Consideration and appropriate action relating to a request for Council approval of Change Order No. 1 to the Rayola Park Drainage Channel Improvement Project, acceptance of the completed construction, and approval of the final payment. Ms. Stagg Attachment #13 Staff will recommend Council approval of Change Order Igo. 1 to the contract for Rayola Park Drainage Channel Improvements decreasing the contract in the amount of $10,400 and a revised contract total of $26,506, acceptance of the completed construction of the Rayola Park Drainage Improvement Project, and approval of the final payment for the construction in the amount of $2,650.60 to Carter Excavating, Inc. of Sand Springs. 14. Consideration and appropriate action relating to a request for Council adoption of Resolution No. 2004 -18, a resolution authorizing the Mayor to request assistance of the Oklahoma Department of Transportation for planning and preliminary design for US 169 fi °om I -244 to SH 20. Consideration and appropriate action relating to a request for Council approval of Change Order No. I to the contract with Total Radio, Inc. regarding the installation of storm warning sirens. Mr. Rooney Attachment #16 The staff will recommend approval of Change Order No. I increasing the amount of the contract by $19,975 for the purpose of installing one additional storm warning siren and concrete mounting pole for a total contract amount of $ 225,169 to Total Radio, Inc. H: \Agendas \Counc i I \2004 \092104.doc OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, September 7, 2004 The Owasso City Council met in regular session on Tuesday, September 7, 2004 in the Council Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 5:00 p.m. on Friday, September 3, 2004. ITEM 1. CALL TOO ER The meeting was called to order at 6:30 p.m. ITEM 2. INVOCATION The invocation was offered by Ralph Lovvorn, Chaplain at Hospice of Owasso. ITEM 3. FLAG SALUTE City Councilor Brent Colgan led the flag salute, PRESENT Susan Kimball, Mayor Craig Thoendel, Vice Mayor Brent Colgan, Councilor A quorum was declared present. STAFF Rodney J. Ray, City Manager Ronald Cates, City Attorney ABSENT Steve Cataudella, Councilor Gary Cochran, Councilor i Lynn VanDeventer presented to the Council 'Truthfulness', the character trait for September, 2004. ITEM 6. BUSINESS OF THE QUARTER PRESENTATION Mayor Kimball announced that Larry's Fried Chicken has been recognized as the Business of the Quarter for Third Quarter 2004 and the presentation will be given to them at their business. Owasso City Council September 7, 2004 ITEM 7. PRESENTATION OF EMPLOYEE OF THE MONTH. Mr. Ray introduced Nancy Edwards, Secretary for the Police Department, as the Employee of the Month for September, 2004. ITEM & CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF THE CONSENT AGENDA A. Approval of Minutes of the August 17, 2004 Regular Meeting and the August 25, 2004 Special Meeting & Approval of Claims C. Action relating to Ordinance No. 792, an ordinance approving the annexation request from Owasso Land Trust, as made in application OA 0406, of approximately 2.25 acres, more or less. The subject property is located south of Remington Place addition immediately cast of North 120th East Avenue, and repealing all ordinances or parts of ordinances in conflict herewith.. E. Action relating to Ordinance No. 794, an ordinance approving the rezoning request from Hunt Properties, Inc. as made in application number OZ 04-10, of approximately 7.34 acres, more or less. The subject property is located south and east of the intersection of North Garnett Road and East 96th Street North, adjacent to U.S. Highway 169, and repealing all ordinances or parts of ordinances in conflict herewith. F. Action relating to Ordinance No. 795, an ordinance approving the Planned Unit Development request from the Longford Group, as made in application number OPUD 04-03, of approximately 66.42 acres, more or less. The subject property is located 0.3 miles northwest of the intersection of North 129th East Avenue and East 96th Street North, and repealing all ordinances or parts of ordinances in conflict herewith. Mr. Thoendel requested the removal of the Approval of the Minutes of the August 17, 2004 Regular Meeting from the Consent Agenda and make it a separate agenda item. Mayor Kimball directed this change to the Agenda. Mr. Colgan moved, seconded by Mr. Thoendel, to approve the Consent Agenda, approving the Minutes of the August 25, 2004 Special Meeting, claims totaling $155,757.96, and payroll claims totaling $263,707.62; and for Council approval of Ordinances 792, 793, 794 and 795, as stated above. CONSrDERATfON AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF THE MINUTES OF THE AUGUST 17, 2004 REGULAR MEETING. Mr. Thoendel requested a change in wording in the August 17, 2004 Minutes for Item 6, changing the phrase 'Addressing the Council to speak against OPUD 04-03' to 'Addressing the Council to speak regarding OPUD 04-03'. Mr. Colgan moved, seconded by Mr. Thoendel, to approve the Minutes of the August 17, 2004 Regular Meeting, as modified, YEA: Colgan, Kimball, Thoendel NAY: None Motion carried 3-0. Mr. Thoendel moved, seconded by Mr. Colgan, for Council approval of Change Order No. I in the amount of $31,988.00, increasing thee total contract amount to $130,264.00, acceptance of the FY2002 Sidewalk Rehabilitation Project contract work N Owasso City Council - September 7 2004 and authorize final payment in the amount of $42,739.90 to Rocket Construction Services, LLC of Sand Springs, Oklahoma. CONSIDERATION AND APPROPR]ATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF A SUPPLEMENTAL APPROPRIATION TO THE GENERAL FUND IN THE EMERGENCY PREPAREDNESS DEPARTMENT. Mr. Rooney presented the item. Mr. Colgan moved, seconded by Mr. Thoendel, for Council approval of a supplemental appropriation to the General Fund, increasing revenues and expenditures by $20,800.00 in the Emergency Preparedness Department for the creating of the Multi Hazard Mitigation Plan.. Mr. Ray acknowledged Melinda Voss in the audience. Melinda is the wife of Roger Voss, who recently received a special recognition for his service to the community. Main Street, per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, September 10, 2004, ITEM 1. CALL TOO RDER Mayor Kimball called the meeting to order at 6:06 PM. ITEM 2. DISCUSSION RELATING TO COMMUNITY DEVELOPMENT ITEMS. A. REZONING (1) B. FINAL PLATS (3) C. APPLICATION FOR REZONING FEES Mr. Wiles addressed the items. It was explained that the rezoning item and the final plats were unanimously approved by the Planning Commission without any opposition. These items will be forwarded to the City Council for action at their September 21, 2004 regular meeting. Discussion regarding the current rezoning application process was held. The staff will continue to review the current rezoning application process and submit their recommendations to the City Council. ITEM 3. DISCUSSION RELATING TO CITY MANAGER ITEMS. Mr. Ray, along with the appropriate staff members, presented the items and discussion was conducted. Garnett Rd. A general area map has been attached for your review. The property is currently undeveloped as is the property to the south with the exception of a large garage/workshop. Single-family homes exist to the north. Large lot residential exists to the east. The property to the west is currently undeveloped however it is the site of the developing Remington Place 11 single family residential development. The subject property is currently zoned AG (Agricultural District) as are the properties to the south and east. Properties to the north and west are currently zoned RS-3 (Residential District). The request is part of a larger development being proposed for the area. The property immediately to the southeast of the subject site is currently being planned as a residential subdivision. To this date that 35.46 acres has been annexed, rezoned to RS-3 and reviewed as part of a preliminary plat. The applicant must submit an application indicating the current zoning designation and defining the requested zoning designation. The application should be accompanied by the zoning fee, an accurate legal description and map showing the property as well as a certified 300' radius report. 1. Is the requested zoning designation consistent with the Owasso 2010 Land Use Comprehensive Plan? 2. Is the requested zoning designation the highest and best land use classification for the subject property? 3. Is the proposed zoning designation consistent with surrounding development? Staff will formulate a recommendation for the request to forward to the Owasso Planning Commission. The Owasso Planning Commission will hold a public hearing to determine if the requested zoning change is appropriate and make a recommendation to forward to the Owasso City Council. The Owasso City Council will make the final determination to rezone the subject property to the requested classification, a less intense classification, or deny the request and leave the subject property's current zoning designation. If the zoning designation is changed by the City Council an ordinance officially declaring the rezoning of the property is written and adopted by the City Council making the change law. Owasso Land Trust is requesting to rezone 2.25 acres of additional contiguous property to incorporate into the developing Remington Place 11 subdivision. The property is located in the northeast comer of said proposed subdivision. During the development review process for the Remington Place 11 subdivision the subject property was identified as a proposed detention pond and determined to be located outside the Owasso corporate limits. It was further determined that it would be in all party's best interest to have the pond within the City's jurisdiction so that the City can ensure that the pond is developed adequately and maintained properly. The developer has since had the proposed detention pond area annexed. The developer has identified an opportunity to utilize a small portion of the subject property adjacent to a proposed roadway for residential development and would like to rezone the property accordingly. The subject property that would be utilized as residential lots would be incorporated into any forthcoming plat and would contribute to the residential character of the development. Residential development on the subject property would pose no conflict with known development plans in the area. Letters were mailed to surrounding property owners and the legal advertisement was published in the Owasso Reporter, Staff has received no phone calls or correspondence from the public in regards to the request. A copy of the legal notice is attached for your information and review. If the zoning request is approved, the land will be required to be included in a plat in accordance with municipal regulations in order for development to occur. Significant Stormwater detention will be required as will adequate infrastructure including water and sewer and all other requirements such as sidewalks, appropriate access and appropriate signage. On September 13, 2004 the Owasso Planning Commission unanimously recommended approval of OZ 04-11 to change the zoning designation of the subject property from AG to RS-3. SEPTEMBER J4, 2004 The City of Owasso has received a request from Kellogg Engineering, applicant, for the review and approval of the Remington Place 11 final plat consisting of 84 lots and one (1) reserve area, in five (5) blocks on 20.98 acres, more or less. It is the intention of the property owner to subdivide and develop the property in a residential manner. The property is located south of the developing th Remington addition and east of th* German Acres mobile home park, south of E. 116 St. N. and east of N. Garnett Rd. A general area map has been attached for your review. The subject property's current zoning designation is RS-3 (Residential District) as is the property to the north. Property to the south, east and west are zoned AG (Agricultural District) with exception to the German Acres mobile home park as it is zoned IZMH (Residential Mobile Homes District). In April, 2004 the Owasso City Council unanimously approved a request to annex the subject property into the City limits of Owasso. In May, 2004 the property was rezoned from AG (Agricultural) to RS ®3 (Residential Single Family). In June, 2004 the Owasso Planning Commission approved the Remington Place 11 Preliminary Plat with the following conditions: 1, Illustrate the northern portion of the public Right-of-Way for E. 111 ' St. N. In August, 2004 the City of Owasso annexed approximately 2.25 acres of property located in the northeast corner of the Remington Place lI area. The small parcel of property was annexed to bring the detention pond proposed for the Remington Place II development into the City limits. Another form of property division that can be considered in some cases is a lot split. L(M splits are minor subdivisions of property into three or fewer tracts, and do not provide A any new public streets. Typically, this is an appropriate option for a land owner W1 wishes to take large undeveloped parcels of land and divide it into two or three small tracts. The Final Plat review process is initiated when a property owner submits an application to the City of Owasso requesting the review and acceptance of a subdivision of land. Each year since then, the City Council has approved a "carryover" supplemental appropriation. PS "carryover" budget is a concept wherein a department's budgeted, but unexpended, funds from one fiscal year may be rem budgeted (appropriated) to the next fiscal year. The goal of a carryover budget is to encourage economy and efficiency in the use of public funds. Traditional public sector budgets "reward" the expenditure of all of the funds under a manager's control and "justify" an increasing level of appropriations in subsequent fiscal years. In using this traditional philosophy, efforts to be efficient and save money often are "rewarded" by a reduction in future budgets. The carryover budget promotes a philosophy of "save and invest it" rather than "spend it or lose it." Managers who save money from last year's budget have been rewarded by the possibility of a carryover appropriation to the new fiscal year budget. bast year, due to the decline in sales tax revenues the carryover requests were restricted to projects in progress at the fiscal year end. The approved FY 2004 -05 budget included an estimated available fund balance at July 1, 2004 of $2,550,000 in the General Fund. That estimate was based on certain assumptions about revenues to be received as well as spending that would occur through the end of the fiscal year. During the development of the FY 2005 budget, it was assumed that some funds in the FY 2004 budget would not be expended and some of those funds have already been included in the FY 2005 budget estimates. The fiscal year end adjustments are still in process, but the actual fund balance will be about $2,767,000, or $217,000 greater than the original estimate. That $217,000 is the basis for funding a carryover budget supplement in the General Fund. The FY 2005 budget assumed that some of those funds would not be spent. Of that amount, $145,806 would normally be eligible for carryover budget requests. The Stormwater Management Fund has a contract that was in progress at the end of the year and should be carried over to the fiscal year 2005 budget. Specifically, the work included reshaping and regrading of approximately 1,700 linear feet of channel (see Attachment A). The construction contract was awarded to Carter Excavating, Inc. (Sand Springs) in May 2003 for the amount of $36,906. Final inspections were conducted in July 2004, and all deficiencies noted have been corrected. The contractor has provided a one-year maintenance bond for the work as part of the Contract documents. Previous payments have been approved in the amount to $23,855.40. Pay Application No. 3 in the amount of $2,650.60 was submitted on September 15, 2004 as request for final payment (see Attachment B). CHANGE ORDER N0.1: During construction of the channel, city staff determined that sodding of the entire channel bottom would not be necessary to achieve desired aesthetics. Thus, deletion of Alternate 2 (sodding) resulted in a credit of $7,300.00. Thus, it is imperative that action be taken now to assure that transportation needs of the Owasso community are met in the future. RESOLUTION 2004-18: It is anticipated that if action is taken today, improvements to US-169 can be scheduled for construction in the next five years. RESOLUTION 2004-19, THE PROPOSED UPDATE OF THE OWASSO MASTER PLAN DATE- September 169 2004 The Master Plan can be generally divided into three parts: 1) statistics, figures and estimates, 2) map of desired land use patterns, and 3) key issues, needs, and goal statements. It serves as an adopted statement of growth policy for the City of Owasso, and provides the basis for land use decisions such as zoning. The update of the Master Plan to date may be divided into two primary focuses: an update of the statistical situation of Owasso at this time and an update of the public's views on Owasso at this time. To begin the process of updating the Master Plan, the staff first updated the statistics, trends, and estimates that are shown in the current portrait, the annual statistical report that is used as one of the bases for the Master Plan. The public's views were gathered in an involved process incorporating various forms of input over an eight-month period. One method of input was a citizens' opinion survey that was mailed to all Owasso utility customers to collect their input on the general conditions of Owasso. Another method of input came when the City Council appointed a 20-member Master Plan steering committee comprised of twelve citizens and eight municipal staff members. A third method of input was used at a public hearing on the Master Plan update that was held by the Planning Commission in June. Resolution No. 2004 -19 September 17, 2004 Page 2 of 3 Up to this point, committee members have evaluated and followed the process and purpose of the Master Flan update, reviewed the Current Portrait, reviewed the results of a citizens opinion survey, prioritized the community's strengths and weaknesses, developed a list of goal statements to be included in the Master Plan update, and revised the land use and transportation plan map. The current portrait, goal statements, and land use and transportation map are attached with this memorandum. BRIEF SUMMARY OF CURRENT FORT To The current portrait is a statistical report that is updated yearly and made to be an integral part of the Owasso Master Plan. It reports on the conditions of transportation, demographics, land use and development, environmental features, and community facilities. ::'�' �'� :1.`' J 1;' ►. .�� As shown in the attached map, the proposed update to the Master Plan continues the basic land use pattern of Owasso that has been established by the several previous versions of the plan. Changes in area designations include the proposed commercialization of the North 96th Street corridor, providing for residential expansion north to 126th and west along Forth 76th Street to 193rd East Avenue, and establishing commercial nodes at arterial intersections that are buffered from residential uses by transitional areas. One noticeable change is the way that the information is presented. Accompanying the map is a Land Use Intensity Classification System that illustrates what zoning districts are allowed to be considered for each land use. For example, AG Agricultural and RE Residential Estate zoning districts could both be considered for application in areas on the maps classified for rural land use. The six basic land use categories shown on the map are rural, residential, transitional, commercial, industrial, and community. The map also designates the proposed road network, proposed trail system, and current floodplain. The contract provided for the purchase and installation of fourteen storm sirens at a total cost of $205, 194. Subsequent to that award a "notice to proceed" was issued to the contractor and work on the project began. Immediately after beginning work, it became obvious that the Owasso Public Schools would be purchasing land for a new elementary school at E 76" Street North and N Memorial Rd. Upon investigation, it was determined that the "coverage area" of the system (as bid) was not capable of providing early warning to the new school. After that review, it was further determined that there were approximately $45,000 remaining in appropriated funds for the project as the result of a lower than expected bid. The staff then requested from the contractor a unit price for both an additional siren and concrete pole upon which the siren would be mounted. Total Radio, Inc. responded to that request and while did not agree to use a price equal to that of the per unit cost of the original fourteen, they did agree to a substantial cost reduction that approximates $8,000 in savings to the City of Owasso. Because the company had miscalculated the cost of the concrete poles in their bid, they would not give the original unit bid price. However, the $8,000 estimated savings is considered significant. Based on the belief that the new school should be covered in the early warning area, the opportunity to receive a lower cost, as well as having appropriations available now, it is the opinion of the staff that a change order to the Total Radio Contract be approved to allow for the inclusion of a fifteenth siren. Storm Siren Memo September 17, 2004 Page 2 of 2 The cost of one additional siren and mounting pole is $17,500. Additionally, the cost for installation and "rock removal" is $2,475. The total cost of the proposed change order is $19,975.00. When added to the original contract cost the project is increased from $205,194 to $225,169. Funding for this project was approved by the City Council at an appropriated level of $250,000. A review of all the other bids submitted indicates that higher prices were quoted for concrete poles versus wooden poles. Total Radio, upon being contacted by staff, acknowledged the error but remains committed to honor their bid. Therefore, the option of concrete poles becomes much more attractive both fiscally and aesthetically. The bid submitted by Total Radio was $205,194 for fourteen (14) sirens on concrete poles. SIR—EN LOCATIONS: Upon the review of the Total Radio bid, staff began a process of pinpointing exact locations of the proposed sirens. Total Radio's bid, utilizing an ATI siren system, actually exceeded specifications, thus causing the need to review the proposed locations in order to ensure consistent and over - lapping coverage while preventing over- saturation. Upon completion of this process, staff also had an independent party review the siren locations. STORM SIREN PURCHASE APRIL 2, 2004 PAGE 3 NUMBER OF SIRENS: A total of 14 sirens would be needed to provide complete coverage of all areas within the city limits of Owasso, while also providing coverage into areas of anticipated growth immediately adjacent to the city limits. Installation is required within 90 days of delivery of the equipment frorn the manufacturer. RECOMMENDATION: Staff recommends the Council award the contract for the installation of fourteen (14) storm sirens utilizing concrete poles to Total Radio of Tulsa, Oklahoma in the amount of $205,194. PROPOSED CARRYOVER BUDGET DATE. September 17, 2004 In 1993, the City Council adopted a "Carryover Budget Policy." Each year since then, the City Council has approved a "carryover" supplemental appropriation. A "carryover" budget is a concept wherein a department's budgeted, but unexpended, funds from one fiscal year may be re-budgeted (appropriated) to the next fiscal year. The goal of a carryover budget is to encourage economy and efficiency in the use of public funds. Traditional public sector budgets "reward" the expenditure of all of the funds under a manager's control and "justify" an increasing level of appropriations in subsequent fiscal years. In using this traditional philosophy, efforts to be efficient and save money often are "rewarded" by a reduction in future budgets. The carryover budget promotes a philosophy of "save and invest it" rather than "spend it or lose it." Managers who save money from last year's budget have been rewarded by the possibility of a carryover appropriation to the new fiscal year budget. Last year, due to the decline in sales tax revenues the carryover requests were restricted to projects in progress at the fiscal year end. This year, two requests in the OPWA Fund are recommended for approval as part of the carryover budget appropriation. The OPWA Capital Improvement Account has a contract for the wastewater master plan that was in progress at the end of the year and should be carried over to the fiscal year 2005 budget. There is also a request for a carryover budget in the OPWA Operating Account. Staff recommends OPWA Trustee approval of a budget amendment increasing the appropriation in the OPWA Fund, Operating Account by $25,000 and increasing the appropriation in the OPWA Fund, Capital Improvements Account by $105,784. In evidence of our support, the City would like to formally submit a request to ODOT for initiation of planning and preliminary design of improvements. Given limited funding, the time period between planning and actual construction can be lengthy. Thus, it is imperative that action be taken now to assure that transportation needs of the Owasso community are met in the future. SOLUTION 2004 -18 It is anticipated that if action is taken today, improvements to US-169 can be scheduled for construction in the next five years. Proposed City of Owasso Resolution 2004 -18 requests the Department of Transportation assistance to begin the process of planning and preliminary design for improvements to US -169 (see Attachment A). Proposed improvements would include highway widening from four to six lanes, in addition to enhancements to existing interchanges and frontage roads, from Inter State 244 (I -244) to State Highway 20 East (SH -20). RESOLUTION 2004-19, THE PROPOSED UPDATE OF THE OWASSO MASTER E PLAN The Master Plan can be generally divided into three parts: 1) statistics, figures and estimates, 2) map of desired land use patterns, and 3) key issues, needs, and goal statements. It serves as an adopted statement of growth policy for the City of Owasso, and provides the basis for land use decisions such as zoning. The update of the faster Plan to date may be divided into two primary focuses: an update of the statistical situation of Owasso at this time and an update of the public's views on Owasso at this time. To begin the process of updating the Master Plan, the staff first updated the statistics, trends, and estimates that are shown in the current portrait, the annual statistical report that is used as one of the bases for the Master Plan. The public's views were gathered in an involved process incorporating various forms of input over an eight -month period. One method of input was a citizens' opinion survey that was mailed to all Owasso utility customers to collect their input on the general conditions of Owasso. Another method of input came when the City Council appointed a 20- member Master Plan steering committee comprised of twelve citizens and eight municipal staff members. A third method of input was used at a public hearing on the Master Plan update that was held by the Planning Commission in June. Resolution No. 2004 -19 September 17, 2004 Page 2 of 3 Up to this point, committee members have evaluated and followed the process and purpose of the Master Plan update, reviewed the Current Portrait, reviewed the results of a citizens opinion survey, prioritized the community's strengths and weaknesses, developed a list of goal statements to be included in the Master Plan update, and revised the land use and transportation plan map. The current portrait, goal statements, and land use and transportation map are attached with this memorandum. BRIEF SUMMARY OF CURRENT PORTRAIT. . The current portrait is a statistical report that is updated yearly and made to be an integral part of the Owasso Master Plano It reports on the conditions of transportation, demographics, land use and development, environmental features, and community facilities. : ►�� �v1,� �t y �. ;lt � �, As shown in the attached map, the proposed update to the Master Plan continues the basic land use pattern of Owasso that has been established by the several previous versions of the plan. Changes in area designations include the proposed commercialization of the North 96th Street corridor, providing for residential expansion north to 126th and west along North 76th Street to 193rd East Avenue, and establishing commercial nodes at arterial intersections that are buffered from residential uses by transitional areas. One noticeable change is the way that the information is presented. Accompanying the map is a Land Use Intensity Classification System that illustrates what zoning districts are allowed to be considered for each land use. For example, AG Agricultural and RE Residential Estate zoning districts could both be considered for application in areas on the maps classified for rural land use. The six basic land use categories shown on the map are rural, residential, transitional, commercial, industrial, and community. The map also designates the proposed road network, proposed trail system, and current floodplain. RAY CITY MANAGER SUBJECT- CHANGE ORDER NO. 1 FOR THE INSTALLATION OF STORM WARNING SIRENS DATE: September 17, 2004 11 On April 6, 2004, the City Council approved a contract with Total Radio of Tulsa for the purchase and installation of storm warning sirens. The contract provided for the purchase and installation of fourteen storm sirens at a total cost of $205, 194. Subsequent to that award a "notice to proceed" was issued to the contractor and work on the project began. Immediately after beginning work, it became obvious that the Owasso Public Schools would be purchasing land for a new elementary school at E 761h Street North and N Memorial Rd. Upon investigation, it was determined that the "coverage area" of the system (as bid) was not capable of providing early warning to the new school. After that review, it was further determined that there were approximately $45,000 remaining in appropriated funds for the project as the result of a lower than expected bid. The staff then requested from the contractor a unit price for both an additional siren and concrete pole upon which the siren would be mounted. Total Radio, Inc. responded to that request and while did not agree to use a price equal to that of the per unit cost of the original fourteen, they did agree to a substantial cost reduction that approximates $8,000 in savings to the City of Owasso. Because the company had miscalculated the cost of the concrete poles in their bid, they would not give the original unit bid price. However, the $8,000 estimated savings is considered significant. Based on the belief that the new school should be covered in the early warning area, the opportunity to receive a lower cost, as well as having appropriations available now, it is the opinion of the staff that a change order to the Total Radio Contract be approved to allow for the inclusion of a fifteenth siren. STORM SIREN PURCHASE DATE- April 2, 2004 BACKGROUND: The capital projects election, conducted in October of last year, resulted in Owasso citizens approving the permanency of the third penny sales tax, as well as the adoption of a proposed Four Tier project priority list. Contained within the Tier One projects is the replacement of the storm siren system. BID PROCESS: In November of 2003, bid specifications were developed by staff after visiting several municipalities in the Tulsa area. The bid specifications included: ® A battery back-up system in order to provide the ability to sound the sirens in the event of a power outage, as well as the continued ability to sound the sirens for a period of up to fourteen (14) days without power. ® Ability to activate only one siren, a group of sirens in a particular area, or the entire siren system. ® Remote activation capability. ® Both tone and voice notification options. ® Alternates for both wooden and concrete poles. ® Alternates for a total of 14 or 20 sirens. ® Installation and training. ® A 2 year warranty. On January 8, 2004, all bids for the replacement of the storm siren system were opened. A review of all the other bids submitted indicates that higher prices were quoted for concrete poles versus wooden poles. Total Radio, upon being contacted by staff, acknowledged the error but remains committed to honor their bid. Therefore, the option of concrete poles becomes much more attractive both fiscally and aesthetically. The bid submitted by Total Radio was $205,194 for fourteen (14) sirens on concrete poles. SIRIEN LOCATIONS: Upon the review of the Total Radio bid, staff began a process of pinpointing exact locations of the proposed sirens. Total Radio's bid, utilizing an ATI siren system, actually exceeded specifications, thus causing the need to review the proposed locations in order to ensure consistent and over-lapping coverage while preventing over-saturation. Upon completion of this process, staff also had an independent party review the siren locations. Although existing sirens are located at various locations throughout the city, the locations are not the most desirable. The new sirens are proposed to be located at major arterial intersections in Owasso — with one exception being the Owasso Sports Park, This allows the City to utilize existing rights-of-way for the placement of the poles, as well as allowing for easier access when maintenance of the system is required. NUMBER OF SIRENS A total of 14 sirens would be needed to provide complete coverage of all areas within the city limits of Owasso, while also providing coverage into areas of anticipated growth immediately adjacent to the city limits. Installation is required within 90 days of delivery of the equipment from the manufacturer. VIEW OF REFERENCES: Staff contacted several of the references provided by Total Radio. The ATI siren system is in use in Addison, Texas, Garland, Texas; and the City of Sarnia, Ontario, Canada as well as several industrial facilities in Arizona, North Carolina, Louisiana, and California. All references contacted gave the ATI system positive comments and recommendations. FUNDING: Funding for the project is available through the Capital Improvements Fund. The total amount allocated for this project is $250,000. COMMENDATION: Staff recommends the Council award the contract for the installation of fourteen (14) storm sirens utilizing concrete poles to Total Radio of Tulsa, Oklahoma in the amount of $205,194.
