Consideration and appropriate action relating to a request for Council approval of OPUD 04-02, a planned unit development. Consideration and appropriate action relating to a request for Council approval of rezoning request OZ 04 ®05, f-om Tyann Development. Mr. Cuthbertson Attachment #14 Staff will recommend Council approve the closure of a utility easement located along the Western boundary of the Coffee Creek development area, beginning in the northeast corner of E. 103" Street North and U.S. Highway 169, proceeding north along the Highway 169 right-of-way and ending in the southwest corner of N. 138"' East Avenue and E. 106"' Street North. 15. Consideration and appropriate action relating to a request for Council acceptance of the Chelsea Park Final Plat from Tulsa Engineering and Planning Associates, Inc. Mr. Cuthbertson Attachment # 15 Staff will recommend Council accept the Chelsea Park Final Plat. 16. The City Council will conduct a public hearing relating to changing priorities previously established for capital improvements projects funded by the third penny sales tax; specifically moving the Garnett Road and E. 96t" Street North projects t o e the Tier I Projects priority level and moving the N. 129 th East Avenue from E. 76 1h Street North to E. 96th Street North project to the Tier 2 Project priority level. ITEM 1. CALL TO ORDER ER The meeting was called to order at 6030 p.m. ITEM 2. INVOCATION The invocation was offered by reverend Frank Adams, Pastor of Believers Covenant Church. ITEM 3. FLAG SALUTE City Manager Rodney Ray led the flag salute. ITEM 4. ROLL, CALL A quorum was declared present. STAFF Rodney J. EMPLOYEE OF THE MONTH Mr. Ray introduced Kyle Foster, an employee with Public Works' Sanitation Department, as the City's Employee of the Month for May, 2004. Action relating to Council acceptance of Ordinance No. 780, an ordinance approving the annexation of approximately 42 acres, more or less. The subject property is located in the northwest corner of US Highway 169 and East 106'h Street North. D. Action relating to Council acceptance of Ordinance No. 781, an ordinance approving the annexation of approximately 35.46 acres, more or less. The subject property is located 0.3 miles southeast of the North Garnett Road and East 116t1' Street Forth intersection. Mr. Thoendel moved, seconded by Mr. Cataudella, to approve the Consent Agenda with claims totaling $82,308.18 and payroll claims totaling $249,605.419 and for Council acceptance of Ordinance No. 780 and Ordinance No. 781, as stated above. Main Street, per the Notice of Public Meeting and Agenda posted on the City hall bulletin board at 4:00 PM on Friday, May 7, 2004. ITEM 1: CALL TO ORDER. Mayor Kimball called the meeting to order at 6:00 PM. PRESENT Susan Kimball, Mayor Craig Thoendel, `lice Mayor Steve Cataudella, Councilor Brent Colgan, Councilor A quorum was declared present. ABSENT Crary Cochran, Councilor Ms. Bishop explained the need for Resolution No. 2004 -08 and the savings on interest payments that would be provided. Councilor Colgan moved to adopt Resolution No. 2004 -08 as presented. The motion was seconded by Councilor Cataudella. The motion carried 4 -0. ITEM 3: DISCUSSION RELATING TO PUBLIC WORDS ITEMS Mr. Carr addressed questions regarding this item. Mr. Carr explained that the Public Works Department would be seeking council acceptance of this bid at the May 18, 2004 regular meeting of the OPWA. The attached resolution #2004-09 requests ODOC to assist the City of Owasso with the Community Development project. Further, the resolution affirms that the City will abide by all federal and state rules attached to the CDBG program. As part of its contract to administer the CDBG program with the City of Owasso, INCOG has prepared a Citizen Participation Plan for the project. The plan provides for and encourages citizen participation, particularly by low and moderate-income persons who reside in areas where CDBG funds are proposed to be used. It also ensures that citizens will be given reasonable and timely access to local meetings, information, and records relating to proposed and actual use of funds. Should the funding be awarded, there would be a match requirement. The City would have to co °t an amount equal to the grant (around $67,000) in order to receive the funds, bringing the total allowable project cost to approximately $134,000. Annual CDBG ftinds can be used for a variety of projects vAthin the eligible neighborhoods of the community, A map showing the eligible area is attached with this memorandum. Generally, the area currently includes census blocks located south of 76hStreet, northeast of Elm Creek and southeast of the Owasso Expressway/86"' Street interchange, and in the Main Street area south of Fourth Street. It should be noted that additional areas were included in previous CDBG projects (such as the Main Street area North of Fourth Street), and could be included in future CDBG projects, but for each project that affects those areas, a new income survey must be performed. Thus, that area is not shown as being included in the Census blocks that are eligible for funding. Two general types of projects are eligible for CDBG funding — community development projects and economic development projects. Examples of community development projects include sidewalks, street improvements, and projects that increase handicapped accessibility to community facilities. Examples of economic development projects include waterlines and sewerlines. In March 2004, the City Council found that the most pressing need of the three is to construct a handicapped accessible restro• rn facility at the skate park. Usage of the is is significant and warrants such a facility. The restroom is estimated to cost $109,000. A drawing of the desired facility is attached with this memorandum. The grant plus matching funds would be in the amount of approximately $134,000. Remaining funds would be used to provide sewer to the facility and to place sidewalks on Main Street in order to further increase accessibility to the park. We are very concerned about this proposed rezoning. We have discussed this issue with numerous residents who all share our concems. We realize the afea will be developed,— but we would like it to be developed in a positive manner. We worry what our neighborhood will be like in 10 years if the rezoning and apartment construction occurs. Proximity to the Smith Elementary — We believe it is irresponsible to locate an apartment complex next to a school, especially an elementary school. The land to be rezoned is directly next door to the school. There would be no "buffer" between the school and the apartments. That would be a prime location for any deviants who wanted to prey on small children. Increase in Crime — We believe an apartment complex would lead to an increase in crime in our neighborhood. I don't have statistics of crime rates in apartment complexes versus crime rates in residential single-family areas, but I believe them to be higher in the areas with apartments. I also believe that increased crime would spill over to our school and neighborhood. Impact to the School - We believe any rezoning done to property adjacent to a public school should be done only if it has a positive or neutral impact to the school. We can't think of one potentially positive impact the zoning charge could have on our school. However, we can think of several potentially negative impacts including decreased safety and increased crime, traffic and 1 rugs. In closing, we believe the Planning Commission and the City Council should base the decision on rezoning on what is best for the current residents. The last time we cliecked, they were representing our interests. The only party that would benefit from this rezoning is Tyann Development. The parties that would be hurt by this rezoning number in the hundreds. We believe it is clear that this rezoning proposal should not be passed. RODNEYJ.RAY CITY MANAGER SUBJECT- CAPITAL IMPROVEMENTS PROJECT PRIORITIZATION DATE- May 14, 2004 In May of 2003, the Capital Improvements Committee submitted its report to the City Council identifying a project prioritization system that contained a total of 21 projects divided into four different priority tiers. Each tier had an associated time frame for anticipated completions of the projects contained within that tier, thus providing a capital improvement "schedule of completion" for the next ten years. A copy of the Project Priorities is attached for your information and review. Additionally, the Capital Improvements Committee recommended to the City Council that an election be conducted in October of 2003 to permanently extend the third penny sales tax, the penny that is restricted to fund capital improvement projects in the City of Owasso. In October of 2003, the citizens of Owasso approved the third penny sales tax permanency. Safeguards and accountability measures were incorporated into the sales tax that was approved by voters. Those safeguards included the following: • Retain the Citizen Watchdog Committee • Retain the Capital Improvements Committee • Retain restriction on use of funds (for capital projects and debt only) • Remove the Capital Future Fund requirement • Remove the requirement for voter approval of the issuance of revenue-backed debt for projects approved by the City Council. • Require a Resolution of the City Council each time project priorities change • Annual review of the priority list The Capital Improvement Committee began meeting in January of this year in order to review the project priorities as previously established. At their April 15, 2004 meeting, as a result of the Hunt Properties announcement to construct a major retail center at E. 96"' Street North and Garnett Road (Smith Farms), the Capital Improvements Committee voted unanimously to recommend to the City Council to change the priorities as they are listed. The change would CAPITAL IMPROVEMENT PROJECT PRIORITIZATION MAY 14, 2004 PAGE, 2 involve moving the E. 96t1i Street North and the Garnett Road projects to Tier 1, and moving the N. 129t1i E. Avenue project to Tier 2. The Capital Improvements also added a stipulation that no money be spent on the reprioritized projects until such time that the sale of the land associated with the Smith Farms project became final. Resolution No. 2003-14, attached for your review, outlines the process the City Council must follow when considering reprioritizing the project list. That process is as follows: The Council must receive a recommendation from the Capital Improvements Committee ® A public hearing must be conducted at a regular or special meeting of the Council. A notice for the public hearing must be published once in a newspaper of general circulation not less than five (5) days prior to the meeting itself. ® Any action the Council deems appropriate regarding the reprioritization must not occur until a minimum of two weeks after the public hearing. Any action to reprioritize must be set forth by way of the adoption of a Resolution. As stated earlier, the Capital Improvements Committee unanimously recommended to the City Council that those priorities be changed. As a result of that action and in anticipating the need to expedite the initiation of the project, the staff published a notice in the Owasso Reporter on April 29, 2004 to notify the public of a public hearing before the City Council at the May 18, 2004 regular meeting. The purpose of the Public hearing is to obtain input from the public regarding the recommendation from the Capital Improvements Committee regarding the project prioritization. Assuming City Council concurrence with the recommendation of the Capital Improvement Committee and the public hearing does not produce significant reasons for denying the recommendation; the next step would be for the City Council to pass a resolution at their June 1, 2004 regular meeting to adopt the recommended new priorities. Avenue, from E. 76th Street North to E. 96'h Street North was a Tier I Priority, As a result, and due to the need to address the transportation concerns, Ray Haynes moved to change priorities, moving both the E. 96th Street North and the Garnett Road projects to Tier I status, and moving the N. 129"' E. Avenue project to Tier 2 status, This motion was seconded, and amended by Vice Mayor Kimball to add the stipulation that no funds be spent on the construction of the Garnett Road or 96'h Street North Project until such time that the purchase of the land involved with the Smith Farm project had been completed. EMPLOYEE HEALTH INSURANCE DATE- May 13, 2004• Two years ago during a budget presentation a commitment was made to the City Council that staff would review the City's options for converting to a self-insured plan for employee health insurance. Spiraling insurance costs and significant increases in premiums led us to believe self- insuring health insurance would be a sound business decision. Insurance companies do not operate at a loss, and it is staff's belief that the City should not incur significant increases in premiums to provide insurance companies the ability to report a profit. It has taken two years to get to the point where staff had the data and information needed to develop a plan that was sound for our employees and sound for the City. A plan has been developed that will allow the City to self-insure the employee's health insurance. The proposed plan will cost about the same as the 17% rate increase we were given by our fully insured carrier. However, the reason to convert to a self - insured plan is not to save money this year, but to gain control of our expenditures and provide the City the opportunity to build reserves in those years that claims do not meet expectations. If claims come in less that projected for fiscal year 2004 -2005, the savings would be to the City, not to the insurance carrier. Under a self- insured health plan the City's liability would be limited in two ways. The first liability limit is known as the Stop Loss. This sets the maximum liability the City would incur per covered member. Should a covered member incur claims exceeding the Stop Loss (usually $50,000 or $75,000) the City would not be responsible for the claims over the Stop Loss, the Stop Loss carrier would pay the claims for that member fiom that point on. The second liability limit is the Aggregate. The Aggregate is the City's maximum exposure for the fiscal year. At this time it appears that the Aggregate is going to be around $1,200,000. For the current fiscal year $1,258,563 in premiums will be paid to our fully insured carrier. Stop Loss and Aggregate coverage is a fixed cost. An additional fixed cost is administration. The plan that has been selected is Aetna. Aetna is a well know carrier who offers frilly insured plans and sell'-insured plans. An example of items provided for in the administration fees are processing and payment of claims, customer service for the employees and city personnel, member ID cards and the use of Aetna's physician network. The proposed fixed costs for Stop Loss coverage, Aggregate coverage, and administration for the upcoming fiscal year is $288,203. Staff has included $1,110,000 in the fiscal year 2004-2005 budget for health insurance. This combined with the employee's contribution of $116,000, will be allocated to pay for Stop Loss and Aggregate coverage, administration fees and claims. Staff recommends Council approval of policy authorizing the City Manager to establish a self- insurance fund for employee health insurance. There are a total of 6 units; one 21 ton unit, three 10 ton units, and one 2 ton unit. The units are approaching 30 years old and have become increasingly unreliable and inefficient due to the amount of use they receive. In 2003, the Owasso Community Center was utilized 363 days. Replacement of the units should result in increased reliability and a more cost efficient system. BIDS: Bids were requested from a list of five different vendors known for supplying this type of equipment. Only one bid was received and it was opened on May 5, 2004. The sole bid was submitted by Dale and Lees Service, Owasso, OK for the total cost of $38,780. Staff review of the bid document indicates that all bid specifications have been met. The Owasso Golf and Athletic Club intends to conduct their fireworks display on Saturday evening July 3, 2004. City Code requires approval from the City Council for any public display of fireworks within the city celebrating Independence Day. A copy of that section of the City Code as it relates to fireworks displays is attached for your information and review. Mr. Mark Carey will be in attendance at the Tuesday, May 18, 2004 meeting to address any concerns you may have relating to plans for the celebration, which will be similar to those held the last four years. The sponsors have met with representatives of both the Fire and Police Departments to coordinate the event and address safety concerns. It appears that those issues concerning public safety are being adequately addressed. RECOMMENDATION: Staff recommends Council approval of the fireworks display at Owasso Golf and Athletic Club on Saturday, July 3, 2004. MAY 14,20 04 Pursuant to direction of the City Manager, I am communicating for purposes of advising the Council of the occurrence of an Open Records request received by staff from Mr. McMartin, staff responses to such and the now consequential agenda item concerning the request. I �_ �' `111 On April 26, 2004, at 5:49 PM, an e-mail communication was received by Ms. Julie Stevens, Administrative Assistant to the City Manager, from Mr. Clayton McMartin. Such communication contained an Open Records request from Mr. McMartin whereby he was requesting that he be provided with copies of the audio tapes from the City Council meetings occurring on June 17, 2003 and April 20, 2004. Upon consideration of the request and discussion concerning same amongst members of the staff, it was determined that Mr. McMartin's request called for materials that were not subject to provision under the terms of the Oklahoma Open Meeting Act. 51 O.S. Sec.24A.9. Further, it is and has been the policy of this administration to recognize the exception as provided by 51 O.S. Sec. 24A.9. Mr. McMartin was advised of this determination by Ms. Stevens, by e-mail, on April 28, 2004, at 8:58 AM. On April 28, 2004, at 4:29 PM, an e-mail was received by me regarding the requested materials. On May 10, 2004, at 3:50 PM, a reply was sent to McMartin essentially re -affirming the position expressed by Ms. Stevens and further, giving the legal reasoning supportive of such position. Mr. McMartin, at 4:29 PM responded to my reply. Mr. McMartin took issue with the reply sent by me and essentially requested that I notify "each affected employee to not reuse audio cassettes of previously recorded City Council meetings". This I did not do. A reply was sent by me on May 14, 2004, to Mr. McMartin, acknowledging his communication and renewing my offer to meet and discuss these matters with him.1 will state that the reply that was sent on the 14th of May, was prepared by me on the 10th of May, however such was not sent sooner because it remained in my "draft" file for me to consider such and any additions that I might want to make. I determined that the message as initially prepared should be sent. Copies of the e-mail transmissions are attached for your review. It is respectfully submitted that the declination of Mr. McMartin's Open Records request is proper. The policy of the administration is consistent with the letter of the Oklahoma Open Records Act. A copy of the relevant provision of law is attached for your convenience. Further, Mr. McMartin's apparent insistance on a continuing dialogue quite simply can not be honored in the time and manner desired by him. Additionally, although this City and its officials as well as officers endeavor to be responsive to the citizenry, it is not a fundamental right that such occur as seemingly Mr. McMartin believes it should. Attached is an Opinion of the Attorney General, Opinion No.- 1998 -45, in part, discussing this point. 1 would also recommend it to the Council an informative discussion of the legal aspects of public participation at City Council meetings. RECOMMENDATION. The staff recommends that the Council listen to Mr. McMartin's concerns and take such action as the Council deems most appropriate. Until such time that this dispute has been resolved, I am requesting that you notify each affected City employee to not reuse audio cassettes of previously recorded City Council meetings (therefore preserving the original recordings, or otherwise not "destroying" the original recordings). If there is some additional expense associated with this request, I am amenable to providing the necessary funds to accommodate this request. Section 24A.9- Confidential Personal Notes and Personally Created Materials of Public Official Making Recommendation provides, in relevant part, as follows, "Prior to taking action, including making a recommendation or issuing a report, a public official may keep his or her personal notes and personally created materials... prepared as an aid to memory... leading to the adoption of a public policy... ". Other authority bears upon the issue presented, however, for the sake of brevity in this reponse I will omit reference to such. I will make myself available to meet with you and discuss such other authority should you desire. In light of the foregoing, your "demand" of me for provision of the audio tapes, as set forth in your email dated April 28, 2004, at 4:29 PM, must be refused. Clearly, adherence to your "demand" by me would be violative of the lawful policy of this City. This I will not do. I am writing to demand that audio tapes from the last City Council meeting, occurring on April 20, 2004, be made available to me so that I can make copies at my expense, before you or other City officials destroy them. I am also demanding that tapes from the June 17, 2003 City Council meeting be made available to me for the same reason. In the event that you have already destroyed the tapes, or other staff members destroyed the tapes, notify me immediately. The response of the City is extremely disturbing considering the fact that City Manager, Mr. Ray, has expressed on numerous occasions the importance of speaking into the microphone so that the City can keep a long term record of all proceedings. A point in case is the Storm Water management meeting that occurred on Monday April 19, 2004, in which there was no minute clerk present, nor any minutes issued, yet it was made clear that the City staff would be keeping those tapes for future reference. Those tapes, just as the ones made on April 20, 2004 and June 17, 2003, are City property and therefore available to me as a citizen of this City. Mr. Cates, I am concerned that the actions of the City in this matter are very suspicious. I respectfully request of you to reconsider your actions.
