All matters listed under "Consent" are considered by the City Council to be routine and will be enacted by one motion. Any Councilor may, however, remove an item from the Consent Agenda by request. A motion to adopt the Consent Agenda is non - debatable. A. Approval of Minutes of the August 15, 2006 Regular Meeting. Attachment # 7-A D. Approval of Claims. Attachment # 7m13 Cm Approval of Ordinance No. 875, an ordinance approving rezoning request OZ 06-05, containing approximately 78.47 acres from (AG) Agriculture to (RS®3) Residential Single -Family, located on the west side of N. 1291h East Avenue, approximately '/2 mile north of E. 66th Street North, just south of the Baptist Retirement Village. Attachment # 7-C Staff will recommend Council approval of Ordinance No. 875 and has listed this item in the consent section of the agenda based on Council actions taken August 15, 2006, approving the rezoning request. D. Approval of Ordinance No. 876, an ordinance approving rezoning request OZ 06-06, containing approximately 0.41 acres from RSm3 (Residential) to RD (Residential Duplex), located at 10628 E. 114th Street North. Attachment # 7®D Staff will recommend Council approval of Ordinance No. 876 and has listed this item in the consent section of the agenda based on Council actions taken August 15, 2006, approving the rezoning request. Consideration and appropriate action relating to a citizen request for an appeal to the Code Enforcement designation of a nuisance at 104 West 7th and subsequent abatement of such nuisance as defined in Section 8-406 of the Owasso Code of Ordinances. Mr. Wiles Attachment 48 Mr. B.R. Jones, property owner of a residential lot located at 104 West 7th has requested a hearing before the Owasso City Council in order to appeal a Code Enforcement finding of nuisance on said property (such consisting of three inoperable vehicles) and the abatement of such. Staff will recommend Council determine the existence of a nuisance, as defined in Section 8-406 of the Owasso Code of Ordinances, to wit: three (3) inoperable vehicles on the property of 104 W 7th and order owner abatement of such nuisance. 9. Consideration and appropriate action relating to a request for Council adoption of Resolution No. 2006-22, a resolution declaring Rayola Parr as a neighborhood park Mr. Wiles Attachment #9 Staff will recommend Council adoption of Resolution No. 2006-22. 10. Consideration and appropriate action relating to a request for Council approval to award a bid for the construction of a restroom facility at Funtastic Island. Mr. Warren Attachment # 10 Staff will recommend Council approval to award a construction bid to Builders Unlimited of Tulsa, Oklahoma in the amount of $71,757 for the construction of a restroom facility located at Funtastic Island. ITEM 1. CALL TO ORDER The meeting was called to order at 6:40 p.m. ITEM 2. FLAG SALUTE The Flag Salute was held during the Owasso Public Works Authority meeting preceding this meeting. ITEM 3. Approval of Minutes of the August 1, 2006 Regular Meeting, B. Approval of Claims. C. Acknowledgement of receiving the monthly FY 2006-2007 budget status report, D. Adoption of Resolution No. 2006-18, a resolution establishing the National Incident Management System as the standard for incident management in the City of Owasso and authorizing the City Manager to appoint a designated local point of contact. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF A FINAL PLAT FOR CAMELOT ESTATES, LOCATED ON THE WEST SIDE OF NORTH 145TH EAST AVENUE, 1/4 MILE SOUTH OF EAST 96TH STREET NORTH, JUST NORTH OF THE VILLAGE OF SILVER CREEK ADDITION Mr. McCulley presented the item. Mr. Kenneth Yates addressed the Council, not in opposition to this item, but to voice his concerns of stormwater run-off from this new addition to Silver Creek and the Village at Silver Creek. Mr. Nurre, Sr. Engineer for the City of Owasso, responded to Mr. Yates' concerns. Mr. Colgan moved, seconded by Ms. Kimball, for Council approval of the final plat for Camelot Estates. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF AN ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF OWASSO AND MESHEK AND ASSOCIATES IN AN AMOUNT NOT TO EXCEED $45,000.00 FOR SERVICES RELATING TO THE PREPARATION OF PRELIMINARY AND FINAL DESIGN PHASES AND THE PREPARATION OF CONSTRUCTION PLANS AND SPECIFICATIONS FOR THE REPLACEMENT OF THE THREE LAKES DAM AND APPURTENANT DRAINAGE IMPROVEMENTS BETWEEN EAST 89TH STREET NORTH AND EAST 90TH STREET NORTH AND BETWEEN NORTH 121 ST EAST AVENUE AND NORTH 123RD EAST AVENUE; AND, AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT Mr. Alexander presented the item. Councilor Kimball asked if this project had been put out for bid. Mr. Ray answered that it had not because the City had used Meshek for other drainage projects and were pleased with their work. Ms. Kimball replied that there were many other engineering firms that should be considered. Mr. Colgan moved, seconded by Ms. Kimball, for Council approval of an Engineering Services Agreement between the City of Owasso and Meshek and Associates, as stated above. CONSIDERATION AND APPROPRIATE i ACTION RELATING REQUEST FOR COUNCIL APPROVAL EXTENSION ENGINEERING SERVICES AGREEMENT BETWEEN REVIEWSOWASSO AND MESHEK AND ASSOCIATES IN AN AMOUNT NOT TO EXCEED $60,000.00 FOR SERVICES RELATING TO DRAINAGE ENGINEERING AND ANALYSIS; ( l AUTHORIZING MAYOR TO EXECUTE SAID AGREEMENT Mr. Alexander presented the item. Councilor Kimball again asked if bids had been solicited for this project. Mr. Alexander answered that this was a continuation of a contract. Mr. Cataudella moved, seconded by Mr. Colgan, for Council approval of the Extension of Engineering Agreement between the City of Owasso and Meshek and Associates, as stated above. Documents required as a result of that adoption includes an agreement by the developer's engineer titled "Agreement for Urban Engineering Services." This agreement requires the engineer to list all improvements associated with the proposed development, attest that all designs will be in compliance with City standards (outlined in the design criteria), pay all fees associated with the plan review, attest that he/she is a Registered Professional Engineer in the State of Oklahoma, and attest that he/she maintains Professional Liability Insurance in limits of not less than $ 1,000,000 for a period of three years. O MEMBERS OF THE CITY COUNCIL CITY OF OWASSO FROM: ERIC WILES COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: AN APPEAL, TO THE CITE' COUNCIL OF A CODE ENFORCEMENT FINDING DATE: August 24, 2006 Mr. B.R. Jones, property owner of a residential lot located at 104 West 7th Street North, has submitted a request to appeal a Code Enforcement finding of nuisance on his property to the Owasso City Council. The nuisance that is the subject of the appeal is a violation of Section 8- 406 B.5, page 8-27 of the City Code — Abandoned, Wreckecl Autos. Three inoperable vehicles are located upon the property; one inoperable vehicle is located on the driveway in front of the house, and two more inoperable vehicles are located in the rear yard. The staff sent Mr. Jones a notice on April 28, 2006 that all vehicles must be located upon hard surfaces and inoperable vehicles must be made operable, located within a building, or removed from the property. Once the staff determined that Mr. Jones did not intend to comply with the notice, the staff sent another letter on June 22, 2006 stating that the violations on the property must be abated by June 28, 2006 or a citation would be issued. Upon receiving the letter, Mr. Jones met with the Assistant City Manager, Police Chief, City Attorney, and Community Development Director to protest the code enforcement action. As a result of that meeting, an agreement was reached that would have allowed Mr. Jones to keep the vehicles at the property, given the following conditions: 1) a privacy fence must be built to screen the inoperable vehicles, and 2) a hard surface must be constructed for all of the vehicles. A deadline of August 15, 2006 was given for these remedies to be provided. As of August 16, 2006 the violations remained upon the property and there was no indication that the fence or hard surface would be constructed. At that time, Mr. Jones was given notices to remove the three inoperable vehicles within 48 hours or the inoperable vehicles would be towed (additionally, Mr. Jones was issued a citation relating to two additional vehicles stored in the front yard of his residence in violation of the City Code, such citation requiring Mr. Jones to appear before the Owasso Municipal Court for adjudication). The "48 hours" notices come with a provision that the recipient can appeal the notices to the City Council if the recipient provides the Code Enforcement officer with a written request within two days of receiving the notices. Mr. Jones did request a hearing before the City Council, and this hearing was scheduled for the Council meeting of September 5, 2006. At the September 5, 2006 meeting, the City Council will conduct a hearing in order to determine whether the three inoperable vehicles (one corvette on the driveway in front of the house, one corvette on grass in the rear yard, and one camaro on grass in the rear yard) constitute the existence of a nuisance on the property at 104 West 7t", and whether this nuisance must be abated. The staff recommends that the City Council find three inoperable vehicles at 104 West 7"' constitute a nuisance and order owner abatement of such nuisance. "Dismantled, junked, abandoned or inoperable vehicles" shall be deemed and means to include the major parts thereof including bodies, an engine, transmissions, frames, rear ends and old tires, wheels and upholstering; 2. "Person" means any person, firm, partnership, association, corporation, company or organization of any kind; 3. "Private Property" means any real property in the city which is not public property; 4. "Public Property" means any property owned or controlled in the city limits by the city, Tulsa County, the state or United States Government, and shall include all streets and highways; and 5. "Vehicle" means any machine propelled by owner other than by muscle and shall include without limitation any automobile, truck, trailer, motorcycle, tractor, buggy, wagon, or self-propelled farm or construction equipment. (Prior Code Sec. 13-49) Mate Law Reference: Removal of abandoned vehicles on private property, state procedure, 47 O.S. Section 954A. SECTION 8-402 ABANDONED, JUNKED VEHICLES PROHIBITED No person shall deposit, store, keep or permit to be deposited, stored or kept in the open upon public or private property a dismantled, unserviceable, inoperable, junked or abandoned vehicle or parts thereof or any vehicle legally or physically incapable of being operated, for a period exceeding forty-eight (48) hours unless such vehicle, or parts thereof, is completely enclosed within a building, or stored in connection with a business lawfully established pursuant to the zoning ordinances of the city, or stored on property lawfully designated under the zoning ordinances of the city as a. place where such vehicles may be stored. Page 8-25 Health and Sanitation SECTION 8-403 NUISANCE The accumulation or storage of one or more vehicles or parts thereof as described in Sections 8-401 and 8-402 of this code shall constitute a nuisance detrimental to the health, safety and welfare of the inhabitants of the city. It is the duty of the owner of such vehicles or parts thereof, or the owner of the private property, lessee or other person in possession or control of the property upon which such vehicle is located to remove the vehicle from such property or have the vehicle housed in a building where it will not be visible from the street or other private property. (Prior Code, Sec. 13-52) SECTION 8-404 IMMEDIATE REMOVAL OF VEHICLE OBSTRUCTING TRAFFIC A. If a police officer of the city or the code enforcement officer of the city, has reasonable cause to believe that a vehicle has been abandoned in a location which would be hazardous to the free flow of traffic, such officer shall have the authority to remove or direct the removal of the vehicle immediately. At the time of ordering the removal of the abandoned vehicle, the authorizing officer shall also determine the sale value of the vehicle and certify that amount on the removal order. B. If the value of the abandoned vehicle is certified as One Hundred Dollars ($100.00) or less, then within ten (10) days of the date of the certification of sale value, written notice shall be sent by the certifying officer or an authorized member of his agency, to the last known registered owner of the vehicle, stating the location where the abandoned vehicle was found, the certified sale value, the physical description of the vehicle, the license registration number, and the location where the vehicle is being stored. If the abandoned vehicle has not been recovered by the owner by payment of all costs of impounding, towing, storage and other related charges, then thirty (30) days from the date of the certification of value, the certifying officer, or an authorized member of his agency, shall then authorize disposal, by selling for salvage or in some other manner, of the abandoned vehicle without further notice. All proceeds realized from the disposal of the abandoned vehicle shall, after payment of any costs involved, be deposited with the appropriate depository of the city. C. If the abandoned vehicle is valued at sale for more than One Hundred Dollars ($100.00), the procedures prescribed by Sections 903 through 911 of Title 47 Oklahoma Statutes shall be applicable. (Ord. No. 375, 11/3/87) SECTION 8-405 REMOVAL OF DISMANTLED, JUNKED ABANDONED OR INOPERABLE VEHICLES FROM PUBLIC PROPERTY A. Any police officer of the city or code enforcement officer of the city, shall have the authority to remove or direct the removal of a dismantled, junked, abandoned or inoperable vehicle when same is found upon any portion of the highway, shoulder, right-of-way, or other public property, if after a period of forty-eight (48) hours from the time of posting of notification on the vehicle directing removal of same, there is no evidence of an apparent owner who intends to remove same. B. The notice provided for above shall be in writing and contain the request for removal within the time specified in this chapter, to -wit, forty-eight (48) hours. The notice shall advise that upon a failure to comply with the notice to remove, the city, or its designee, will undertake such removal with the cost of the removal to be levied against the owner of the property. Such notice shall further provide that the owner or such owner's authorized representative, may, within the time specified in the notice, contact the city manager of the city, for the purposes of challenging whether or not such vehicle constitutes a nuisance, as defined herein and whether same should be removed. If the vehicle has not been removed within the forty-eight (48) hour period provided for in the notice, or a hearing, as above provided for with the city manager, is not requested within such timc, the vehicle shall at the expiration of the forty-eight (48) hour period be removed, impounded and stored for violation of this chapter. Subsequent to such removal, the code enforcement officer shall give notice to the owner of the location where the vehicle is Page 8-26 Ilealth and Sanitation stored and the cost incurred by the city for the removal; whereupon, the vehicle shall be re -delivered to the owner, or sold, under the conditions as provided for in Section 8-407. (Ord. No. 375, 11/3/87) SECTION 8-406 REMOVAL OF DISMANTLED, JUNKED —ABANDONED OR INOPERABLE VEHICLES_ LOCATED ON PRIVATE PROPERTY A. Any police officer of the city or code enforcement officer of the city, shall, under the circumstances hereinafter set forth, have the authority to remove or direct the removal of a dismantled, junked, abandoned or inoperable vehicle when same is found upon private property within the corporate limits of the city. B. The police officer or code enforcement officer, as may be designated by the city manager, shall notify the owner, as evidenced by the records of the State Department of Public Safety, of such abandoned, junked, unserviceable, inoperable or dismantled vehicle, either- by certified mail, return receipt requested, or by personal service, or by attaching a copy of the notice in a conspicuous place on the property to be removed, and if there be a building located on the property, by attaching a copy of the notice to the main entranceway of the building in a conspicuous place thereon. Notice may also be given by service of same on a person in possession or control of the property as owner, lessee, custodian or licensee over the age of fifteen (15) years or upon the member of any household fifteen (15) years of age or older. The notice shall contain the following information: 1. The nuisance must be abated within forty-eight (48) hours after receipt of notice by certified mail or within forty-eight (48) hours of posting of notice or upon personal service as hereinbefore provided; 2. The owner or person having control of the property upon which the nuisance is located may, within the forty-eight (48) hour period provided for in the notice for removal, request, in writing, directed to the code enforcement officer of the city, a hearing before the city council of the city; 3. The failure to request a hearing within the time period shall cause an abatement order to be issued and the same shall be removed by the proper city authorities and all charges incidental and necessary to the removal thereof shall be charged to the owner or the person having control of the property; 4. If a hearing as above provided is requested within the time provided a hearing shall be set before the city council not less than five (5) days nor more than fifteen (15) days from the request. At such hearing the owner may appear and protest and show cause why such abatement order should not be issued; and 5. If the city council determines a nuisance exists and if the city council orders an abaterent after the hearing provided herein, the same shall be removed by the city at the cost of the owner or the person having control of the property upon which the nuisance is located; provided, the city shall allow the owner or person having control thereof seventy-two (72) hours after such order within which to abate the nuisance. C. Upon failure of the owner of the vehicle or the owner, lessee or person having control of the property on which the vehicle is located to request a hearing within the time provided as provided in the preceding subsection, or to remove the vehicle or to place it in an enclosed building, the city shall have the right to abate the nuisance forthwith without further notice or time being given. D. If such owner, lessee or person in control of the property requests a hearing within the time provided and appears to protest at the hearing provided and is ordered to abate such nuisance at the Page 8-27 Health and Sanitation hearing, then such owner, lessee or person having control of the property shall abate same within seventy- two (72) hours of the ruling. E. The city manager, if same is not abated within seventy-two (72) hours of the order of abatement, shall direct the code enforcement officer, to cause the removal and abatement of such nuisance and reasonable costs and charges for the removal of the nuisance shall be charged to the owner, lessee or person in control of the property upon which the vehicle is located in the manner as provided for in Section 8-407. SECTION 8-407 OWNER MAY REGAIN The owner of any vehicle so removed may regain possession thereof by making application to the code enforcement officer, within thirty (30) days after removal and upon payment to the city all reasonable costs of removal and storage which shall have accrued to such vehicle. If the vehicle is not so reclaimed within thirty (30) days, it may be sold without further notice in a reasonably commercial manner. After payment of towing and storage costs, all funds remaining shall become the property of the City. The Oklahoma Department of Commerce (ODOC) administers these funds as pail of its "Small Cities set -aside program". So far, the City has used this money to improve sidewalks in the downtown area, to construct a restroom at the skate park, and to help fund the street improvements at Three Lakes Village. Should the funding be awarded, there would be a match requirement. The City has included in this year's budget an amount of money equal to the grant funds ($66,450), likely bringing the total allowable project cost to around $132,900. One requirement for CDBG funding is that the improvement project benefits an area that is made up of at least 50% low to moderate income households. Parks Department staff surveyed the area to be served by the Rayola Park splash pad in June, and submitted the results to ODOC indicating that more than half of the households within the service area are low to moderate income. The service area is bounded by 86'11 Street on the north, the Owasso Expressway on the cast, 3d Street on the south, and Main Street on the west. In order for ODOC to be able to show that approval of the City's CDBG application would benefit an area made up of at least 50% low to moderate income households, ODOC has requested documentation stating that Payola Park is a neighborhood park. Neighborhood parks are parks that, while open to the general public, are designed to be used primarily by people within walking distance of the park. The staff has been unable to locate any documentation classifying Payola Park as a neighborhood park. Therefore, ODOC has agreed to accept a resolution that declares Rayola Park a neighborhood park as a satisfactory form of documentation. The proposed Resolution 2006-22 cites the grant application for the splash pad, cites the requirement of ODOC for CDBG approval, and cites that Rayola Park primarily serves the immediate area. Included in that project list was funding to provide improvements to Funtastic Island Park. A total of $85,000.00 was budgeted in the Park Development Fund for this purpose. In July, the Parks Department began the process of advertising for bids in order to provide the Funtastic Park restroom. The bid packet was developed with a base bid specification. The base bid included the installation of a handicapped accessible restroom at the Funtastic Island Park, a restroom which would match the existing restrooms located at Elm Creek Park and the Skate Park, as well as the restroom under construction at Centennial Park. A copy of the floor plan and elevation profile is attached for your information and review. All bids received were opened on August 15, 2006 at 10:00 AM, A total of two bids were received and are listed below: Builders Unlimited, Inc of Tulsa - $71,757 Kenneth Petty Co., Inc of Tulsa - $74,889 A review of the bids indicate that both were in compliance with the bid specifications. Due to this restroom being identical to the existing restrooms located at the Elm Creek Park and the Skate Park, no pre -bid meeting was conducted. Builder's Unlimited, Inc provided the lowest bid on the restroom project. Builder's Unlimited was also the low bidder and is in the process of constructing the restroom at Centennial Park which is identical to this restroom. FUNDING. Funds for the restroom improvements were included within the Park Development Fund Projects budget in the amount of $85,000.00. COMMENDATION - Staff recommends Council award construction of the restroom at Funtastic Island to Builders Unlimited of Tulsa, OK in the amount of $71,757. DIRECTOR OF PUBLIC WORKS SUBJECT: AGREEMENT FOR ELECTRICAL DISTRIBUTION FACILITIES RELOCATION WITH PUBLIC SERVICE COMPANY OF OKLAHOMA - MAIN STREET BEAUTIFICATION PROJECT DATE® August 28, 2006 BACKGROUND: As part of the Vision 2025 Downtown/Neighborhood Rehabilitation Program, Tulsa County voters approved a $1.1 million expenditure to promote community beautification and economic vitality in the Owasso Downtown area. The proposal — which is in accordance with the Owasso Downtown Development Plan (2001) — calls for the burial of overhead utilities, construction of streetscaping, and installation of ornamental lighting and signs along Main Street between E. 76 Street forth and ) Street Forth (see Attachment A). The Public Service Company of Oklahoma (PSO) considered several options for the relocation of overhead utilities located along Main Street, The first option included the burial of utilities along the same route currently occupied, However, due to the cost of the underground switch gear and transformers, this option was found to be in excess of the amount budgeted for this project. A second option included the relocation of all overhead facilities to Birch and Atlanta Streets. Once the cost of running all of the service lines to individual businesses and homes was taken into account, this option also proved to be in excess of the amount budgeted for this project. The final option considers a combination of the first and second options. PSO plans to achieve the relocation of its existing Main Street overhead utilities between E. 76 Street North and) Street North by upgrading overhead facilities along Birch and Atlanta Street and installing 2,000 linear feet of new underground facilities at several locations along Main, Birch, and Atlanta Streets. Construction estimate for the proposed work, to include upgrade of existing power utilities to accommodate future growth, is nearly $630,000. PSO has agreed to contribute over $400,000 to this project, reducing the City's cost to an estimated $227,994.00 (but not to exceed $250, 793.40) for material, labor, and contract administration. AGREEMENT FOR ELECTRIC DISTRIBUTION FACILITIES LOCATION: The Agreement (see Attachment B), which contains similar language to previously executed agreements with PSO, stipulates the scope of services and reimbursement guidelines for the work performed by PSO. The City Attorney has reviewed this agreement and found it acceptable.
