AN ORDINANCE AUTHORIZING THE CALLING AND HOLDING OF A
SPECIAL ELECTION IN THE CITY OF OWASSO, STATE OF OKLAHOMA,
FOR THE PURPOSE OF SUBMITTING TO THE REGISTERED QUALIFIED
ELECTORS OF SAID CITY THE QUESTION OF ISSUING ITS BONDS OF
SAID CITY IN THE SUM OF NOT TO EXCEED NINE MILLION DOLLARS
($9,000,000) TO BE ISSUED IN SERIES TO PROVIDE FUNDS FOR THE
PURPOSE OF ECONOMIC AND COMMUNITY DEVELOPMENT IN THE
CITY OF OWASSO, OKLAHOMA, TO INCLUDE (I) IMPROVEMENTS TO
EXISTING CITY PARKS, (II) THE CONSTRUCTION AND EQUIPPING OF AN
AQUATIC CENTER TO BE LOCATED AT A SITE TO BE DETERMINED,
AND (III) THE ACQUISITION OF LAND AND THE CONSTRUCTION OF A
FESTIVAL PARK AT A SITE TO BE DETERMINED; AND LEVYING AND
COLLECTING A SPECIAL ANNUAL TAX, IN ADDITION TO ALL OTHER
TAXES, UPON ALL THE TAXABLE PROPERTY IN SAID CITY SUFFICIENT
TO PAY THE INTEREST ON SAID BONDS AS IT FALLS DUE, AND ALSO
TO CONSTITUTE A SINKING FUND FOR THE PAYMENT OF THE
PRINCIPAL THEREOF WHEN DUE; PROVIDED HOWEVER, THAT IN NO
EVENT SHALL THE REAL AND PERSONAL TAXABLE PROPERTY IN
SAID CITY BE SUBJECT TO A SPECIAL TAX IN EXCESS OF FIVE MILLS
ON THE DOLLAR FOR ALL BONDS ISSUED PURSUANT TO SECTION 35,
ARTICLE X OF THE OKLAHOMA CONSTITUTION; AUTHORIZING
PROFESSIONAL SERVICES AGREEMENTS PERTAINING TO THE
ISSUANCE OF BONDS OF THE CITY; AND CONTAINING OTHER
PROVISIONS RELATING THERETO.
WHEREAS, it is deemed advisable and necessary by the City Council of the City of
Owasso, Oklahoma (the "City"), to pursue economic and community development in the City
which will include (i) improvements to the following existing City parks: Elm Creek Park,
Centennial Park, Rayola Park, Ator Park, Funtastic Park, and McCarty Park, (ii) the construction
and equipping of an aquatic center to be located at a site to be determined, and (iii) the acquisition
of land and the construction and equipping of a festival park at a site to be determined; and
WHEREAS, the estimated amount necessary for such purposes is Nine Million Dollars
($9,000,000); and
WHEREAS, there are no funds in the treasury for such purpose, and power is granted said
City by Section 35, Article X of the Oklahoma Constitution and laws of the State of Oklahoma, to
issue bonds to provide funds for such purpose, provided the same be authorized by the registered
qualified electors thereof, voting at an election held for that purpose.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
OWASSO, OKLAHOMA:

Section 1. That the Mayor of the City be, or in his absence or incapacity, the duly
qualified Vice-Mayor, be and is hereby authorized and directed to call a special election to be held
in said City on the 11th day of October, 2011, for the purpose of submitting to the registered,
qualified electors of the City, the following proposition:
PROPOSITION NO. 3
"SHALL THE CITY OF OWASSO, STATE OF OKLAHOMA (THE "CITY"),
INCUR AN INDEBTEDNESS BY ISSUING ITS BONDS IN THE SUM OF
NOT TO EXCEED NINE MILLION DOLLARS ($9,000,000) FOR THE
PURPOSE OF ECONOMIC AND COMMUNITY DEVELOPMENT IN THE
CITY OF OWASSO, OKLAHOMA, TO INCLUDE (I) IMPROVEMENTS TO
THE FOLLOWING EXISTING CITY PARKS: ELM CREEK PARK,
CENTENNIAL PARK, RAYOLA PARK, ATOR PARK, FUNTASTIC PARK,
AND MCCARTY PARK, (II) THE CONSTRUCTION AND EQUIPPING OF
AN AQUATIC CENTER TO BE LOCATED AT A SITE TO BE
DETERMINED, AND (III) THE ACQUISITION OF LAND AND THE

OF OTHER FUNDS; AND LEVY AND COLLECT A SPECIAL ANNUAL

PROPERTY IN SAID CITY SUFFICIENT TO PAY THE INTEREST ON SAID
BONDS AS IT FALLS DUE, AND ALSO TO CONSTITUTE A SINKING
FUND FOR THE PAYMENT OF THE PRINCIPAL THEREOF WHEN DUE,
SAID BONDS TO BEAR INTEREST AT NOT TO EXCEED THE RATE OF
TEN PERCENTUM (10%) PER ANNUM, PAYABLE SEMI-ANNUALLY
AND TO BECOME DUE SERIALLY WITHIN TWENTY (20) YEARS FROM
THEIR DATE; PROVIDED HOWEVER, THAT IN NO EVENT SHALL THE
REAL AND PERSONAL TAXABLE PROPERTY IN SAID CITY BE
SUBJECT TO A SPECIAL TAX IN EXCESS OF FIVE MILLS ON THE
DOLLAR FOR ALL BONDS ISSUED PURSUANT TO SECTION 35,
ARTICLE X OF THE OKLAHOMA CONSTITUTION?"

DESCRIPTION OF PROJECT AND USE OF PROCEEDS
The projects for which the proceeds of the aforesaid $9,000,000 bonds shall be expended
shall be limited to qualified economic and community development purposes as defined in Title
62, Section 802 of the Oklahoma Statutes, which may be accomplished through participation
with other governmental agencies and others, and which may be accomplished in phases. The
projects will include (i) improvements to the following existing City parks: Elm Creek Park,
Centennial Park, Rayola Park, Ator Park, Funtastic Park, and McCarty Park, (ii) the construction
and equipping of an aquatic center to be located at a site to be determined, and (iii) the
acquisition of land and the construction and equipping of a festival park at a site to be
determined.
Section 2. That such call for said election shall be by proclamation and notice, signed by
the Mayor or Vice-Mayor of the City and attested by the City Clerk, setting forth the proposition to
be voted upon, the number and location of the polling places, the hours of opening and closing of
the polls, and the names of the officers who shall conduct said election. That the ballots shall set
forth the proposition to be voted upon substantially as set out in Section 1 hereof, and that the
returns of said election shall be made to and canvassed by the Tulsa County Election Board.
Section 3. In connection with the issuance of bonds by the City, the Mayor or Vice
Mayor, on behalf of the City, is authorized to enter into professional services agreements with
The Public Finance Law Group PLLC for bond counsel services and with Municipal Finance
Services, Inc. for financial advisory services, and the City Clerk is hereby authorized to attest and
affix the seal of the City to said professional services agreements.
Section 4. That a copy of this Ordinance and Special Election Proclamation and Notice
shall be personally delivered to the office of the County Election Board of Tulsa County, State of
Oklahoma, at least sixty (60) days prior to the date of said election.

Under and by virtue of Section 35 of Article X, of the Oklahoma Constitution and the
Statutes of the State of Oklahoma, and Acts complementary, supplementary, and enacted pursuant
thereto, and Ordinance No. 994 dated August 9, 2011, authorizing the calling of an election on the
proposition hereinafter set forth, I, the undersigned Mayor of the City of Owasso, Oklahoma,
hereby call a special election and give notice thereof to be held in the City of Owasso, Oklahoma,
on the 11`x' day of October, 2011, for the purpose of submitting to the registered, qualified voters in
said City the following proposition:
PROPOSITION NO. 3
"SHALL THE CITY OF OWASSO, STATE OF OKLAHOMA (THE "CITY"),

The number and location of the polling places and the names of the persons who shall
conduct said election shall be designated by the County Election Board of Tulsa County,
Oklahoma. Such officers shall also act as counters and certify the results in the case of regular
elections and certify the results thereof as required by law.

DESCRIPTION OF PROJECT AND USE OF PROCEEDS
The projects for which the proceeds of the aforesaid $9,000,000 bonds shall be expended
shall be limited to qualified economic and community development purposes as defined in Title
62, Section 802 of the Oklahoma Statutes, which may be accomplished through participation
with other governmental agencies and others, and which may be accomplished in phases. The
projects will include (i) improvements to the following existing City parks: Elm Creek Park,
Centennial Park, Rayola Park, Ator Park, Funtastic Park, and McCarty Park, (ii) the construction
and equipping of an aquatic center to be located at a site to be determined, and (iii) the
acquisition of land and the construction and equipping of a festival park at a site to be
determined.
That only the registered, qualified voters of the City of Owasso, Oklahoma, may vote upon
the proposition as above set forth.
The polls shall be opened at 7:00 o'clock a.m. and shall remain open continuously until and
be closed at 7:00 o'clock p.m.
The number and location of the polling places and the names of the persons who shall
conduct said election shall be designated by the County Election Board of Tulsa County,
Oklahoma. Such officers shall also act as counters and certify the results in the case of regular
elections and certify the results thereof as required by law.

CHAMBERS AT OLD CENTRAL, 109 NORTH BIRCH, IN SAID CITY ON THE 9TH DAY OF

Notice of this special meeting was given in writing to the City Clerk at 9:00 o'clock a.m.
on the 4th day of August, 2011, forty-eight (48) hours or more prior to this meeting and public
notice of this meeting, setting forth the date, time, place and agenda was posted on the public
bulletin board at the north entrance of City Hall, in prominent view and open to the public
twenty-four (24) hours each day, seven (7) days each week at 9:00 o'clock a.m. on the 4th day of
August, 2011, being twenty-four (24) hours or more prior to this meeting, excluding Saturdays,
Sundays and State designated legal holidays, all in compliance with the Oklahoma Open Meeting
Act.

Under and by virtue of Section 35 of Article X, of the Oklahoma Constitution and the
Statutes of the State of Oklahoma, and Acts complementary, supplementary, and enacted pursuant
thereto, and Ordinance No. 994 dated August 9, 2011, authorizing the calling of an election on the
proposition hereinafter set forth, I, the undersigned Mayor of the City of Owasso, Oklahoma,
hereby call a special election and give notice thereof to be held in the City of Owasso, Oklahoma,
on the 11`x' day of October, 2011, for the purpose of submitting to the registered, qualified voters in
said City the following proposition:
PROPOSITION NO. 3
"SHALL THE CITY OF OWASSO, STATE OF OKLAHOMA (THE "CITY"),
INCUR AN INDEBTEDNESS BY ISSUING ITS BONDS IN THE SUM OF
NOT TO EXCEED NINE MILLION DOLLARS ($9,000,000) FOR THE
