It is the desire and intent of Owasso Land Trust, LLC, to create a residential community in which such beauty shall be substantially preserved and enhanced by the creation and enforcement of CONSISTENCY WITII OPUD 02-03 (NEW BRUNSWICK) OPUD 02-03, a planned unit development application, was unanimously approved by City Council on November 5, 2002. Planned Unit Developments are approved with the stipulation that an Outline Development Plan, which guides the layout of the proposed subdivision, is submitted at the time of the PUD application. After careful review of the final plat application, staff finds that the final plat is consistent with the approved OPUD 02-03 Outline Development Plan and the City of Owasso Zoning Code. BACKGROUN!! The City ofOwasso has received a request from Owasso Land Trust, applicant/owner, for the review of a final plat for the New Brunswick Addition. The New Brunswick Addition is located at the northwest corner of the 96th Street N. and 97th East Ave (Mingo Rd.). The preliminary plat contains 42 residential in, 3 blocks on approximately 9.92 acres +/-. New Brunswick Final Plat. RECOMMENDATION Staff recommends approval of the New Brunswick Final Plat, subject to the execution of aforementioned T AC recommendations. If this item is recommended for approval, City of Owasso City Council review and approval is required. TECHNICAL ADVISORY COMMITTEE 'The Technical Advisory Committee the New plat at November 27,2002 regular meeting. The following comments were provided: 1. Standardize language in the Covenants, Deed ofDedicatioll, Certain Restrictions: #3 2. Add the eastem property line in the Covenants, Deed of Dedication, Certain Restrictions: #2A. development standards. It offers a unique housing opportunity not widely available within the City of Owasso. The proposal would allow for garden homes in a cohesive neighborhood setting that would supplement the City's current housing stock and provide further opportunities for home ownership. In staff's opinion, the proposal would provide for a consistent and well-designed subdivision that staff is certain would prove to be an aesthetically pleasing addition to the City of Owasso. Carlsbad St. (Residential Single-Family) Proposed Zoning Designation: AG (Agricultural) Current Zoning Designation: !}ACKGROU@ The City of Owasso has received a request from applicant(s)/owner(s), the approximately acres, more or current designation of (Agricultural) to (Residential). The property was one small number of parcels located in the 'Old Town' portion Owasso not included as a part of the original town site limits. The property owners recently filed a petition for annexation into the City of Owasso which was approved by the City Council on July 15, 2003. It is the intention of the owners to sell the property to a developer for the purpose of constructing two single family residential units along N. Carlsbad St. OZ 03-10 (New Hope Baptist Church) STAFF REPORT CITY OF OW ASSO COMMUNITY DEVELOPMENT DEPARTMENT ATTACHMENTS I. General Area Map 2. 02 03-10 Rezoning Application 3. Legal Notice RECOMMENDATION Staff recommends approval of the rezoning request by New Hope Baptist Church to change the property's designation from AG to RS-3. TECHNICAL ADVISORY COMMITTEE The Technical Advisory Committee reviewed the rezoning request on July 30, 2003. There were no concerns regarding the rezoning. Staffbelieves that the rezoning request and the eventual construction of two single family homes will contribute to the surrounding neighborhood compatibly and in a positive manner. The currently vacant site will become a productive parcel in the City of Owasso. Staff published legal notice of the rezoning request in the July 10, 2003 edition of the Owasso Reporter, sent notices to property owners within 300' of the property and posted a notification of a rezoning request sign on the property. Staff has received one phone call concerning the potential use of the site it was the concern of the caller that there would be duplexes constructed on the site instead of single family homes. Staff informed him that duplexes were not the intentions of the developer and that duplexes are only allowed as a special exception which would have to be approved by the Board of Adjustment and that he would have his chance to oppose duplexes at that time if it were to materialize. The proposed rezoning is in accordance with the Owasso 2010 Land Use Master Plan. The Plan exhibits this area as being residential in character. There are no conflicting or potentially conflicting land uses adjacent to or within close proximity to the subject property. The property is currently zoned AG (Agricultural General District). The applicant wishes to rezone the property to the RS~3 (Residential High Density District), which is similar to the surrounding zoning in the neighborhood. This designation would authome the intended construction two (2) single family residential units which are allowed by right, according to the Zoning Code, on parcels zoned as a part of Use Unit 6 ._, Single Family Dwelling. addition, meets all Code's bulk and area two (2) single family homes on the site in harmony with the surrounding neighborhood. In order to benefit from the experience that these individuals could provide, the staff desires to ask the former steering committee members to serve again on the new committee. Of course, the staff would also include new members to represent the City Council, Owasso Reporter, and Planning Commission. For example, Bruce Jones from the Owasso Reporter and Dewey Brown from the Planning Commission have indicated an interest in participating on the committee. Of these fourteen members, six were citizen representatives: STEERING COMMITTEE: The Master Plan can be generally divided into three parts: 1) statistics, figures and estimates, 2) map of desired land use patterns, and 3) key issues, needs, and goal statements. The staff has updated the statistics, figures, and estimates of Owasso's characteristics. Now, public input is needed to form recommendations about desired land use patterns and goals. This input will be gathered in multiple forms: written surveys will be distributed to the public, public hearings will invite the public to speak about the Plan, and a Master Plan steering committee will guide the Plan through the public involvement process. The Owasso Master Plan is a document representing desired future land use and transportation patterns for the physical development of the community. The Plan was adopted by the City Council on January 18, 2000. The staff is currently updating the Master Plan. AGREEMENT FOR GAS FACILITIES RELOCATION: ONG currently owns approximately 705 linear feet of low- and medium-pressure distribution pipelines to be relocated within the limits of the proj ect. Ofthe total length, 200 linear feet are located outside the public ROWand within a privately owned easement. This portion will have to be relocated at an estimated cost to the City of $53,523.00, including material, labor, and contract administration. American Electric and Power (AEP), Southwestern Bell, Verdigris Electric Company, Oklahoma Natural Gas (ONG) and Cox Cable have engineered the relocation of utilities to allow for the construction of the improvements. All utilities, except for ONG's, are located within the public ROWand have no dedicated easements, thus relocation will be at no expense to the City. Included in the 1998 bond issue, the E 86th Street North (from N 129th to N 145th East Avenue) Improvements involves the widening of the street to five lanes, construction of new sidewalk, curb and gutter, and signalization at the 8th Grade. Engineering design was initiated in August 2002 by C. H. Guemsey & Company and finished in June 2003. Advertisement for Bids was published in the Owasso Reporter on July 26,2003 and four bids were received on July 28,2003. On August 5, 2003, City Council awarded the construction contract to Becco Construction, Inc., Tulsa, Oklahoma in the total amount of $2,472,065.20. Notice to proceed was issued on August 14,2003. FUNDING: The City Attorney has reviewed this agreement and found it acceptable. o The City will reimburse ONG within thiliy (30) days of completion of work, which is estimated to be mid-August. Relocation costs will be based on actual relocation costs. ONG will award and pay for the work based on competitive bids or continuing contract, whichever is deemed most practical and economical by ONG. o If the contract is awarded at a higher amount than the estimate, ONG will send the City a written notice, and the City will have the right to terminate the agreement within ten (10) days of receipt of notice. ONG easements shall be considered to retain precedence so that any City project in the future requiring additional relocations of the same facilities shall be paid by the City. Page 2 Agreement For Gas Facilities Relocation East 86th Street North Improvements (N 129th E Ave To N 145th EAve) Page 1 of 3 The Company by agreeing to or by abandoning, relocating, or modifying any ofits facilities pursuant to this agreement It is further understood, and City by accepting this proposal agrees, that City will reimburse the Company in accordance with this agreement within thirty (30) days after the said relocation work has been completed and Company's statement for City's costs thereof has been submitted. Company agrees that in the event Company should determine prior to commencement of construction that the revised estimated amount of the reimbursement by the City may exceed the estimated cost as stated herein, Company shall notify the City of such determination in writing. City shall have the right to terminate this agreement within ten (10) days of receipt of such said written notice. If City elects to so terminate, City shall pay Company the City's share of any engineering cost incurred to date of termination. If the City does not terminate the agreement within the ten (10) days, it shall remain in full force and effect. Such relocation costs will be based upon, but not necessarily limited to, material suppliers', work contractors', and equipment-rental invoices; and at then-current rates and prices, company's transfer and stores expense charges for warehoused materials; payroll time sheets; indirect labor charges; auto, truck, and equipment use records; expense statements; and standard allocated overhead charges. Company's award of and payment for contracted work will be based upon competitive bids or continuing contract, whichever appears to the Company will be most practical and economical. City by accepting the proposal agrees that City shall reimburse Company for its share ofthe total actual relocation costs, said costs being arrived at in the same manner as used in Company's estimated cost of the project attached hereto. Company proposes to perfOlID the necessary relocation of its facilities in substantial accordance with the eight plan sheets and the one-page cost estimate, all dated April 4, 2003, of which four copies each are attached. Company will bear the cost of relocating the portions of the facilities which do not occupy private rights-of-way. The City's share of the estimated cost of the necessaty relocation will be $53,523, all of which is to be reimbursed to Company by City. City of Ow as so, Oklahoma, a municipal corporation, hereinafter called "City," has requested Company to relocate these facilities to accommodate the proposed construction of the referenced project as shown on plans therefor, the latest of which were received by Company on February 28,2003. City agrees to reimburse Company in the extent and manner hereinafter stated for that portion of the cost of relocating said facilities which is for the benefit of City. Oklahoma Natural Gas Company, a Division of ONE OK, Inc., hereinafter called "Company," owns various medium- pressure and low-pressure distribution natural gas pipelines within the construction limits of the referenced project in the City of Ow as so, Tulsa County, Oklahoma, which Company utilizes in the discharge ofits duties as a public service corporation. AVE CITY OF OWASSO OKLAHOMA Additionally, it is possible that an adjustment to the bid quantities be necessary at final payment to reflect actual quantities provided during the construction of improvements. The contract was awarded as a unit price based on the best estimate of required quantities. However, such quantities cannot be guaranteed and are rather used for the purpose of comparison of bids. Although it is the City's intension to ensure the completeness ofthe contract plans and specifications, it is often impossible to predict field conditions. During construction, the Contractor may be required to perform extra work or furnish materials which cannot reasonably be classified under any item of the contract but which may be necessary to complete the work intended in the design. EXPECTED CHANGE ORDERS: Per the contract documents, improvements shall be constructed within three-hundred and forty- six (346) calendar days from the Notice to Proceed (with an anticipated project completion date of August 2004). Construction will be performed in four phases and will commence with improvements to the east bound lanes. Included in the 1998 bond issue, the E 86th Street North (from N 129t11 to N 145th East Avenue) Improvements involves the widening of the street to five lanes, construction of new sidewalk, curb and gutter, and signalization at the 8th Grade. BACKGROUND: DATE: August 7, 2003 SUBJECT: .CHANGE ORDERS EAST 86TH STREET NORTH IMPROVEMENTS (N 129TH E AVE TO N 14STH E AVE) FROM: ANA STAGG, P,E, ENGINEERING PROJECTS TO: THE HONORABLE MAYOR AND CITY COUNCIL CITY OF OW ASSO MEMORANDUM Staff recommends Council approval of authority for the City Manager to execute change orders for amounts not to exceed $10,000 and a maximum cumulative total of$100,000. RECOMMENDATIONS: Sufficient funds remain in the 1998 Bond Issue for this project. FUNDING: Under either case, compensation for extra work may result in an increase to the contract amount which must be approved by Council prior to the start of construction. The expeditious approval of such changes, however, is frequently required to prevent construction delays and is critical to the construction schedule. It is therefore recommended that City staffbe authorized to execute change orders up to a pre..set limit and allowed to present changes to Council for approval at a later date. Page 2 Change Orders East 86th Street North Improvements (N 129th E Ave To N 145th EAve) Funding for this request is derived from the Bulletproof Vest Pminership Grant in the amount of $9,495.40, This grant program is provided through the Department of Justice. FUNDING: In order for the City of Owasso to utilize funds from the Bulletproof Vest Partnership Program, a supplemental appropriation to the Police Department of the General Fund is needed. The supplemental appropriation would increase both revenues and expenditures of the Police Depmiment by $ 9,495.40. REQUEST: In June 2003 the Department of Justice sent notification via email stating the City of Owasso was successful with the submitted request and would be receiving $ 9,495.40 in grant funding. Due to federal budget constraints, the department's request was only partially funded. In February 2003, the Owasso Police Department applied for grant funding through the Bulletproof Vest Pminership Program to assist the department in the purchasing of protective vests during the FY 2003-2004. The vest grant program allows agencies to apply for up to 50 percent of the cost of any vest approved by the National Institute of Justice (NIl). In addition, the program allows agencies to receive reimbursement on vests purchased within the two (2) years previous to the date of grant application. With this in mind, the department submitted its application with a total request of approximately $ 14,500.00, of which, approximately $ 6,500.00 is for reimbursement of previously purchased vests. From: Sent: To: Subject: Yancev,Dan Two final notes regarding this project: The first would be that a "grant" for a substantial savings on the project is still anticipated from one of the bidders. The second would be that throughout the entire process the skating community has been involved. The end result should be a skate facility where users have ownership, resulting in less vandalism and increased use. A draft ordinance, which staff would propose to be acted upon at the same meeting that contains the bid for the award of the Skate Park itself, has been attached for your information and review. The ordinance would prohibit "stunt skating" on all private property with public access in the City of Owasso providing the business owner completes a short form at the Owasso Police Department. As a result ofthe final design, bid specifications were developed and the project is currently out to bid. The remaining step in the process, in addition to the award of bid, is obtaining approval from the Owasso Board of Adjustment for a Special Exception in order to locate the facility just north of the Animal Control Facility on South Main Street. Upon completion of this process, staff developed an "Online Survey" to obtain input from the end users of the Skate Park, as well as supplying the local skate shop (Haz-Mat) with hard copies for their customers to complete. Results from the online survey were overwhelming, as well as the hard copies received. These results were utilized to form a final design for the Skate Park which will be presented to you on Tuesday evening. Staff initiated the process for the development of the Skate Park several months ago. Initially, staff visited several cities with skate facilities to review their locations, methodology for equipment selection, and overall cost. Additionally, staff reviewed existing ordinances in each community to see what types of restrictions were being applied to areas outside of the designated skate facility. SKATE BOARD PARK AND SKATE ORDINANCE August 8, 2003 PAGE 2 "SIDEWALK" is that portion of the highway designated or ordinarily used for pedestrian travel. "ROADWAY" means that portion of the highway designed or ordinarily used for vehicular travel, excluding sidewalks. "PRIVATE PROPERTY" means property that belongs to an individual person, company, corporation or interest; any property that is not included within the public rights of way. A. OWASSO, OKLAHOMA, THAT: WHEREAS, through the creation of the "Skate Par'k" and the adoption of this ordinance, the Council hopes to reduce damage caused to property throughout the City of Owasso and encourage the use of the "Skate Parle" WHEREAS, the City Council has recently approved the expenditure of funds to create, design, and construct a "Skate Park" specifically for skateboards and the enjoyment of skateboard enthusiasts; and WHEREAS, the City Council has been advised of an increase of complaints generated from private business owners regarding damage to their property believed to be caused by skateboards and their users; and Al~ ORDINANCE Al'V1ENDING PART 15 "TRAFFIC AND VEHICLES" OF THE CODE OF ORDINANCES OF THE CITY OF OW ASSO, OKLAHOMA, CREATING CHAPTER 16 THEREOF PROVIDING FOR PROVISIONS PERTAINING TO SKATEBOARDS, SAID CHAPTER 16 PROVIDING FOR SKATEBOARD DEFINITIONS, RULES OF THE ROAD, PARENTAL RESPONSIBILITIES, COMPLIANCE WITH OTHER LAWS, VIOLATIONS AND PENALTIES. CITY OF OW ASSO, OKLAHOMA ORDINANCE NO. ### A. No person shall operate a skateboard on any roadway or public alley in the City of Owasso in violation of any traffic ordinance of the City of Owasso or the law of the State of Oklahoma. SECTION 15-1604 COMPLlAL"JCE WITH OTHER LAWS A. It shall be unlawful for every parent, guardian, or other adult person having the care and custody of any minor child under 18 years of age to knowingly permit such a minor child to violate any provision of this chapter, A violation of this chapter shall be punished by a fine of not more than $50.00. SECTION 15-1603 PARENTAL RESPONSIBILITIES G. No person shall ride a skateboard on any public roadway, sidewalks or alley, public parks, paths, public places, public property, private property with public access in the City of Owasso after dark. F. Skateboarding operators on sidewalks and roadways shall yield the right- of-way to all vehicles and all other pedestrian (non-skateboard) traffic upon the sidewalk and roadway. E. No person shall operate or ride a skateboard on any roadway where the volume or speed of the vehicular traffic or the width of the roadway renders the roadway unsafe or unsuitable for skateboarding. D. No person shalllide a skateboard on private propeliy whereon such act is expressly prohibited by the owner thereof In order for this act to be unlawful, the ptivate property owner must have first filed with the Chief of Police, upon such fOlms as are to be provided by the Chief of Police, a wtitten declaration that skateboarding upon such owner's ptivate propeliy is expressly prohibited, together with such other infOlmation reasonably peliaining thereto that the Chief of Police may require. C. No person shalllide a skateboard onto or from any bench, chair, flower box, retaining wall, stailway or other public accessory or stmcture not intended for pedestrian foot traffic, or intended only for pedestrian foot traffic. B. No person shall let a skateboard stand upon any sidewalk, park, path, roadway or any public place where it is an obstmction or hazard to pedestrians. A. No person shall ride a skateboard upon any sidewalk, park, school yard or any public place not designated for such purpose or on any roadway so as to obstruct pedestrian traffic or endanger another person's safety, or lide a skateboard on any highway, street or roadway in such a manner so as to impede the nOlmal flow of vehicular traffic. SECTION 15- 1602 RULES OF THE ROAD "VEHICLE" is every device, excluding skateboards, wagons, wheelchairs, unicycles, pushcmis, tticycles and other children's toys, in, upon or by which any person or propmiy is or may be transported or drawn upon a roadway or sidewalk. "SKATEBOARD" is a single platform mounted on wheels, which are propelled solely by human power and which has no mechanisms or other devise with which to steer or to control the movement or direction of the platfOlm.
