Consideration and appropriate action relating to a request for Council adoption of Resolution No. 2004-17, a resolution requesting assistance from the Oklahoma Department of Commerce (ODOC) to secure funding for a stormwater detention improvement project at the National Steak and Poultry located at 301 E 5th Avenue. Mr. Wiles Attachment #9 The staff will recommend approval of Resolution #2004-17. Staff will recommend Council approve Change Order No. 1 in the amount of $31,988, increasing the total contract amount to $130,264, acceptance of the FY2002 Sidewalk Rehabilitation Project contract work and authorize final payment in the amount of $42,739.90 to Rocket Construction Services, LLC of Sand Springs, Oklahoma. 11. Consideration and appropriate action relating to a request for Council approval of a supplemental appropriation to the General Fund in the Emergency Preparedness Department. Mr. Rooney Attachment #11 Staff will recommend Council approval a supplemental appropriation to the General Fund, increasing revenues and expenditures by $20,800, in the Emergency Preparedness Department for the creation of the Multi Hazard Mitigation Plan. Susan Kimball, Mayor OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, August 17, 2004 The Owasso City Council met in regular session on Tuesday, August 17, 2004 in the Council Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 5:00 p.m. on Thursday, August 129 2004. ITEM 1. CALL TOO ER The meeting was called to order at 6:30 p.m. ITEM 2. INVOCATION The invocation was offered by Charlie Curran, Senior Minister at First Christian Church of Owasso. ITEM 3. FLAG SALUTE City Councilor Gary Cochran led the flag salute. PRESENT ABSENT Susan Kimball, Mayor Craig Thoendel, Vice Mayor Steve Cataudella, Councilor Gary Cochran, Councilor Brent Colgan, Councilor A quorum was declared present. STAFF Rodney J. Ray, City Manager Ronald Cates, City Attorney ITEM 5. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF THE CONSENT AGENDA A. Approval of Minutes of the August 3, 2004 Regular Meeting and the August 01 10, 2004 Special Meeting B. Approval of Claims Owasso City Council August 17, 2004 C. Action relating to Council acceptance of water system improvements for Derr - Travel Trailer Park. The subject property is located on East 66th Street North immediately east of US Highway 169. D. Action relating to Council approval of Ordinance No. 791, an ordinance approving the zoning request of first Freewill Baptist Church, as made in application number OZ 04-08, and providing for the rezoning of approximately 42 acres, more or less, generally located in the northeast corner of fast 106th Street North and US Highway 169 from AG (Agricultural) to OM (Office Medium) / ISM -2 (Residential Multi - family), and repealing all ordinances or parts of ordinances in conflict herewith. Mr. Cochran moved, seconded by Mr. Colgan, to approve the Consent Agenda with claims totaling $186,238.65, and payroll claims totaling $271,333.569 and Council acceptance of water system improvements for Derr Travel 'frailer Park and Council approval of Ordinance No. 791 as stated above. YEA: Cochran, Colgan, Cataudella, Kimball, Thoendel NAY: None Motion carried 5 -0. Mr. Cuthbertson presented the item. Addressing the Council to speak against OPUD 04 -03 were Mr. Don LeMieux, Mr. Joe Esposito with comments from Mr. Bill Jacobs, Ms. Mary Buff, Ms. Sandra Casler, Ms. Sara Price, and Mr. Larry Price. Responding for the applicant was Jerry Ledford, Jr. representing Longford Group, Inc. One of the citizens' concerns was the use of the property if the plans for the medical park development were not realized and the PUD was still in effect. After considerable discussion regarding this concern, Mr. Colgan moved, seconded by Mr. Thoendel, that Council approve OPUD 04 -03 subject to staff and Planning Commission conditions with the stipulation that, if the PUD expired or is abandoned, the City Manager is directed to initiate a down zoning back to the zoning in place prior to the approval of the PUD. Addressing the Council to speak against the rezoning was Ms. Cindy Prock, Miss Chelsea frock, Mn James brook, Mr. Joe Esposito, Ms. Heather Satterwhite, Ms. Mary Huff and Mr. Larry Price. The Councilors then addressed the Citizens' concerns and explained the position of the Council. Mr. Cataudella moved, seconded by Mr. Thoendel, that Council approve rezoning request OZ 04-09 from the Longford Group, Inc. YEA: Cochran, Colgan, Cataudella, Kimball, Thoendel NAY: None Motion carried 5-0. Mr. Cuthbertson presented the item. Mr. Colgan moved, seconded by Mr. Cataudella, that Council approve rezoning request OZ 04-10 from Hunt Properties, Inc. Mr. Cochran moved, seconded by Mr. Colgan, that Council approve the Smith Farm Marketplace Final Plat subject to the successful execution of the TAC comments and the Planning Commission condition. YEA: Cochran, Colgan, Cataudella, Kimball, Thoendel NAY: None Motion carried 5-0. Ms. Stagg presented the item. Mr. Colgan moved, seconded by Mr. Thoendel, that Council approve Resolution No. 2004-14, authorizing the Mayor to 1) approve the concept of restructuring North Garnett Road, and 2) request ODOT to provide the title of the State owned 4 Owasso City Council August 17, 2004 property and/or parcels of land along North Garnett Road from East 86"' Street North to E a-st- 96"' Street North within the City of Owasso. YEA: Cochran, Colgan, Cataudella, Kimball, Thoendel NAY: None Motion carried 5-0. Mr. Ray introduced Jennifer Koscelny, an Owasso resident and former memher of the ODOT team. Ms. Koscelny was very helpful in assisting the City reach an agreement with ODOT ITEM 12. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF AN AMENDMENT TO AN AGREEMENT FOR ENGINEERING SERVICES FOR A STORMWATER MASTER PLAN WITH MESHEK & ASSOCIATES, INC. Ms. Stagg presented the item. Mr. Thoendel moved, seconded by Mr. Cataudella, for Council approval of Amendment #1 to an Agreement for Engineering Services for a Stormwater Master Plan with Meshek & Associates, Inc. to perform the second phase of the Stormwater Master Plan in the amount of $87,950.00 and authorize the Mayor to execute all necessary documents. YEA: Cochran, Colgan, Cataudella, Kimball, Thoendel NAY: None Motion carried 5-0. ITEM 13. PUBLIC HEARING. A Public Hearing held for the purpose of receiving comments and citizen input on the proposed Multi Hazard Mitigation Plan. Mr. Rooney presented the item. Mayor Kimball opened the floor for Citizen comments. There were no questions or comments from the audience. The Councilors asked Mr. Rooney if having a secondary water supply was pail of the Plan. Mr. Rooney answered that although our primary source of water was from the City of Tulsa, there are several other water source options available in case of emergency. Mr. Rooney introduced Cliff Motto, Director of Emergency Preparedness, and Roger Voss, an Owasso citizen who volunteers many hours of his time assisting Mr. Motto in the Emergency Preparedness department. 5 Owasso City Council August 17, 2004 ITEM 14. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A - REQUEST FOR COUNCIL ADOPTION OF RESOLUTION NO. 2004-15, A RESOLUTION ADOPTING THE MULTI HAZARD MITIGATION PLAN FOR THE CITY OF OWASSO. Mr. Rooney presented the item. Mr. Cataudella moved, seconded by Mr. Cochran, for Council adoption of Resolution No. 200415, a resolution allowing for formal Council adoption of the Multi-Hazard Mitigation Plan. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL ADOPTION OF RESOLUTION NO. 2004-16, A RESOLUTION ALLOWING THE CITY OF OWASSO TO PARTICIPATE IN THE 2004 ELECTION OF' THE OKLAHOMA MUNICIPAL RETIREMENT FUND BOARD • TRUSTEES. Mr. Rooney presented the item. Mr. Colgan moved, seconded by Mr. Cataudella, for Council adoption of Resolution No. 200416, casting a vote for Bob Provine of Midwest City to fill the expiring term of Trustee At Large on the Oklahoma Municipal Retirement Board of Trustees. Main Street, per the Notice of Public Meeting and Agenda posted on the City hall bulletin board at 12:00 PM on Monday, August 23, 2004. ITEM 1: CALL, TO ORDER. Vice Mayor Thoendel called the meeting to order at 5 :31 PM. PRESENT Craig Thoendel, Vice Mayor Steve Cataudella, Councilor Brent Colgan, Councilor Clary Cochran, Councilor A quorum was declared present. Garnett Rd. A general area map has been attached for your review. The second step in the development of a piece of property in Owasso is rezoning. When a property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. One type of rezoning that a developer may choose to seek is a Planned Unit Development, or PUD. When a development proposes to exhibit a mixture of uses with specific regulations and standards unique to a particular tract of land, a PUD is often the preferred land use control mechg-nism. The Committee reviews the petition for compliance with the Annexation Policy and establishes a recommendation to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the property is compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso City Council. The Owasso City Council will make the final determination to annex the property of refuse annexation. if the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. ANALYSIS Staff received a petition from Owasso Land Trust, requesting the City to annex approximately 2.25 acres of property. As stated earlier the applicant is requesting this annexation petition in order to ensure that the detention pond proposed for the Remington Place 11 addition is inside the Owasso corporate limits. Although this property is smaller than the 20 acres minimum recommended in the Owasso Annexation Policy, it is for all intents and purposes a part of the Remington Place II addition which contains approximately 35.46 acres. The Owasso 2010 Land Use Master Plan calls for residential development in that general area and it is intended that the subject property will be utilized as a detention pond in support of residential development. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. To this date staff has received no phone calls or correspondence in opposition of the request. ANNEXATION COMMITrEE On July 289 2004 the Owasso Annexation Committee voted unanimously to recommend approval of the request to annex 2.25 acres into the City. DUANE CIS THBERTSON, CITY PLANNER_ SUBJECT- PLANNED UNIT DEVELOPMENT — (OPUD 04-03) OWASSO MEDICAL CAMPUS DATE: AUGUST 12, 2004 In conjunction with OP UD 04-03 the applicant has submitted OZ 04-09, a request to rezone the property to OM (Office Medium Intensity District), to be utilized as the underlying zoning designation. DEVELOPMENT PROCESS The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the city limits is made a part of the city. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. When a property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. One type of rezoning that a developer may choose to seek is a Planned Unit Development, or PUD. When a development proposes to exhibit a mixture of uses with specific regulations and standards unique to a particular tract of land, a PLfD is often the preferred land use control mechanism. Another form of property division that can be considered in some cases is a lot split. Lot splits are minor subdivisions of property into three or fewer tracts, and do not provide for any new public streets. Typically, this is an appropriate option for a land owner who wishes to take large undeveloped parcels of land and divide it into two or three smaller tracts. The fourth step in the development o f a piece of property in Owasso is the site plan. Site plans are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. Upon receipt of all appropriate materials the staff initiates the review process which begins with a thorough analysis of the proposal. The primary consideration is the proposals compliance with the Owasso Zoning Code, specifically Chapter 8. The PLJD is then presented to the Owasso Technical .Advisory Committee at which time utility providers and staff are able to review and provide input on the proposals details. The Technical .Advisory Committee along with city staff make a recommendation to the Owasso planning Commission, The Owasso Planning Commission reviews the PUD proposal to determine if the proposal is compliant with the Owasso Zoning Code and forwards a recommendation to the Owasso City Council. The Planning Commission may make a recommendation to approve the proposal with conditions. If so, the conditions must be met before the application is forwarded to Council unless the applicant disputes a condition, then the council will make the final determination. The Owasso City Council will make a final determination as to whether the PUD proposal is complaint with the Owasso Zoning Code and consistent with development plans for the City of Owasso. If the Council approves the PLTD an ordinance officially declaring the zoning change to PLTD is written and adopted by the City Council. Particular site details such as drainage, streets, and utilities are appropriately discussed during the development review phases (plat and site plan) and not during a rezoning hearing. During a public review a decision on zoning changes must be based on one fundamental question: does the requested zoning allow a land use that is appropriate for the subject property.) The transitional designation in the Owasso Master Plan represents the middle of the land use intensity spectrum. The designation was conceived essentially to provide a transition between intense land use designations such as commercial and industrial and lower land use desi('nations such as residential. The 2010 Land Use Master Plan in affect today calls for residential land uses for the property, however in the same document the Master Plan calls for the need to provide for transitional uses between higher and lower land use classifications so as to create a transitional buffer between the two. OP UD 04-03 ) represents the very ideal of a transitional buffer. It is staff s opinion that the PUD proposed by the applicant would be consistent with the Comprehensive Plan. PLANNING AND SITE ENGINEERING While the applicants have provided for an onsite pond and ample green space to accommodate detention and drainage needs, staff would recommend the requirement of a detailed drainage report and certification of such document by an engineer at the time of platting. Internal street patterns appear to be of a logical and sensible pattern. Although there exists two fairly Iona straight streets that may encourage speeding if not checked. Staff would recommend 0 Staff would recommend that a detailed landscape plan be submitted with any site plan for development within the PUD. Said landscaping plans would then be reviewed by staff to ensure that compatible relationships between the differing surrounding uses are maintained. The Planning Commission would also be required to review and approve these plans at the time of site plan submittal. The PUD calls for the establishment of an Architectural Review Board to review and approve all site, landscape, drainage and architectural plans as well as approve all architectural building materials. The Board will be one of the major steps in assuring that the project is developed in a consistent and cohesive manner and in making sure all development follows the guidelines and objectives of the PUD. In short, providing a PLTD is well-thought by the applicant and reviewed by the staff, Planning Commission and Council properly, it can be an asset to both the applicant and the community. Attached for you information and review is a copy of the application, general area map, as well as the legal notice sent to surrounding property owners and advertised in the Owasso reporter. Funding for the creation of the plan document was made possible through a grant application through FEMA and the Oklahoma Department of Emergency Management. The amount of the grant award was $20,800, UEST: In order for the City of Owasso to utilize funds from the Multi-Hazard Mitigation Grant program, a supplemental appropriation to the Emergency Preparedness Department of the General Fund is needed. The supplemental appropriation would increase both revenues and expenditures of the Emergency Preparedness Department by $ 20,800. FUNDING: Funding for this request is derived from the Multi-Hazard Mitigation Grant program in the amount of $20,800. Once again, this grant program is provided through FEMA and the Oklahoma Department of Emergency Management. RECOMMENDATION: Staff recommends Council approval of a supplemental appropriation to the General Fund, increasing revenues and expenditures by $ 20,800 in the Emergency Preparedness Department.
