Attachment #7 ®p The staff recommends Council approval of a one year extension of a contract with gale Cleaners for uniform cleaning for the period July 1, 2003 through June 30, 2004. O. Action Relating to a Bequest for the City Council to Authorize the Notice, Equalization and Levy of Assessments Against properties in Tulsa County Sewer Improvement District #6. Attachment #7 -G The staff recommends that the Council authorize notice, equalization and levy of assessments against properties within the District (pleasant View Estates) sufficient to pay the interest and principal amounts due on the outstanding indebtedness represented by the District Bonds. 8. Owasso City Council May 20, 2003 Page 4 9, Consideration and Appropriate Action Relating to a bequest for Council Acceptance of a Donation from Wal-Mart foundation, and the Approval of a Supplemental Appropriation. Mr. Rooney Attachment #9 The staff will recognize Mr. Marty Cooper, Manager of the Owasso al -Mart, and will recommend City Council acceptance of the donation from the Wal -Mart foundation in the amount of $1500, and request approval of a supplemental appropriation increasing revenues by $1500 in the General fund and increasing expenditures in the Police Department and fire Department by $750 each. The staff will recommend City Council approval of Ordinance #754. 11. Consideration and Appropriate Action Relating to Resolution #2003 -07, a Resolution of the City Council Adopting a Stormwater System Service Charge. Owasso City Council May 20, 2003 Page 5 11 Consideration and Appropriate Action Relating to City Council Approval of an Agreement Between the City of Owasso and the YMCA of Greater Tulsa, Providing for the Lease of City-Owned Recreational Facilities Located at Rayola Park to the YMCA. Mr. It Attachment #12 The staff will recommend approval of a lease agreement between the City of Owasso and the YMCA of Greater Tulsa for the Rayola Recreation Center, outdoor swimming pool and appurtenant facilities listed in the agreement, for a term of ten years ending on May 31, 2013; and authorization for the Mayor to execute the document. 13. Consideration and Appropriate Action Relating to the Award of a Contract for Rayola Park Drainage Channel Improvements Mr. Warren Attachment # 13 Staff has completed the bidding process, reviewed the bids received, and will recommend a contract be awarded to Carter Excavating, Inc, Sand Springs, OK, in the amount of $36,906 for the Rayola Park Drainage Channel Improvements, consistent with bid specifications, and authorization for the mayor to execute the contract. 14. Consideration and Appropriate Action Relating to the Award of a Contract for FY 2002- 2003 Street Repairs. Ms. Stagg Attachment #14 Staff has completed the bidding process, reviewed the bids received, and will recommend a contract be awarded to Magnum Construction, Inc., Broken Arrow, OK in the amount of $85,100 for the FY 2002-2003 Street Repairs, consistent with bid specifications, and authorization for the mayor to execute the contract. Owasso City Council May 20, 2003 Page 6 15. Consideration and Appropriate Action Relating to the .Award of a Contract for a Pre -Cast Modular Fence System at Fairview Cemetery. Ms. Stagg Attachment #15 Staff has completed the bidding process, reviewed the bids received, and will recommend a contract be awarded to Pemier Crete products, L,L,C, Dallas, Tx, in the amount of $65,700 for the construction of a Sias -foot high concrete fencing system along the cemetery's east and north property lines, and authorization for the mayor to execute the contract. 16. Consideration and Appropriate Action Relating to a Request for Approval of an lnterlocal Agreement for Jail Services, Such Agreement Between the City of Owasso and the City of Collinsville. Chief Yancey Attachment #16 The staff will recommend City Council approval of an interlocal agreement between the City of Owasso and City of Collinsville for jail services, at a cost to Collinsville of $27.00 per day per prisoner, and authorization for the Mayor to execute the document. 17. Consideration and Appropriate Action Relating to a Request for Approval of Fees Charged for Providing Police Records. Mr. Wiles Attachment #23 The Owasso Planning Commission has conducted a hearing on this request and recommends Council approval of the final plat for The Home Depot, a 12.61 acre, one lot commercial subdivision, located on the west side of North 1291h East Avenue, south of East 96t" Street North. Final flat for Country Estates Vl, an Addition to the City of Owasso, Tulsa County, State of Oklahoma. Mr. Wiles Attachment #24 The Owasso Planning Commission has conducted a hearing on this request and recommends Council approval of the final plat for Country Estates VI, an 11.5 acre subdivision containing 37 residential lots, located on the west side of Forth Garnett Load, approximately one -half mile north of East 116'h Street North, The staff concurs with the recommendation. 25. Consideration and Appropriate Action Relating to a bequest for the Purchase of radios and .Associated Equipment for Expansion of the City's Two -Way Communication System. Mr. White .Attachment #25 The staff will recommend City Council authorization for the sole source purchase of necessary radios and associated equipment in an amount not to exceed $100,000 from the following vendors: Motorola, Total Radio of Tulsa, and Hutton Communications. 26. Consideration and Appropriate Action Relating to the Award of a Contract for the Purchase of Gasoline and Diesel Fuel and Related Services for City Vehicles. Mr. White Attachment #26 The staff will recommend Council approval of a contract with Fuelman of Oklahoma to provide gasoline and diesel fuel and related services through June 30, 2004, with a provision for renewal for successive one -year terms for a period of up to three years, at a bid margin of 8.5C per gallon over the Oil Price Index Service, and that the Mayor be authorized to execute the contract. Payment must be made at the time of closing, therefore it was necessary for the Council to take action to approve the payment. Funds have been budgeted to purchase additional radio equipment to accommodate all city departments, providing 800-megahertz capability. Also discussed was the fleet fuel management services contract. Mr. White and Ms. Boutwell were able to negotiate a contract with Fuelman of Oklahoma, the city's current provider, at a rate below that of the state bid, even though Fuelman has the state contract. This will allow the city to purchase fuel at the same rate that has been paid for the last four years. Both of these items will be placed on the May 201h City Council agenda for action. N Owasso City Council May 13, 2003 ITEM 6: DISCUSSION RELATING TO PLANNING ITEMS. Mr. Wiles briefly discussed the items that appeared on the Planning Commission agenda at their meeting on May 12th. All items, with the exception of one, were approved by the Planning Commission. One lot split was tabled to the June meeting. The rezonings, final plats, and INCOG agreement will be placed on the May 201h City Council agenda for action. ITEM 7e DISCUSSION RELATING TO DRAINAGE CHANNEL BID. Mr. Warren said that five bids were received to provide improvements to the Rayola Paris drainage channel. Because the bids were lower than expected, in addition to the base bid, an alternate is being recommended that will allow for a sodded bottom of the draina echanneland seeding /mulching of all sloped areas. Council/Manager Issues Item A was discussed under the Police Department items. Mr. Ray gave a brief review of the status of the budget preparation. The budget must be presented to the Council, a public hearing held, and the budget adopted at least seven days prior to the end of June. The Capital Improvements Committee report was also discussed. May 14, 2003 At the December 17"' regular meeting, the Owasso City Council unanimously adopted an ordinance approving a request for the annexation of property totaling 15.03 acres, more or less. The subject properties are generally located within the E. 116t" St. N. right-of-way and along the south side of E. 116t" Street N., approximately 1700 feet cast of the E. 116"' Street N. and N. Garnett Road intersection. The ordinance as approved contained a minor scrivener's error in the legal description. I F- %I M-Z, X3 In 1995, homeowners in the Pleasant View Estates Addition approached staff concerning the ability to connect to City sewers in order to alleviate septic system problems in their subdivision. The addition is outside the current City limits, but collection lines were designed in conformance with established city criteria. The homeowners elected to form a Sewer Improvement District (Tulsa County Sewer Improvement District No. 6) and issue bonds to finance construction. On February 18, 1997, Council agreed to accept, operate and maintain the system contingent upon the vote of the District. In March 1997, the District held an election to consider the transfer and conveyance of the Sewer system to the city. The District agreed to the consolidation. The "Agreement for Consolidation of Sewer Improvement District with City of Owasso and for Connection of Sanitary Sewer Systems to Existing Excess Capacity Sanitary Sewer System" was approved by Council on April 21, 1998. That agreement provided that the City would: 1. Accept the sewer system and consolidate the District with the City, and 2. Collect a reimbursement from properties subsequently connected to the system that utilize excess capacity. Reimbursements to be in the amount of $1,338.58 per acre and be applied solely to amortization and satisfaction of the bonded indebtedness. 3. Give notice, equalization and levy of assessments for satisfaction of bonded indebtedness. On August 6, 1998, the District transferred all assets of the District, to the City of Owasso. The amount received from the District paid the first payments of bonds and interest, which were due November 1, 1998. Each year, the City Council authorizes the assessment of the consolidated Sewer District for each property owner. The last assessment paid the bonds and interest due on May 1, 2003 and will pay for the interest payment on November 1, 2003. In order to assure the continued flow of money from the District to pay for the interest and principal of the bonds, it is necessary to assess the homeowners on an annual basis. In 2004, the amount of principal and interest due is $5,000 and $2,520, respectively. In addition, 10% may be collected to set aside as a reserve for any nonpayment of assessments. This year, each homeowner assessment will be a total of $683.64, which includes $454.55 for principal, and $229.09 for interest. No reserve assessment is needed at this time. This amount must be assessed now to receive payment in early 2004. upon acceptance, staff will mail notifications to homeowners in :Pleasant View Estates concerning assessment and also to the Tulsa County Treasurer for actual assessment. TO: THE HONORABLE MAYOR & CITY COUNCIL CITY OF OWASSO FROM- RODNEY Jo RAY CITY MANAGER SUBJECT: CLAYTON McMARTIN DRAINAGE ISSUES DATE- May 15, 2003 Mr. Clayton McMartin, a resident of the Windsor Lake subdivision, has requested an opportunity to address the City Council regarding a concern relating to stormwater drainage in his subdivision, and specifically a concern relating to a drainage issue on his property. Mr. McMartin has met with various city officials over the past three years (see his email attached) in an attempt to resolve his concerns. I have, in fact, met with Mr. McMartin on three occasions and did direct the Public Works Department to develop a design solution to what was considered to be his major concern. Unfortunately, the estimated cost of the solution was significantly greater than originally expected and, on July 30, 2002, Mr. McMartin was notified that the contractor's estimate for the solution "far exceeded the ability of city funding," and that "we would have to budget funding in the future." Since that time (July 2002), I have not spoken to Mr. McMartin other than once. At last review, the cost of providing a partial solution to the concern is $13,660 and would include extending drainage pipe, constructing a "drop inlet box," and installing an additional discharge line from the junction box to an existing drainage inlet (see attached plans). All of that work would be conducted in an area that has been "filled" by homeowners, thus resulting in the problem. Additionally, Mr. McMartin, in his email, asserts a new claim that wastewater has "leaked" onto his property. While unlikely that such occurrence has taken place, the city staff responded on Monday and Tuesday (May 12 & 13) to collect samples of the area to determine if a wastewater overflow or seepage has occurred. Test results should be returned by Tuesday, May 20 ". Mr. McMartin also states that the city was cited in June 2001 for an environmental hazard due to the drainage concern he has. The staff discussions with the Tulsa City - County Health Department indicates they have no record of such a citation. A check with the staff confirms that no citation was issued to the city. McMartin Drainage Issues May 15, 2003 Rage 2 Finally, Mr. McMartin has stated that the city has an "illegal" drainage structure on his property because the city does not hold a "drainage easement" for his property. The attached information indicates that in August of 2001 the City attorney notified Mr. McMartin that a drainage structure (pipe) is not an illegal use of a utility easement (it should be noted that Oklahoma courts have defined drainage as a utility). The above comments are not meant to be argumentative, but to inform the City Council of the staff perspective of this issue. Certainly the staff is ready and willing to respond to any direction given to the City Manager by the City Council in response to Mr. McMartin's concerns. Raw sewage from a manhole located at 9206 N 135th East Ave is leaking onto my property. 2. Storm water from 134th street, North of my property, and the adjoining 93rd street is gathered and discharged openly into my back yard. 3. Storm water from the new church located just North of 96th street is gathered in a retaining pond and subsequently routed across my back yard from North to South. Related to item #1, the services of a licensed surveyor and professional engineer were secured to evaluate each issue described in this letter. Upon investigation, Civil Design Services advised that there is high likelihood that raw sewage is leaking from the manhole encasement and/or from the joint seals of the sewage lines. Due to the city's lack of response on prior issues (described below), I have requested that Mr. Warren Straatmann of Civil Design Services contact the city water department directly on my behalf concerning this item. The health, safety, and environmental implications demand an immediate response; which I hope it will receive from the City of Owasso. If necessary, I will contact agencies having proper authority to expedite a solution. Related to item #2, the city has no drainage easement on my property. Furthermore the city of Owasso was cited in June of 2001 by the Tulsa County Health Department for an environmental health hazard caused by stagnated water resulting from this illegal drainage. Related to item #3, the city has no drainage easement on my property, yet drainage easement does exist, on average, within 15 feet of the current drainage. Additionally, the proper city authorities were notified of this concern well in advance of actual construction beginning at the church. The added runoff has increased the ground water volume, resulting in water now percolating up on my property on a continuous basis (this may also be related to item #1). It is regrettable that I must bring these issues to the attention of the Mayor and City Councilors, yet I have limited options available at this point. I have attempted to work with multiple city employees, with no results. Over the course of the last three (3) years I have worked, in good faith, to resolve these problems with Robert Carr, Ron Cates, Gerald Hoffman, Phil Lutz, Larry Mitchell, and most recently Rodney Ray. In the case of the current City Manager, Rodney Ray, I have documented thirty-seven (37) attempts to communicate with him, over the past 13 months. All toll, I have documented over eighty (80) attempts to communicate with the entire list of city officials. Mr. Ray, after visiting my property and acknowledging the problem, committed to me on April. 19, 2002 that he would have a plan to solve the 0 problem by the following Friday, and that the solution would be in place within 60 days. Over 375 days have passed since that time, and Mr. Ray has refused to return any phone calls or e -mails that I have sent since August of 2002. The lack of professional conduct in this matter is disappointing. Attached to this e --mail is a sequence of e- mails, last sent to me by Mr. Ray on July 1, 2002. As you will see documented, Mr. Ray makes a commitment to solving issue 42 right away, and addressing issue U. Nothing has happened since this time. I would like to address the City of Owasso Council members directly on these matters, and would request that the issue be added as an agenda item to the next Council meeting. I understand that the Council provides direction to the City Manager, and strives to promote a positive and productive work relationship with the City Manager. Please recognize that the City Manager is employed through the taxes of the citizens and has certain responsibilities to the citizens. I appeal to you to give my case a fair_ hearing. You have my assurance that I will.. be presenting the matter at the most professional level possible. Drainage from the street (134th East Ave) that discharges openly along the South edge of property. My understanding is that your plans are to join the existing concrete drainage line with full diameter pipe to be routed East across my property into the existing drainage easement located within the Nottingham subdivision. The line will then be routed South and terminate at the existing junction box located approximately 200 feet South. Additionally, the plans call for a surface drain to be located at the low point along the South end in my yard. During the course of this work it is recognized that at least one tree, and possibly two, will need to be removed in order to accommodate the new line. Efforts will be made to minimize the amount of damage and removal of trees. 2. Increased drainage resulting from the construction of the church and parking lot just North of 96th Street: My understanding is that the city's position is that the benefits of an enclosed drainage system, starting at the newly constructed retaining pond, do not justify the expense at this time. It is understood that additional water will flow across my property as a result of this construction, yet the magnitude and impact can not be sufficiently determined at this point in time to justify the expenditures that would be required to maintain or possibly improve the current drainage. 'The city plans to monitor the development and appropriate money in the future should the issue become more significant. In response to the city's position on drainage issue #2, 1 would like to offer the following. Considering a 3-inch rain and the fact that water from the church and parking lot will not be allowed to saturate into the earth, assuming an area of 20 acres, my calculations indicate that 1,600,000 additional gallons of water will flow across my property as a direct result of this new construction. Although paving has yet to be completed at the church property, I have already seen a significant increase in water run-off, directly related to the church construction. This increase in amount of water along with the entrained dirt from the construction has rendered my existing 4-inch drainage system useless for this new load. I hope you can understand why I do not agree with the "Cost/Benefit" analysis and justification. However, I can appreciate the fact that the city's budget may not be able to justify starting this phase of the work right away. As I indicated while we were discussing the situation yesterday, I would like to see an interim solution to issue #2. That being the installation of a 12-inch perforated line and french drain system starting at the North edge of my property. This system would augment the existing drainage line that the homeowners within Windsor Lake have already installed. The majority, all but approximately 20 feet, of the new 12-inch line can be run in existing Utility Easement (17.5 feet located on the East 3 edge of my property). Additional easement could be granted, or possibly the final 20 feet could be financed by myself - "piggybacking" with the construction contractor that the city will use. This compromise solves the immediate issue of additional drainage across by property. It is much less costly than a complete system installed starting at the source of the new water. It can be accomplished in conjunction with the existing work for Item #l. The city has money in the budget to address the issue now. And it provides for additional time to fully access the impact of the final church construction. Please review this memo and let me know if I have misunderstood you in anyway. Please also give serious consideration to the proposal for an - interim solution. As for timing. I am anxious to get the project underway, as I am sure you are also, Since it is now starting to dry out, this is the right time of the year to take on the work, as it will result in minimal damage to the property and allow your crews to make the most use of their time and city dollars. Either the current or former owner of the subject property has installed a subsurface drainage pipe which extends southeast across the neighboring lot and into the drainage channel still open to the south. This system is not Sufficient to evacuate the seepage and resulting pool and swampy area at the pipe outlet. The seepage keeps the pool at the end of the pipe full and the southeast comer of the lot saturated. The pipe outlet was located at the existing channel bank with discharges allowed to flow downstream to the storm inlet box. Currently, the discharges cannot flow because the channel has been filled both on your property and on Lot #8 to the south). This condition is in violation of City of Owasso Code of Ordinances, Section 10-214. The ordinance states, in part, that: It is unlawful for any person to fill up, deflect, or obstruct any gutter, waterway, water outlet, drain, stream, ditch, sewer or other water passage, either natural or artificial, by throwing or causing to be thrown therein any trash, rubbish, garbage, brush or other thing. The City Attorney's opinion is that the existence of the storm drain pipe within the designated utility easement constitutes no greater burden on the property owner than that of any other utilities. The true cause of the problem relates to the filling of the natural channel. Therefore, the fill placed in the channel needs to be removed by the party responsible for placing the fill to allow free discharge of storm flows and any related scepagc to the downstream storm inlet. An Annual Deport is to be submitted to the ODEQ that documents implementation and MP effectiveness under each of the six MCMs. A Stormwater Management Program is proposed to be established by ordinance (see Attachment 3 --- Proposed Ordinance 754). The ordinance includes creation of a stormwater management fund and stormwater system service charge. As defined in the ordinance, the stormwater management fund is a special fund to be maintained for the purpose of identifying and controlling all revenues and expenses attributable to stormwater management services. All loans, grants or funds received for the administration, operation, construction and improvement of stormwater management services are to be deposited in the fund. Disbursements for costs of data collection, planning, maintaining, operating and improving drainage services and /or facilities are proposed to be made from the fund. The proposed ordinance also includes establishment of a Stormwater System Service Charge. As defined in the ordinance, the service charge is based on the amount of impervious area on individual parcels of land. Typically, impervious areas cause water to run off the surface in greater quantities or at an increased rate of flow than was present under natural conditions, thus creating potential impacts of stormwater. Types of areas include, but are not limited to, rooftops, Page 3 Stormwater Management asphalt or concrete sidewalks, paving, driveways and parking lots, walkways, patio areas and storage areas. Amounts of impervious area are expected to vary considerably between properties. Therefore, charges should generally be expected to vary from one parcel to the next. To a large degree, smaller parcels, such as residential property, could be expected to contribute considerably less i uno ff than a shopping center. To calculate monthly service charges an average residential property is defined in the ordinance as a base "Equivalent Service Unit (ESU)". Each ESU has been assigned a value of 3,000 square feet of impervious area. A typical residential parcel would have one (1) ESU. On the other hand, depending on the impervious area identified for a shopping center, there could be multiple ESUs associated with this type of use. A Resolution adopting the rate to be charged is attached (see Attachment 4 — Resolution 2003 07). In order to provide flexibility in modification of the rate without necessitating change(s) to the ordinance, the charge is established by resolution. The proposed charge will be included for the first time in the FY03-04 budget as a means to fund the work elements needed for compliance with Phase 11 Stormwater program requirements. The service charge will be included on water or sewer utility bills for all customers inside the city limits. The manner to collect the charge will be similar to that used to collect the ambulance fee. Rural water customers inside the city limits will be included. A total of $205,000 is proposed for stormwater management in the FY0304 budget, including INCOG services, data collection and conducting stormwater master planning. Beyond the FY03- 04 budget year,, however, additional Phase 11 Best Management Practices and stormwater system improvements identified in the master plan capital improvements program will be needed on an on-going basis. Page 4 Stormwater Management The stormwater system service charge established in Resolution 2003 -07 is $2.50 per month per Equivalent Service Unit. As data are collected, adjustment /refinement of this charge is expected. Each developed land parcel will be categorized and individually evaluated to calculate the amount of impervious area on the parcel and the total of ESTJs appropriate to each property will be determined, All applicable impervious area data for each individual City of Owasso stormwater customer are not presently available. "Impervious surface" shall mean any hard surfaced area which prevents or retards the entry of water into the soil in the manner and to the extent that such water entered the soil under natural conditions, causing water to run off the surface in greater quantities or at an increased rate of flow than was present under natural conditions, such as but not limited to rooftops, asphalt or concrete sidewalks, paving, driveways and parking lots, walkways, patio areas, storage areas, and gravel, oiled macadam or other surfaces which similarly affect the natural infiltration or ran-off patterns of real property in its natural state. 7. "Drainage Basin Plan" shall mean the plan adopted by the City for managing surface and stormwater facilities and features within an individual drainage basin. 8. "Service charge" shall mean the fee levied within the boundaries of the City for the use of the City of Owasso stormwater drainage facilities. 9. "Undeveloped real estate" shall mean real estate unaltered by the construction or addition of any impervious surface which would change the hydrology of the property from its natural state. 10. "Retention facilities" shall mean facilities designed to hold stormwater for a sufficient length of time to provide for it to be consumed by evaporation, infiltration into the soil or other natural means. 11. "Residential property" shall mean any property designed and used principally for residential single-family or duplex purposes and developed according to and meeting the bulk and area requirements for residential single-family or duplex zoned property as set forth in the Owasso Zoning Code at the time of development of such property. CHAPTER 2 STORMWATER MANAGEMENT PROGRAM SECTION 18201 FINDINGS OF FACT The City of Owasso, Oklahoma makes the following findings of fact: 1. In 1990 the U.S. Environmental Protection Agency (EPA) promulgated regulations for establishing water quality based municipal stormwater programs to address stormwater runoff from municipal separate storm sewer systems (MS4s); 2. These regulations were incorporated into existing wastewater treatment permits under National Pollutant Discharge Elimination System (NPDES) rules. Urban runoff from storm events became regulated under the NPDES permitting requirements. 3. On December 8, 1999, EPA published final "Phase 11" regulations and state regulatory agencies (which includes the Oklahoma Department of Environmental Quality (ODEQ)) were required to determine cities under 100,000 population and designate small MS4s that require permitting. The small MS4s are defined as those towns with at least 10,000 population and a minimum density of 1,000 people per square mile. 4. The City of Owasso has been notified that the city meets the conditions to be designated as a regulated small MS4. 5. Both the EPA and Oklahoma regulations require that the six Minimum Control Measures (MCMs) be addressed in implementing a successful Phase Il Stormwater Management Program. Each Minimum Control Measure has a number of Best Management Practices (BMPs) that constitute the core activities pertaining to each. 6. A Stormwater Management Program document (SWMP) specifies for each MCM what activities will be performed, measurable goals, implementation schedules and estimated annual costs. 7. A comprehensive approach to managing stormwater runoff and floodplain management is required to address existing and future needs. 9. The existing stormwater drainage facilities of the City of Owasso require continuous operation, maintenance, renewal and replacement. 10. Drainage conditions may be created by the cumulative effect of increase in impervious areas due to subdivision, commercial and institutional construction. 11. While the City does not own all drainage facilities within its jurisdiction, it does own or control a sufficiently comprehensive system in each of the major drainage basins so as to make a unified approach to stormwater drainage issues a desirable and administratively achievable goal. Ordinance #754 Stormwater Management Page 2 SECTION 18-202 PURPOSE It is the purpose of this ordinance is to improve the promotion of public health, safety and welfare by providing for, acquiring, constructing, operating, equipping and maintaining within the City of Owasso a Stormwater Management Program and to provide a source of funding for the program. The Stormwater Management Program is intended to: 1. Protect human life, health, and property; 2. Minimize public and private storm and flood losses from stormwater runoff in the City; 3. Provide for development of a Stormwater Master Plan which will define the existing and future drainage system, identify drainage facilities improvements and project long -range capital improvements requirements; 4. Comply with the Phase lI Stormwater Management regulations of the U.S. Environmental Protection Agency /Oklahoma Department of Environmental Quality and the National Pollutant Discharge Elimination System; CHAPTER 3 STORMWATER SYSTEM SERVICE CHARGE SECTION 18.301 INTRODUCTIONS AND EXEMPTIONS There is hereby established a Service Charge for the use of the City of Owasso Stormwater System at rates hereinafter established; provided, however, that the Stormwater System Service Charge shall not be imposed on the following types of property: 1. City -owned highways, streets, rights -of- -way, parks and open space, and leased uses on city -owned properties; 2. Privately -owned residential streets and rights -of -way, other than driveways; parks and open space; 3. Public schools; 4. Railroad rights -of -way; 5. Undeveloped parcels of agricultural use consisting of five (5) or more acres and containing no habitable structures. SECTION 18 -302 RATE STRUCTURE The monthly Stormwater System Service Charge for all tracts with impervious area is determined as follows: 1. Single family, residentially used property within the corporate limits of the City is hereby assigned one Equivalent Service Unit for each developed lot, tract, or parcel of record with the County Clerk. For purposes of this section, agricultural property which includes a single habitable structure shall be considered residential property, and agricultural property which includes more than one habitable structure shall be assigned one Equivalent Service Unit for each structure. Provided further, in case of duplex through quadplex developments with two (2) or more dwelling units on the same lot, tract or parcel, one Equivalent Service Unit shall be applied to each dwelling unit. 2. The impervious surface of all other lots, tracts, or parcels of developed real estate within the corporate limits of the City shall be measured to determine the Equivalent Service Units to be assigned to such lots, tracts or parcels. The developer shall calculate and report the proposed impervious area to the Director for each new development. The current Stormwater System Service Charge will be applied to each Equivalent Service Unit or portion thereof. 3. The rates established herein shall become effective on July 1, 2003 for all areas within the City on that date. For areas annexed thereafter, the rates shall become operative within thirty (30) days following annexation by the City Council. Ordinance #754 Stormwater Management page 3 SECTION 18 -303 ADJUSTMENT OF SERVICE CHARGE If any person considers the Stormwater System Service Charges to be inaccurate or erroneous, the owner of the parcel may request a review of the charges by the Director within thirty (30) days of the bill or statement in question. The Director shall respond to the request within fifteen (15) days. The property owner shall have ten (10) days to challenge the decision of the Director to the City Manager. All requests must be in written form and no notice of review shall delay payment by the due date. The Director or the City Manager may adjust a Stormwater System Service Charge and this action shall be accounted for on the next billing cycle. SECTION 18.304 COLLECTION 1. The Service Charges herein established for use of the City of Owasso Stormwater System shall be billed to each user monthly, along with any bill for water, sanitary sewer, solid waste collection, or other utility services provided by the City, and such penalties as are now or may hereafter be established for the City of Owasso utility service bills. All collecting agencies authorized by the City to accept payment of any City utility bills are hereby directed to advise customers of the provisions of this section. 2. In the event that any utility account shall become delinquent, water services or any other City utility service may be terminated until all delinquent charges shall have been paid in fall. The provisions for collection provided herein shall be cumulative to any rights or remedies, which the City may have under the laws of the State of Oklahoma. 3. In the case of users of real estate who are not billed for water, sanitary sewer or collection of solid waste by the City, the owner of the real estate or agent of the owner shall be billed monthly for the Stormwater System Service Charges herein established. 4. The City may enter into contracts with other public, quasi - public or private utility companies for the cooperative collection of any or all of the City of Owasso Service Charges. 5. All of the proceeds of this Stormwater System Service Charge are deemed to be in payment for use of, and in receipt of benefits from, the City Stormwater Management Program by the real property on, and with respect to which, the charge is imposed to the owners. j SECTION 18 -401 FUNDS A special fund or funds shall be maintained for the purpose of identifying and controlling all revenues and expenses attributable to stormwater management services. All loans, grants or funds received for the administration, operation, construction and improvement of Stormwater management services shall be deposited in such fund or funds. Disbursements for costs of data collection, planning, maintaining, operating and improving drainage services and/or facilities shall be made from the appropriate fund or funds. CHAPTER 5 STORMWATER FEE SCHEDULE SECTION 18501 FEE SCHEDULE Consistent with the requirements defined herein, the monthly stormwater system service charge may be established by the City Council of the City of Owasso by separate resolution for each Equivalent Service Unit assigned to a lot, tract, or parcel of real estate. The lease period was ten years and included the initial investment of a minimum $ 250,000 into the center by the YMCA. The decision to approve the YMCA lease followed a "Request for Proposals" and an evaluation of the proposals received, Over the last several months, staff has been meeting with YMCA officials in order to renew their lease of the facility. The YMCA approached the City about renewing the lease earlier than needed as they are desirous of making some additional improvements to the facility and the parking lot, but did not want to do so until the lease renewal could be finalized. Fks it turns out there are minor changes in the proposed lease agreement. The changes include ,�s,ates, minor notification requirements, the removal of the minimum investment requirement of $ 250,000 that was contained in the first lease agreement, and a reduction in the amount of liability insurance. LESSEE shall hold harmless LESSOR, LESSEE agreeing to indemnify LESSOR fi-orn and against any and all claims, cost, damage and expense, including any LESSOR incurred attorney fees and costs of alternative dispute resolution, and attorney fees and costs or loss incurred or suffered by the LESSOR arising out of LESSEE's Recreational Facility capital improvements, excluding attorney fees and costs incurred in any dispute between LESSEE and LESSOR. If, upon the expiration of the term hereof, and for a period of five (5) years thereafter, LESSOR sells such Recreational Facility herein demised, then, in such event, LESSOR shall pay LESSEE, solely from the proceeds of such sale, an amount of money for the Recreational Facility value enhancement resulting from the Recreational Facility capital improvement by LESSEE; provided, however, such value enhancement repayment from proceeds shall equal the value of enhancement from the date of capital improvement completion as depreciated on a straight line basis over the term of years from date of completion until the date of sale. For the purposes of this Lease, depreciable life of said capital improvement shall be fifteen (15) years. 1 Notwithstanding any other provision hereof to the contrary, either party hereto may terminate this Lease at any time upon one hundred eighty (1 80) days' written notice to the other party. If LESSEE so terminates, it shall forfeit all its right, title and interest to said capital improvements to LESSOR. If LESSOR so terminates, the parties hereto shall seek to negotiate a mutually satisfactory settlement. In the event the parties cannot agree, determination of LESSEE's damages shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The location for any such arbitration shall be in Tulsa, Oklahoma, 3. LESSOR shall not allow the Recreational Facility to be used in any manner which shall unreasonably interfere with LESSEE's occupancy and/or programs, nor which shall, in any way, cause any damage to the Recreational Facility or the LESSEE's equipment located thereon. 4. LESSEE has examined and knows the condition of the Recreational Facility and has received the same in its present condition. LESSEE shall keep the Recreational Facility in a clean, safe, and healthy condition, in accordance with the ordinances of the City of Owasso, Oklahoma, and applicable safety and recreational standards as agreed to between LESSOR and LESSEE. 5. LESSEE will use and occupy the Recreational Facility and appurtenances in a careful, safe, and proper manner, in accordance with the ordinances of the City of Owasso, Oklahoma; and LESSEE will not allow the Recreational Facility to be used for any purpose in any way that will increase the rate of insurance thereto, not for any purpose other than that hereinbefore specified, not to be occupied in whole or in part by any other persons; and will not bring nor suffer to be brought into or upon the Recreational Facility any substance or force that will increase the hazard of fire in or on the Recreational Facility, and will not permit liquor to be sold at wholesale or retail, or consumed on the Recreational Facility; will not sublet the Recreational Facility or any part thereof, not assign this Lease, without in each case, the written consent of the LESSOR first obtained; and will not pem-tit any transfer by operation of law of LESSEE's interest in the Recreational Facility. LESSEE shall not use the Recreational Facility for any unlawful purpose or in any way that will injure the reputation of the same or disturb the neighborhood; and will not permit any substantial alteration of or upon any part of the Recreational Facility, with the exception of the Recreational Facility capital RECREATION FACILITY LEASE AGREEMENT 2 improvements, nor allow any sign or placard posed or placed thereon, except by written consent of LESSOR unless otherwise provided in said written consent. 7. LESSEE shall have the following duties with reference to the Recreational Facility: a) To keep the Recreational Facility clean, as stated herein; b) To dispose from the Recreational Facility all rubbish, garbage and other waste, in a clean and sanitary manner; C) To properly use, operate and maintain the facilities hereby demised, including, but not limited to, all exterior and interior portions of the recreation facilities, all electrical, gas, plumbing, heating and cooling equipment therein, as well as that portion of the parking lot which is part of the Recreational Facility; d) To maintain the grounds of the Recreational Facility in a clean, safe and sanitary condition, including all mowing of the grass and maintenance of the demised athletic fields thereof, and C) To assume and be solely responsible for the planning, development, safety, supervision and other program aspects of LESSEE's recreational programs. 8. LESSEE will deliver up and surrender to the LESSOR possession of the Recreational Facility hereby leased upon the expiration of this Lease or its termination in any way in as good condition and repair as the same shall be at the commencement of said term (loss by fire and ordinary wear and decay only excepted) and deliver the keys at the office of the LESSOR or LESSOR's agent. 9. LESSOR may have free access to the Recreational Facility at all reasonable times for the purpose of examining the same. 10. LESSEE's use of the Recreational Facility, as well as its programs instituted and administered thereon, shall at all times be done with the objective of enlarging and expanding upon recreational opportunities for all members of the YMCA and the citizens of Owasso, Oklahoma. Further, LESSEE's use of the Recreational Facility, as well as its programs instituted and administered thereon, shall not discriminate against any person or persons on the basis of race, creed, sex, national origin, disability status, or religious belief, RECREATION FACILITY LEASE AGRE EMENT 3 11 LESSOR shall not be liable for any damage occasioned by or from plumbing, gas, water, steam, or other pipes, or sewage, or bursting, leaking or running of any cistern, tank, washstand or waste pipe in, above, upon or about said building or premises, nor for damage occasioned by water, snow or ice, nor for any damage arising from acts or negligence of LESSEE, its agents, licenses, employees, invitees or guests. 15. The LESSOR hereby covenants and agrees that if the LESSEE shall perform all the covenants and agreements herein stipulated to be performed on LESSEE's part, the LESSEE shall at all times during said term have the peaceable and quiet enjoyment and possession of the Recreational Facility without any manner of let or hindrance from LESSOR or any person or persons lawfully claiming said premises. 16. LESSEE shall hold the City of Owasso, Oklahoma, its officers, agents, employees, and independent contractors harmless and fully indemnify said City of and from any and all claims of neglect, negligence, liability for personal injury or property damage occurring during the terms of this Lease, except as the same may arise from the negligence of LESSOR or LESSOR's agents or employees. Included in that project list was funding to provide improvements to the Rayola Park Drainage Channel, A total of $100,000 was budgeted for this improvement. All bids were to be received by April 18, 2003 at 2:00 PM and due to the nature of the project, a mandatory pre-bid meeting was also required. A total of eight bid packets were picked up from the City Clerk's office and five companies submitted bids. A copy of the bid tally sheet is attached. A review of the bids submitted indicates than one company did not submit complete bid documents and that Carter Excavating of Sand Springs is the qualifying low bidder. Although not previously awarded a contract with the City of Owasso for any type of improvement of this nature, a review of the references of Carter Excavating were positive, with work being completed recently in Broken Arrow and Tulsa. Due to the significantly low bid figures, staff would also like to include Alternate #2 in the project. This will allow for a sodded bottom of the drainage channel, 'as well as the seeding/mulching of all sloped areas. This will provide for a more polished finish at the time of completion of Phase I of the improvements. Phase 11 of the improvements will include additional plantings and channel aesthetics. Funds for the drainage channel improvements were included within the Capital Projects Department budget in the amount of $100,000. Three bids were received (see Attachment 17) with bid totals (base bid and additive) as follows; Apparent Low JLT Corporation $ 67,064.70 Second Low Magnum Construction, Inc. $ 85,100.00 High Horizon Construction, Inc. $ 132,365.05 Engineer's Estimate $ 85,950.00 The large difference between the JLT Corporation total bid compared to the second low bid and Engineer's Estimate raises a concern as to JLT's ability to complete the work to bid specifications. Although JLT was the contractor for the FYOI -02 Street Repair contract, we had much difficulty in completing some repair sites to the satisfaction of the city. Under Oklahoma State law, award of a construction contract does not require award to the lowest bidder but to the "lowest responsible bidder ". It is for the reasons stated above that staff do not consider JLT as the lowest responsible bidder and recommends award to the second low bidder (Magnum Construction, Inc.) in the amount of $85,100.00. Magnum has successfully completed work for the city on previous street repair contracts. The FY02 -03 Capital Improvement Fund Budget included $ 1 15,000 for street improvements. Of this amount, $23,396.50 has been expended by city crews for some of the smaller high priority repairs leaving a total of $91,603.50 remaining for contract work. INTER-LOCAL AGREEMENT FOR JAIL, SERVICES DATE: May 20, 2003 In December 2001 the City of Collinsville city hall was destroyed due to a structure fire, which also contained the fire and police operations. At the time, the police department was operating a 24 hour holding jail, by Oklahoma jail standards. As a result of the loss of the jail the Collinsville police Department has been unable to effectively process and hold prisoners on Collinsville municipal charges for lack of jail space. In March 2003 the City of Collinsville approached the City of Owasso about providing temporary jail space in the event their police officers arrested someone on municipal misdemeanor charges. The City of Owasso being receptive to helping a neighboring city, began the process of examining legal and procedural requirements, compensation and proper documents for the Inter-local agreement. Title 74 of the Oklahoma Statute, Chapter 31 -1001 is a statue that provides municipalities with the authority to enter into inter -local agreements. The purpose of Section 1001 is to permit local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population and other factors influencing the needs and development of local communities. The cooperating governmental units can, if they deem it necessary, create an entity to carry out the cooperative functions. Prior to its entry into force, an agreement made pursuant to the act shall be filed with the county clerk and with the Secretary of State. In the event that an agreement entered into pursuant to this act is between or among one or more public agencies of this state and one or more public agencies of another state or of the United States, said agreement shall have the status of an interstate compact, but in any case or controversy involving performance or interpretation thereof or liability thereunder, the public agencies party thereto shall be real parties in interest and the state may maintain an action to recoup or otherwise make itself whole for any damages or liability which it may incur by reason of being joined as a party therein. Such action shall be maintainable against any public agency or agencies whose default, failure of performance, or other conduct caused or contributed to the incurring of damage or liability by the state. Collinsville understands that Owasso will accept prisoners on a nonexclusive basis under this ARreement. The acceptance of prisoners is subject to space being available, Owasso reserves the right to reserve space in the jail for its anticipated prisoner needs and may require the removal of Collinsville prisoners to accommodate Owasso prisoners. Collinsville must notify Owasso via facsimile immediately of any prisoner who has posted the bond. COMPENSATION: Collinsville shall pay Owasso at a rate per prisoner on a 24-hour basis set out in Schedule "A" ($27 per day) attached hereto. Said rates shall be adjusted from time to time by mutual agreement in advance of the renewal of any term of this agreement as provided. All respective parties involved including; both Chiefs of Police, City Managers, City Attorneys from both Collinsville and Owasso have reviewed said agreement and recommend approval. If approved by the council, the agreement will be sent to the State Attorney General's Office for review. If approved through the A.G.'s Office, the agreement will be filed with the Secretary of State and Tulsa County Clerk's Office. It is the staffs recommendation that council approval be given to the Interlocal Agreement for jail services between the City of Owasso and City of Collinsville. 1. Interlocal Agreement with attachments. INTERLOCAL AGREEMENT FOR JAIL SERVICES THIS INTERLOCAL AGREEMENT' FOR JAIL SERVICES (hereinafter "Agreement") is made and entered into by and between the CITY OF OWASSO, OKLAHOMA, (hereinafter "Owasso"), and the CITY OF COLLINSVILLE, OKLAROMA (hereinafter "Collinsville") WHEREAS, Title 74 O.S. 2001 1001 et seq. authorize cities to enter into interlocal agreements for jail services that specify the responsibilities of each party; MM-1 WHEREAS, Owasso has a jail facility and Collinsville desires to enter into this agreement to utilize Owasso's jail facility and the terms and conditions of this agreement; NOW, THEREFORE, in consideration of the mutual covenants, conditions and promises contained herein, Owasso and Collinsville mutually agree as follows: 1. DEFINITIONS. Unless the context clearly shows another usage is intended, the following terms shall have the following meanings in this agreement: b. Collinsville prisoner means a person arrested by the Collinsville Police and held and confined in the Owasso Jail (either pre- or post-trial) pursuant to a violation of a Collinsville ordinance or a violation of state law which designated the crime for Owasso,Cityof/Intei-localAgreemetit.doc 1 JAIL AND HEALTH SERVICES b. If Collinsville prisoners are to displaced and must be removed from the jail, Owasso agrees to provide Collinsville with notice in writing for, or teletype that the Collinsville prisoner must be removed. b. Prisoners may not be incarcerated in the Owasso jail longer than ten (10) days or contrary to any federal or state statutes or regulations or constitutional requirements for the Owasso Jail. Should an inmate serve his/her 10-day sentence in the Owasso Jail and still have additional days of jail time, Collinsville will transport their inmates to another facility. Should transportation be required for Collinsville inmates to appear in Municipal Courts, transportation will be the responsibility of Collinsville. C. Collinsville agrees that if any Collinsville prisoner is deemed out of control or dangerous by the personnel at the Owasso Jail, on four (4) hours' notice from Owasso to Collinsville, Collinsville shall make arrangements to remove and transport to Owasso, Cityo f/1 n ted ocal Ageement. doe 2 Acceptable reasons for the Owasso Intake Officer to refuse a prisoner include: The Owasso Intake Officer will inform the Collinsville personnel that they must get a medical and/or mental health release for the prisoner from a licensed physician before the individual will be accepted into the jail. e. If the prisoner is released by a licensed physician, the individual committing the prisoner must submit the following documents to the intake officer prior to processing of the prisoner: i A medical or mental health release signed by physician, and ii Any discharge "instruction sheet", and iii) Any prescriptions ordered by the physician. Collinsville shall be responsible for all costs for the transport of its prisoners. a. Payment shall be made promptly by Collinsville to Owasso within thirty (30) days after a monthly statement is submitted by Owasso to Collinsville. 6. DURATION. The initial terms of this agreement shall commence upon execution by both parties and shall expire on December 31, 2003. Collinsville shall have an option to renew this agreement for a one-year term commencing on January 1, 2004 and ending on December 31, 2004, and a second renewal for a one-year term, commencing on January 1, 2005 and ending on December 31, 2005. Said renewals shall be subject only to mutual agreement of the parties with the rate and payment set forth in Schedule A. 7. RECORD KEEPING (BOOKING). Owasso agrees to maintain a system of record keeping relative to the booking and confinement of each Collinsville prisoner in Owasso,Cityof/Interloca]Agreemetit.doe 4 such style and manner as equivalent to Owasso's records pertaining to its own prisoners. Such records shall include, but not be limited to, the following information: defendant's name, charge, booking date, release date, and manner of release (i.e., personal recognizance, bond, cash bail). Along with monthly billing statement, Owasso shall submit to Collinsville or its authorized representative's copies of said records. 8. BOOKING PROCEDURE. Prisoners will be booked by Collinsville according to procedures and policies jointly agreed to by Owasso and Collinsville by completing for each such prisoner an appropriate booking sheet with a copy to be provided to Owasso, if requested, A copy of said booking sheet to be utilized under this contract is attached as Exhibit "B". 9. RELEASE OF COLLINSVILLE PRISONERS FROM OWASSO JAIL. No Collinsville prisoner confined in the Owasso Jail subject to this Agreement shall be released except: a. When requested by a member of Collinsville Police Department; b. In compliance with orders of the court in those matters which the courts have jurisdiction; C. For appearance in court; d. For interviews by Collinsville Police or attorneys; C. If the prisoner has served his or her sentence or the charge pending against the prisoner has been dismissed; or f. As determined by the Owasso Chief of Police or his designee as part of a plan to reduce prisoner population as a result of facility overcrowding; PROVIDED, however, Owasso and Collinsville prisoners shall be released or relocated to the David L. Moss Correctional Center on a "first in first out" basis. 9. When in the discretion of an Owasso police officer holding the rank of Sergeant or above, or the Communications Supervisor, such release is warranted, Owasso shall notify Collinsville Police of such event as soon as possible. 11. OPERATION OF JAIL. Owasso agrees to operate the jail to current professional standards and practices in accordance with all state and federal standards, Owasso, Ci tyo f/1 n terl ocalAgreem en Ld oc 5 whether set by constitution, statute or regulation. Collinsville shall receive equal treatment to that supplied to Owasso's own prisoner. 12. INDEMNIFICATION. b. In the event of the concurrent negligence of the parties, each party shall be responsible for payment of any claim or judgment in proportion to the percentage fault attributed to that party, C. The indemnities provided for in this paragraph I I shall apply to all legal costs and attorney's fees incurred by the party indemnified. In any action to enforce the indemnities provided for in this paragraph, the prevailing party shall be entitled to recovery of costs and attorneys' fees for the enforcement of these indemnities. 13. TERMINATION OF AGREEMENT. Either party may terminate this Agreement upon thirty (30) days written notice to the other City Manager. a. The Police Chiefs for each city and appropriate staff shall meet quarterly to discuss any pending issues to resolve disputes, if any. b. It is the parties' intent to resolve any disputes relating to the interpretation or application of this agreement informally through discussions at the staff level as described in paragraph 13 (a) above. In the event disputes cannot be resolved informally, resolution shall be sought by the City Managers. If the City Managers reach no resolution within thirty (30) days, either party may terminate this agreement. 15. WAIVER. No waiver of any right under this Agreement shall be effective unless made in writing by the authorized representative of the party to be bound thereby. Owasso,Cityof/InterlocalAgi-eement.doc 6 Failure to insist upon full performance on any one or several occasions does not constitute consent to or waiver of any later nonperformance. 18. PARTIAL INVALIDITY. Whenever possible, each provision of this agreement shall be interpreted in such a manner as to be effective and valid under applicable law. Any provisions of this agreement which shall prove to be invalid, void or illegal shall in no way affect, impair or invalidate any other provisions hereof, and such other provisions shall remain in full force and effect. 19. ASSIGNABILITY. The rights, duties and obligations of either party to this agreement may not be assigned to any third party without the prior written consent of the other party, which consent shall not be unreasonably withheld. 20. NO THIRD-PARTY RIGHTS. Except as expressly provided herein, nothing in this agreement shall be construed to permit anyone other than the parties hereto and their successors and assigns to rely upon the covenants and agreements herein contained nor to give any such third party a cause of action (as a third-party beneficiary or otherwise) on account of any nonperformance hereunder. 21. ENTIRE AGREEMENT. This agreement constitutes the entire agreement between the parties hereto and no other agreements, oral or otherwise, regarding the subject matter of this agreement shall be deemed to exist or bind any of the parties hereto. Either party may request changes in the agreement. Proposed changes that are mutually agreed upon shall be incorporated by written amendment hereto. 22. SEVERABILITY. If any portion of the Agreement is changed per mutual agreement, or any portion is held invalid, the remainder of the Agreement shall remain in full force and effect. There are no other oral or written agreements between the parties as to the subjects covered by this Agreement. No changes or additions to this Agreement shall be valid or binding upon either party unless such change or addition be in writing and executed by both parties. 24. NOTICES AND ADMINISTRATOR. The fees now charged by Owasso, Broken Arrow, Tulsa, Sapulpa, Sand Springs, Skiatook, Bartlesville, and Edmond Police Departments were compared. The cost of obtaining a traffic accident report ranged from $0.25 per page to $4.00 regardless of the number of pages. Usually, traffic reports are two or three pages in length. Insurance companies request a number of reports each month and they furnish a self-addressed stamped envelope to mail the transaction. The cost of crime reports ranged from $0.25 per page to $4.00 for the first page and $0.25 for each additional page. The number of pages released varies depending on legal technicalities of the case involved. State law allows for a reasonable charge for research which is normally the cost of the employee's time. The cost ranged up to $17.50 per hour depending on the salary and benefit cost of employee doing the research. Background chocks on individuals ranged from $3.00 to $5.00. Normally these are at the request of prospective employers and governmental agencies with the proper releases attached and require responses on departmental letterhead. Notarized or certified copies of reports and background checks are universally $1.00 per page. Attached is a comparison of the fees charges by area law enforcement agencies including the current fees charged by Owasso and the proposed fee changes. The grant for FY2002-2003 is for construction of sidewalks, handicap ramps and curb repairs in an area generally bounded on the south by 51' Avenue, cast by U.S. Highway 1699 north by E. 86' Street North and west by the SK&O Railroad. The Indian Nations Council of Governments (INCOG) has provided administrative services for previous CDBG grants awarded to the City of Owasso. Attached is an agreement for services for the present award. The attached agreement has been prepared in order to expedite completion of the project grant. Involvement by INCOG in the past has provided the expertise necessary to ensure meeting CDBG requirements. Administrative services to be provided by INCOG include the following: ® Assisting the City in grant documentation ® Conduct of public hearings ® Processing requests for payment ® Close-out of the project The cost for services is proposed to be an amount not to exceed $4,000. May 5, 2003 The Owasso City budget for FY-2003 included a capital outlay allocation to expand the radio system. With the City Council's approval of this budget, staff began preparation to expand the radio system and accommodate all City departments requiring two-way radio communication. During the next eight months the computer based format of the system was analyzed and revised. The new format allows the additional equipment to expand and improve security of the system. The existing radios were reprogrammed to accommodate the additional equipment and provide interoperability. This interoperability between departments will provide safety for all departments by making available direct radio access to the City's emergency services, and the necessary communications in time of a disaster. The new equipment would replace all emergency services, police officers and firefighters, mobile radios, and 70% of all portable radios, leaving t 6 portable radios, which are three years old. These radios could be replaced next year with the implementation of a radio replacement policy. The radios removed from the TWO-WAY COMMUNICATION SYSTEM MAY 5, 2003 PAGE 2 FUNDING. It is recommended the funding for the additional radio equipment for the expansion to other city departments would be $25,000.00 from the E911 fund, and the balance, approximately $65,000.00, from the approved capital outlay budget for FY 2003. May 14, 2003 BACKGROUND: The first contract for privatized fleet fuel services was awarded to GO! Systems on October 5, 1993, following the bidding practices required by law. Contract terms stated that GO! Systems would supply fuel for the city fleet twenty-four hours a day, seven days a week, at a margin of 70 per gallon, based on the OPIS average wholesale cost of fuel on a weekly basis. The contract was re-bid each succeeding year through FY 199798, with GO! Systems awarded each bid. Section 7-107 (6) of the City of Owasso Code of Ordinances provides that competitive bidding is not required for "supplies, materials, equipment or contractual services when purchased at price not exceeding a price set therefore by the State purchasing agency or any other state agency hereafter authorized to regulate prices for things purchased by the State, ".... Fuelman holds the State contract for fleet fuel management services at a margin of 9.50 per gallon, based on the OPIS average wholesale cost of fuel on a weekly basis. Staff was able to negotiate a contract with Fuelman at a margin of 8.50 per gallon, the price currently being paid for fuel. CONTRACTOR shall provide all fuel types, grades and octane ratings request by the City of Owasso for° City -owned equipment. B. CONTRACTOR shall provide to the City of Owasso a Fuelman fleet management fuel card for all vehicles and pieces of equipment. Contractor has the ability of restricting "fuel only" and other restrictions if so desired by the City of Owasso. C. CONTRACTOR shall provide personal Identification Numbers (pins) for each driver or operator of City -owned equipment. D. CONTRACTOR shall provide at least one fuel station with the city limits of the City of Owasso, which shall be attended 24 hours each day. All grades of fuel specified by the City of Owasso will be provided by contractor within the City of Owasso. The Fuelman fleet card is accepted at over 900 locations in the ,Mate of Oklahoma, and in 35 other states. All Loves stores nationwide accept Fuelman. F. CONTRACTOR will work with MERCHANT (fuel station) to promptly resolve any disputes concerning quality of fuel issues. H. CONTRACTOR shall furnish the Fuelman fleet management system with the price of fuel based on the weekly Oil Price Index Service (OPIS). I. Issuing debt could benefit the city by providing a sizeable amount of money immediately, but a significant amount of money would be used to cover loan costs and interest. April 8, 2003 Over the course of the past few months, the Capital Improvements Committee has worked to develop priority projects and reach consensus on those projects. During that time, the staff has worked with the committee and finance professionals to develop funding ideas and options for those projects. Generally, there are three broad options available to the City to fund a comprehensive capital improvement plan as envisioned by the conunittee. All of those options are based on the use and extension of a one-cent sales tax that is scheduled to expire in October of 2007. The staff has also reviewed other issues associated with funding these projects. In fact, a comprehensive review of the basic approach used in past finiding proposals was conducted.
