Garnett Rd. and E. 96 th adjacent to U.S. Hwy 169. During the development process, which to this date has included a rezoning of the property to CS (Commercial Shopping) and a preliminary plat review, the applicant discovered that an additional 7.34 acres would be needed to accommodate the planned development. The applicant is requesting the city rezone the additional 7.34 acres to CS (Commercial Shopping District) so that this additional property's zoning designation is consistent with the development plans and legally able to accommodate the intended development of a commercial shopping center. CS (Commercial Shopping District) East: OM (Office Media Intensity) West: CG/AG (Commercial General/Office Light/Agricultural DistricV, ZONING HISTORY May, 2004 — Associative property located immediately to the south was rezoned to CS (Commercial Shopping District). May, 2004 — Applicant received approval of a preliminary plat (15 lots in 2 blocks) for subject property. Present — The applicant also has a final plat and site plan for the subject property currently in the review process. Another form of property division that can be considered in some cases is a lot split. Lot splits are minor subdivisions of property into three or fewer tracts, and do not provide for any new public streets. Typically, this is an appropriate option for a land owner who wishes to take large undeveloped parcels of land and divide it into two or three smaller tracts. The fourth step in the development of a piece of property in Owasso is the site plan. Site plans are reviewed by the T AC and Planning Commission. Issues such as building setbacks, parking, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HV AC. REZONING REVIEW PROCESS The rezoning process is initiated when a property owner submits an application requesting a change in a property's zoning designation. The property owner must submit an application indicating the current zoning designation and defining the requested zoning designation. The application should be accompanied by the zoning fee, an accurate legal description and map showing the property as well as a certified 300' radius report. Upon receipt of a complete application the staff will begin the review process by providing legal notice through the placement of an advertisement of the application in the newspaper, sending notice letters to property owners within 300' of the subject propelty and posting a sign on the property at the point closest to a public road. As staff is soliciting citizen input from the notification the application will receive an internal review. The internal review consists of answering three primary questions: 1. Is the requested zoning designation consistent with the Owasso 2010 Land Use Comprehensive Plan? 2. Is the requested zoning designation the highest and best land use classification for the subject property? 3. Is the proposed zoning designation consistent with surrounding development? Based on that criteria staff will formulate a recommendation for the request to forward to the Owasso Planning Commission. The Owasso Planning Commission will hold a public hearing to determine if the requested zoning change is appropriate and make a recommendation to forward to the Owasso City Council. The Owasso City Council will make the final determination whether or not to rezone the subject property to the requested classification or a less intense classification. If the .zoning designation is changed by the City Council an ordinance officially declaring the rezoning of the property is written and adopted by the City Council making the change law. LEGAL CONSIDERATIONS OF A REZONING REVIEW The decision to rezone a particular property in the City of Owasso should be based on three fundamental questions: I . Is the requested zoning designation consistent with the Owasso 2010 Land Use Comprehensive Plan? 2. Is the requested zoning designation the highest and best land use classification for the subject property? 3. Is the proposed zoning designation consistent with surrounding development? It is important to note that particular site details such as drainage, streets, and utilities are appropriately discussed during the development review phases (plat and site plan) and not during a rezoning hearing. Letters were mailed to surrounding property owners and the legal advertisement was published in the Owasso Reporter. Staff has received no phone calls or correspondence from the public in regards to the request. Copies of both the letter to property owners and the legal advertisement are attached for your information and review. If the zoning request is approved, the land will still have to be platted in accordance with municipal regulations in order for development to occur. Signcant development will be subject to a site plan review, at which time proposed and existing development will have to meet the City's requirements. Stormwater detention will be required as will adequate infrastructure including water and sewer and all other requirements such as sidewalks, appropriate access and appropriate signage. If the Commission approves this application it will then require City Council approval. RECOMMENDAUON Staff recommends approval of OZ 04-10 to change the zoning designation of the subject property from AG (Agricultural District) to CS (Commercial Shopping District). ATTACHNIENTS 1. The commercial activity extends from N. Garnett Rd. in the west to N. 129t" E. Ave. in the east. This property possesses a unique position within that node as it is highly visible from U.S. Hwy 169 and will be directly accessible from If N. Garnett Rd. and E. 96h As this growth has occurred the city has been required to maintain or develop adequate infrastructure. As such, N. Garnett Rr. is in the preliminary stages of being widened to five lanes. To accommodate the road improvement the plat has dedicated 60' of Right - of -Way. Only one additional public street is proposed in the plat, a collector street, N. 121't E. Ave., will provide local access to the development and provide direct access to zrterials situated to the west and north. The applicant is proposing 15 lots in two (2) blocks on 66.23 acres, more or less. More specifically the applicant would like to create three (3) larger lots on the northern portion of the property to contain the larger commercial elements of the development, which at this time include Target (planned for lot two), Hobby Lobby and Belk among others. The remaining 12 lots are located south of N. 121 E. Ave. and are proposed as pad sites for future development to include banks and restaurants. Included in the final plat are three (3) reserve areas, all of which are proposed as detention facilities to serve the development.' As previously mentioned site detention is planned to be contained in the 3 reserve areas scattered throughout the site, however before any building permit may be permitted drainage and detention details must be reviewed and approved by the Owasso Public Works department. Lot 3 in Block 2 as displayed in the southwest portion of the proposed plat does not abut a public street however a 24' mutual access easement has been provided to guarantee direct access. A 24 mutual access easement will also be required along the northern boundary of the Block I to ensure that rear access is guaranteed to the large developments that are proposed on those lots. Any development that occurs on the property will be subject to a site plan review and must adhere to all subdivision, zoning and engineering requirements including but not limited to paved streets and sidewalks. The proposed development will require no significant expansion of utilities or infrastructure. The site will be provided with sewer and water service by the City of Owasso. A preliminary plat for Smith Farm Marketplace was reviewed by the'rechnical Advisory Commission and the Owasso Planning Commission in May, 2004. The proposed plat was approved with the following conditions: 1. Community Development — Provide an access guarantee to Lots 3 and 11 in Block 2. 2. Community Development — Establish a third block for existing lots 8-12 in Block 2 or connect the block. 3. Community Development — Provide an addition 13' of Right -of -Way width to the proposed thru street for 100' from the intersection with N. Garnett Road. Community Development — Strike the statement allowing Pylon/Monument signs to be placed in Utility Easements from the Deed of Dedication, Section LA 5. Community Development — Provide topographical lines to the platted area. 6. Community Development — Pay the Owasso Storm Siren Fee of $16 per acre. 7. Community Development Ensure that sidewalks are constructed along all public right-of-ways. 8. Community Development Provide adjacent property details on the plat drawing. 9. Community Development — Rename the public street as directed by Community Development. TECHNICAL ADVISORY COMMITTEE The Final Plat was reviewed at the regularly scheduled Owasso Technical Advisory Committee on July 28, 2004. At that meeting utility providers and city staff are afforded the opportunity to comment on the technical aspects of the development proposal. During the review of the Preliminary Plat fl Remington Place II it was discovered that the addition's proposed detention facility was off si and not within Owasso's municipal jurisdiction. It was determined that detention facilitil serving a development within the City limits should also be within the City limits so that the Ci. would have jurisdiction over that facility. As is normal procedure, if the property is annexed into the City the applicant will be required t* follow normal development procedures which would include rezoning, preliminary and final plat review. If annexed, any development proposed for the property would be required to meet the Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering standards as proscribed by Public Works including but not limited to paved street� and sidewalks. The property would be served sewer by the City of Owasso and water by the Rural Water District 43 of Washington County. The Owasso 2010 Land Use Master Plan calls for residential development in that general area and it is intended that the subject property will be utilized as a detention pond in support of residential development. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300 radius. To this date staff has received no phone calls or correspondence in opposition of the request. ANNEXATION COMMITTEE On July 28, 2004 the Owasso Annexation Committee voted unanimously to recommend approval of the request to annex 2.25 acres into the City. ME CITY OF OWASSO MW BACKGROUND The City of Owasso has received a request from the Longford Group, Inc., applicant/owner, for the review and approval of ,d Unit Developments approximately 66.42 acres of property for OM (Office Medium Intensity) uses to enable the development of a full service hospital, associative medical office space and assisted living residential. In conjunction with the PUD application the property owner has requested the city rezone the property to OM. LOCATION The subject property is located northwestS and N. 1291h E. Ave.; immediately north of the Owasso Market. SURROUNDING North: Sherril :;residential South:Owasso Market Shopping Center Vacant/plannedti Bailey Ranch , PRESENT ZONING R.SW3, RS-2 & RE (Residential Districts) SURROUNDING ZONING North: RE (Residential Estates District) South: CS (Commercial Shopping District) East: CS, OL (Commercial Shopping District and Office Light Intensity District) West; R -3 (Residential Single Family District) ZONINGHISTORY Another form of property division that can be considered in some cases is a lot split. Lot splits are minor subdivisions of property into three or fewer tracts, and do not provide for any new public streets. Typically, this is an appropriate option for a land owner who wishes to take large undeveloped parcels of land and divide it into two or three smaller tracts. The fourth step in the development of a piece of property in Owasso is the site plan. Site plans are reviewed by the TAC and Planning Commission, Issues such as building setbacks, parking, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. REZONING REVIIEW PROCESS The rezoning process is initiated when a property owner submits an application requesting a change in a property's zoning designation. The property owner must submit an application indicating the current zoning designation and defining the requested zoning designation. The application should be accompanied by the zoning fee, an accurate legal description and map showing the property as well as a certified 300' radius report. I . Is the requested zoning designation consistent with the Owasso 2010 Land Use Comprehensive Plan? 1 Is the requested zoning designation the highest and best land use classification for the subject property? 3. Is the proposed zoning designation consistent with surrounding development? Based on that criteria staff will formulate a recommendation for the request to, forward to the Owasso Planning Commission. The Owasso Planning Commission will hold a public hearing to determine if the requested zoning change is appropriate and make a recommendation to forward to the Owasso City Council. The Owasso City Council will make the final determination whether or not to rezone tile subject property to the requested classification or a less intense classification. If tho zoning designation is changed by the City Council an ordinance officially declaring the rezoning of the property is written 1nd adopted by the City Council. ANALYSIS To-ngford is requesting to rezone 66.42 acres of property to OM (Office Medium Intensity District) in order to develop a full service hospital complex, The proposal includes a hospital, associative medical support offices and a multi -family assisted living complex. As was stated above staff believes that this type of transitional zoning designation is appropriate between high and low intensity zoning districts. The proposed use and requested designation of OM(Office Medium Intensity District) are compatible with the most recent development trends in the surrounding area. The subject property lies within the rapidly growing 96t" St. N. and U.S. Hwy 169 activity node. The node has blossomed into a densely developed commercial center. An office complex indirectly accessible from 96th St. N. and directly accessible from N. 129th E. Ave. behind the Owasso Market would be consistent with that growth trend. The property seems ideal for a Hospital as it is in the geographic center of Owasso and highly accessible from all directions. The property is also highly visible from169. Staff is aware that the proposed development would abut residential property however the zoning code does provide for protection in the form of screening requirements and light pollution protection. In addition, there exists a large berm between Bailey Ranch Estates and the subject property that would provide further insulation between the two uses. The property owner has, in conjunction with the requested zoning change, applied for a Planned Unit Development (PUD) designation for the subject property. If the zoning request is approved a PUD would allow the city to apply any measures it deems necessary to fUrther ease the transition from the proposed zoning designation of OM to the residential is uses to the north. If the Commission approves this application it will then require City Council approval. The PUD provides an outline for the development of approximately 66.42 acres of property. The property would be developed in accordance with an OM (Office Medium Intensity) underlying zoning designation. Uses proposed in the outline development plan associated with this PUD include a full service hospital, associative medical office space and assisted living residential attached housing. in conjunction with OPUD 04-03 the applicant has submitted OZ 04-09, a request to rezone the property to OM (Office Medium Intensity District), to be utilized as the underlying zoning designation. LOCATION The subject property is located 03 miles northwest of the intersection of E. 960' St. N. and N. 129th E. SCREENING AND LANDSCAPING REQUIREMENTS — The Planning Commission shall ryrescribe perimeter requirements for screening and landscaping as are necessary to assure compatibility with adjoining and proximate properties. The applicant has established a 50' landscape buffer between the development and surrounding residential uses and has asserted that a coordinated landscaping effort will be made throughout the development. co--N The Owasso Land Use Master Plan is currently in the process of being updated and will be presented for another public hearing before the Owasso Planning Commission and City Council next month. That updated version, as compiled by the Owasso Master Plan Steering Committee identifies the property as having a future utilization of transitional uses which would support development allowed by the OM zoning designation as proposed in the this PLID. The transitional designation in the Owasso Master Plan represents the middle of the land use intensity spectrum. It was discovered that name "Owasso Medical Center" has already been used in a recorded Final Plat with the City of Owasso. Therefore, the applicant will be required to rename the PLJD and subsequent Plats so as to not be confused with any existing subdivisions of the City of Owasso. UNIFIEED TREATMENT OF THE PUD SUBJECT AREA A review of the applicant's Conceptual Site Plan for the "Owasso Medical Center" finds an excellent utilization of the project site. As indicated within the applicant's submittal, drainage within the undeveloped project site is oriented toward two existing ponds, one on the western portion of the property and the other existing behind the Owasso Market southeast of the PUD. Again, the certified drainage report must conclude that both ponds will accommodate all necessary drainage and detention. Staff would recommend that a detailed landscape plan be submitted with any site plan for development within the PUD. Said landscaping plans would then be reviewed by staff to ensure that compatible relationships between the differing surrounding uses are maintained, The Planning Commission would also be required to review and approve these plans at the time of site plan submittal. The PUD calls for the establishment of an Architectural Review Board to review and approve all site, landscape, drainage and architectural plans as well as approve all architectural building materials. The Board will be one or the major steps in assuring that the project is developed in a consistent and cohesive manner and in making sure all development follows the guidelines and objectives of the PUT). While PL)D submittals are often times complex in nature and not easily understood, it is extremely beneficial in two significant manners. The first, is it allows for staff, Planning Commission, Council and most importantly — citizens — to see a complete picture of how an entire subject area will develop. This prevents a 'piece-mealed' community and eliminates potential surprises. It assists in knowing the entire infrastructure needs of the addition and assists the city in planning and scheduling other improvements. The second is that it essentially allows for conditional zoning. While many of the requirements recommended by staff to be conditions of approval are currently contained within other development documents of the city, some are not. If this were a standard rezoning, not only would the flexibility of the applicant to shift densities and vary code requirements be restricted, but it would also result in limited ability for staff, the Planning Commission, and the City Council to address areas that are unique to the subject property but not found within the development documents. In short, providing a PUD is well -thought by the applicant and reviewed by the staff, Planni Commission and Council properly, it can be an asset to both the applicant and the community. I Attached for you information and review is a copy of the application, general area map, as well the legal notice sent to surrounding property owners and advertised in the Owasso Reporter. copy of the Outline Development Plan for OPUD 04-03 is also attached for your review. I Staff has received numerous phone calls concerning the proposed development. Many of t-V contacts refer to the developments potential conflict with the existing residential subdivisions the north and west. Some of the concerns deals with lighting pollution, noise, and additional tra caused by the development. Staff has coordinated a neighborhood meeting between the applica and the surrounding residents to try to address some of the issues of concern, That meeting to place on Thursday, August 5, 2004. The citizen input gained from the meeting will communicated during the Planning Commission hearing. RECOMMENDATIONS Given the above analysis, it is staff s opinion that OPUD 04-03 is consistent with the Planned Unit Development portion of the Owasso Zoning Code. Garrett Road from E. 86th Street North to E. 96th Street North. On June 1, 2004, Council approved an .Agreement for Engineering Services with C2A Engineering, Inc. (Tulsa, Oklahoma) in the total amount of $132,375. The scope of services include preliminary and final designs for the widening of the road to five lanes, construction of new sidewalk, curb and gutter, and signalization improvements at the intersection with E. 86"' Street North. The design work is to be integrated with final design currently being completed by Guernsey and Company for the portion of E. 96th Street North west of Owasso Market to N. Garnett Road. Both projects are expected to be constructed simultaneously and be completed prior to the opening of the Smith Farm Market. SOLUTION 2004®1e In Spring 2004, anticipating the need for additional right-of-way to construct planned improvements, City staff began discussions with the Oklahoma Department of Transportation (ODOT) to facilitate the transfer of title of one mile of state owned properly (located on N. Garnett Road from E. 86th Street North to E. 96"' Street North) to the City of Owasso (see Attachment A). On January 3, 1989, a section of North Garnett Load (old US 169) was removed from the State Highway System, and maintenance responsibilities were transferred to the City of Owasso. Because the City assumed maintenance responsibilities in 1989, land transfer at this time will not result in additional maintenance burden but, on the contrary, may save the City of Owasso tax dollars and provide for fixture economic development opportunities. In return for the land, the City of Owasso agrees to upgrade N. Garnett Road from two existing lanes to five lanes, including partial realignment near E. 86th Street North, by October of 2005. The City Attorney has reviewed this agreement and found it acceptable. Cates, City Attorney AGREEMENT <., ENGINEERING SERVICES t,MASTER PLAN ADDENDUM NU o Stormwater runoff volumes generally become larger and flood hazards increase as watersheds develop. runoff volumes increase as previously pervious ground is developed into impervious streets, driveways and rooftops. In response to these changing conditions, on February 3, 2004, Council approved an .Agreement for Engineering Services with Meshek & Associates, Inc. (Sand Springs, Oklahoma) in the amount of $150,000 for the preparation of a Stormwater Faster Flan. The Master flan will serve to guide the orderly development of necessary capital improvements to mitigate effects of stormwater runoff, satisfy stormwater quality requirements and provide for adequate conveyance needs for the existing and future service area. SCOPE OF WORK CHANGES — PHASE II: The Agreement identified the need for a second phase of work with additional design elements to complete all watershed analyses (see Attachment A). In February 2004, it was estimated that the remaining work could be performed at an additional cost not to exceed $50,000. However, due to funding limitations in FY03-04 in the Stormwater Management Fund to $150,000, it was recommended that the additional $50,000 be funded from the FY04-05 budget, and as part of an addendum to the Agreement. The second phase of work ss to xncludc; hydrology and hydraulic modeling of Elm Creek and Blackjack Creek main streams and tributaries (see Attachment B). As noted in the attachments, a considerable area within the City fence line is located within the Elm Creek and Blackjack basins. Thus, it is recommended that the additional modeling be performed at this time to better address drainage needs for all existing and fixture service areas within the City fence line. In May 2004, Meshek & Associate Inc. informed city personnel that the digital mapping required to accurately perform the desired modeling was not available and would have to be obtained at an additional cost to the City. On July 29, 2004, a proposal by Aerial Data Service, Inc. for Addendum No. I Agreement for Engineering Services Page 2 of 3 $37,950.00 was received to perform the mapping. It is worth noting that once purchased, the mapping would become the property of the City of Owasso. Thus, the City may share the data with surrounding communities and/or authorities in an effort to recuperate its investment. In July 2004, Meshek & Associate Inc. submitted Amendment No. 1 for $87,950 to perform the second phase of the work, including hydrology and hydraulic modeling of Elm Creek and Blackjack Creek basins in addition to the purchase of the necessary digital mapping (see Attachment Q. The total cost for the completion of the Stormwater Master Plan, inclusive of Addendum No. 1, is $237,950. The schedule for the completion of the Stormwater Master Plan is amended as follows: ® Phase I (Ranch Creek and Bird Creek) modeling to be completed by September 2004; - Phase 11 (Elm Creek and Blackjack Creek) modeling to be completed by December 2004; and - Stormwater Master Plan document to be completed by February 2005. FUNDING - Funding for Addendum No. I is included in the FY04-05 budget in the Stormwater Management Fund. RECOMMENDATION. Other than the obligation of the ENGINEER to perform in accordance with the foregoing standards, no warranty, either express or implied, shall apply to the SERVICES to performed by the ENGINEER pursuant to this AGREEMENT or the suitability of ENGINEER'S work 1 prod 7.1. ENGINEER shall not be responsible for construction means, methods, techniques, sequences, procedures, or safety precautions and programs in connection with the PROJECT. 7.2. The presence of ENGiNEER's personnel at a construction site is for the purpose of providing to the CITY a greater degree of confidence that the completed construction work will conform generally to the construction documents and that the integritv of the design concept as reflected in the construction documents has been implemented and preserved by the construction contractor(s). 7.3. In soils, foundation, groundwater, and other subsurface investigations, the actual characteristics may vary significantly between successive test pointt and sample intervals and at locations other than where observations, exploration, and investigations have been made. Because of the inherent uncertainties in subsurface evaluations, changed or unanticipated underground conditions may occur that could affect total PROJECT cost and/or execution. These conditions and cost/ execution effects are not the responsibility of ENGINEER. 7.4. Record drawings will be prepared, in part, on the basis of information compiled and furnished by others, and may not always represent the exact location, type of various components, or exact manner in which the PROJECT was finally constructed. ENGINEER is not responsible for any errors or omissions in the information from others that is incorporated into the record drawings. 7.5. ENGINEER's deliverables, hicludirig record drawings, are limited to the sealed and signed hard copies. Computer -generated drawing files furnished by ENGINEER are for CITY or others' convenience. Any conclusions or ii-dormation derived or obtained from these files will be at user's sole risk. 8. OPINIONS OF COST AND SCHEDULE. 8.1. Since ENGINEER has no control over the cost of labor, materials, equipment, or services furnished by others, or over contractors', subcontractors', or vendors' methods of determining prices, or over competitive bidding or market conditions, ENGINEER'S cost estimates shall be made on the basis of qualifications and experience as a Professional Engineer. 8.2., Since ENGINEER has no control over the resources provided by others to meet construction contract schedules, ENGINEER'S forecast schedules shall AGREEMENT FOR ENGINEERING SERVICE A be made on the basis of qualifications and experience as a Professional Engineer. 9.1. ENGINEER shall defend and indemnify CITY from and against legal liability for damages arising out of the performance of the SERVICES for CITY, including but not limited to any claims, costs, attorney fees, or other expenses of whatever nature where such liability is caused by the negligent act, error, or omission of ENGINEER, or any person or organization for whom ENGINEER is legally liable. Nothing in this paragraph shall make the ENGINEER liable for any damages caused by the CITY or any other contractor or consultant of the CITY. 9.2. ENGINEER shall notbe liable to CITY for any special, indirect or consequential damages, such as, but not limited to, loss of revenue, or loss of anticipated profits. 10. CONTRACTOR INDEMNIFICATION AND CLAIMS. 10.1. CITY agrees to include in all construction contracts the provisions of Articles 7.1, and 7.2, and provisions providing contractor indemnification of CITY and ENGINEER for contractor's negligence. 10.2. CITY shall require construction contractor(s) to name CITY and ENGINEER as additional insureds on the contractor's general liability insurance policy, 11. COMPLIANCE WITH LAWS. In performance of the SERVICES, ENGINEER shall comply with applicable regulatory requirements including federal, state, and local laws, rules, regulations, orders, codes, criteria and standards. ENGINEER shall procure the permits, certificates, and licenses necessary to allow ENGINEER to perform the SERVICES. ENGINEER shall not be responsible for procuring permits, certificates, and licenses required for any construction unless such responsibilities are specifically assigned to ENGINEER in Attachment B, SCOPE OF SERVICES. U INSURANCE. 12.1. During the performance of the SERVICES under this AGREEMENT, ENGINEER shall maintain the following insurance: 12.1.1. General Liability Insurance with bodily injury limits of not less than $1,000,000 for each occurrence and not less than $1,000,000 in the aggregate, and with property damage limits of not less than $100,000 for each occurrence and not less than $100,000 in the aggregate. 12.1.2. Automobile Liability Insurance with bodily injury limits of not less than $1,000,000 for each person and not less than $1,000,000 for each accident and with property damage limits of not less than $100,000 for each accident. 12.1.3. Worker's Compensation Insurance in accordance with statutory requirements and Employers' Liability Insurance with limits of not less than $100,000 for each occurrence. INTEGRATION AND MODIFICATION. This AGREEMENT may be amended only by written instrument signed by each of the Parties. I 20. ASSIGNMENT. ENGINEER shall not assign its obligations undertaken pursuant to this AGREEMENT, provided that nothing contained in this paragraph shall prevent ENGINEER from employing such independent consultants, associates, and subcontractors as ENGINEER may deem appropriate to assist ENGINEER in the performance of the SERVICES hereunder. 21. APPROVAL. It is understood and agreed that all work performed under this AGREEMENT shall be subject to inspection and approval by the Public Works Department of the City of Owasso, and any plans or specifications not meeting the terms set forth in this AGREEMENT will be replaced or corrected at the sole expense of the ENGINEER. (hereinafter referred to as "Tyann") of Owasso, Oklahoma. The Sanitary Sewer Payback Agreement (hereinafter referred to as "Agreement") is the vehicle by which Tyann will recoup from subsequent sanitary sewer users a portion of the monies expended by it for construction of a sanitary sewer extension from the west side of U.S. highway 169 to properties on the eastern side of the highway between 661h Street Forth and 76th Street North. Sanitary sewer service to properties on the east side of U.S. highway 169 and south of E. 76th Street Forth was not possible until the later part of 1999 when Tyann constructed a sanitary sewer extension from. the west side of the highway. This gravity sanitary sewer line was constructed from a manhole on the northeast corner of the City of Owasso lagoons and extended east and under U.S. highway 169. The line was constructed along the East Service road to the north end of the property immediately north and adjacent to llammco. When QuikTrip relocated, approximately a year later, this sanitary sewer line was extended to serve new and existing property along the south side of E. 76th Street North. Shortly thereafter, holiday It -in Express connected to the new sewer. The gravity sanitary sewer line was constructed at a total cost of $72,358.75. Please see R & M Pipeline Const., Inc. Invoices 12013 and 12073 attached. A significant portion of the cost to construct the gravity sanitary sewer line was associated with boring the line under U.S. highway 169. As may be gleaned from a review of Invoice Number 12013 attached, the cost of such boring was $68,382.00. Although this cost was borne in the first phase of construction, extension of the line to serve other property could not have been accomplished without the boring. Therefore, it is considered reasonable to prorate reimbursement of the costs paid by Tyann. The methodology employed in the Agreement for the payback calculation is submitted as being reasonable. Essentially, the present undeveloped acreage has been identified and quantified. The shaded area on Exhibit A to the Agreement that is attached illustrates such acreage. The construction costs paid by Tyann are then to be divided by the total remaining undeveloped acreage to determine a per acre reimbursement. Subsequent developers will be required to pay over to the OPWA, for the benefit of Tyann, the appropriate amount at the time of execution of the application to the Oklahoma Department of Environmental Quality. Such sum so received shall be remitted to Tyann within a reasonable time. The reimbursement mechanism is designed for a period not to exceed ten (10) years from the date of execution of the Agreement. The proposed Agreement imposes no obligation to the OPWA other than collection and remittance of sums collected. No funds of the OPWA shall be utilized for repayment to Tyann of the referenced construction costs. Tyann will be reimbursed only as development occurs within the ten (10) year period. Any questions that any Trustee(s) might have regarding this matter should be directed to Mr. Ray, Mr. Carr or me. During the timeframe between October 2002 and December 2003, the City applied for, and received, an additional grant for the development of an Emergency Operations Plane The grant amount for that project was $14,285 and the Emergency Operations Plan was approved and adopted by the City Council in December 2003. A portion of the Emergency Operations Plan, Annex T, recommended that the City of Owasso further develop a multi -hazard mitigation plan upon receipt of the grant funding. The enclosed plan is a result of that recommendation. Members of the City of Owasso Multi -Hazard Mitigation Planning Committee were identical to those that participated in the Emergency Operations flan Committee and began meeting in January 2004. Mitigation involves the development of a plan or schedule to address those hazards. Both short term and long term hazard mitigation opportunities are addressed. For example, an identified hazard can be the need to update the storm siren system, improve the knowledge and training of all city employees to enable them to provide CPR care in the event of a disaster, or supply NOAA weather radios to all local government buildings, schools, and critical facilities. The mitigation plan would identify the departments involved, the time -frame, and the funding needed to address those needs. DEVELOPMENT OF THE PLAN: Surveys were utilized by the committee to obtain public input regarding those hazards that the community felt was important. The surveys were available at City Hall and the Owasso Public Library. Additionally, the surveys were also published in the Owasso Reporter and were made available online through the City's website. The survey period was approximately 45 days. Utilizing the results from the survey, the committee was able to develop a 66I'op 20" list of hazardous mitigation projects. This list was further broken down to provide an action plan for the 10 highest ranking mitigation projects. This list and action plan is included in Chapter 5 of the plan and will be utilized for budgetary and planning purposes. In order for the plan to be adopted by the City of Owasso, a public hearing is required to be conducted. Staff is currently planning on conducting the public hearing on Tuesday, August 17, 2004 at the regular meeting of the City Council, followed by an action item for possible adoption of a resolution approving the plan. FUNDING: As previously referenced, the funding for this project is available through a grant from the FEMA and the Oklahoma Department of Emergency Management. While the City has been notified that we have received the grant, the funds have not been transmitted at this time. Upon receiving the actual funds, a supplemental appropriation increasing both revenues and expenditures in the Emergency Preparedness budget will be necessary. The evaluation involved the completion of an online survey with follow-up one-on-one interviews with department directors and members of the City Council. Post evaluation discussions with the Council indicated there was a desire to conduct an evaluation of the City Manager on an annual basis. It was noted that the next evaluation process needed to start earlier in the year, allowing more time for completion. PROPOSAL. The following timeline has been developed to allow ample time to complete this year's evaluation. August —Conduct discussions with Council regarding the evaluation process September ---Finalize agreement for evaluation process October —Conduct evaluation November —Finalize evaluation report December 1---Submit evaluation to City Council DISCUSSION ITEMS.
