water system, sanitary sewer system, storm drainage systems and street installation for the

10. Consideration and appropriate action relating to a request for City Council to declare a
1972 fire truck surplus to the needs of the City of Owasso, establish a value for the
Vehicle, and authorize the disposal of such.

Staff will recommend Council declare the 1972 fire truck surplus to the needs of the City,
establish the value of the vehicle at $100.00 (salvage value) and authorize the sale of the
fire truck to the Turley Fire Department for the sum of ten dollars ($10.00).

11. Consideration and appropriate action relating to a request for the approval and adoption of
an Emergency Operations Plan for the City of Owasso.

Staff will recommend approval of the plan and its adoption as the City's Emergency
Response Policy.
Staff will recommend Council approval of a zoning change for the property located on
the northwest corner of the intersection of East 86th Street North and North Cedar Street.
Such zoning to include CS (Commercial Shopping) in the amount of 3.51 acres in the
southern portion of the property, more or less, OL (Light Office) in the amount of 0.72
acres in the central portion of the property, more or less, and RS (Residential) in the
amount of 0.88 acres in the northern portion of the property, more or less.

MINUTES OF SPECIAL MEETING
Tuesday, November 11, 2003
The Owasso City Council met in a special meeting on Tuesday, November 11, 2003 in the
Lower Level Conference Room at the Emergency Operations Center, 207 South Cedar Street,
per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m.
on Friday, November 7, 2003.
ITEM 1:' CALL TOO ER.
Mayor Cochran called the meeting to order at 6:00 p.m.
A quorum was declared present.
FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING
PERSONNEL MATTERS RELATING TO THE OFFICE OF THE CITY
MANAGER, SUCH EXECUTIVE SESSION PROVIDED FOR
SECTION 30L(B)LIJ.
Councilor Cataudella moved, seconded by Councilor Helm to enter into Executive Session in
order to discuss the evaluation of the City Manager. All voted in favor of retiring into Executive
Session and the Council entered into Executive Session at 6:05 PM.
Discussion held amongst City Council members regarding personnel matters relating to the
office of the City Manager. At 7:00 PM, the Executive Session concluded. Mayor Cochran called
the meeting back into open session. No action was taken in Executive Session.
ITEM 3: DISCUSSION RELATING TO PLANNING ITEMS
Mr. Cuthbertson presented the planning items, a rezoning for Bethel Baptist Church, a rezoning
for Budgget Industries, a final plat for First Christian Church, an annexation request for Kellog
Engineering, and an annexation request for the Sue McPartland Trust.
Staff explained that the Bethel Baptist Church rezoning was denied by the Planning Commission
and would not be forwarded to the Council unless the applicant appeals the rezoning request.

Staff also explained that the Budgget Industries rezoning request will be forwarded to the
Council without a recommendation from the Planning Commission as they had no
recommendation from a tie vote. The other items were approved by the Planning Commission
and will be recommended for Council approval at the November 18, 2003 regular meeting.
ITEM 4: DISCUSSION RELATING TO STATION �TN FIRE THE FIRE BAY RENOVATION AT THE

Mr. Fisher presented a project update on the renovation work needed and planned at the
downtown fire station.
ITEM 5: DISCUSSION RELATING TO THE AWARD OF POLYCART BIDS
Mr. Carr provided the Council with a status report on the polycart system and that staff was
working with a vendor to test out a somewhat modified polycarC to ensure that it would meet
specifications.
ITEM 6: PRESENTATION ON THE COMMUNITY EMERGENCY RESPONSE TEAM
TRAINING PRQQRAMICERT)
Mr. Motto and Ms. Sullivan gave a presentation on the CELT program and the potential funding
available through grants to facilitate such a program.
Mr. Motto presented the planned storm siren improvement system. Staff informed the Council
that a bid document would be developed and bids would begin to be sought for the siren
replacement program so that the sirens would be in place by the Spring.
Mr. Motto presented the Emergency Operations Plan. Staff explained the necessity for this item
and that it would be placed on the December 2, 2003 City Council agenda as an action item.

Tuesday, November 18, 2003
The Owasso City Council met in regular session on Tuesday, November 18, 2003 in the Council
Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda
posted on the City Hall bulletin board at 5:00 p.m. on Friday, November 14, 2003.
ITEM I , CALL TO ORDER
Mayor Cochran called the meeting to order at 6:51 p.m.
ITEM 2. FLAG SALUTE
The flag salute was held during the OPWA meeting preceding this meeting.

REQUEST FOR APPROVAL OF THE CONSENT AGENDA.
A. Approval of Minutes of the November 4, 2003 Regular Meeting.
B. Approval of Claims.
Mr. Cataudella moved, seconded by Mr. Helm, to approve the Consent Agenda with claims
totaling $517,916.67, including addendum, and payroll claims totaling $247,074.13.

Mr. Cross presented the item. Ms. Kimball moved, seconded by Mr. helm, to accept the
L.,akeridge Phase 111 sanitary sewer system.
ITEM 6. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR THE REZONING OF PROPERTY FROM CIS (COMMERCIAL,
HIGH INTENSITY) TO IL, (INDUSTRIAL L,IGHT). THE SUBJECT
PROPERTY IS LOCATED AT 8 SOUTH ATLANTA, BUDGET INDUSTRIES.
This item was withdrawn and re-scheduled for the 12/2/03 City Council Meeting.
CONSIDERATION ITEM 7.
APPROVAL OF THE FIRST CHRISTIAN CHURCH OF OWASSO
PLAT. THE SUBJECT PROPERTY IS LOCATED IN THE NORTHWEST
CORNER OF NORTH GARNETT ROAD AND
Ms. Cuthbertson presented the item. Mr. Helm asked if there was a payback to Washington
County Rural dilater District. Mr. Cuthbertson answered that First Christian Church of Owasso
would be responsible to pay a $50.00 water tap fee to Washington County Rural dilater District.
Mr. Cataudella moved, seconded by Mr. Thoendel, to approve the First Christian Church of
Owasso final plat.

ITEM 8. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A

OR LESS. THE SUBJECT PROPERTY IS LOCATED IN THE NORTHWEST
CORNER O NORTH , ♦ - AVENUE ♦ D EAST 98TH PLACE NORTH.
Mr. Cuthbertson presented the item. Ms. Kimball moved, seconded by Mr. Cataudella, to accept
the annexation request of approximately 1.71 acres located in the northwest corner of Forth 105`}'
East Avenue and East 98th Place North.

ITEM 9. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR ANNEXATION OF APPROXIMATELY 185 ACRES, MORE
OR LESS. THE SUBJECT PROPERTY IS LOCATED ONE HALF MILE EAST
AND SOUTH OF THE NORTH 129T' EAST AVENUE AND EAST 76 TH
STREET NORTH INTERSECTION.
Former Mayor John (Troth added a historical fact that this land, located in the vicinity of Elm
Creek, was the original town site of Owasso before the railroad went through.
Mr. Thoendel moved, seconded by Mr. Cataudella, to accept the annexation request.
YEA: Kimball, Thoendel, Cataudella, Cochran
NAY: Helm
Motion carried 4-1.
Mr. Ray invited all to attend the reception for retiring City Attorney Stephen Gray after
adjournment.
Mr. Ray also expressed his pride in the Skate Park project. He was pleased to see a group of
youth and their parents gathered at the park during the weekend. He expressed his appreciation
to David Warren for not only have the vision but the tenacity to see his vision through and
thanked the City Council for their decision to go ahead with the project.
Mr. Ray also said the Timmy and Cindy project was going smoothly.

ITEM 12. REPORT FROM CITY COUNCILORS
Mr. Helm stated that as we move forward with a 9.3 million dollar water project, the City should
adopt a policy of not providing wastewater service unless the proposed development requests
City water service.
Mr. Cochran stated that the staff is currently working on such a policy to present to the Council.

ITEM 14. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A
REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF

Mr. Cataudella moved, seconded by Mr. Helm, to enter into executive session for the purpose
stated.

The Mayor recessed the meeting to allow the Council to move into an adjoining room for
executive session. The Council entered into executive session at 7:25 pm and retired from
executive session at 7:53 pm, at which time the Mayor reconvened the meeting.
ITEM 15. CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE
APPOINTMENT OF ♦ CITY ATTORNEY.
Mr. Cataudella moved to hire Ron Cates as City Attorney effective December 1, 2003. Motion
was seconded by Ms. Kimball.

Oklahoma Statutes, the City of Owasso is permitted to annex additional territory,

As directed by the City Council, the Staff notified the First Baptist Church of the needed
improvements in their detention facility and met with their staff to answer any questions
they had. The Church indicates that it accomplished the required work in the detention
facility in late October 2003. The Staff has not finalized a review of the improvements as
of this date. However, it is apparent that some regrading of the facility has occurred.
In respect to the drainage project located on Mr. McMartin's property the work has been
awaiting a final schedule by the Public Works staff. Unfortunately, there have been a
series of projects (planned and unplanned) that were of a higher priority. It is anticipated
that the work can be accomplished in January 2004.
During the last heavy rainfall, I personally observed the impact of the stormwater flow in
the area between the Windsor Lakes subdivision and the Nottingham subdivision. While
there was a strong current of water, it did not appear to be greater than past occurrences.

The First Baptist Church drainage facility did not overlap and did appear to retain their
stormwater runoff. While there was damage to a fence in the McMartin neighborhood,
the fence crossed a drainage easement and is subject to damage in rainfall events. No
stormwater entered any, homes in the area and there are no indications that homes were
threatened with inundation. Water will flow in a strong current between the two
subdivisions because it was planned to flow in that manner. Any fences in the natural
flow of water will always be subject to damage as will any fences constructed across
drainage easements.

past one and one-half years. Although city staff has engineered several possible solutions, no
final decisions have been made to his satisfaction.

It is unlawful for any person to fall up, deflect, or obstruct any gutter, waterway, water
outlet, drain, stream, Glitch, sewer or other water passage, either natural or artificial, by
throwing or causing to be thrown any trash, rubbish, garbage, bush or other thing.
No remedial actions were taken by either property owners in 2001. In June 2003, City staff
contracted the services of a surveyor to determine current topographic conditions of the channel
bank. Results from the survey indicate that the ground elevation has been raised — by as many as
four feet in areas of Lots 7 (see Attachment E).

In addition, the consultant reported the presence of a "by-pass" swale (located cast of the
detention basin) which directs runoff away from the detention basin; thereby bypassing
detention. Per the report, the presence of this bypass causes an increase in runoff during smaller
(loss or equal to 5-yr storm) events.
Construction of the pipe extension discussed above at a cost of about $13,300 (July 2002 price)
can be accomplished. This project will not collect groundwater without installation of a
subsurface collection system and will not redirect natural channel flows off of the McMartin
property and into the Nottingham drainage casement. Regrading of Mr. Martin's backyard
would be necessary to redirect flows away from the existing natural channel bank.
The USGS quadrangle topographic map indicates an historic spring either at or in close
proximity to the McMartin lot (see Attachment J). If this spring is still active, it may be a SOUrCC
of constant seepage.

2. Construct a closed (ape or box culvert) system within the 10-foot drainage easement
with intermittent inlets spaced to receive overland runoff from the east side of
Windsor Lake II and the west side of Nottingham and regrade of individual
properties. The preliminary estimated cost of this option would be about $200,000
(see Attachment L).
3. Construct a smaller closed (pipe or box culvert) ystem within the 10-foot drainage
easement with an overlaying swale ditch to carry Windsor Lake II and Nottingham
overland flows to the inlet box and regrade of individual properties. The preliminary
estimated cost for this option would be about $ 190,000 (see Attachment M).
Additionally, property owners have constructed decorative walls, gardens and other
improvements along the drainage channel which would be impacted by the work. The estimated
amounts do not include costs for acquiring temporary construction and access easements,
removing and /or replacing fences, and replacing trees and landscaping improvements. Finally,
no communications have been initiated with upstream property owners regarding the acceptance
of such improvements. These communications must be initiated prior to the commencement of
any work.

I am writing today requesting your assistance with a matter that I have
repeatedly brought to the attention of City Staff, The subject pertains
to various drainage onto my residence, located at 9215 N. 139th East
Ave, There are three separate drainage issues that are deficient and
need to be addressed:
Related to item #2, the city has no drainage easement on my property.
Furthermore the city of Owasso was cited in June of 2001 by the Tulsa
County Health Department for an environmental health hazard caused by
stagnated water resulting from this illegal drainage.
Related to item #3, the city has no drainage easement on my property,
yet drainage easement does exist, on average, within 15 feet of the
current drainage. Additionally, the proper city authorities were
notified of this concern well in advance of actual construction
beginning at the church. The added runoff has increased the ground
water volume, resulting in water now percolating up on my property on a
continuous basis (this may also be related to item #1)m
It is regrettable that I must bring these issues to the attention of the
Mayor and City Councilors, yet I have limited options available at this
point. I have attempted to work with multiple city employees, with no
results. Over the course of the last three (3) years I have worked, in
good faith, to resolve these problems with Robert Carr, Ron Cates,
Gerald Hoffman, Phil Lutz, Larry Mitchell, and most recently Rodney Ray,
In the case of the current City Manager, Rodney Ray, I have documented
thirty - -seven (37) attempts to communicate with him, over the past 13
months. All toll, I have documented over eighty (80) attempts to
communicate with the entire list of city officials.
Mr. , Ray, alter visiting my property and acknowledging the probl-em,
(:ornrrii I.ted t:o me, on Abri..l 19, 2002 that lie would have a elan to solve the

problem by the following Friday, and that the solution would be in place
within 60 days. -Over 375 days have passed since that time, and Mr. Ray
has refused to return any phone calls or e-mails that I have sent since
August of 2002, The lack of professional conduct in this matter is
disappointing,

Ray on July 1, 2002. As you will see documented, Mr. Ray makes a
commitment to solving issue #2 right away, and addressing issue #3.

The purpose of this report is to present our findings, conclusions, and
recommendations of a drainage study of the detention pond at first Baptist
Church in Owasso. This study was authorized by the City of Owasso Public
Works Department based on citizen's concern of receiving increased runoff after
the church site was developed.

These deficiencies have the following flood flow routing results:
1 Stored water is being discharged out of the pond earlier than
planned due to lower berm elevation.
20 Pond has less storage capacity due to pond floor elevations being
higher than planned.
& Designed runoff volume does not enter into the pond due the
bypass swab.

To prevent situations like this in the future when private facilities are constructed,
we recommend that the City adopt a policy that the owner provide record
drawings signed and sealed by the design engineer. This type of policy has
been adopted by numerous communities throughout the United States.

provides direction to the City Manager, and strives to promote a
positive and productive work relationship with the City Manager. Please

citizens and has certain responsibilities to the citizens. I appeal to
you to give my case a fair hearing. You have rely assurance that I will
be presenting the matter at the most professional level. possible. I
have a genuine interest in settling each of these issues and am open to

Rodney,
I want to thank you and Mr. Lutz for finding time in your schedule to
meet with me at my property. I am writing to confirm our meeting and
to make certain that I understand all that was agreed to. I will
address
the two drainage issues separately.
1. Drainage from the street (134th East Ave) that discharges openly
along
the South edge of property: My understanding is that your plans are to
join the existing concrete drainage line with full diameter pipe to be
routed East across my property into the existing drainage easement
located
within the Nottingham subdivision. The line will then be routed South
and terminate at the existing junction box located approximately 200
feet
South. Additionally, the plans call for a surface drain to be located
at the low point along the South end in my yard. During the course of
this work it is recognized that at least one tree, and possibly two,
will
need to be removed in order to accommodate the new line. Efforts will
be made to minimize the amount of damage and removal of trees.
20 Increased drainage resulting from the construction of the church and
parking lot just North of 96th Street: My understanding is that the
city's position is that the benefits of an enclosed drainage system,
starting
at the newly constructed retaining pond, do not justify the expense at
this time. It is understood that additional water will flow across my
property as a result of this construction, yet the magnitude and impact
can not be sufficiently determined at this point in time to justify the
expenditures that would be required to maintain or possibly improve the
current drainage. The city plans to monitor the development and
appropriate
money in the future should the issue become more significant.
In response to the city's position on drainage issue #2, 1 would like
to offer the following. Considering a 3-inch rain and the fact that
water
from the church and parking lot will not be allowed to spturate into the
earth, assuming an area of 20 acres, my calculations indicate that
1,600,000
additional gallons of water will flow across my property as a direct
result
of this new construction. Although paving has yet to be completed at
the church property, I have already seen a significant increase in water
run-off, directly related to the church construction. This increase
in amount of water along with the entrained dirt from the construction
has rendered my existing 4-inch drainage system useless for this new
load.
I hope you can understand why I do not agree with the "Cost/Benefit"
analysis
and justification. However, I can appreciate the fact that the city's
budget may not be able to justify starting this phase of the work right
away. As I indicated while we were discussing the situation yesterday,
I would like to see an interim solution to issue #2. That being the
installation of a 12-inch perforated line and french drain system
starting
at the North edge of my property. This system would augment the
existing
drainage line that the homeowners within Windsor Lake have already
installed.
The majority, all but approximately 20 feet, of the new 12-inch line
can be run in existing Utility Easement (1705 feet located on the East

edge of my property). Additional easement could be granted, or possibly
the final 20 feet could be financed by myself - "piggybacking" with the
construction contractor that the city will use.
This compromise solves the immediate issue of additional drainage across
by property, It is much less costly than a complete system installed
starting at the source of the new water. It can be accomplished in
conjunction
with the existing work for Item #1„ The city has money in the budget
to address the issue now. And it provides for additional time to fully
access the impact of the final church construction.
Please review this memo and let me know if I have misunderstood you in
anyway. Please also give serious consideration to the proposal for an
interim solution.
As for timing. I am anxious to get the project underway, as I am sure
you are also. Since it is now starting to dry out, this is the right
time of the year to take on the work, as it will result in minimal,
damage
to the property and allow your crews to make the most use of their time
and city dollars. My understanding from yesterday was that I will
hear
back from the city, via. Mr. Lutz, on Tuesday July 2, 2002 concerning
the contractors status and next steps. (Please provide my e-mail
address
to Phil, as 1 will be out of town on the 2nd) Eased on our
conversations,
I am presuming that the work wilel, begin on or before July 20, 2002.
I am looking forward to having this drainage issue solved. I do

The question is, does this item pertain to the existing drain pipe even though it is located in
what is shown on the plat as a utility easement (TJ/E)? The pipe existed when the current
owner purchased the property.
Item 16, Water. Sanitary & Storm Sewer — The title infers application to all three utilities but
text in the first paragraph particularly addresses only water and sanitary sewer facilities.
The second paragraph addresses damage or relocation of water, sanitary and storm
"facilities". No actual damage has been done .to the drain pipe, but could the word "facilities"
be interpreted to include both the pipe and downstream channel?
The third paragraph cites the City's right to enter "easement ways", and in the same sentence,
refers to "sewer facilities" to include both sanitary and storm (per the section title), i.e., where
"sewer" is cited, both sanitary and storm are included and the type of easement designation is
not differentiated.
This context is followed in the next (fourth) paragraph where "sewer facilities" refers to both
sanitary and storm.
Bottom line, are we legal with a storm sewer located in what is designated a U/E and could
the current owner force us to close, remove or otherwise alter the drain pipe?

It is unlawful for any person to fill up, deflect, or obstruct any gutter, waterway,
water outlet, drain, strewn, ditch, sewer or other water passage, either natural or
artificial, by throwing or causing to be thrown therein any trash, rubbish,
garbage, brush or other thing.
The City Attorney's opinion is that the existence of the storrn drain pipe within the
designated utility easement constitutes no greater burden on the property owner than that
ol'Ilily other utilities. The true cause of the problem relates to the filling of the natural
Channel.
Therefore, the fill placed in the channel needs to be removed by the party responsible for
placing the fill to allow free discharge of storm flows and any related seepage to the
downstrearn storm inlet.
This letter will also be directed to the owner of Windsor Lake 11, Lot 48. If you require

Mr. Kenneth Yates, a resident of the Silver Creek subdivision has requested an
opportunity to address the City Council. While Mr. Yates was not specific in his request
it is assumed that he will discuss ffifther drainage concerns he has relating to his property.
It is further assumed this request was initiated because of heavy rains that occurred on
November 18, 2003. Mr. Yates last addressed the Council on November 4, 2003.
The staff of the Public Works Department is currently involved in determining the
validity of previous calculations made by the department and developing options for
consideration. The City Manager has also met with the Homeowners Association to
discuss issues including drainage concerns. No homes were inundated during the rainfall
of November 18, 2003. Mr. Yates requested "sandbags" and the city did, in fact, supply
filled sandbags to him on Monday, November 17, 2003.
It is the staff's position that any corrective action taken prior to having a clear
understanding of the impact of those actions could result in aggravating the existing
conditions. Progress is being made on this issue.
Attached for your review arc several documents relating to the Silver Creek drainage
issues in which you have seen previously, along with Mr. Yates e-mail requesting

On December 19, 2002 a site visit was made to discuss drainage issues at Mr. Yates' residence,
located at 8908 North 103'd East Avenue within Phase I at Silver Creek. During the meeting,
Mr. Yates communicated that construction of Phase 11 had resulted in excess stormwater ninoff
surpassing the capacity of the existing drainage system. He requested that improvements be
made to the detention pond and conveyance system servicing Phase I to avoid property damage
due to -flooding.
In a letter dated June 7, 2003 (see Attachment Q, Mr. Yates states that drainage problems first
became apparent in 2001 following the start of construction of Phase 1, presumably due to a
design flaw. Reportedly, a meeting was held to discuss remedial actions at that time. Those in
attendance included the property owner, developer (Tom Morris) and design engineer (Ronald

Tracy of Tracy Consulting Engineering, Inc.). It was agreed that changes were to be made to the
Phase 11 drainage system to reduce the impact of stoirawater runoff on the Phase I system. The
City has no records of the meeting or changes made to alleviate the problem.
In subsequent communications, Mr. Yates stated that stormwater runoff from Phase H continues
to flood the north end of his property, Runoff has reportedly reached the elevation of his back
porch. Additionally, he reported that during recent rain events stormwater has accumulated in
the streets at depths exceeding the curb elevation and that the water surface of the detention pond
reached excessive levels (see Attachment D).
Although remedial actions taken by the City had a positive impact, drainage issues continued at
the Yates property. In June 2003, Mr. Yates contacted the City to communicate that the rain
events on May 19 and June 2, 2003 had produced serious flooding in his backyard and the street
immediately in front of his house. The City responded by committing to complete an internal
hydrology review, which would include long-term solutions. In addition, the City has taken
every opportunity since June 2003 to record storm events in an effort to better access the
vulnerability of the drainage system. on September 11, 2003, the City experienced a 5-year, 6-
hour, rain event (see Attachment E). No homes were reported to have been flooded.
According to the Hydrologic Analysis prepared for Phase I by Cantrell and Associates in March
1997, the detention pond and associated conveyance system were designed to provide adequate
storage to handle post-development peak flows from a portion of Brentwood, Phase I and Phase
11 at Silver Creek for a 100-year (6 hour duration) rainfall.
Staff is of the opinion that the original analysis included assumptions that were not appropriate
for the subject area. During a recent analysis of 2-foot contour maps and the existing storm

Final inspections were conducted as follows: water and sanitary sewer systems on September 18,
2002, storm drainage systems on September 30, 2002 and streets on March 19, 2003. All items
identified at the final inspection requiring correction to meet city standards have been completed.
The construction contractor has provided the required one-year maintenance bond for the water,
sewer, and storm drainage systems and the required two-year maintenance bond for the asphalt
paving (see attached). The delay in presenting the systems for acceptance was due to a long wait
for the water system Oklahoma Department of Environmental Quality (ODEQ) permit.
Staff recommends Council acceptance of the Country Estates VI water, sanitary sewer, storm
drainage systems and streets.

The Turley Fire Department has expressed an interest in acquiring this vehicle. Turley is
a neighboring department that we routinely receive and provide mutual aid. They plan on
utilizing this vehicle for parts. Their department currently has the sister pumper for
Engine One and the parts can be interchanged.
Engine One has been evaluated, and the staff believes it has a value of less than five
hundred dollars. This is due to its current state of disrepair, and the parts are only useful
to this specific year and model of truck.
Staff would recommend that the sale, for the price of ten dollars ($10.00), of this vehicle
be authorized to the Turley Fire Department for use as they deem necessary to ensure the
in-service status of Engine One's sister pumper, which is currently in the inventory of the
Turley Fire Department. I

BACKGROUND:

For the past year, Owasso Emergency Management staff has been working on writing an
emergency operations plan for the City of Owasso. The emergency operations plan, or EOP,
addresses how the city, community, and responding outside agencies operate during times of
major emergencies and / or disasters.
The EOP takes an 66all hazards" approach to any natural or man made disaster that may affect the
community of Owasso and its citizens. In July of this year, staff was able to obtain a $ 14,000.00
grant from FEMA and the Office of Oklahoma State Emergency Management to prepare the
final EOP document. The grant was important because of Federal policies recently adopted that
require cities to have an official Emergency Operations Plan in order to be eligible for Federal
Emergency Disaster Funds. Since Owasso, like most other cities, had no plan the grant made
possible the development of the proposed Emergency Operations Plan document you have been
presented.
Once the grant was secured, Owasso and other metro cities contracted with INCOG to assist in
preparing the final document. An Emergency Operations Planning Committee was formed and
monthly meetings were conducted to discuss the plan as it was being prepared, make
recommendations as to how Owasso's emergency services and major departments would
respond to a disaster or terrorist situation, and provide information as to the capabilities and
readiness of each city department. This committee consisted of city personnel, citizens, INCOG
staff, and business representatives from the Owasso community. A list of committee members is
attached to this memorandum.

As one can see, the document is not only comprehensive but is fashioned after the Federal, State,
and County models to ensure that all forms of government can work side by side during a
disaster.
If approved by the City Council, the EOP is a document that is intended to be reviewed annually
by the Emergency Operations Planning Committee in order to provide updates should their be
changes in the city's infrastructure and resources.
In order to meet deadline requirements, an approved EOP should be received by the Oklahoma
Office of Emergency Management by December 15, 2003.
RIECOMMENDATION:
Staff recommends Council approval and adoption of the Emergency Operations Plan.

BACKGROUND
The City of Owasso has received a request from Bethel Baptist Church,
applicant(s)/owner(s), for the rezoning of approximately 5 . I I acres, more or less from its
current designation of RS-3 (Residential) to CS (Commercial).
Current Zoning Designation-

RS-3 (Residential Single-Family)
The applicant has filed an appeal to the City Council asking for the reversal of a Planning
Commission decision rendered at the November 10, 2003 regular meeting. At that
meeting the Planning Commission denied the request of Bethel Baptist Church to rezone
its property located in the northwest comer of Cedar St. and E. 86th. The church
currently occupies the southern portion of the site while a parking lot occupies the middle
section of the site and remaining northern section contains a storage building and a
playground. Single Family residential units occupy the property to the south of the site.
Single family units and a few duplexes are located north of the site. Restaurants are
located to the east and west of the subject property and the main post office is located to
the east of the site as well. The current zoning on the subject property is RS-3
(Residential Single-Family District). RS-3 zoning is present on the properties to the
north and south while CG (Commercial General District) zoning is present on the
property to the east and west of the subject site.
ANALYSIS
The CS classification desired is consistent with the commercial pattern currently
established along the north side of 86t" Street North and any if any commercial
development were to occur on this site it the Owasso Zoning Code would limit its
conflict with the residential neighborhood to the north. This request along 86"' St. N. is
consistent with the Owasso 2010 Land Use Master Plan.
The church site consists of multiple lots. A portion of the property extends north into the
Ator neighborhood. Rezoning the lots that extend into a residential neighborhood is not

consistent with the Owasso Zoning Code nor the Land Use Master Plan. Rezoning the
lots on the northern portion of the churches property to CS would allow the potential for
commercial development within a residential neighborhood. Considering the type of
commercial development that the Owasso Zoning Code allows under its commercial
zoning designations the potential commercial development would in all likelihood not be
compatible with the residential neighborhood's scale or pace and could potentially pose
conflict, such as additional traffic into the neighborhood, more noise and light pollution.
Staff published legal notice of the rezoning request in the September 17., 2003 edition of
the Owasso Reporter and sent notices to property owners within 300' of the property and
posted a notification of a rezoning request sign on the property. Staff received one phone
call concerning the potential use of the site. It was the concern of the caller that the
rezoning would allow the church to sell the property in the future to commercial interest.
He was mostly concerned with potential commercial development of the lots on the
northern section of the churches property.
PLANNING COMMISSION
The Owasso Planning Commission, at the November 10, 2003 regularly scheduled
meeting, voted 3 -1. to deny the rezoning request.
RECOMMENDATION
Staff recommends rezoning Bethel Baptist Church's southern most lot (on which the
main structure is situated) adjacent to 86th Street North to CS (Commercial Shopping
district), rezoning lots 8 and 9 of block 10 in Ator Heights to OL (Office Light intensity
district) and maintain an RS ®3 zoning designation for lots 5 -7 of block 10 in Ator
Heights. The zoning classifications would allow the church to place signs within their
property and more specifically within their parking lot to the north. The CS zoned
property along 86th St. will establish a consistent developable pattern along that corridor
and the OL zoning on the middle lots would (along with allowing the sign) provide a
smoother transition of intensity from Commercial to Residential. Uses typical in OL
zoned districts share similar characteristics to Residential zoning therefore the potential
for conflict is minimized. A map illustrating the staff recommendation is attached.
