFUL ENJOYMENT: Lessor covenants that the Lessee, on paying the rental
herein provided, and performing the covenants and conditions herein contained , shall and may
peacefully and quietly have, hold, and enjoy the said demised premises for the term aforesaid.
PRIOR LEASEHOLD TERMINATION- The parties, by execution hereof, cancel and
hold for naught all terms, conditions and provisions of that certain lease agreement by and

Pursuant to direction of the City Manager, there is presented for Council consideration a
proposed revised Policy Statement of the Owasso City Council relating to the Owasso Sales Tax
Watchdog Committee. Additionally, staff is submitting proposals for notification to the public of
vacancies on the Sales Tax Watchdog Committee ( "Committee "), time frames for receipt of
Letters of Interest from citizens as well as procedures for Committee member selection.

The Sales Tax Watchdog Committee was initially formed as a part of the 1988 sales tax extension
bond election. The purpose for its formation was to provide a body of representatives from
various interest groups within the Owasso community to monitor the use of the designated third
penny of local sales tax.. In the Spring of 1991, a membership criteria subcommittee of the
Committee made recommendations to the full Committee establishing minimum criteria for
appointments to the Committee. This, it was opined, was necessary to insure the integrity of the
makeup of the Committee as established by a vote of the people. A policy providing criteria and a
guideline for selection would eliminate as best as possible any arbitrary selection and further the
representative make-up of the Committee. On May 15, 1991, the Council approved a policy
relating to appointment of Committee members from certain predetermined vocations.
On October 14, 2004, the voters of Owasso approved a ballot measure that, in part, removed any
cessation of the third penny sales tax absent future action on the part of the Council or the voters
themselves. The Sales Tax Watchdog Committee was essentially reestablished as a part of the
proposition approved by the voters. In furtherance of this electoral mandate, staff has undertaken
a review of the existing policy to "shore up" any areas that have proven to be problematical.
Essentially, the area in greatest need of revision involves when a member ceases to hold a
membership position on the Committee. Over the years questions have arisen concerning the
status of members who had either moved from the City without notice to City Officials or
members simply not attending meetings. This uncertainty resulted in a Committee without full
membership participation and consequently without full community representation as intended.
The proposed Policy Statement delineates the events which serve to create a vacancy.In this
regard the events chosen are, to -wit: absence from meetings, residency and cessation occupation
within the appointive category. Staff also is proposing for the Councils' consideration elimination
of the Economic Development category, creation of a new category, i.e., Service Industry, and a
reallocation of the number of positions within the categories to accommodate the changes. This is
proposed as a means of providing more representation to the ever - increasing service sector of the
City's economy without numerically sacrificing any person(s) with interests in the economic
betterment of the community.
A proposed Policy Statement is attached for your review. It consists of a short statement and a
listing of ten criteria /definitions that are directly related to each of the categories.
It will be incumbent upon the Council to select members for the re-established Committee. The
membership of the existing Committee is set forth on an attachment. Indicated on the Listing
attached are the names of the individuals who wish to continue serving. Additionally, there is
provided a "Notice of Sales Tax Watchdog Committee Vacancy ". If approved, the staff would
post the notice in City buildings, publish the notice in the Owasso Reporter and place the notice
on the City's WebPages. Additionally, the staff will monitor and retrieve names from the City's
talent bank of persons who have indicated an interest in the Sales Tax Watchdog Committee.
Receipt of the Letters of Interest is targeted to occur between May 3, 2004 and May 10, 2004. At
the conclusion of the receipt period, staff will assimilate the letters and provide copies to the
Councilors. On a date to be determined by the Council, interviews of interested persons will be
scheduled. On a date to be determined by the Council, the matter of the appointment of members
of the Committee will be placed on the agenda of a regular scheduled Council meeting.
The staff recommends Council adoption of the revised Policy Statement, approval of the Notice
of Vacancy and authorization to solicit interested persons for the positions.

The Sales Tax Watchdog Committee was initially formed as a part of the 1988 Sales Tax
Extension for the purpose of providing a body of representatives from various interest
groups within the Owasso community to monitor the use of the designated third penny of
local sales tax. Individuals from the representative group as well as from at large are
appointed to this committee by the Mayor and confirmed by the City Council. Such
persons are charged with meeting on a regular basis to review the status of capital
improvement projects funded by the third penny sales tax. The passage of Ordinance
Number 763 and 766 by the City Council as well as the subsequent approval of such
ordinances by the qualified electors of the City of Owasso assured a continuation of the
Sales Tax Watchdog Committee and the oversight given by such committee.
In order to ensure the integrity of the composition of the Sales Tax Watchdog Committee,
the City Council of the City of Owasso adopts the following criteria as guidelines for the
future appointments to the Owasso Sales Tax Watchdog Committee.
Each appointee must be a resident within the area defined as the Owasso fenceline
and /or school district (herein referred to as the "service area ") and must not be
presently serving in any elective or other Council appointive position with the City
of Owasso;
2. NEWS MEDIA APPOINTMENTS -An individual who conducts media - related
activities within the service area as their primary career or business;
RETAIL BUSINESS APPOINTMENTS- An individual who operates a retail outlet,
that being a business conducting direct sales to the public within the service
area;
4. SERVICE BUSINESS APPOINTMENTS -An individual who operates a service
business, that being a business providing direct services to the public within the
service area;
EDUCATION APPOINTMENTS -An individual employed by and actively engaged

in an Owasso school, either as an administrator or a teacher, and who resides in the
service area;
6. RECREATION APPOINTMENTS-An individual who is an active member of an
organized group promoting the development of amateur sports and recreation in
the service area-,
7. BUILDING INDUSTRY APPOINTMENTS-An individual who is engaged in
real estate improvement consisting of construction and/or development and having
his/her primary business within the service area,
SENIOR CITIZEN APPOINTMENTS -An individual who has attained the age of
60 years or more and who reside within the service area;
9. FINANCIAL APPOINTMENTS-An individual who is an officer or employee of
a financial institution engaging in banking, the brokerage of stocks or bonds, or
other major financial activity within the defined service area; and,
10. MEM13ERS AT LARGE APPOINTMENTS-An individual who is a resident within
the Service area.
The Sales Tax Watchdog Committee shall consist of fourteen (14) members selected
from the following,

A vacancy in any appointed position is hereby declared to exist upon the occurrence of
any of the following events, to-wit:
Any appointee absent from one-half (1/2) of all regular or special meetings in
any twenty-four (24) consecutive month period;
2. Any appointee who moves his/her residence out of the service area; or,
3. Any appointee who is no longer employed or engaged in the category from which
he /she was appointed.
The City Council shall be the sole judge of the qualifications of the appointees. Once a
vacancy has been determined to exist by the City Council, the City Council shall appoint
an individual possessing the requisite qualifications to serve from the respective category
on the Sales Tax Watchdog Committee.
The Sales Tax Watchdog Committee shall meet not less than two (2) times per fiscal
year. Such two regular meetings are hereby set for the fourth Monday of January and the
fourth Monday of July, and thereafter the fourth Mondays in January and July of each
succeeding year thereafter.

The City of Owasso requests "letters of interest" from citizens interested in filling a
vacancy on the Owasso gales Tax Watchdog Committee. The persons appointed by the Council
to fill these vacancies must be residents of the City of Owasso. Additionally, persons appointed
must be employed or engaged in one of the following occupational categories, to -wit: News
Media, Detail Business, Service Business, Education, Recreation, Building Industry, Senior
Citizen, financial, or be appointed to one of the Member at Large positions.
Upon appointment, such Member shall continue to reside within the City of Owasso
during the entire period of the Member's service, or upon removal of residence therefrom, forfeit
such office. Additionally, such Member must continue to be employed or engaged in the
category from which he /she was appointed. This appointment shall be for an indefinite time
period.
Letters of Interest shall contain information clearly indicating the address of the
interested citizen, the business, profession or occupation of the interested citizen and any other
information the interested citizen should wish to include, provided that such submittal shall not
exceed 10 total pages of standard 81/2" x 11" paper. No person presently serving in an elective or
other Council appointive position with the City of Owasso may hold an office on the Sales Tax
Watchdog Committee.
All "letters of interest" will be received between May 3, 2004 and May 10, 2004. Letters
