Consideration and Appropriate Action Relating to Ordinance No. 765, an Ordinance establishing new regulations which would prohibit the use of skate equipment on private property with public access. The Owasso City Council met in regular session on Tuesday, August 19, 2003 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, August 15,2003. Mr. Cataudella moved, seconded by Mr. Thoendel, to approve adoption of Resolution No. 2003-12 in order to provide the City Manager with authority to execute Change Orders for amounts not to exceed $10,000 and a maximum cumulative of $30,000, as they relate to the East 86th Street North widening project. ITEM 10. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR CITY COUNCIL AUTHORIZATION OF THE CITY MANAGER TO EXECUTE CHANGE ORDERS AS THEY RELATE TO THE EAST 86TH STREET NORTH WIDENING PROJECT. Cost of contract is $53,523.00. CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN AGREEMENT BETWEEN THE CITY OF OW ASSO AND OKLAHOMA NATURAL GAS FOR UTILITY RELOCATION ALONG EAST 86TH STREET NORTH FROM NORTH 129TH EAST AVENUE TO NORTH 145TH EAST AVENUE. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN AMENDMENT TO THE FY04 GENERAL FUND BUDGET WHEREIN A SUPPLEMENTAL APPROPRIATION INCREASING THE REVENUES AND EXPENDITURES OF THE POLICE DEPARTMENT IN THE AMOUNT OF $9,495 IS REQUESTED. NEW BUSINESS Ms. Kimball acknowledged Tammy McCall and David Warren for their hard work in the Clark in the Park presentation Mr. Helm asked for clarification for the Council that the City of Owasso provides the water supply for the New Brunswick Subdivision not Washington Co. RWD3 as stated on the Final Plat Application. Mr. Carr confirmed that the City provides the water service. ITEM 16. REPORT FROM CITY COUNCILORS None ITEM 15. Rural Water District No.3, Washington County has stated in a letter dated August 28, 2003 that all requirements have been met for the water line installation (Phase I). The system has been included on the September 8, 2003 Board meeting agenda for final approval (see attached). Final inspections for the sewer system (Phase I of construction) were conducted on August 19, 2003. All items identified at the final inspection requiring correction to meet city standards have been completed except for the installation of a telemetry system for the wastewater lift station which sends emergency signals to operations personnel. Due to the limited availability of the equipment, the installation of the system is expected to be completed by September 12, 2003 but will pose no operating problems since building construction has yet to be started. FINAL INSPECTIONS: The subject 22-acre residential development is located southeast of the E 116th Street NOlih and N 129th East Avenue intersection (see attached map). The water system lies within Rural Water District No.3, Washington County. The sanitary sewer system consists of approximately 5,648 linear feet of 8-inch PVC sanitary sewer line, 10,294 linear feet of 8-inch PVC sanitary sewer force main and a 315 gallon per minute wastewater lift station. Design for the sewer system was reviewed and approved in April 2003. Construction was inspected by the Public Works Department. THOMPSON Executive Director A total of $118,000 was budgeted for the Skate Park project which would include not only the equipment, but the dirt work, concrete, and parking lot as well. With this in mind, staff initiated the process of negotiating with the "lowest, best bid" submitted in hopes to receive a more competitive price. Fortunately, Miracle Recreation was willing to negotiate a lower price and has agreed to adjust their bid to $82,000. This adjustment will allow staff to complete the entire project, as well as include the alternate. As a result of the final design, bid specifications were developed and the proj ect was sent out for public bid. The bid specifications consisted of a Base Bid, which included a series of 12 skate activities, as well as an alternate. The altemate included one additional ramp that was 5 feet by 20 feet in length. A total of 3 bids were received for the project, with the overall low bid for the Base Bid and Alternate being submitted by Miracle Recreation of Bixby, Oklahoma in the amount of $88,925. A copy of the bid tally sheet is attached for your information and review, as well as a portion ofthe bid specifications. Upon completion of this process, staff developed an "Online Survey" to obtain input from the end users ofthe Skate Park, as well as supplying the local skate shop (Haz-Mat) with hard copies for their customers to complete. Results from the online survey were overwhelming, as well as the hard copies received. These results were utilized to form a final design for the Skate Park which was previously presented to you. Staff initiated the process for the development of the Skate Park several months ago. Initially, staff visited several cities with skate facilities to review their locations, methodology for equipment selection, and overall cost. Additionally, staff reviewed existing ordinances in each community to see what types of restrictions were being applied to areas outside of the designated skate facility. Please note that the next item on the agenda is an Ordinance that would prohibit stunt skating on plivate property with public access unless the owner of the propeliy requests othelwise. Action on that item must occur separately and if approved, the ordinance would not go into effect until the completion ofthe Skate Park. The Skate Park would be located on South Main Street, between Main Street itself and the Animal Control Facility. In order for the Skate Park to be located in this area, a Special Exception from the Board of Adjustment was required to be obtained. Letters were mailed to all property owners within three-hundred (300) feet of the subject property on August 4,2003 and the request was advertised in the Owasso Reporter. Staff received no inquiries concerning DBDA 03-21. Staff believes the development of a Skate Park in the 400 block of South Main Street would be a positive addition to the growing list of recreational opportunities offered to the community of Owasso. In addition, attached you will find a proposed Ordinance that would restrict stunt skating and stunt biking to those areas similar to a Skate Park. This would assist local business owners that have requested the City's assistance in limiting damage to their properties as a result of stunt skating and biking. The skate park intends to provide a long overdue service to the citizens Owasso. Skateboarding has been a prevalent alternative activity for the youth (or young at he(11) of Dwasso for some time. In that time, a recognized place for participants to perform was not available. As a result, all of the community (private and public property) became the playing ground for the activity. The development this park aims to organize and enhance skating activity in a protective yet proactive manner. is the City of Ow as so's desire that this park will become the focal point for the skating community of Owasso. The proposed park will contain a multiple of event structures that are commonly used for stunt skating. It will also include benches, vending machines and a parking lot for patrons. As proposed, the development of the skateboard park is in compliance with the requirements of the Owasso Zoning Code. ATTACHMENTS: 1. Ordinance No. 765 Staff recommends Council adoption of Ordinance No. 765. RECOMMENDATION: As mentioned in Mr. Warren's memorandum, it is proposed that this ordinance would be published in such a manner that the changes would be concurrent with the opening of the Skate Park. The most significant, and desired, change to Part 15 of the Code of Ordinances would be the prohibition of stunt skating of any kind on private property with public access unless the owner of said propeliy submits necessary paperwork to be filed with the Chief of Police. This process would allow for easier enforcement by police officers and would eliminate the need for each business owner to post their property with a "No Skateboarding" sign. Staff initially contacted several municipalities and reviewed their ordinances regarding the use of skateboards in their communities. Additionally, Parks Department personnel contacted other communities to review regulations regarding alternative recreation. The attached ordinance contains information from several of the contacted municipalities. As a result of concems expressed in several Town Hall meetings from business owners regarding stunt skating and skateboarding, staff was directed to review changes in Pali 15 - "Traffic and Vehicles" of the Owasso Code of Ordinances. Any changes to this portion of the Code were to accompany the Skate Park opening so as to not relocate youth in our community without providing a recreational altemative. No person shall operate or ride a skateboard on any roadway where the volume or speed of the vehicular traffic or the width of the roadway renders the roadway unsafe or unsuitable for skateboarding. No person shall ride a skateboard on private property that is zoned for commercial, industrial, multi-family, or office use in the City of Owasso unless such act is expressly allowed by the owner thereof. In order for this act to be lawful, the private property owner must have first filed with the Chief of Police, upon such fOI1TIS as are to be provided by the Chief of Police, a written declaration that skateboarding upon such owner's private property is expressly allowed, together with such other information reasonably pertaining thereto that the Chief of Police may require. C. No person shall ride a skateboard onto or from any bench, chair, flower box, retaining wall, stairway or other public accessory or structure not intended for pedestrian foot traffic, or intended only for pedestrian foot traffic. B. No person shall let a skateboard stand upon any sidewalk, park, path, roadway or any public place where it is an obstruction or hazard to pedestrians. A. No person shall ride a skateboard upon any sidewalk, park, school yard or any public place not designated for such purpose or on any roadway so as to obstruct pedestrian traffic or endanger another person's safety, or ride a skateboard on any highway, street or roadway in such a manner so as to impede the normal flow of vehicular traffic.
