9. Consideration and appropriate action relating to a request for approval of the Consent
Agenda. All matters listed under "Consent" are considered by the City Council to be
routine and will be enacted by one motion. Any Councilor may, however, remove an item
from the Consent Agenda by request. A motion to adopt the Consent Agenda is non-
debatable.

C. Action relating to Council approval to increase AFIS fees collected by the City of
Owasso on all criminal misdemeanor and traffic violations resulting in an adjudication
of guilt or a finding that results in a suspended or deferred sentence. This increase in
fees collected is pursuant to Senate Bill 1542, signed by Governor Brad Hemy on
March 28, 2004.

Staff will recommend Council approve an increase current AFIS fees collected by the
Owasso Municipal Court in the amount of $2.00, resulting in an increased total
amount of administrative fees collected by the court to $34.00, and has placed this
item on the consent agenda due to the mandatory increase directed by the Senate Bill
1542
D. Action relating to a request for Council acceptance of the Dirty Dawg Mini Storage
water system, sanitary sewer system, and storm water drainage system.

Staff will recommend Council accept the Chelsea Park sanitary sewer system.
Eo Action relating to Council approval of Ordinance No. 797, an ordinance approving the
annexation request of Hemy Penix, as made in application number OA 04-07, and

located at the southeast comer of E. 76th Street North and N. 1291h East Avenue, and
repealing all ordinances or parts of ordinances in conflict herewith.

08, and providing for the annexation of approximately 30 acres, more or less, generally
located Y2 mile south of E. 116th Street NOlih on the east side ofN. Garnett Road, and
repealing all ordinances or parts of ordinances in conflict herewith.

12. Consideration and appropriate action relating to a request for Council approval of a final
plat for Renaissance Center from Ed Long. The subject property is located in the
southeast corner ofE. 86th St. N. and N. 13ih E. Ave., containing approximately 3.264
acres, more or less.

13. Consideration and appropriate action relating to a request for Council acceptance of a
Community Development Block Grant (CDBG) in the amount of $66,450 for the purpose
of constructing a handicapped accessible restroom and sidewalk access to the Owasso
Skate Park.

Monday, October 11, 2004
The Owasso City Council met in a special meeting on Monday, October 11, 2004 in the Lower
Level Conference Room at Owasso City Hall, 111 N. Main Street, per the Notice of Public
Meeting and Agenda posted on the City Hall bulletin board at 4:00 PM on Thursday, October 7,
2004.

totaling $326,121.42 (including an addendum to claims list totaling $102,836.26), and payroll
claims totaling $267,736.38.

ITEM 7.
CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR COUNCIL APPROVAL OF THE OW ASSO MEDICAL
CAMPUS FINAL PLAT FROM THE HASKELL COMPANY. THE SUBJECT
PROPERTY IS LOCATED APPROXIMATELY .3 MILES NORTHWEST OF
THE INTERSECTION OF EAST 96TH STREET NORTH AND NORTH 129TH
EAST AVENUE.
Mr. Cuthbertson presented the item. Ms. Mary Huff addressed the Council with concerns
regarding this item. Mr. Jason Bray also briefly addressed the Council. Mr. Cataudella moved,
seconded by Mr. Cochran, for Council approval of the Owasso Medical Campus final plat
contingent upon the successful execution of the Technical Advisory Committee conditions and
the additional Planning Commission condition.

REQUEST FOR COUNCIL ACCEPTANCE OF A DONATION FROM THE
WAL-MART FOUNDATION, AND THE APPROVAL OF A SUPPLEMENTAL
APPROPRATION.
Mr. Rooney presented the item. Mr. Cochran moved, seconded by Mr. Cataudella, for Council
acceptance of the donation from the Wal-Mart Foundation and the approval of a supplemental
appropriation in the General Fund. The supplemental appropriation would increase revenues by
$3,000, as well as increase the Police Depmiment and Fire Department expenditures by $1,500
each.

EXCEED $36,430.00.

FIRE STATION #2, LOCATED ON EAST 76TH STREET NORTH.

award the renovation contract for Fire Station #2 to Barton Construction of Tulsa, Oklahoma in
the amount of$127,454.00.

award the FY04-05 Street Repair contract to Magnum Construction, Inc. of Broken Arrow,
Oklahoma in the amount of $1 00,570.00.

ANTICIP ATION NOTE OF THE OW ASSO ECONOMIC DEVELOPMENT
AUTHORITY, APPROVING A LOAN AGREEMENT, AND APPROVING
RELATING DOCUMENTS.

ITEM 18. CONSIDERATION AND APPROPRIATE ACTION RELATING TO ADOPTION
OF RESOLUTION NO. 2004-22, A RESOLUTION APPROVING THE OW ASSO
PUBLIC WORKS AUTHORITY INCURRENCE OF AN OBLIGATION TO SF
MARKETPLACE INVESTORS, LTD. AND ENTERING INTO AN
INFRASTRUCTURE IMPROVEMENTS AGREEMENT.
Mr. Hayes presented the item. Mr. Cataudella moved, seconded by Mr. Colgan, for Council
approval of Resolution No. 2004-22, approving an Infrastructure Improvement Agreement
between the Owasso Public Works Authority and SF Marketplace Investors, LTD. and
authorizing the Mayor to execute documents relating to the agreement.

ITEM 19. REPORT FROM CITY MANAGER
Mr. Ray said each Councilor had been given a draft copy of the 'Engineering Design Criteria,
Constmction Standards and Standard Details' along with a Transmittal Memorandum explaining
what Public Works' plan is for its use.
Mr. Ray also updated the Council on the water supply situation with City of Tulsa.
Mr. Ray advised the Council he had received a memorandum from the Owasso City Clerk
advising him that, based on the Opinion of the City Attorney regarding a recently prefiled
Initiative Petition, said Petition was legally insufficient for submission to the qualified electors
because of its subject matter, the amendatory rezoning of real property. All petitioners would be
notified by certified mail ofthe City Attorney's Opinion.

BACKGROUND:
On May 28,2004, Governor Henry signed SB1542 which increased the Automated Fingerprint
Identification System (AFIS) fee, collected by the Oklahoma State Bureau of Investigation
(OSBI), by $2.00. The fee is mandatory and is collected on all criminal and traffic citations with
an adjudication of guilt or a finding that results in a suspended or deferred sentence. Current
CLEET fees include $9.00 for the penalty assessment fee, $3.00 for the Automated Fingerprint
Identification System (AFIS), and $5.00 for the Forensic Science Improvement Assessment Fee
for a total of$17.00.
Beginning November 1, 2004, the Automated Fingerprint Identification Fee will increase to
$5.00 per citation. The additional $2.00 penalty assessment fee will bring the total fees collected
by the court for CLEET/OSBI to $19.00. The Owasso Municipal Court cunent1y assesses $32.00
in administrative costs and fees, along with the appropriate fine on all convictions or deferrals.
With the penalty fee assessment increase, the court will collect a total of $34.00 in administrative
costs and fees, along with the fine assessed on all convictions or defenals.
This item has been placed on the consent agenda because the fee increase is mandatory and must
be approved by the governing body by motion.
~MENDATION:
The staff recommends the City Council by motion, as authorized by Section 6-138 of the City
Code, increase the current court costs to $34.00 to allow collection of the increase in the AFIS
Assessment Fee as mandated by Oklahoma State Statutes.

A. In addition to the fees imposed by Sections 1313.2 and 1313.4 of this title, any person convicted of any
offense, including traffic offenses but excluding parking and standing violations, punishable by a fine of Ten
Dollars ($10.00) or more or by incarceration or any person forfeiting bond when charged with such offense, shall
be ordered by the court to pay a fingerprinting fee in the amount of Five Dollars ($5.00) for each offense for the
A.F .I.S. Fund created by Section 150.25 of Title 74 of the Oklahoma Statutes. The fee shall be in addition to and
not in substitution for any and all fines and penalties otherwise provided for by law for the offense. The fee shall
be collected at the same time as the fees provided for in Section 1313.2 of this title. Four Dollars and fifty cents
($4.50) of each fee received pursuant to this section shall be paid directly to the A.F.I.S. Fund and the balance
shall be deposited in the General Revenue Fund by the court clerk. The payments shall be made to the
appropriate fund by the court clerk on a monthly basis as set forth by subsection H of Section 1313.2 of this title.
B. As used in this section:
1. "Convicted" means any final adjudication of guilt, whether pursuant to a plea of guilty or nolo contendere or
otherwise, and any deferred judgment or suspended sentence; and
2. "Court" means any state or municipal court having jurisdiction to impose a criminal fine or penalty.

BACKGROUND:
The subject commercial development is located at 11505 N. 109th East Ave (see attached map).
The sanitary sewer system consists of approximately 157 feet of 8-inch PVC sanitary sewer line,
and the water system consists of approximately 278 feet of 6-inch PVC water line. Design of the
sanitary sewer and water systems were reviewed and approved in April 2004 and have been
permitted by the Oklahoma Department of Environmental Quality (see attached permit letters).
FINAL INSPEcTION~
Final inspections for the sanitary sewer and water systems were completed on July 13,2004. All
items identified at the final inspection requiring correction to meet city standards have been
completed. The construction contractor has provided the required one-year maintenance bond
for each system (see attached).
RECOMMENDATION,:.
Staff recommends Council acceptance of the Diliy Dawg Mini-Storage sanitary sewer and water
systems.

BACKGROUND
The City of Owasso has received a request from Henry Penix for the annexation of
approximately 9.274 acres of property. At this time it is the City's understanding that the
applicant is requesting this annexation petition in order to begin a process that will result in the
commercial development of the property.
The property is located at the southeast corner ofN. 129th E. Ave. and E. 76th St. N. A general
area map has been attached for your review.
A Koala Care child care center and a single family house are located on the subject. Large-lot
residential development can be found along the northern and southern boundaries of this
property. Rural residential development is located to the east and the Baptist Retirement Center
is located to the west.
The property is cUITently zoned AG (Agricultural District) in Tulsa County as is the propeliy to
the east. The properties to the north and south are zoned RE (Residential Estates District) in
Tulsa County. The property to the west is zoned RS-l (Residential Single Family District).
DEVELOPMENT PROCESS:
The first step in the development of a piece of property in Owasso is annexation. Annexation is
the method whereby land located outside the City limits is made a part of the City. Property
owners and land developers sometimes choose to have their property annexed into Owasso in
order to receive Owasso municipal services, such as police and fire protection, refuse col.lection,
and sanitary sewer.
The second step in the development of a piece of property in Owasso is rezoning. When a
property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In
order to develop the property, the land must be zoned for particular kinds of uses, such as
residential, office, commercial, or industrial. Rezoning decisions are made in accordance with
the growth policy displayed in the Owasso Master Plan.
One type of rezoning that a developer may choose to seek is a Planned Unit Development, or
PUD. When a developer proposes to exhibit a mixture of uses with specific regulations and
standards unique to a particular tract of land, a PUD is often the preferred land use control
mechanism.
The third step in the development of a piece of property in Owasso is platting. A preliminary
plat is required for any development that proposes to divide land into two or more lots.
Preliminary plats illustrate the development concept for the property, and are often modified
significantly after being reviewed by the Technical Advisory Committee (T AC), and the Owasso
Planning Commission. Sometimes, difficult development issues such as existing utility lines,
wells, or easements are brought to light at the preliminary plat stage and must be remedied prior
to development.
After the preliminary plat has been reviewed by the City and various utility companies,
construction plans for the development's infrastructure are typically submitted. These plans
include specifications and drawings for stormwater drainage, streets and grading and erosion
control, waterlines) stormwater detention, and wastewater lines. Often, approval is required of
other agencies, such as the Department of Environmental Quality for wastewater collection and
the US Army Corps of Engineers for properties that may be development sensitive.
Once the property development proposal shows a division of lots that is acceptable to both the
developer and the City of Owasso, a final plat application is submitted. A final plat illustrates
the layout and dimension of lots included on the final plat, right-of-way widths, easements, and
other physical characteristics that must be provided for review by the City. After obtaining
approval from the T AC and Planning Commission, the final plat is considered by the City
Council. If approved, the final plat is filed with the office of the County Clerk and governs all
future development on that property.
Another form of property division that can be considered in some cases is a lot split. Lot splits
are minor subdivisions of property into three or fewer tracts, and do not provide for any new
public streets. Typically, this is an appropriate option for a land owner who wishes to take large
undeveloped parcels ofland and divide it into two or three smaller tracts.
The fourth step in the development of a piece of property in Owasso is the site plan. Site plans
are reviewed by the T AC and Planning Commission. Issues such as building setbacks, parking,
access, landscaping, and building footprint are presented in the site plan. Once a site plan is
approved, the development is clear to apply for a building permit and to submit construction
plans for the building's foundation, plumbing, electrical system, and .HV AC.
ANNEXATION REVIEW P~OCESS
The annexation process is initiated when a property owner submits a petition to the City of
Owasso requesting that the City bring the property into the City limits.
The applicant must submit as part of the request a signed petition requesting the annexation, an
accurate legal description and map of the property being requested for annexation and a certified
300' radius report so that staff may send legal notices to surrounding property owners.
Upon receipt of all appropriate materials the staff initiates the review process which begins with
a thorough analysis of the request. The primary consideration is the property's compliance with
the Owasso Annexation Policy. The policy establishes a set of guidelines that define which
properties are considered for annexation.
The annexation request is then presented to the Owasso Annexation Committee for review and
recommendation. The Annexation Committee is made up of staff, elected officials and citizens.
The Committee reviews the petition for compliance with the Annexation Policy and establishes a
recommendation to the Owasso Planning Commission.
The Owasso Planning Commission holds a public hearing to determine if the property is
compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso
City CounciL
The Owasso City Council will make the final determination to annex the property or refuse
annexation. If the property is annexed into the City limits an ordinance officially declaring the
annexation is written and adopted by the City CounciL Once adopted the ordinance is circulated
to appropriate regional and national agencies for recording and altering maps.
LEGAL CONSIDERA nONS OF AN ANNEXATION
The following annexation policy for the City of Owasso is provided as a guideline and should
not be constructed as inflexible requirements for annexation.
1. While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing City Limits.
3. All properties should be annexed into the City limits as the lowest zoning classification,
that is, Agricultural (AG). Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the City will be legal,
but non-conforming, which means that they may continue but cannot be expanded
without proper zoning.
4. All public infrastructures that do not meet City standards will not be improved by the
City until brought to the City standard and accepted by the City CounciL Such public
facilities must be improved at owner's expense by the establishment of a special
assessment distIict or some other financing method.
S. Where a City limit boundary ends at a dedicated street, the boundary will not include the
street right-of-way. This policy will establish consistency and allow City employees and
citizens to know where the City boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for a
six month period after rejection by the City Council.
ANALYSIS
Staff has received a petition from Henry Penix, requesting the City to annex aPEroximately 9.274
acres of propelty located at the southeast comer of E. 76th St. N. and N. 129 E. Ave. At this
time it is our understanding the applicant is requesting this annexation petition in order to begin a
process that will result in the commercial development of the property. The property is located
at the southeast corner of a significant intersection in the City.
A Koala Care child care center and single family house currently exist on the property. As a
matter of City policy the property would be annexed in at the lowest zoning classification of AG
(Agricultural District). Therefore the Koala Care child care center would become a legal non-
conforming use until the property was rezoned to appropriate zoning district. A legal non-
conforming use is a designation given to an existing use on property at the time of a zoning
change. The designation allows the existing use to continue operating in its current status under
its current ownership. If the annexation is approved the applicant intends to request a rezoning
to CS (Commercial Shopping) in the next month.
The current site conditions are mostly favorable. All parking and driving surfaces are paved.
The Koala Care site is developed in accordance with City site development standards except for
the lack of sidewalk and a borrow ditch along the roadways. Again, the applicant has stated his
intention to develop the property in a commercial manner and he has stated that he will address
all site deficiencies discovered on the properties during the site development.
If the property is annexed into the City the applicant will be required to follow normal
development procedures which would include rezoning, preliminary and final plat review.
Again, if annexed, any development proposed for the property would be required to meet the
Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site
engineering standards as proscribed by Public Works including but not limited to paved streets
and sidewalks. The property would be served water and sewer by the City of Owasso.
The property being requested for annexation is currently two separate tracts, however, they will
be combined into one plat that will address the developability of the property.
The Owasso 2010 Land Use Master Plan calls for commercial development on the subject
property.
When examining the Owasso Annexation Policy, one finds that the subject site is not larger than
the recommended size of 20 acres. However, the site does represent a potentially significant
commercial corner in the overall land use plan of the City of Owasso. The property is
contiguous to existing City limits. If annexed, the subject property will acquire an AG
(Agricultural District) zoning designation.
Staff published legal notice of the annexation petition in the Owasso Reporter and letters of
notification were mailed to property owners within a 300' radius. To this date staff has received
no phone calls or correspondence in opposition of the request.
PW ASSO ANNEXA nON COMMITTEE
At their September 29, 2004 meeting the Owasso Annexation Committee unanimously
recommended approval ofOA 04-07. Minutes from that meeting are attached for your review.
PLANNING COMMISSION
At the regularly scheduled meeting on October 11, 2204 the Owasso Planning Commission
unanimously recommended approval of OA 04-07 to annex the property into the City limits of
Owasso.
RECOMMENDATION
Staff recommends approval of OA 04-07.

BACKGROUND
The City of Owasso has received a request from the Owasso Land Trust for the annexation of
approximately 30.00 acres. At this time it is our understanding the applicant is requesting this
annexation petition in order to begin a process that will result in the development of a single-
family subdivision.
The property is located south and west of the developing Remington Place II addition. More
specifically the property is located at or near the east side of the 11000 Block ofN. Garnett Rd.
A general area map has been attached for your review.
The property is currently undeveloped as is the property to the east. The properties to the north
and south are developed in a rural residential manner. The properties to the west are developed
in a large-lot residential manner.
The property is currently zoned AG (Agricultural District) in Tulsa County as are properties to
the north, south and west. The propelty to the east is currently zoned RS-3 (Residential Single-
Family District). .
DEVELOPMENT PROCESS:
The first step in the development of a piece of property in Owasso is annexation. Annexation is
the method whereby land located outside the City limits is made a part of the City. Property
owners and land developers sometimes choose to have their property annexed into Owasso in
order to receive Owasso municipal services, such as police and fire protection, refuse collection,
and sanitary sewer.
The second step in the development of a piece of property in Owasso is rezoning. When a
property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In
order to develop the property, the land must be zoned for particular kinds of uses, such as
residential, office, commercial, or industrial. Rezoning decisions are made in accordance with
the growth policy displayed in the Owasso Master Plan.
One type of rezoning that a developer may choose to seek is a Planned Unit Development, or
PUD. When a developmer proposes to exhibit a mixture of uses with specific regulations and
standards unique to a particular tract of land, a PUD is often the preferred land use control
mechanism.
The third step in the development of a piece of property in Owasso is platting. A preliminary
plat is required for any development that proposes to divide land into two or more lots.
Preliminary plats illustrate the development concept for the property, and are often modified
significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso
Planning Commission. Sometimes, difficult development issues such as existing utility lines,
wells, or easements are brought to light at the preliminary plat stage and must be remedied prior
to development.
After the preliminary plat has been reviewed by the City and various utility companies,
construction plans for the development's infrastructure are typically submitted. These plans
include specifications and drawings for stormwater drainage, streets and grading and erosion
control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of
other agencies, such as the Department of Environmental Quality for wastewater collection and
the US Army Corps of Engineers for properties that may be development sensitive.
Once the property development proposal shows a division of lots that is acceptable to both the
developer and the City of Owasso, a final plat application is submitted. A final plat illustrates
the layout and dimension of lots included on the final plat, right-of-way widths, easements, and
other physical characteristics that must be provided for review by the City. After obtaining
approval from the T AC and Planning Commission, the final plat is considered by the City
Council. If approved, the final plat is filed with the office of the County Clerk and governs all
future development on that property.
Another fOlm of property division that can be considered in some cases is a lot split. Lot splits
are minor subdivisions of property into three or fewer tracts, and do not provide for any new
public streets. Typically, this is an appropriate option for a land owner who wishes to take large
undeveloped parcels ofland and divide it into two or three smaller tracts.
The fourth step in the development of a piece of property in Owasso is the site plan. Site plans
are reviewed by the T AC and Planning Commission. Issues such as building setbacks, parking,
access, landscaping, and building footprint are presented in the site plan. Once a site plan is
approved, the development is clear to apply for a building permit and to submit construction
plans for the building's foundation, plumbing, electl1cal system, and HV AC.
ANNEXATION RE}'IEW PROCE~
The annexation process is initiated when a property owner submits a petition to the City of
Owasso requesting that the City bring the property into the City limits.
The applicant must submit as part of the request a signed petition requesting the annexation, an
accurate legal description and map of the property being requested for annexation and a certified
300' radius report so that staff may send legal notices to sun'ounding property owners.
Upon receipt of all appropriate materials the staff initiates the review process which begins with
a thorough analysis of the request. The primary consideration is the property's compliance with
the Owasso Annexation Policy. The policy establishes a set of guidelines that define which
properties are considered for annexation.
The annexation request is then presented to the Owasso Annexation Committee for review and
recommendation. The Annexation Committee is made up of staff, elected officials and citizens.
The Committee reviews the petition for compliance with the Annexation Policy and establishes a
recommendation to the Owasso Planning Commission.
The Owasso Planning Commission holds a public hearing to determine if the property is
compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso
City Council.
The Owasso City Council will make the final determination to annex the property or refuse
annexation. If the property is annexed into the City limits an ordinance officially declaring the
annexation is written and adopted by the City Council. Once adopted the ordinance is circulated
to appropriate regional and national agencies for recording and altering maps.
LEGAL CONSIDERATIONS OF AN ANNEXATION
The following annexation policy for the City of Owasso is provided as a guideline and should
not be constructed as inflexible requirements for annexation.
1. While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing City Limits.
3. All properties should be annexed into the City limits as the lowest zoning classification,
that is, Agricultural (AG). Landowners may then petition for rezoning if they desire
further development of their property. All legal uses annexed into the City will be legal,
but non-conforming, which means that they may continue but cannot be expanded
without proper zoning.
4. All public infrastructures that do not meet City standards will not be improved by the
City until brought to the City standard and accepted by the City Council. Such public
facilities must be improved at owner's expense by the establishment of a special
assessment district or some other financing method.
S. Where a City limit boundary ends at a dedicated street, the boundary will not include the
street right-of-way. This policy will establish consistency and allow City employees and
citizens to know where the City boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for a
six month period after rejection by the City Council.
ANALYSIS
Staff received a petition from Owasso Land Trust, requesting the City to annex approximately
30.00 acres of property. At this time it is our understanding the applicant is requesting this
annexation petition in order to begin a process that will result in the development of a single-
family subdivision. The property is connected to the developing Remington Place II addition
and could conceivably serve as an extension of the development and serve as the western
terminus, or outlet onto N. Garnett Rd.
If the property is annexed into the City the applicant will be required to follow normal
development procedures which would include rezoning, preliminary and final plat review. If
annexed, any development proposed for the property would be required to meet the Owasso
Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering
standards as proscribed by Public Works including but not limited to paved streets and
sidewalks. The property would be served water and sewer by the City of Owasso.
The Owasso 2010 Land Use Master Plan calls for residential development in that general area.
In regards to the Owasso Annexation Policy the request is larger than 20 acres and contiguous to
existing City limits. No public infrastructure or development currently exists on the property; all
public improvements will be made by the developer. If annexed, the subject property will
acquire an AG (Agricultural District) zoning designation.
Staff published legal notice of the annexation petition in the Owasso Reporter and letters of
notification were mailed to property owners within a 300' radius. To this date staff has received
no phone calls or correspondence in opposition of the request.
OW ASSO ANNEXATION COMMITTEE
At their September 29, 2004 meeting the Owasso Annexation Committee unanimously
recommended approval of OA 04-08.
PLANNING COMMISSION
At the regularly scheduled meeting on October 11, 2204 the Owasso Planning Commission
unanimously recommended approval of OA 04-08 to annex the property into the City limits of
Owasso.
RECOMMENDATION
Staff recommends approval of OA 04-08.

The Owasso Trustee position with the Metropolitan Environmental Trust Authority has been
vacated with the resignation of the previous appointee, Mr. Robert Carr. It is, therefore, the
purpose of this memorandum to recommend for Council confirmation the appointment of Ana
Stagg, Public Works Director, to the Metropolitan Enviromnental Trust (M.E.T.) Authority.

BACKGROUND
The City of Owasso has received a request from Ed Long, Jr. for the review and
approval of a final plat for Renaissance Center consisting of one lot and one reserve
area in one block on 3.264 acres, more or less. It is the intention ofthe property owner to
plat the property and develop a commercial shopping center on the northern section of the
property and a mini-storage facility on the southern section of the property.
The propeliy is located at the southeast comer ofN. 13ih E. Ave. and E. 86th St. N. A
general area map has been attached for your review. It is currently undeveloped as is the
property to the east. The Owasso Eighth Grade Center is located to the north and the
Greens Apartments are located to the south. The Owasso Medical Center is located
immediately to the west.
The subject property is cunently zoned CS (Commercial Shopping) while propeliy to the
north and east are zoned AG (Agricultural District). The propeliy to the south is zoned
RM -1 (Residential Multi-Family District) and the property to the west is zoned OM
(Office Medium Intensity District).
SITE SPECIFIC HISTORY
In 2003, the property was platted as ROC Owasso III; two lots on two blocks intended to
be developed in a commercial manner. The approved plat was never filed with the Tulsa
County Clerk's office and has expired. The property has since changed hands and the
new applicant is in the process of establishing a new plat and site plan for the
development of the property.
On September 28, 2004, the applicant received a Special Exception from the Owasso
Board of Adjustment to allow the development of mini-storages on the southern 1/3 of
the property.

FINAL PLAT REVIEW PROCESS

to the City of Owasso requesting the review and acceptance of a subdivision of land. The
application shall be accompanied by the correct fee and final plat drawings and
covenants. If the final plat is one lot on one block the applicant may forego the
Preliminary plat review, in such case the applicant will be responsible for submitting a
certified abutting property owners report at the final plat stage so that staff may notifying
abutting property owners.
Upon receipt of a complete application City staff will begin reviewing the proposal for
compliance with the Ow as so Zoning Code, Subdivision Regulations and Engineering
specifications.
The proposed final plat will then be presented to the Owasso Technical Advisory
Committee (T AC) for review and recommendation. At that meeting utility providers and
City staff are afforded the opportunity to comment on the technical aspects of the
development proposal. The T AC will forward a recommendation to the Planning
Commission.
The Owasso Planning Commission will hold a public hearing to determine if the
application is compliant with the Owasso Zoning Code, Subdivision Regulations, and
Engineering criteria. The Planning Commission will forward a recommendation to the
City Council.
The Owasso City Council will then determine if the final plat meets city specifications
and approve, deny, or approve the final plat with conditions.
The applicant will then produce copies of the approved Final Plat for signatures from the
appropriate officials and file it with the county clerk's office. The applicant will provide
the city with three certified, signed, and recorded plats along with an 8 Yz 11 copy and
an electronic copy for records.
ANALYSIS
A Final Plat is the final map or record of a subdivision and any accompanying material,
as described in the Subdivision Regulations, based on a Preliminary Plat with revisions, if
any, to be submitted to the Planning Commission and City Council for approval, denial,
or approval with conditions.
Ed Long is requesting the review and approval of the Renaissance Center final plat so
that he may eventually develop a commercial shopping center on the nOlihern section of
the property and a mini-storage facility on the southern section ofthe property.
According to the proposal the property will be accessible directly from E. 86th St. N. The
applicant has proposed one access on the plat of 40'. The remainder of the frontage on E.
86th St. N. will be marked with a Limit of No Access (LNA) prohibiting future curb cuts
into the development from E. 86th St. N. The location of the Limit of Access provides
adequate spacing between it and an existing curb cut located on adjacent property to the
west. An adequate amount of width has been dedicated to the E. 86th St. N. right-of-way.
A sidewalk cunently exists along E. 86th St. N. The developer will be responsible for
ensuring that the sidewalk condition remains adequate after the development phases of
the property.
The proposed plat shows a reserve area located in the southern portion of the plat. It is
the intention of the developer to utilize that reserve area as a detention pond that would
provide storm water detention for the site. The covenants state that the developer/owner
is responsible for maintaining the reserve area. Before any building permit may be
permitted drainage and detention details must be reviewed and approved by the Owasso
Public Works department. It should be noted that this reserve area is not part of the
wetlands area that lies east of the property.
The applicant has provided 17.5' utility easements along the nOlihern, southern, and
western perimeter lines of the plat. The Technical Advisory Committee did not require a
utility easement along the eastern side of the plat.
Any development that occurs on the property will be subject to a site plan review and
must adhere to all subdivision, zoning and engineering requirements including but not
limited to paved streets and sidewalks. The site will be provided with sewer and water
service by the City of Owasso. The applicant will be responsible for paying all fees
associated with developing the property including the Storm Siren fee of $16 per acre and
the Elm Creek Sanitary Sewer fee of$1580 per acre.
TECHNICAL ADVISORY COMMITTEE
The Renaissance Center Final Plat was reviewed at the regularly scheduled Owasso
Technical Advisory Committee on September 29,2004. At that meeting utility providers
and city staff are afforded the opportunity to comment on the tecp,nical aspects of the
development proposal. The following comments were provided:
1. Community Development - Show the ownership of the property on the plat
drawing;
2. Community Development - Ensure that sidewalks are established along all public
roadways within and adjacent to the development;
3. Community Development - Pay the Storm Siren fee of $16 per acre upon approval
of the Final Plat;
4. Community Development - Pay the Elm Creek Sanitary Sewer fee of $1580 per
acre upon approval of the Final Plat;
5. Oklahoma Natural Gas - Provide standard language in the deeds of dedication.
PLANNING COMMISSION
At their regularly scheduled meeting on October 11, 2004 the Owasso Planning
Commission unanimously recommended approval of the Renaissance Center final plat
contingent upon the successful execution of the T AC conditions.
RECOMMENDATION
All of the conditions of approval have been met or agreed upon by the applicant. Staff
recommends approval of the Renaissance Center final plat.

BACKGROUND:
On May 18, 2004, the Owasso City Council approved Resolution #2004-09 as part of the
application process requesting financial assistance from the Oklahoma Department of Commerce
under the FY 2004 Small Cities set-aside funding. The application was specifically directed
toward improvements relating to the Americans With Disabilities Act (ADA). The intent is to
construct a handicapped accessible restroom facility at the Owasso Skatepark and to construct
access ramps and sidewalks leading to the Skatepark. The recommended improvements were
presented at a public hearing on March 9,2004.
FUNDING:
The staff received notice on October 7, 2004 that funding in the amount of $66,450 has been
approved. A "one-for-one" cash match is required of the city each year in order to receive the
grant funds. The FY 2004-2005 city budget includes funds within the Parks Department in an
amount sufficient to satisfY the match requirement.
RECOMMENDATION:
The staff recommends that the City Council accept the Small Cities set-aside grant fJ:om the
Oklahoma Department of Commerce, and authorize the Mayor to execute the acceptance letter
and all appropriate documents.

Grant funds. If the enclosed documentation (items 2 - 5) are not returned to the Office of
Community Development at the Oklahoma Department of Commerce within six (6) weeks of
the date of this letter, the award of Community Development Block Grant funds will be ///

1. Copy of Signatories Cunently on File With Us: If the Oklahoma Department of
Commerce (ODOC) has received a Certificate of Authorized Signatures (Signatory) fonn
from you within the last 12 months, a copy is attached. If the signatories shown on this
copy are still the same, you may skip paragraph #2 and proceed to paragraph #3. If there is
to be a change or if we do not have a Signatory form less than 12 months old, please
proceed to paragraph #2.
Signatory Form: Please ensure that the Signatory form is completed before the contract

FY 2003 CDBG SIDEWALK REHABILITATION PROJECT

BACKGROUND:
As part ofthe Community Development Block Grant (CDBG) program, this project includes
construction of new sidewalks, repair of existing sidewalks, removing tripping hazards, and
construction of new handicap ramps in locations where accessibility standards are not cun"ently met.
Locations for improvements were identified within the original area oftown (known as old town)
generally bounded by East 76th Street North to 11 th Street and U.S. Highway 169 west service road to
Atlanta Avenue. That portion ofthe Three Lakes addition which lies east of U.S. Highway 169 and
south of 86th Street NOlih also qualifies under the CDBG program.
In September 2004, the Public Works Department Engineering Division finalized plans and
specifications for the FY 2003 project (see Attachment A). Contract documents include additive
alternates in order to allow completion of as many sites as possible and expend all available funds.
Advertisement for Bids was published in the Owasso Reporter on September 30th and October ih,
2004.
Contract documents are structured with a base bid to complete all construction and various repairs.
Additive alternates are included for the removal and replacement of sidewalk and the constmction of
new sidewalk in alternate locations within the program area. The Engineer's Estimate prepared by
Public Works staffin October 2004 is $126.314.50 for the base work and $26,700.00 for alternate
work resulting in a total estimate of$153,014.50 (see Attachment B).
ANALYSIS OF)3IDS:
Bids were opened on October 20, 2004 from seven (7) companies as shown on the attached summary
sheet (see Attachment B). The apparent low bid was submitted by AP AC-Oklahoma of Tulsa in the
amount of$116,221 for the base bid and $17,150 for the alternates for a total bid of$133,371 (see
Attachment C).
City staff examined the submitted bid package and no omissions or errors were found. Additionally,
based on work history, AP AC appears qualified to perform the work.

Funds for this project are available through a federal matching grant in the amount of $67,132.00.
The City contribution of$67,132 is included in the FY 04-05 Capital Project Grant Fund (Line Item

Staff recommends Council award of the FY 2003 CDBG Sidewalk Rehabilitation Project to AP AC-
Oklahoma, Tulsa, Oklahoma in the amount of$133,371.

BIDDER acknowledges that estimated quantities are not guaranteed and are solely for the
purposes of comparison of Bids. Final payment for all Unit Price Bid Items will be based

4. BIDDER agrees that the Work will be substantially complete within fifty (50) calendar
days after the date when the Contract Times commence to run as provided by the General
Conditions and completed and ready for final payment in accordance with the General

BIDDER accepts the provisions of the Agreement as to liquidated damages of $300.00 for
each consecutive calendar day in the event of failure to complete the project within sixty
