AGENDA
The following is submitted as an addendum to the Owasso Public Works Authority Agenda filed
on Friday, November 12, 2004. Items numbered 1 -4 shall remain the same. Item number 5 is
now number 7 and a new item 5 and item 6 are listed as follows:
5. Consideration and appropriate action relating to a request for Trustee approval of a
supplemental appropriation to the Owasso Public Works Authority (OPWA) fund
increasing expenditures of the Water Distribution Department by $18,500.

Staff will recommend Council approve a supplemental appropriation to the OPWA Fund,
increasing expenditures of the Water Distribution Department by $18,500 for the purpose
of obtaining a feasibility study regarding a water transmission line from the Oklahoma
Ordinance Works Authority in Pryor, Oklahoma to the City of Owasso, such study
financed cooperatively with the cities of Jenks, Bixby, and Glenpool.

6. Consideration and appropriate action relating to a request for Council authorization of the
City Manager to execute an engineering agreement with Holloway, Updike and Bellen, Inc.
in the amount of $18,500.

Staff will recommend Council authorize the City Manager to execute an engineering
agreement in the amount of 518,500 for the purpose of obtaining a feasibility study
regarding a water transmission line from the Oklahoma Ordinance Works Authority in
Pryor, Oklahoma to the City of Owasso, in conjunction with the cities of Jenks, Bixby, and
Olenpool.

SUBJECT: RIGHT -OF -WAY AGREEMENT
OKLAHOMA NATURAL GAS

BACKGROUND
As a result of recent expansion efforts at the National Steak and Poultry facility, Oklahoma Natural
Gas sought the City's assistance in order to obtain right -of -way for the construction of a new service
line. Due to the location of their main supply line, ONG needed to access the National Steak and
Poultry site by obtaining right-of-way easement through property owned by the Owasso Public
Works Authority.
ONG met with representatives from the City (Mr. Warren and Mr. Yancey) to ensure that the
intended location of the new service line would not interfere with future expansion at either the
Skate Park or the Animal Control facility. The planned location of the line is indicated on the
attached site map and does not interfere with any potential future expansion of either facility.
Because of the importance of the service line to both ONG and National Steak and Poultry, staff
provided approval and signed off on the right -of -way agreement. This item is being placed on the
OPWA agenda in order to obtain Trustee ratification of the action taken by staff.
While the cost of the right -of -way easement was limited to $1, a donation for $800 has been received
from ONG for the planting of trees at the Skate Park. (See City Council Consent Agenda item #5 -F)
RECOMMENDATION
Staff recommends Trustee ratification of action taken by staff, thus approving a right -of -way
agreement between Oklahoma Natural Gas and the Owasso Public Works Authority.

RIGHT OF WAY AGREEMENT

THIS AGREEMENT, made and entered into by and between OWASSO PUBLIC WORKS AUTHORITY hereinafter
called the Grantor, and OKLAHOMA NATURAL GAS COMPANY, a Division of ONEOK, Inc., an Oklahoma corporation,
hereinafter called the Grantee.
WITNESSETH, that said Grantor, for and in consideration of $ 1.00 and other valuable considerations, the receipt of which is
hereby acknowledged, does hereby grant to said Grantee, its successors and assigns, a permanent easement and right of way to lay,
maintain, operate, relay and remove a pipe line, with fittings, tie - overs, cathodic protection equipment and other appurtenant
appliances, with the right of ingress and egress to and from the same, over and through certain lands situated in the County of
Tulsa, State of Oklahoma, and more particularly identified and described as follows, to -wit:

particularly descr w

COMMENCING at the NW /Corner of said NE /4° THENCE S00°17'00 "E alone the west boundary of said NE /4 a distance
of 1617.54 ft. to the POINT OF BEGINNING; THENCE N89 °51'35 "E a distance of 353.96 ft. to a point; THENCE
S71 °44'48 "E a distance of 215.50 ft. to a point THENCE N89 °51'35 "E a distance of 717.02 ft, to the POINT OF ENDING;
said point of ending being 1682.40 ft. Soukh and 1283.64 ft. East of the NW /Corner of said NE /4 LESS AND EXCEPT the
Atchison, Topeka & Santa Fe Railway right -of -way thereof.
THIS RIGHT OF WAY GRANT IS MADE SUBJECT TO THE FOLLOWING;
1. That said Grantor is to fully use and enjoy said premises subject to the easement rights hereby granted, but Grantor agrees
that it will not construct nor permit to be constructed any lakes, ponds, buildings or other structures of a permanent nature upon or
over said right of way or within ten feet of the pipe line of Grantee without the written consent of Grantee.
2. That said Grantee hereby covenants to bury its pipe 24- inches below surface of the ground so that the same will not
interfere with the cultivation of said premises.
3. That the Grantee shall have the right at any time to change the size of its pipe line and to cut, trim and keep clear all trees,
brush and other obstructions that may injure, endanger or interfere with the construction, operation, maintenance or removal of
said pipe line.
4. That the Grantee shall pay all damages to fences, crops, and premises, which may be suffered by reason of laying,
relaying, maintaining, operating, or removing said line of pipe. If not mutually agreed upon, the parties may agree to have
damages ascertained and determined by three disinterested persons, one thereof to be appointed by the owner of the premises, one
by the Grantee, and the third by the two so appointed as aforesaid, and the award of two of such three persons shall be final and
conclusive.
This right of way grant contains all the agreements and stipulations between the Grantor and Grantee with respect to the
granting of said easement, and the same shall inure to the benefit of and be binding upon the Grantor and Grantee and their
respective heirs, successors and assigns.
